AN ORDINANCE AMENDING CHAPTER 78 OF THE ORONO CITY CODE
CONCERNING SITE PLAN REVIEWS
The following is the official summary of Ordinance No. 68 , Third Series approved by
the City Council of the City of Orono on February 8, 2010.
The Ordinance adds language to Chapter 78 of the Orono Code defining a site plan
review process and replaces the requirement for Council approval of building permits for
commercial and industrial uses with one for administrative or council approval of a site
plan review for these uses.
This is an abbreviated summary of Ordinance No. 68 , Third Series. A printed copy of
Ordinance No. 68 Third Series in its entirety is available for inspection by any person
at the office of the City Clerk during regular office hours. This ordinance becomes
effective immediately upon publication.
Adopted by the City Council of the City of Orono, Minnesota on this 8th day of
February, 2010 by a vote of 5 ayes and 0 nays.

AN ORDINANCE AMENDING CHAPTER 78 OF THE ORONO CITY CODE
CONCERNING SITE PLAN REVIEWS
THE CITY COUNCIL OF THE CITY OF ORONO, MINNESOTA ORDAINS:
SECTION 1. The following language has been added to Section 78-42(a) (Fees for zoning
applications) of the Orono City Code:
(a) The fees to be paid for each application for rezoning, simple subdivision or
variance, new, special or conditional use, accessory and principal uses, site nlan
review. or other approvals required in this Code shall be in the amount prescribed
by the current city fee schedule provisions. Fees shall be payable at the time
applications are filed with the zoning administrator. There shall be no fee in the
case of applications filed in the public interest by the council or by the planning
commission.
SECTION 2. The following language has been deleted and added to Section 78-45
(Administration and Enforcement) of the Orono City Code:

SECTION 3. The following definition has been added to Section 78-1 (Definitions) of the
Orono City Code:
Site nlan means a man denictin�the develonment of tract of land, includin�, but not
limited to. the location and relationshin of structures, streets. drivewavs, recreation areas.narkin�
areas. easements. utilities. landscanin� and walkwavs, as related to a nronosed develobment.
SECTION 4. The following language has been deleted and added to Section 78-642 (B-1
District) of the Orono City Code:

SECTION 11. Chanter 78. Article II. Division 4. Site Plan Review is added to the Orono Citv
Code:
DIVISION 4. SITE PLAN REVIEW
78-141. Purnose.
The bumose of this division is to establish a formal site nlan review nrocedure for
commercial and industrial uses and brovide re�ulations nertainine to the enforcement of site
desi consistent with the reauirements of this Ordinance in advance of buildin�nermit issuance
78-142. Annroval Reauired.
It shall be unlawful to construct a building. enlaree the footnrint of a buildin�. or chan�e
or intensifv the use of an existin�buildin�or site in anv business or industrial district without
annroval of a site nlan in accordance with this division.
78-143. Review Process. Site blan reviews shall be reviewed in accordance with the followin�:

(11 Citv council. The citv council shall make a decision on site nlans reviews to
construct a buildine or enlar�e the footnrint a building. Prior to council consideration the
plannins commission shall hold a nublic hearin�and make a recommendation reQardin�the site
plan review. Notice of the nublic hearin� shall be �overned bv Citv Code Section 78-915
(21 Planning and Zoning Coordinator. The blannine and zonin� coordinator shall
make a decision on site nlans reviews to chanee the use of a buildine or narcel of land: to modifv
the interior or exterior of a building or site or land feature in anv manner that results in a
different site desi�n or intensitv of use, includin�the reauirement for additional narkin�or to
enlar�e a buildin�bv less than ten nercent(10%1 of its eross floor area. The nlannin� and
zonin�coordinator shall have the authoritv to refer an administrative site nlan review to the citv
council for decision. The owner mav anneal the decision of the nlannin� and zonin� coordinator
to the citv council.
78-144. Anblication for Site Plan Review.
An annlication for a site nlan review shall be made to the nlannin� and zonin�
coordinator on a form nrovided bv the Citv and shall include the name address and telenhone
number of the annlicant the name address and telenhone number of the nronertv owner and the
district in which the nronertv is located The annlication shall be also be accomnanied bv three
co ies of the followin�information. unless waived bv the blannin� and zonin�coordinator•
�1 A current certificate of survev of the nronertv. This survev shall be used as the
base for all reauired nlans.
2� A detailed site nlan denictin�the following:
a. Site dimensions.
b. Site conditions and existing develonment on the subiect nronertv and immediatelv
adiacent nronerties.
c. Pronosed use of all areas of the site
d. Reauired and nronosed setbacks
e. Location. setback. and dimensions of all nronosed buildin�s and structures
f. Location of all adiacent buildin�s located within one hundred feet (100'1 of the
exterior boundaries of the nronertv in auestion
g•
Location. number. dimensions and setbacks of nronosed narkin� snaces drive
aisles. and loadin�areas.
h. All nublic streets. entrance and exit drives. and walkwav locations.
i. Location. access. and screenin�detail of nronosed trash enclosures.
j. Location of outdoor mechanical eauinment and nronosed screenin�
3� Landscanine nlan.
4� Tree nreservation nlan, includin�the location. tvne_ and size of all existing trees
six inches (6"1 or more in diameter to be removed or nreserved.
5� Grading and erosion control nlan prebared and siened bv a Minnesota licensed
en�ineer.
�6 Utilitv nlans.
�7 Annlication fee and escrow.

to:

Sec. 78-145. Evaluation criteria.
Before �-antin� annroval of the site nlan review. the citv council or the nlannin�and
zonin�coordinator shall determine that the nronosal:
1� Is comnatible with surroundin� land uses:
2� Preserves existin�uniaue and natural features of the site and minimizes imnacts
to wetlands. floodnlains, and shoreland areas:
3� Creates harmonious relationshin of buildin�s and otien snace with natural site
features and with existing and future buildines having a visual relationshin of the
develonment:
4� Achieves a safe and efficient vehicular and nedestrian circulation svstem:
5� Places no excessive demands on services and infrastructure includin local
streets:
6� onforms to the Citv's nlans for narks, streets. and walkwavs;
7� Conforms to the Orono Communitv Mana�ement Plan:
8� Achieves a maximum of safetv and convenience of vehicular and nedestrian
movement:
�9 Incoroorates sufficient landscaning to reasonablv screen undesirable features and
to enhance the ima�e of the develonment:
10 Protects abuttin�nroperties and does not create detrimental disturbances to
surroundin�nronerties:
11 Conforms to all reauirements of this chanter unless a variance has been �ranted.
12 Incoroorates efforts to conserve ener�v whenever nractical.
Sec. 78-146. Conditions.
The citv council or the nlanninQ and zonin�coordinator mav imnose conditions in
�ranting abbroval of a site nlan review to nromote the intent of this division and to nrotect
adiacent nronerties.
Sec. 78-147. Securitv A�reement.
Before issuance of anv nermit. a letter of credit or cash denosit shall be sunnlied bv the
owner euaranteein�comnletion of reauired site imnrovements. The amount of the securitv shall

be one hundred twentv-five nercent(125%1 of the estimated cost of the imnrovements other than
the buildin�.
Sec. 78-148. Snecific Proiect.
A site nlan review anproval shall be valid onlv for the nroiect for which annroval is
�ranted. Construction of all site elements shall be in comnliance with the tilans and
snecifications annroved bv the citv council or the blanninQ and zonin�coordinator.
ec. 78-149. Lanse of Annroval.
Unless otherwise snecified bv the citv council or the nlannine and zonin� coordinator a
site lan review annroval shall become null and void one(11 vear after the date of annroval
unless the nronertv owner or annlicant has substantiallv started the construction of anv buildine.
structure. addition or alteration. or use reauested as nart of the annroved nlan.
Sec. 78-150. Buildin� Code.
The review and annroval of site imnrovements nursuant to the reauirements of Citv
adonted buildine and fire codes shall_be in addition to the site nlan review nrocess established
under this division. Site nlan review annroval does not imnlv comnliance with the reauirements
of the buildin� and fire codes.
Secs. 78-151 -- 78-160. Reserved.
SECTION 12. Effective date. This ordinance shall be effective upon its passage and publication
according to law.
