ORDINANCE NO. _, THIRD SERIES AN ORDINANCE AMENDING THE MUNICIPAL CODE OF OROP AND AMENDING THE OFFICIAL ZONING MAr BY REZONING CERTAIN PROPERTIES FROM RR -1B SINGLE FAMILY RURAL RESIDENTIAL DISTRICT TO RPUD RESIDENTIAL PLANNED UNIT DEVELOPMENT DISTRICT - FILE #16-380713842 WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, Estate Development Corporation, a Minneso+ oration, has applied for subdivision and rezoning of the properties located at 425 thru 595 ' Bay Road North from RR -1B Single Family Rural Residential District to R' Planned Unit Development in order to allow for development of single fal WHEREAS, the property to be rezo [ /� ORONO PRESERVE and is legally described in Exhibit A (atta R�` ©v� anty PINS 33-118-23 24 0001, 33-118-23 24 0002, and 33-118-23_ 1" e operty"); and WHEREAS, the City Council has approvedaid properties per the findings, terms and conditions of Resolution No. ado1. �, 2016, and the PUD No. 11 Agreement between Estate Development Corporation and city of Orono executed on , 2016. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ORONO DOES HEREBY ORDAIN: Section 1. The Municipal Code of Orono is amended by amending the official zoning map and zoning district boundaries for the Property described in Exhibit A. Said property is hereby rezoned from RR -1B Single Family Rural Residential District to RPUD Residential Planned Unit Development District. Section 2. This ordinance shall take effect only upon execution of the PUD No. 11 Agreement, which Agreement shall govern future development of the Property. Section 3. This ordinance shall be published in The Laker and The Pioneer newspaper and shall be effective upon publication. Adopted by the City Council of the City of Orono, Minnesota at a regular meeting held on the 27th day of June, 2016 by a vote of ayes and nays.
