AN ORDINANCE AMENDING
CHAPTER 78 OF THE ORONO MUNICIPAL CODE
BY AMENDING SECTIONS 78-1 AND 78-624 TO
ADD "ASSISTED LIVING FACILITIES"AS
AN ALLOWED CONDITIONAL USE
IN THE RPUD ZONING DISTRICT
The City Council of Orono,Minnesota ordains as follows:
SECTION 1. Municipal Zoning Code Section 78-624 is hereby amended by adding "Assisted
living facilities"as an allowed conditional use in the RPUD District, to read as follows:
(2)Assisted livingfacilities. Assisted living facilities as defined in this Chapter, subject to
the �eneral conditions and multifamily-specific conditions applicable to uses in the RPUD
District."
SECTION 2. Municipal Zoning Code Section 78-1 "Definitions"is hereby amended by adding
the following definitions:
"Assisted living acilities"(nursing home, rest home) means housing designed for invalid
infirmed, aged convalescent or physically or mentally disabled persons who need
assistance with their dailv living needs includin�special support services such as meal
preparation,housekeepin�personal nursin�care, etc.; but not including hospitals clinics
sanitariums or similar institutions, or residential programs licensed pursuant to Minnesota
Statutes Sections 245A.01 to 245A.16 or 252.28.
"Hospital"means a licensed facility for the hospitalization or care of human beings within the
meaning of Minnesota Statutes Chapter 144.50,as mav be amended.
"Nursing Home, Rest Home"means a state licensed facilitv or that part of a facilitv which
provides nursin�care nursuant to Minnesota Statutes Chapter 144A.01. "Nursin home
rest home" does not include a facilitv or that nart of a facility which is a hosnital a hospital
with approved swin�beds as defined in Minnesota Statutes Section 144 562 clinic
doctor's office, diagnostic or treatment center, or a residentialprogram licensed pursuant to
Minnesota Statutes Sections 245A.01 to 245A.16 or 252.28.
SECTION 4. This Ordinance shall be effective upon approval and publication.
Adopted by the City Council of Orono on this 12th day of July, 2010 by a vote of 5
ayes and p nays.
