A RESOLUTION
GRANTING VARIANCES TO
MUNICIPAL ZONING CODE
SECTIONS 78-305 AND 78-1279
- FILE NO. 14-3667
WHEREAS, Tammara L. Maddrey, a single person, and Steven Sabes, a
single person (hereinafter "the Applicants") are the owners of the property located at 3435
Eastlake Street within the City of Orono (hereinafter the "City") and legally described as
follows:
The West 50 feet of the East 200 feet of Lot 2, Block 8, BAYSIDE ADDITION
TO LAKE MINNETONKA, Hennepin CounTy, Minnesota.
(hereinafter the "Property"); and
WHEREAS, the Applicants have made application to the City of Orono for
variances to Orono Municipal Zoning Code Section 78-305 to allow construction of a second
story addition above the existing residence on a lot of 4,975 s.f. in area where a lot azea of
87,120 s.f. is normally required, and of width 50' at the 929.4' shoreline contour and at the 75'
setback line where a lot width of 200' is normally required, and for side setbacks of 13.9' and
15.7' from the east and west lot lines respectively, where side setbacks of 30' are normally
required; and
WHEREAS, the Applicants have applied for a variance to Orono Municipal
. Zoning Code Section 78-1279(1) to allow construction of a second story addition above the
existing residence 52' from the OHW of Lake Minnetonka where a 75' setback is normally
required; and
WHEREAS, the Applicants have applied for variances to Orono Municipal
Zoning Code Sections 78-305 and 78-1279(2) to allow construction of a second story addition
above the existing residence at a setback of 19.8' from the street lot line where a 50' setback is
normally required by the LR-lA District Standards and a 30' setback is normally required by the
Shoreland Overlay District standards; and
WHEREAS, after due published notice and mailed notice in accordance with
Minnesota Statutes and the Orono, Minnesota, City Code, the Orono Planning Commission held
a public hearing on May 19, 2014 at which times all persons desiring to be heard concerning this .
application were given the opportunity to speak thereon.

NOW, THEREFORE BE IT RESOLVED by the City Council of Orono,
Minnesota:
FINDINGS
1. This application was reviewed as Zoning File number 14-3667.
, 2. The Property is located in the LR-lA One Family Lakeshore Residential Zoning
District which requires a minimum lot area of 2.0 acres and a minimum lot width
of 200'.
3. The Planning Commission reviewed this application at a public hearing held on
May 19, 2014 and voted 7 for and 0 against on a motion to approve the requested
variances subject to certain conditions and based on the following findings:
a. The Property contains 4,975 square feet in area and has a defined width of 50
feet at the 929.4' OHW contour for Lake Minnetonka and at the 75-foot
setback line.
b. The existing residence structure is 20'x28', one story with some attic space
and no basement. The request is to add a second story directly above the
existing main level. This would be consistent with a number of past additions
approved on Eastlake Street.
c. The existing residence structure is connected to municipal sewer.
d. Adding a second story to the existing residence structure will not increase
hardcover on the property and will not further reduce the existing substandard
setbacks from the lake or property boundaries. It will increase the visual bulk
and massing within the substandard setbacks, but not to the extent that it will
be out of character with homes in the neighborhood.
e. Because the 929.4' Lake Minnetonka OHW contour extends a few hundred
feet up the creek based on surveys on file, the majority of the subject property
is unbuildable as all but the front 25' is located within 75' of the OHW level.
This creates a practical difficulty for any modifications to the property.
f. Because the required side, front and rear/lake setbacks overlap, the site has no
functional buildable envelope. The only opportunity for expansion without
additional footprint encroachments is above the existing structure.
g. Planning Commission finds that the property owner proposes to use the
property in a reasonable manner, i.e. for residential purposes, in a manner
similar to other homes on the block, on a parcel similar in size to others in the
immediate neighborhood. The small lot was created and developed for

residential use long ago, a circumstance not created by the owner. The
proposed residence addition will result in a home that is similar in scope to
other homes in the immediate neighborhood on small lots with substandard
setbacks and will not alter the character of the locality.
h. The Applicants' request is in harmony with the purpose and intent of the
ordinance.
i. The Applicants have demonstrated that enforcing the provisions of the Zoning
Ordinance deprives the Applicants of the reasonable use of their Property.
j. Due to the lack of information about the ability of the existing foundation to
support a second story, the foundation should be certified by a structural
engineer prior to issuance of a building permit and corrections made if
necessary.
4. The City Council has considered this application including the findings and
recommendation of the Planning Commission, reports by City staff, comments by
the Applicants and the public, and the effect of the proposed variances on the
health, safety and welfare of the community.
5. The City Council finds that the conditions existing on this Property are peculiar to
it and do not apply generally to other property in this zoning district; that granting
the variances would not adversely affect traffic conditions, light, air nor pose a
fire hazard or other danger to neighboring property; would not merely serve as a
convenience to the Applicants, but are necessary to alleviate a practical difficulty;
are necessary to preserve a substantial property right of the Applicants; and would
be in keeping with the spirit and intent of the Zoning Code and Comprehensive
Plan of the City.
CONCLUSIONS, ORDER AND CONDITIONS
Based upon one or more of the above findings, the Orono City Council hereby grants
variances to Orono Municipal Zoning Code Section 78-305 to allow construction of a second
story addition above the existing residence on a lot of 4,975 s.f. in area where a lot area of
87,120 s.f. is normally required, and of width 50' at the 929.4' shoreline contour and at the 75'
setback line where a lot width of 200' is normally required, and with side setbacks of 13.9' and
15.7' from the east and west lot lines respectively, where side setbacks of 30' are normally
required; and grants a variance to Section 78-1279(1) to allow construction of a second story
addition above the existing residence 52' from the OHW of Lake Minnetonka where a 75'

setback is normally required; and grants variances to Orono Municipal Zoning Code Sections 78-
305 and 78-1279(2) to allow construction of a second story addition above the existing residence
at a setback of 19.8' from the street lot line where a 50' setback is normally required by the LR-
lA District Standards and a 30' setback is normally required by the Shoreland Overlay District
standards; subject to the following conditions:
1. Council approval is based on the survey submitted by the Applicants and annotated by
City staff, attached to this Resolution as Exhibit A. Any amendments to the site plan
which are not in conformity with City codes will require further Planning Commission
and City Council review.
2. Approval is based on the preliminary floor plans and elevation view submitted by
.applicant and attached hereto as Exhibit B, which depict a 2-story home of
approximately 26' peak height. Any substantial revisions to the bulk of the addition may
require further City review.
3. Prior to issuance of a building permit, applicants shall provide certification from a
structural engineer that the foundation can support a second story, or provide plans for a
suitable foundation. In the event the foundation requires total replacement, further
Council review will be required if the building footprint, height, setbacks or building
envelope are changed as a result.
4. Authorities granted by this resolution run with the properiy not with the Applicants, but
are permissive only and must be exercised by obtaining a building permit for the
addition. A framing inspection must be completed within one year of the date of Council
approval, or the variances granted herein will expire on that date (June 9, 2015).
. 5. Violation of or non-compliance with any of the terms and conditions of this resolution
shall constitute a violation of the zoning code, shall automatically terminate any authority
granted herein, and shall be punishable as a misdemeanor.
6. The undersigned Applicants have read, understand and hereby agree to the terms of this
resolution and on behalf of the Applicants and the Applicants' heirs, successors and
assigns, hereby agree to the recording of this resolution in the chain of title of the
Property.
