Thorfinnson 400 Marquette Bank Building 6640 Shady Oak Road Eden Prairie, MN 55344 Re: Reconstruction of Guest House at 1420 Bohn' s Point Road Dear Mr. Thorfinnson: In reviewing the after-the-fact permit application for work on the accessory structure at 1420 Bohn's Point Road (1418 Bohn's Point Road), it is clear that this structure is intended to serve as a second dwelling unit on the property. Because an entirely new foundation was placed under this structure, the building is considered as a "new" structure, and must meet all req�irements of the zoning code. The structure in question appears to meet the required front, side and rear setbacks for a detached accessory structure, but the use of that structure is further regulated in the zoning code. Such a detached structure could take on either the character of a storage building, or the character af a guest house. Because the obvious intent is that this become a dwelling unit with plumbing and kitchen facilitie�'Zoninn Code Section Permit for guest house use is required, p g 10.20 , Subdivision 3 (G). No building permits for the work already done or yet to be comp leted can be issued until a Conditional Use Permit for guest house use is applied for and approved by the City Council. I have attached the appropriate zoning code sections, along with the conditional use permit application form. Please note that the application and alI required submittals must be in this office by noon on Friday, August 25th in order to be scheduled for a public hearing at the Planning Commission meeting of September 18th. The earliest pvssible date of final action by the Council on this would be October 9, 1989. If your app lication is approved on that date, we would anticipate being ab le to issue permits shortly thereafter. I understand he was told that permits could not be issued until next week. This is incorrect, in that building permits cannot be issued until the guest house conditional use permit is finalized. During this inspection the following code violations were noted: 1, You have put in an entire new basement under the structure at 1418 Bohn's Point Road without permits. 2. You are installing retaining walls at 1420 Bohn's Point Road without permits. 3. The pool permit has expired and must be renewed. In the past the inspection department has conducted inspections on your property and found work being done without the required permits. On January 27, 1983 a letter was sent to you stating that if you were found working without a permit again within Orono, not only would the after-the-fact investigation fee be charged, put a citation will be issued to the person in charge and or responsible for the construction. At this time I am requesting you to make an appointment on Monday, July 17 , 1989 , to go over the violations on your property. I am also putting you on notice that since you are in violation of Minnesota State Buildind Code/Uniform Building Code Section 301(A), Work Without Permits, I am putting you on notice that all work must stop at the above subject property persuant to Minnesota State Building Code/Uniform Building Code Section 202(D) Stop Work Orders.
