HomeMy WebLinkAboutOrd #121-3rd Ser/Admin offenses / ORDINANCE NO. 121, THIRD SERIES � CITY OF ORONO HENNEPIN COUNTY,MINNESOTA AN ORDINANCE PROVIDING FOR ADMINISTRATIVE OFFENSES AND PROVIDING PENALTIES FOR VIOLATION OF THE ADMINISTRATIVE OFFENSES THE CITY COUNCIL OF THE CITY OF ORONO, MINNESOTA ORDAINS: SECTION 1. The following language is hereby added to Chapter 66 of the Orono City Code as Article VIII, Division 1: 66-250. Administrative Offenses The Orono City Council has determined to enforce certain offenses within the Cit ��of Orono as Administrative Offenses. Those offenses to be enforced as Administrative Offenses shall be determined by resolution of the Citv Council as recommended bv the Chief of Police. 66-251. Violation/Penaltv ✓, Anxperson violatin�one of the Administrative Offenses within the Citv of Orono shall be subject to the scheduled administrative penalty. The CitYCouncil shall determine the administrative penalties and both the Administrative Offenses and the penaltv amount ma ��be amended, from time to time,by resolution of the City Council. 66-252. Enforcement Any member of the police department or any other person emplo ��v the cit� authoritv to enforce the Citv Code may issue administrative violations under this Ordinance. Notice shall be given to the violator settin�tforth the nature of the offenses, the date, time of the violation, the name of the official issuin�the citation and the amount of the scheduled penalty. 66-253. Pavment Once notice of an administrative violation is given, the person responsible for the violation shall,within 14 calendar days of issuance of the notice,pay the stated violation penalty to the Finance Director. r � 66-254. Failure to Pay If a violator fails to pav the penaltv im�osed bv this Administrative citation, or if the violator wishes to contest the citation then the matter shall be processed as a Ordinance violation or criminal offense through the Hennepin CountYDistrict Court System. A person convicted of a violation of this Ordinance shall be guilty of a misdemeanor and punished bv a fine of not more than $1 000 imprisonment for a term not exceeding ninety�90) davs, or any combination thereof• provided however that if the violation is declared to be a petty misdemeanor, the penalty shall be a fine not to exceed $300. Additionally, a person convicted of a violation of this Ordinance shall pav the costs of prosecution. 66-255. Disposition of Penalties All penalties collected shall be paid over to the Finance Director and deposited in the General fund. 66-256. Effective Date—January 1, 2014 SECTION 2. The following language is hereby added to Chapter 66 of the Orono City Code as Article VIII, Division 2: 66-257. State Provisions Adopted. � The re u�latorv provisions of M.S. Chapters 169 and 171 Annotated, to�ether with all , amendments thereto are hereby adopted as a traffic code re u� lating use of highways streets and allevs within the city and are herebv incorporated and made a part of this section as completelv as if set out here in full. The penalty for violations of the provisions of state statutes adopted by reference in this section shall be identical with the penalties provided for in the statutes for the same offence. 66-258. Unreasonable Acceleration. No person shall unreasonably and/or unnecessarily accelerate a motor vehicle so rapidly and abruptiv that a tire or tires break traction with the street surface, causing a squealing sound or dislod�in� sand gravel or other ob'ec� ts by the tires. The unreasonable or unnecessarv acceleration is prohibited on an�public street or highway or any private propertv within the citv. 66-259.Unsafe Oneration. �)No person shall drive or operate a motor vehicle, motorized bicycle or motorized foot scooter on any street hi�hwax, road, roadwa�}�or private property in a manner which is unsafe. Unsafe means but is not limited to distracted driving, speeds and/or maneuvers which are not reasonable or prudent or safe given the weather, road conditions, vehicle conditions the proximity of persons and other vehicles and includes such drivin� or o�eration which is unsafe for the driver or operator. ��- � SECTION 3. Effective date. This ordinance shall be effective upon adoption and publication according to law. ADOPTED this 9th day of December, 2013 by the Orono City Council with a vote of 5 ayes and�nayes.
