Mayor Searles introduced findings of fact that
differs the Herrick Circle property from other
properties in Orono that might be projected
for future development. These were:
1. That the property is a small, separate parcel,
not contiguous to any other lands 'subject to future
subdivision, separated from such lands by a nature
trail and a golf course.
2. That the property is also adjacent to the
dense uses of the Wayzata Club house, road access
and parking area.
3. That the property is on a street leading
directly onto U.S. #12, with no intervening
residences, cross roads, underpasses or other '
traffic impediments.
4. That private sewage disposal arrangements
appear to be available to this property, through
the Wayzata public sewage system, for the applied
for uses only, without committing other properties
to a similar use.
5. That there are no projected public improvements,
projects or highways involving this land.
6. That the availability of sewer, proximity to
adequate transportation and other cited factors
are consistent with the Comprehensive Plan.
,*After hearing comments from the residents in the
area,
Searles moved, Butler seconded, to adopt
Resolution #627 to rezone the Herrick Circle
property, 440 Old Long Lake Road, from RR -1B
(two acres) to R-lA (one acre) and granted
conceptual approval for PRD and a conditional
use permit for allowing six homes and instructed
City staff to commence drafting a contractual
rezoning agreement conditioned on:
1. That all considerations and alternatives have
been explored.
2. That the applicant withdraw their original
rezoning request proposal of the Herrick property

from RR -1B (two acres) to R -1B (one-half acre)
and submitting a new proposal to request
rezoning from RR -1B (two acres) to R-lA (one
acre) allowing six single living units on this
six -plus acre parcel.
3. That the policy statement contained in the
April 22, 1975 Council Minutes, that:

developer, if the development is approved,
hall construct and provide utilities that are
designed to serve the developed area only, would
be served by the City of Wayzata only, and would
not be sized for any future growth or reserve
capacity, would be consistent with the Village

Comprehensive Land Use Plan, and with all costs RESOLUTION #627
being borne by the developer. (Continued)
4. To include all the recommendations 04 the
` Planning Commission Minutes dated June 16, 1975,
which states that:
'Van Nest moved, Dunlap seconded, that the Planning,
Commission recommend to Council that Herrick Circle
be rezoned R-lA instead of the proposed R -1B and
further that the Conditional Use be granted for
PRD based on six single family detached dwellings,
meeting all requirements of the PRD zoning code
provided that developer provide sanitary sewer
at his expense connecting to the Wayzata system.
This sewer connection will meet the requirements
of the Village of Wayzata and Orono. Further
recommendation that the project be done on a
contractural basis, also conditioned on verification
of the Village Engineer that six acres do in fact
exist, further that sewer be provided before
any units are completed -and no occupancy will be
allowed until such time. Motion, Ayes (7) - Nays (0).'
5. Planning Commission to amend Comprehensive
Plan to change zoning map. Motion, Ayes (4) -
Nays (0) .
Mr. Louis Oberhauser representing Mr. Norman
'-,*Nafstad, stated that his client would withdraw
his original request to rezone the Herrick
property from RR -1B to R -1B and would resubmit
a request for a zoning change from RR -1B to RR -1A.
Letter from McCombs -Knutson to Jim Blumendahl
regarding the Luce Line Trail Bridge over Orono
Orchard Road - City of Orono.
'Dear Mr. Blumendahl:
Mr. Arne Stefferud of the Department of Natural
Resources recently submitted a plan for proposed
revisions in the Orono Orchard Road Bridge to
the City of Orono for approval.
This plan was very nearly the same plan submitted
in November of 1974. At that time, I met on the
site with Gerald Philson of the Department of
Natural Resources and it was determined that
to provide adequate sight distance on the
street, it would be necessary to shorten the
west bent of the bridge by 6 feet, as well as,
to remove the east bent as proposed.
*t that time, you indicated that the Department
of Natural Resources did not have funds in the
1975 budget for this extra work and that Orono
could either pay the additional cost (approximately
$5,000) or wait and have the bridge constructed
