RED DANIELS THIRTY DAYS LEAVE WITH PAY AND OTHER ACCRUED BENEFITS FOR A DISABILITY DISCHARGE WITH FINAL TERMINATION ON DECEMBER 7, 1975 - 4:30 P.M. WHEREAS, the City of Orono has the power to appoint and discharge an employee with a hearing pursuant to Minnesota Statutes 412.111, and WHEREAS, there are no statutory provisions requiring that the City follow certain procedures in the discharging of an employee, and WHEREAS, there is no civil service commission in the City of Orono, and THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ORONO: 1. Red Daniels per his admission is not a veteran under the Veterans' Preference Act and does acknowledge that there are no other requirements of the City to grant him a hearing or to take other • administrative steps before termination of employment. 2. There has been an extensive investigation by the Clerk/ Administrator and Chief of Police concerning Mr. Daniels' ability to physically perform his duties as a police officer. 3. That investigation has resulted in a recommendation by the Clerk/Administrator and Chief of Police that Mr. Daniels be discharged because of the direct result of an injury, sickness and disability incurred in and arising out of an act of duty while he was performing his services as a police officer. 4. That as a result of the injury and sickness incurred and arising out of an act of duty, that he can no longer physically perform his duties as a police officer in the field. 5. That Mr. Daniels be allowed 30 days and other paid accrued benefits beginning November 7, 1975, 4:30 P.M., with final employment termination December 7, 1975, 4:30 P.M.
