HomeMy WebLinkAboutOrd #012-3rd Ser/Amending code re: non-encroachments : ORDINANCE NO 12 , THIRD SERTES AN ORDINANCE AMENDING THE CITY OF ORONO ZONING CODE SECTION 78-1405 REGARDING NONENCROACHMENTS The City Council of Orono ordains as follows: Section 1: Municipal Zonin� Code Section 78-1405 is hereby revised by adding Subsection(8)which shall read as follows: Sec. 78-1405. Nonencroachments. � Entrance monuments, defined for the �urpose of this section as a nearlv permanent nhvsical structure or obiect, natural or artificial used to depict an entrance to the nropertv, erected in all residential zonin� districts are considered nonencroachments when thev conform with the followina standards• a. Each monument, witli a inaximum of two, shall be limited to a sin l�e pillar with a faotnrint measurinQ no larger than 25 sq�.�are feet and no len7tlz to exceed 5'; b. The monument must be setback a minimum of 5' from all propertY boundaries and never fewer than 10' from the edge of the paved traveled roadwa� c. Plans and/or elevation views of the pronosed monuments are required to be submitted for approval by the Planning Director• d. All siQna�e proposed for the monuments must comply with Section 78-1467• e. The monuments are limited to 8' in height includin�an�appurtenances Anv monument exceedin� the maximum hei�ht must meet principal structure setback requirements: f. When more than one monument is proposed a minimum horizontal width of 12' is required between them; � Li�htin� is allowed, in conformance with Section 78-1573 and at the discretion of the Plannin�Director. h. When a �ate is prouosed the following requirements must be met• 1) The �ate must open into the propertv not outwazd towards the rieht-of- wav, and The s�language is deleted;the underlined language is inserted. ' , y 2) For locked and/or secured �ates a knox box, meetina the standards set forth bv the. police and fire department, must be provided for emer�ency access, and 1) On major thorou�hfares the monuments and �ates must be located 40' from the paved, traveled road to allow for vehicle stackin�. A major thorou�hfare for thepuiposes of this section means anv countv road or state highwa� i. A buildin; permit is required for installation. A survev must be submitted depicting where the monuments will be placed, and the propertv corner pins must be located for inspection purposes. Section 2: This Ordinance shall be published in THE PIONEER and THE LAKER newspapers and shall become effective upon approval and publication.
