Title: Minutes of Public Meetings
1.Purpose:
The purpose of this item is to review public meeting minute requirements.
2.Background:
The city's minutes had over the last several years started to drift way from their intended and legal
purpose and toward near verbatim transcripts of meetings. This is not required nor is it best
practice. Over the last year city staff led by our City Clerks have been working to restore our
minutes to their intended purpose, legal requirements, and best practices.
Some recent efforts include:
a. Staff presented minutes standards at the February 13, 2023 work session.
b. In the fall of 2023 the city contracted for a new meeting management software and
videography system. The new system has a built in transcription element. Part of the justification
for the implementation of the closed caption/transcription services was to remove those elements
from the meeting minutes.
3.Summary:
a. Minutes are a legal record of meetings. Minutes are a record of what is done at a meeting, not
what is said. Not only is it not necessary to summarize matters discussed at a meeting in the
minutes of that meeting, it is improper to do so. (RONR 12th ed. 48:2; see also pp. 148–49 of
RONR In Brief.)
(1) Minutes should include:
> name, date and location of meeting,
> list of attendees (for quorum)
> time meeting was called to order
> approval of previous meeting minutes
> motion text and name of maker
> status/results of motions
> time meeting was adjourned
(2) Minutes do not include:
x discussion
x personal opinion
x motions withdrawn
x entire reports
b. Public meetings, public hearings, public comment periods all have different purposes, levels of
AGENDA ITEM

public participation, and legal requirements.
(1) Public hearing proceedings are specifically held for the public to provide input and
testimony on a topic to be considered in the votes and decisions by the council and the record
should include additional details.
(2) Public comment period is not a public hearing. A public meeting is open for public
viewing for transparency while public business is conducted.
c. Meeting minutes are transparent when actions are easy to find and not hidden within lengthy
non-critical text. City Council members are elected by the community to do business on behalf of
all residents. City Council meetings exist for the purpose of transparently conducting business
transactions. City Council members arrive prepared to vote on matters and these business
transactions are preserved with the city's historical records. The meetings are open to the public for
observation only (transparency) and the public may not participate in the meeting or disrupt in any
way.
d. Meeting minute information from the Minnesota Mayors Handbook:
Meeting minutes
A statutory city clerk must keep a minute book of all city council meetings. Generally, the
clerk has wide discretion as to how to keep the minutes. A verbatim record of everything that was
said is not normally required. However, the law does require that the following be included in the
minutes:
• The members of the public body who are present.
• The members who make or second motions.
• Roll call vote on motions.
• Subject matter of proposed resolutions or ordinances.
• Whether the resolutions or ordinances are defeated or adopted.
• The votes of each member, including the mayor.
Examples of minutes produced by various other agencies are attached.

HOW TO PROVIDE PUBLIC TESTIMONY: The Council values community
input and looks forward to hearing from you.
There are three ways to provide public testimony:
1.In person: You may attend the meeting in person in Council Chambers.
2.By email: You may testify by submitting a COMMENT email. If your
testimony is submitted before 10:00 a.m. on the day of the Council
meeting, your email testimony will be distributed to the Councilmembers
and appropriate staff prior to the meeting. Please submit your testimony

Title: Street Maintenance 2025
1.Purpose:
The purpose of this action item is to gain council guidance on planning for the 2025 Street
Maintenance Project.
2.Background:
In order to maintain our city streets the engineering department recommends a portion of the city’s
streets for various pavement preservation activities each year. Streets are inspected and assigned a
pavement condition index (PCI) rating. The PCI allows street to street comparisons and provides
the data required to conduct street maintenance programming and planning.
3.Summary:

4.Funding:
A. Pavement Funding. The projects will be funded with a combination of the Pavement
Management Fund, Sewer Funds, and Stormwater Fund. The Pavement fund is the limiting factor
in the amount of pavement maintenance that can take place each year. Adequate funding is
available in the Stormwater, Water and Sewer Funds.
(1) Pavement Funding for 2025. The Pavement Fund receives resources from the pavement
levy. The levy for 2024 is $1,000,000. Adjusted for a modest 2% Construction Inflation Index
per year the amount for the 2025 levy should be $1,020,000.
(2) Pavement Funding for the Future. After 2025 the pavement levy should be adjusted for
inflation. Assuming a 2% inflation, that level of funding should allow the City to complete all of
the projects listed in section 4 above and increase the preventive maintenance portion to by 2030.
B. Municipal State Aid Roads (MSA). The city receives approximately $450,000 / yr from the
state MSA fund. The debt service is scheduled to be paid off in 2025. In 2018 the city took a
five-year advance in order to reconstruct Old Crystal Bay Road. The fund is projected to have a
positive balance again in 2024. The following MSA roadways are in need of maintenance.
