HomeMy WebLinkAboutResolution 699Resolution No. 699 RESOLUTION SETTING FORTH REQUIREMENTS TO BE FULFILLED BY ROBERT J. WYATT IN ORDER TO OBTAIN AND KEEP A CONDITIONAL USE PERMIT TO ALLOW FOR THE TEMPORARY PRESENCE OF A GUEST HOUSE ON HIS PROPERTY WHEREAS, Robert J. Wyatt has applied for a conditional use permit to have a guest house on his property for a period of eighteen months, and WHEREAS, the City Council is concerned about the adverse effect of a guest house on that property for a period of over eighteen months but desires to assist the applicant in effectu- ating his plans. NOW, THEREFORE, BE IT RESOLVED: That the City of Orono grant a conditional use permit to Robert J. Wyatt pursuant to the following conditions: 1. That the applicant and the property owner be allowed to maintain the guest house only for a period of eighteen months and that by the end of the period of eighteen months from the date of this resolution, the guest house must be completely removed. 2. In the event that the guest house is not removed by that time, the City of Orono is given the right to enter on the property, with or without notice, and destroy the building and assess the cost thereof against the property. The applicant and the property owner agree to hold the city harmless from any and all liability for that action if such action is necessary to effectuate the terms of this conditional use permit and reso- lution. 3. The applicant shall provide prior to any granting of this permit and placement of the additional home on the property, a title opinion brought up to date addressed to the City of Orono, which title opinion shows all the owners of the property including all mortgage holders. All such property owners or others with interest in the property must agree to the terms of this resolution and this resolution will thereafter be filed in the chain of title for the property. 0 ik • 4. Before any subdivision of this property can take place, the applicant and/or other owners of the property must meet the requirements of the ordinance including providing of the title opinion showing ownership in the applicants for the subdivision. 5. Nothing in this ordinance shall in any way impose any liability or duty to act upon the City of Orono concerning development of this property.
