HomeMy WebLinkAboutResolution 6401 � o� O ,��,� O CITY of ORONO ,>�i, . �='- �� � ;��� � �� � ,,�?,�, D+ RESOLUTION OF jHE CITY COUNCIL �, �� �, �� � � j �� ` a; ;�� ti � NO. r�kESH04� A RESOLUTION GRANTING VARIANCES TO MUNICIPAL ZONING CODE SECTIONS 78-350; 78-1279; 78-1288; 78-1680 AND A CONDITIONAL USE PERMIT PURSUANT TO MUNICIPAL ZONING CODE SECTIONS 78-966 8� 78-1286 FILE NO. 14-3660 WHEREAS, AI John Hagen and Donna Mae Hagen, a married couple (hereinafter "the Applicants") are the owners of the property located at 3655 North Shore Drive within the City of Orono (hereinafter the "City") and legally described as: Attached as Exhibit A (hereinafter the "Property"); and WHEREAS, the Applicants have made application to the City of Orono for a variance to Orono Municipal Zoning Code Section 78-350 to allow construction of a new home on a property 16,612 square feet in area in the LR-1 C zoning district where a minimum lot area of 21,780 square feet is required; WHEREAS, the Applicants have made application to the City of Orono for a variance to Orono Municipal Zoning Code Section 78-1279 to allow construction of a new home on the property as close as 52 feet to the OHWL of Lake Minnetonka where a 75-foot setback is required for structures; WHEREAS, the Applicants have made application to the City of Orono for variances to Orono Municipal Zoning Code Sections 78-1288 and 78-1680 to permit construction of a new home and hardcover improvements within 75 feet of the OHWL of Lake Minnetonka where no hardcover is permitted; WHEREAS, the Applicants have made application to the City of Orono for a conditional use permit pursuant to Orono Municipal Zoning Code Sections 78-966 and 78-1286 to permit grading and filling activities within the 75-foot setback from the OHWL of Lake Minnetonka in excess of 10 cubic yards in order to remove the existing home; construct the new home and improvements; and conduct finish grading on the site; and WHEREAS, after due published notice and mailed notice in accordance with Minnesota Statutes and the Orono, Minnesota, City Code, a public hearing was held by the Orono Planning Commission on April 21, 2014 at which times all persons desiring to be heard concerning this application were given the opportunity to speak thereon. This application was reviewed as Zoning File number 14-3660. 2. The Property is located in the LR-1 C One Family Lakeshore Residential Zoning District which requires a minimum lot area of 0.5 acre and a minimum lot width of 100'. 3. The Planning Commission reviewed this application at a public hearing held on April 21, 2014 and voted 6 for and 0 against on a motion to approve the conditional use permit and variances based on the following findings: a. The Property contains 16,612 square feet in area and has a defined width of 198' at the OHWL and 100' at the 75-foot setback. b. The orientation of the Property with respect to County Road 51, the private access road, and the lakeshore results in a practical difficulty preventing placement of a reasonable sized home on the Property in a conforming location. c. There were no negative neighbor comments received regarding the Applicants' proposed plan. d. The proposed home location will not adversely impact views of the lake currently enjoyed by the adjacent properties. e. The Property will conform to the hardcover limitations of Tier 1 and structural coverage limitations. f. The design and orientation of the proposed home should reduce massing with the 75-foot setback area, particularly along the channel. The proposed home will not alter the essential character of the neighborhood and will result in minimal or no negative impact on adjacent properties. g. The proposed grading within the 75-foot setback area is necessary for the construction of the new home and will have no impact on surrounding lands. Drainage patterns for runoff leaving the Property will not be significantly altered. The resulting grades will be similar to the other properties in the neighborhood. Page 2 of 5 � O� O �. The Applicants' request is in harmony with the purpose and intent of the ordinance. i. The Applicants have demonstrated that enforcing the provisions of the Zoning Ordinance deprives the Applicants of the reasonable use of their Property. 4. The City Council has considered this application including the findings and recommendation of the Planning Cornmission, reports by City staff, comments by the Applicants and the public, and the effect of the proposed variances and conditional use permit on the health, safety and welfare of the community. 5. The City Council finds that the conditions existing on this Property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variances and conditional use permit would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the Applicants, but is necessary to alleviate a practical difficulty; is necessary to preserve a substantial property right of the Applicants; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants a variance to Orono Municipal Zoning Code Section 78-350 to allow construction of a new home on a property 16,612 square feet in area in the LR-1C zoning district where a minimum lot area of 21,780 square feet is required; a variance to Section 78-1279 to allow construction of a new home on the property as close as 52 feet from the OHWL of Lake Minnetonka where a 75-foot setback is required for structures; variances to Sections 78-1288 and 78-1680 to permit construction of a new home and hardcover improvements within 75 feet of the OHWL of Lake Minnetonka where no hardcover is permitted; and a conditional use permit pursuant to Sections 78-966 and 78-1286 to permit grading and filling activities within the 75-foot setback from the OHWL of Lake Minnetonka in excess of 10 cubic yards on the Property; subject to the following conditions: 1. Council approval is based on the survey and building plans submitted by the Applicants and annotated by City staff, attached to this Resolution as Exhibits B and C. Any amendments to the approved plans which are not in conformity with City codes will require further Planning Commission and City Council review. 2. Proposed hardcover levels are conforming to the Tier 1 standards; no hardcover variances are granted. Structural coverage limitations will also be met. Authorities granted by this resolution run with the Property not with the Applicants, but are permissive only and must be exercised by obtaining a permit for and commencing construction of said project. A framing inspection must be completed within one year of the date of Council approval, or the approvals granted with this Resolution will expire on that date (May 12, 2015). 4. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 5. The undersigned Applicants have read, understand and hereby agree to the terms of this resolution and on behalf of the Applicants and the Applicants' heirs, successors and assigns, hereby agree to the recording of this resolution in the chain of title of the Property.
