RE50LUTION DENYING AN APPLICATION FOR VARIANCE
FOR SETBACK FROM STREET AND VARTANCE FOR SET-
BACK BETWEEN STRUCTURES ON PROPERTY LOCATED �
� AT 4445 NORTH SHORE DRIVE
WHEREAS , Mr. Ken Heroux has applied for variances
from the setback from street and for variances from setbaek
between structures for certain property in Orono in order to
bui.ld a two-story garage with an area of 936 square feet, and
WHEREAS, the City Council and Planning Commission have
reviewed that application,
NOW, THEREFORE, BE IT F�ESOLVED:
l. That the variance request by Mr. Heroux is hereby
denied.
2. The proposed structure is too large for the existing
1ot.
• ' 3. . . The proposed structure does not conform with exi.sting
residential� uses.
4. There is a possible commercial use of a garage of
this size on this lot.
5. The two-story structure as proposed would obstruct
the vision of the residence to the west. .
6. The second story above the garage would provide a
second residence on a single parcel.
7. The distance between structures must meet the state �
requirement of six feet.
This resolution was passed by a vote of 5 ayes and 0
nays on August 23, 1976.
