We again stated that the City has no enforcement power over private easements. There are issues, however, that need your attention. 1. When your excavator comes back to move the driveway(as we discussed), the City will require you to remove any fill from the 5' setback and rough in the swale to accommodate rains and spring thaw. I would like to meet you and the excavator on site to discuss this before the work is started. 2. The berm you created next to the outlot must meet a 5' setback from the property line and the silt fence must be fixed up in that area. 3. Prior to final grading,the City will require you to submit a grading plan done by your surveyor. The plan will show how the cul-de-sac drainage will be directed by existing and proposed contours. The City will require Mr.Ritter to revise the berm to meet the 5'required setback from the property line. This work will be required to be completed before the City issues a certificate of occupancy.
