HomeMy WebLinkAboutOrd #100-3rd Ser/Amending code re: definitions, CUP's/access uses �t • � � ORDINANCE NO. 100, THIRD SERIES CITY OF ORONO HENNEPIN COUNTY, MINNESOTA � AN ORDINANCE AMENDING SECTIONS 78-1, 78-303, 78-328, 78-348, 78-367, 78-394, 78-419, 78-443 AND 78-566 OF THE ORONO MUNICIPAL ZONING CODE REGARDING DEFINITIONS, CONDITIONAL USES AND ACCESSORY USES THE CITY COUNCIL OF THE CITY OF ORONO, MINNESOTA ORDAINS: SECTION 1. The following language indicated by strikethrough is hereby deleted from Section 78-303(3)(a.) of the Orono City Code: Sec. 78-303. - Conditional uses. Within any LR-lA one-family lakeshore residential district, no structure or land shall be used for the following uses except by conditional use permit: (3) Keeping of farm animals for noncommercial purposes and for the use of the occupants of premises, provided that: a. Where the applicant requests a conditional use permit to keep horses, there must be at least one acre for the dwelling and two acres of open pasture for the first horse. If the applicant requests a conditional use permit to keep more than one horse, the property must have one additional acre of open pasture for each additional horse. Calculations of minimum pasture acreage shall not include any land defined as a wetland or wetland buffer under section 78-1602. �2 , SECTION 2. Any building or structure associated with the animals is located more than 150 feet from the nearest adjacent residence and at least 75 feet from the nearest lot line. d. The use is operated in compliance with Chapter 62. Animals. SECTION 6. The following language is hereby deleted and added to Section 78-419(5) of the Orono City Code: Sec. 78-419. -Accessory uses. The following language is hereby deleted and added to the preamble paragraph of Section 78-566 of the Orono City Code: Sec. 78-566. -Accessory Uses. Within any RS seasonal recreational district, no accessory structure or use of land shall be permitted unless a permitted or conditional use is first established on such land, except as allowed in Section�5-5�4�} 78-564 3 . Once a permitted or conditional use exists on any lot or parcel, no accessory structure or use of land shall be permitted except for one or more of the following uses: (The list of uses following the preamble paragraph remains unchanged) SECTION 9. The definitions of Animal Unit and Pasture contained within Section 78-1 of the Orono City Code are hereby revised by deleting and adding language as follows: Sec. 78-1. - Definitions. The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning. Unless specifically defined in this section, the words and phrases used in this chapter shall have the meanings given to them in Chapter 82. Page 4 of 5 � , Animal unit means, for one animal unit equivalency, one cow or steer; one horse, donkey or burro; three sheep; or�8 25 fowl. Pasture means o�en, non-treed land containin�ve etg ation �se�-�e� which can su�port grazing � horses, cattle or other domestic animals. Calculations of minimum pasture acrea�e for the keepin��of farm animals shall not include anv land defined as a wetland or wetland buffer under Section 78-1602. SECTION 10. Effective date. This ordinance shall be effective upon adoption and publication according to law. ADOPTED by the City Council of the City of Orono, Minnesota at a regular meeting held on the 25th day of February, 2013 by a vote of 5 ayes and 0 nays.
