AN ORDINANCE AMENDING THE CODE OF ORDINANCES
PERTAINING TO THE BUILDING CODE,APPEALS,PLUMBING PLAN REVIEW
AND STATE STATUTE REFERENCES
THE CITY COUNCIL OF ORONO ORDAINS:
SECTION 1. Sec. 86-01 shall be amended by adding text to read as follows:
Sec. 86-1. Permits and special requirements for moving buildings.
(a) Definitions.The following words,terms and phrases,when used in this section,shall have the meanings
ascribed to them in this subsection,except where the context clearly indicates a different meaning:
Street means all streets and highways in the city which are not state trunk highways,county state-aid
highways, or county roads.
(b) Moving permit required and application.
(1) It is unlawful for any person to move a building on any street without a moving permit from the city.
(2) The application for a moving permit shall state the approximate size and weight of the structure or
building proposed to be moved,together with the places from and to which it is proposed to move the
structure or building, and proposed route to be followed, proposed dates and times of moving and
parking,and the name and address of the proposed mover.Such application shall also state any
municipal utility,street and public property repairs or alterations that will be required by reason of
such movement.
(c) Permit and fee. The moving permit shall state the date or dates of moving, hours, routing, movement and
parking. Permits shall be issued only for moving buildings by building movers licensed by the state. Fees to be
charged shall be separate for each of the following:
(1) A moving permit fee to cover use of streets and route approval;and
(2) A fee equal to the anticipated amount required to compensate the city for any municipal utility and
public property(other than streets) repairs or alterations occasioned by such movement,which shall
be paid in advance.
(d) Building permit and code compliance. Before any building is moved from one location to another within the
city, or from a point of origin without the city to a destination within the city, regardless of the route of
movement, it shall be inspected and a building permit shall have been issued for at least the work necessary
to bring it into full compliance with the state building code, including site, utility, and foundation work.
(e) Proof of tax payment. It is unlawful to move any building(including a manufactured home)if the point of
origin or destination (or both) is within the city, and regardless of the route of movement,without having
paid in full all real and personal property taxes and special assessments due on the building, and filing
written proof of such payment with the city.

SECTION 2. Sections. 86-38 through 86-43 shall be amended by adding and deleting text to
read as follows:
Sec. 86-38. Codes adopted by reference.
The Minnesota State Building Code, as adopted by the commissioner of administration pursuant to Minn.
Stat. §§ 166.59 to 166.753266.101-.16, including all of the amendments, rules and regulations established,
adopted and published from time to time by the Minnesota Commissioner of Administration,through the Building
Codes and Standards Division is hereby adopted by reference with the exception of the optional chapters, unless
specifically adopted in this ordinance.The Minnesota State Building Code is hereby incorporated in this section as
if fully set out herein.
1 Sec. 86-39. Application, administration and enforcement.
2 (a) The application, administration,and enforcement of the code shall be in accordance with Minnesota State
3 Building Code, MN Statute 326B.121, as amended from time to time.The Code shall be enforced within the
4 extraterritorial limits permitted by Minn.Stat.§166.62,subd. 1 when so established by this section.
5 (b) The code enforcement agency of this municipality is called the Building and ZoningCommunity Development
6 Department.
7 (c) This code shall be enforced by the Minnesota Certified Building Official designated by this Municipality to
8 administer the Code(Minn.Stat.§ 16B.65326B.133,subd. 1).
9 (d) Prior to installation of a system of plumbing other than for a single-family dwelling with independent
10 plumbing service,complete plumbing plans and specifications,together with any additional information that
11 the Building Official may require,shall be submitted and approved by the Building Official,subject to
12 applicable state law. No construction shall proceed except in accordance with the approved plans. Any
13 alteration or extension of any existing plumbing system shall be subject to these same requirements.
14 (e) Upon receipt of an application,the City shall forward to the state for review all plumbing plans and
15 specifications for the following types of projects within the city:
16 (1)State licensed facilities as defined in Section 3268.103,subdivision 13
17 (2)public buildings as defined in Section 326B.103,subdivision 11;and
18 (3)projects of a special nature for which department review is requested by either the city or the state.

20 Sec. 86-40. Permits and fees.
21 (a) The issuance of permits and the collection of fees shall be as authorized in Minn.Stat. §166.62,subd. 1Rule
22 1300.
23 (b) Permit fees shall be assessed for work governed by this Code in accordance with the fee schedule adopted by
24 the municipality in Ordinance No. 22, 3rd series. In addition, a surcharge fee shall be collected on all permits
25 issued for work governed by this Code in accordance with Minn.Stat. §468483268.148.
26 Sec. 86-41.

37 Sec. 86-42. Violations and penalties.
38 A violation of the Code is a misdemeanor(Minn.Stat. § 166.693266.082).
39 Sec. 86-43. Building code optional chapters.
40 (a) The Minnesota State Building Code, established pursuant to Minn.Stat. §§ 166.59 to 16B.75326B.101-.16
41 allows the municipality to adopt by reference and enforce certain optional chapters of the most current
42 edition of the Minnesota State Building Code.
43 (b) The following optional provisions identified in the most current edition of the State Building Code in Minnesota
44 Rules,Chapter 1306,Special Fire Protection Systems are hereby adopted and incorporated as part of the
45 Building Code for this municipality.

48 SECTION 3. EFFECTIVE DATE: This ordinance shall take effect immediately upon its passage
49 and publication.
