ORDINANCE NO. L7_ THIRD SERIES <br />CITY OF ORONO <br />HENNEPIN COUNTY, MINNESOTA <br />AN ORDINANCE AMENDING THE ZONING ORDINANCE PERTAINING TO THE <br />APPROVAL PROCESS FOR SUBDIVISION EXCEPTION <br />THE CITY COUNCIL OF ORONO ORDAINS: <br />SECTION 1. Article III of Chapter 82 Subdivision Regulations shall be amended by <br />adding the following text to read as follows: <br />Division 5 Exception <br />Sec. 82-200. - Exception. <br />(1) The following land subdivisions are excepted from Divisions 1 through 4 of this Article. <br />Upon request, the Community Development Director shall, within ten days, certify that a <br />proposed subdivision is excepted because: <br />a. all the resulting parcels, tracts, lots or interests will be 20 acres or larger in size <br />and 500 feet in width for residential uses and five acres or larger in size for <br />commercial and industrial uses, or <br />b. will create cemetery lots, or <br />c. is court ordered, or <br />d. is an adjustment of a lot line by the relocation of a common boundary as long <br />as each of the two resulting lots meets the requirements of Chapter 78 and no new <br />non -conformities are created. <br />1. Adjustment of a lot line by the relocation of a common boundary when <br />one or both resulting lots do not meet the requirements, or other non - <br />conformities are created may be certified following approval of a variance. <br />(2) Procedure for exempted. subdivisions. The owners of such lots to be certified shall file with <br />the zoning administrator a certificate of survey of the lots to be divided, and pay the required <br />fee. Such certificate of survey shall show the dimensions of the lots, as measured upon the <br />recorded plan, the area of the lots, all corner elevations, all existing structures, including <br />dimensions to existing and proposed property lines, all visible encroachments, all easements <br />of record, and their proposed division. A written description of the separately described <br />tracts which will result from the proposed division shall be included on the survey. If the <br />proposed certification complies with all of the requirements of this section, it will be <br />approved by the Community Development Director and forwarded to the county for fling. <br />
