AN ORDINANCE AMENDING THE CITY OF ORONO ZONING CODE
SECTION 78-1431
REGARDING CONDITIONAL USE PERMITS
ON THROUGH LOTS
The City Council of Orono ordains as follows:
Section 1: Municipal Zoning Code Section 78-1431 is hereby revised as follows:
Sec. 78-1431. . Accessorv buildings and structures
on through lots.
All accessory buildings and structures on through lots located in R districts shall
� �a�*����' � ���*meet the following requirements:
l. The buildin� or structure shall meet the principal building setbacks that are
established under sections 78-230, 78-255, 78-305, 78-330, 78-350, 78-370, 78-
395, 78-420, 78-444.
2. No ne�ative impacts to adiacent nei�hbors or public right-of-wav result in the
placement of the buildin� or structure, determined at the discretion of the
Plannin� Director.
Should the Plannin� Director determine that item #2 above cannot be met an accessor,y
structure or buildin� mav be permitted bv conditional use nermit if the Plannin�
Commission determines no ne�ative impacts result in the placement of the buildin or
structure. The Plannin� Commission mav applv reasonable conditions as part of the
a�proval.
Section 2: This Ordinance shall be published in THE PIONEER and THE LAKER
newspapers and shall become effective upon approval and publication.
Adopted by the City Council of Orono on this 28�' day of June, 2004 by a vote of
4 ayes and � nays.
