HomeMy WebLinkAboutOrd #135-3rd Ser/An Ordinace Protecting the City's Wellheads Prohibiting New Private WellsORDINANCE NO. 135, THIRD SERIES CITY OF ORONO HENNEPIN COUNTY, MINNESOTA AN ORDINANCE FOR PROTECTING THE CITY'S WELLHEADS BY PROHIBITING NEW PRIVATE WELLS WHERE PUBLIC WATER SUPPLY IS AVAILABLE THE CITY COUNCIL OF ORONO ORDAINS: SECTION 1. Orono Municipal Code Section 14.142 regarding Wellhead Protection New Private Wells Prohibited is hereby adopted to read as follows: Sec. 14-142.- Wellhead Protection - New Private Wells Prohibited. (a) -The owners of all buildings where a public water supply is available, or becomes available, shall connect the buildings to the public water supply, subject to the following conditions: (1) A private property with a functioning well will not be required to be connected to the city water until the well becomes nonfunctioning or the building undergoes major remodeling resulting in an increase in water use that exceeds the capacity of the well. (2) Where it is not feasible to connect to a public water supply, or if private on-site water supplementation is required as determined by the City of Orono, a well may be drilled in accordance with the specifications and provisions of the Minnesota Department of Health, Water Well Construction Code. (b) At the time connection to the public water supply is completed, all existing private wells no longer in use shall be sealed by a licensed well contractor according to the Rules of the Minnesota Department of Health. SECTION 2. EFFECTIVE DATE: This ordinance shall take effect immediately upon its passage and publication. ADOPTED this 9th day of February, 2015 on a vote of _a ayes and 2 nays by the City Council of Orono, Minnesota.
