HomeMy WebLinkAboutResolution 6432 �°�o C ITY OF ORONO RESOLUTION OF THE CIT'Y COUNCIL � � � ~ No. b � , 2 �' G t�KFSH��� A RESOLUTION GRANTING AN EXTENSION OF SITE PLAN AND CONDITIONAL USE PERMIT APPROVALS FOR PROPERTY LOCATED AT 450 OLD CRYSTAL BAY ROAD NORTH GRANTED VIA RESOLUTION NO. 6312 FILE #13-3589 WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, the City Council of the City of Orono (hereinafter "City Council") has adopted land development regulations for the orderly, economic and safe development of land within the City; and WHEREAS, on August 26, 2013 the City Council approved Resolution No. 6312 granting the following: Industrial Site Plan Approval to allow improvements to the parking areas and to construct an addition to and conduct modifications to the existing building; a CUP approval to allow deferment of construction of 62 (of the required 101) parking stalls; a variance to locate the deferred stalls off of the Property at 550 Old Crystal Bay Road North which is also owned by the Owner; a setback variance from the requirements of City Code Section 78-827 to permit the proposed parking area to be set back 6 feet from the existing building where a 10 foot setback is required for the Property; and WHEREAS, Pine Corner Properties LLC, (hereinafter the Owners) requested a 12-month extension of the approvals granted under Resolution No. 6312 for property located at 450 Crystal Bay Road North and legally described as follows: LOT 1, BLOCK 1, CRYSTAL BAY BUSINESS CENTER 2ND ADDITION, Hennepin County, Minnesota (hereinafter the "Property"); and WHEREAS, the City Council has considered the request by the Owners for a 12- month extension of the approvals granted under Resolution No. 6312 for development of the Property; and WHEREAS, the Owners were not able to commence construction within the allotted one-year established by Resolution No. 6312; and WHEREAS, the approvals granted by Resolution No. 6312 expire on August 26, 2014; and Page 1 of 3 ���� ITY F ORONO C O RESOLUTION OF THE CITY COUNCIL ��'�,, tiG� N o. 6 4 3 2 kEsxo`� NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Orono does hereby grant an extension August 26, 2015 of the approvals granted under Resolution No. 6312, subject to the following conditions: 1. Authorities granted by this resolution run with the Property not with the Owners, but are permissive only and must be exercised by obtaining building permits and commencing construction by August 26, 2015 or the approvals will expire on that date. 2. All other findings, conclusions, and conditions of Resolution No. 6312 shall remain in efFect. 3. Violation of or non-compliance with any of the terms and conditions of the conditional use permit approval and industrial site plan approval shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 4. The undersigned Owners have read, understand and hereby agree to the terms of this resolution and on behalf of the Owners, their heirs, successors and assigns, hereby agree to the recording of this resolution in the Chain of Title of the Property.
