CITY OF ORONO, MINNFiiOTA MINUTES OF A PLANNING C0M4ISSIO4 MEETING HELD NOVEMBER 7, 1977 The Orono Planning Commission met on the above date with the following members present: Chairwoman ^fcDonald, Members Hurr, Hairmerel, Hassel, Hannah, Frahm. Also present was Zoning Administrator Hank Muhich. Chairwoman McDonald announced that this was the time and place for a public hearing on the petition of Wayside Kennels for a transfer of a conditional use permit of property located at 3505 Wayzata Boulevard. The Zoning Administrator presented the Notice of Public Ifearing and the i'^fi davit of Piilication. The Fulmer’s have purchased this property from Norman Larson and are requesting approval for a transfer of the existing non-conforming use. Dr. Fulmer was presort and introduced his son and daughter-in-law, Brian and Cathy Fulmer, who will be running the kennel operation. The applicants presented a sketch of a sign they are proposing to use in place of all the signs now posted on the building and the property. The Planning Commission agreed that it would be an improvement. The size of the sign appeared to meet the code requirements. The name of the kennel would be changed from Wayside Kennels to the Dog House Boarding Kennels. The Planning Commission opened the discussion to the public. Dick Selhost, who owns property to the south of the kennel, and Angie Koenig were present. Mr. Selhost expressed his coTicem regarding noise, odor and general appearance of the property. In response, Brian Fulmer stated that they are aware of the problems of the past operation such as noise and odor. He asked that everyone bear with them imtil they have cleaned up the premises. Tliis is something that will take awhile. The reason they purchased the property was because they would like to fix it up in the way they feel a kennel operation should be and feel tliat it will be a good business for the community. They plan to lower the ceiling in the main building and insulate the walls vhich would reduce the noise factor. They will also be living on the property and will be affected by the noise also and will attempt to control this. The applicant also reaffirmed the fact that this would be a boarding operation with a maximum of 60 dogs. This maximum capacity would very seldom occur except possibly on holidays and some weekends. The outside nins will be concrete as well as the inside. The dogs will be inside after a reasonable hour. The operation would be open to the public and staff for inspection. ATTENDANCE - 7:30 P.M. The Commission felt that the applicants were responsible and enthusiastic people and would be reliable in their attempts to improve the property. Several of the members steted that they observed a vast improvement on the property since the Fulmer's have started cleaning up the property. After some discussion, Hassel moved, Hananerel seconded, to recommend approval of the transfer of the Conditional Use Permit to expire on the date new licenses are required on the condition that this is primarily a hoarding kennel and the capacity would be no more than 60 dogs. Also, that no dogs be sold for experimental purposes. Also, tne understanding that the kennel facilities be open to the public under normal hours of business or would be inspected from time to time by the building inspector or other health inspector from the City to see that no unsaie health condition exists. Motion - Ayes (6), Nays (o). The question of the disposal of the manure was brought up. Dr. Fulmer explained that the process for the waste disposal would be similar to a satellite facility which would be treated with chemicals. When the container is full it would be decomposed in much the same way that a septic tank would be. Dr. Fulmer further stated that the total amount of waste from three horses would exceed waste from 60 dogs. Hassel moved, Hammerel seconded, to amend the motion to include: the waste material will be disposed of in a generally accepted method so as not to cause a health, safety or welfare problem on the property. Chairwoman McDonald announced that tliis was the time and place for a public hearing on the petition of James Lawrence for a subdivision of property located at 1550 Sixth Avenue N. The proposal consists of a sub­ division and rearrangement of the Lawrence property of the east lot of the Dayton subdivision. The proposed 8 lots meet the 2-acre area requirement. Lot 1 is 6 ft. short of the required 200 ft. lot width requirement. Fred Herfurth, representing the applicant, was present. The Planning Commission determined that the proposed subdivision would be a remedy to the existing situation. Frahm moved, Hassel seconded, to recommend approval of the preliminary subdivision subject to access easements as necessary to eliminate possible access problems in the future. Motion - Ayes (6), Nays (O). Chairman McDonald annoimced this was the time and place for a public hearing on the petition of Conley Brook*- for a subdivision of property located at 1125 Spring Hill Road. The Zoning Administrator presented the Notice of Public Hearing and the Affidavit of Publication. Mr. Herfurth, representing Mr. Brooks, presented the preliminary subdivision proposal. Mr. Brooks is requesting approval to subdivide Tract A (part of original subdivision approved by Council this past August) into two i>arcels. Both parcels would exceed the minimum 2 acre and 200 ft. Tot width require­ ments. However, there is only one access for the two parcels and the driveway entering Parcel A-2 is partially located on Parcel A-1. The Zoning Administrator presented a copy of the letter from the City Engineer in which he i-ecommended that an easement be included to eliminate any possible legal problems. The City Engineer also noted that a garage located on Parcel A-1 is not showfi on t’ne preliminary plat. Mr. Herfurth commented that Mr. Brooks may consider moving the bam. The Coimnission reviewed the report submitted by the Minnehalia Creek Watershed District indicating their concern for the marsh areas along the creek. Tlieir recommendation is to provide for i-etaining of these wetlands in their present state. The rex>ort received from Jim Anderson, of the Hennepin Soils Conservation District revealed that the proposal would meet the requii’ed dry land area for two lots. Mr. Gridley was advised that an individual on-site septic system would need to be approved by the City Engineer before a building permit would be issued. The Zoning Admin­ istrator presented Mr. Gridley wl.th a copy of a bill for boat rental in the amount of $14.50 incurred by Jim Anderson to be reimbursed by the applicant. Mr. French of the Hennepin County Park Reserve was present. He was interested in knowing Orono^B position for projected park use of Big Island. It was their understanding that the City of Orono would be willing to utilize and do all that it could to facilitate the acquisition of Big Island for the park. Mayor Van Nest was present. He stated that several years ago Orono, by j*esolution, supported the Park Reserve District procuring as mueli as possible on Big Island end to some day turn ns much of Big Island as possible into a park for the Metropolitan area. Mayor Van Nest further stated that Orono still supports this position and they would be willing to reaffirm same. Mayor Van Nest volunteered to attend the next Hennepin County Park Reserve meeting to reaffirm Orono*s position. Mr. French was advised by the Planning Commission that it would be difficult to deny this subdivision proposal as it does meet on the zoning requirements. The Planning Conunission reviewed his preposal 'vAiich consists of the construction of e detached garage. A survey was not submitted, and the exact extent of the variance could not be determined. The Planning Commission appeared to indicate approval of the concept if all dimensions could be verified. The Planning Commission directed staff to inform, applicant that at least a partial survey would be necessary before the Planning Commission could maite a definite determination of the extent of the variance. Hassel moved, Hurr seconded, to table the application as Mr. Dorn was not present. Motion - Ayes (6), Nays (o). Mr. Bie was present. Tiie Planning Commission reviewed his proposal for an electrical shop and gift/hobby shop area on the gi*oiLn<I floor with rental office space on the second floor. The Zoning Adiainistrator advised the Planning Commission th.at the final plans are soine\diat different than the preliminary sketch presented to the Planning Conimlssion previously in that variances would be necessary frem both rear setback and parking requirements. The final plans also indicated no change in the originally preposed access to County Road ±5. The Planning Commission discussed the proposed curb cut on County Road 15. Several members oC the Planning Conunission felt that access should be to Navarre Lane. A letter submitted by Hennepin County also inilicated no direct access to County Road 15. After some discussion, Hassel moved, McDonald seconded, to recommend approval of a variance to the parking requirements and rear yard setback, and approval of site and ouilding elevation plans subject to the following: 1. This subdivision plat was approved by Council June 28, I976, subject to payment of the park dedication fee and engineer's approval of the drainage plans. From the plat survey it is apparent that the driveway entering Parcel A-2 is partially located on Parcel A-1. Since there are large evergreens located on the east side of the roadway, the recuMstruction of the driveway to the east does not seem to be the best solution. A permanent easement which would include the driveway i.nto Parcel A-2 would eliminate any possible legal problems. Another solution would be to change the boundary line between the two Parcels so that the east property line of Parcel A-2 would be on the west perimeter of the existing driveway. A garage is located on Parcel A-1 which is not shown cn the submitted plat drawing. Since the garage is not shown, it is not possible to tell if the garage encroaches on any property or if there may be a problem with setback requirements. The low or marshy lands along the shore are not included in the area calculations. We are in the Slectrical Contracting Business D.B.A. Village Electric Company. We have been in business for six years in Navarre. We would like to build a building on lots l5,l6 with the idea of housing Village Electric and with possible business expansion in mind. One thing that concerns us about the project is the proposed curb cut onto County Road 4^15* Oe, September 21, 1977 I met with Mr. Don Murphy form Hennepin County traffic engineering and went over the problem with him. At that time he mentioned that the county was concerned about the traffic safety. We are oncemed about traffic safety too but feel that the access from Navarre Avenue is very inadequate. #1. The opening to Navarre Avenue from County #l9 is oJ^ly 30 7 inches between the N.S.P. pole and the stop si^ posts. Eight feet of this 35 feet right of way not paved. A short distance up the hill only 15 feet is defined roadway. #2. We feel this narrow roadway will make it very difficult for one car to enter and one car BTd.t by the same means. Our Architects have laid out ora* proposed lot design that will offer a 30 foot curb cut in width and will give adequate car length. This will allow a car to stop well out of the line of traffic, look and then proceed when safe. It also eliminates conjestlon and confusion of two way traffic in and out of one entrance. I have parked my truck on the proposed curb cut and had good observation of traffic in both directions. We feel, with the narrow approach of Navarre Avenue that two openings to our parking area is necessary. With the design we feel it is safer and will work better. This is the last remaining site in Block 3. The site appears to meet the width require­ ments, but lacks adequate area. The survey submitted with the application appears to have been made some time ago It notes the markers and dimensions of the subject parcel as platted, but fails to indicate the status of the right of \%rays as constructed. If this right of way area were to be deducted, the total area ivould be reduced quite substantially. Although we generally require a current survey with proposals such as this, I felt it would be too costly to the applicant if the application were denied. If the variance is approved, however, it should be contingent upon the applicant providing a current survey to verify data submitted and eliminate the guess work. Minimum lot area requirement in this district is 43,560 sq. ft. The area of this lot as shown on the survey is approximately 22,000 sq. ft. This is questionable, however. That area upon which the right of way exists (as shown on survey) should probably be deducted from the total buildable area. Access to County Road #19 would also create a problem. The limited vision around the curve of County Road #19 would only add to the current hazardous traffic situation along the highway. Unless the owner can provide proof of some safer means of access to the property, I would hesitate recoirmending approval. M O Because it is difficulc tor me to speak in public I am writiiig tlvis letter and hoping vou will take a few minutes to read it. In mid 1975 I purchased, by Contract for Deed, a 1/2 acre lot at 3024 Casco Point Rd. owned by Joseph Braun. It took until January of 1976 to close on the lot as Mr. Braun had some estate work affecting the that had to be cleaied up. At that time we liad a legal floscrip— tion written and approved by the Torrens Office and taxes have Ijeen charged on that parcel ever since. Soon after that, we api^lied for a building permit and were told to get the property surveyed first; wliich we did. Then we wore told that the survey was not enough and we needed to have it on hard shells and mylars. Also, we v;ould need soil testing and again we had this done, (I paid $430.00 for surveyino and $400.00 for soil testing). After that we wore again ready to proceed when we were told of a $2000.00 park dedication fee. This was just about the last straw. For the next several months Braun and I talked about the legality of such a charge and wlio was to pay it. In January 1977, I agreed to pay it. H.ad we any idea that the city had a 6 months time limit on consul's decision's we would have paid it in December of 1976 (10 months ago) and would not be taking you time now. At this point I have tendered Mr. Braun full payment for the lot, the park dedication foe, and two years of Real Estate taxes on the lot. He is now unable to deliver a deed. I feel that a lot of delays in tliis matter are a result of poor direct­ ion from the city to Mr. Braun as to what was necessary to subdivide his property and the city's regulations rogtardrng time limits. As you can imagine I am quite concerned about this matter and would appreciate any lielp you can give. It is not clear from this data what the proposed desig­ nated wetlands area would be. In our evaluation of the previous proposal for this area by Centurion Company and Cheyenne Land Company in 1974 the two major wetland areas Cin Lots 1, 2 and 6, Block 2 and in Lots 4 and 5, Block 3) were to be preserved and we found this to be adequate with certain conditions. The current plat appears to delete one of these wetlands and would, therefore, be undesirable in our opinion for lack of flood storage and filtration capacity in spite of the reduction in number of lots proposed relative to the 1974 plat. Regarding on-site sewage disposal, our soils map shows this to be generally an unfavorable area. Percolation tests would, of course, have to precede any specific installation but it %)ould be helpful to conduct these as early as possible to determine whether some other alternative to on-site dis­ posal would be advisable. --v w Mr. H. HOW TO USE THE SOIL MAP TMs is a prelifliijiaTy soils evaluation and plan review of the pro­ posed Orono Oaks Addition in the City of Onmo. A detailed soils map for the area of proposed development is provided with this report. This map is based on information contained in "Soil Survey of Hennepin County** and "Landscapes of Henn^in County" as well as 1975 aerial photograi^ of the area and an on-site investigation. Each of the soils mapped within the proposed development ar^ is briefly described. Favorable and unfavorable development characteristics are discussed. Explanations of the soil map syn^ls and colors are pre­ sented in Sections II and III. This is a preliminary soils evaluation and additional engineering tests should be conducted before construction is begun. The potential of the soils mapped for installation of ment systems is discussed. Areas within the proposed develop^t area which may be classified as public waters or wetlands are indicated. Methods for control of runoff and sediment from this site are discussed. To use the soil map one needs to know ^diat the symbols mean. Ihis is a nearly level soil occupying areas on flats and in shallow drainageways. The level slope requires little grading. There is a seasonal watertable at a 1 to 3 foo depth for extended periods. Soil strength is adequate for residential develop ment. The soil is sticky and difficult to work >hen wet. There is a high potential for frost action. Shrink-swell (volume change) is moderate with changes in moisture content. The soil is moderately to slowly permeable. Erin loam; This is a deep, well-draimed, moderately fine textured soil that formed in calcareous shaly till. The shaly till is underlain by friable, calcareous, loamy till at a depth of 3 to 20 fqet. The soil occurs on smooth, irregularly shaped hills. There are stones and boulders in and on this soil. The native vegetation was mixed hardwood forest. There are several slope phases of this soil mapped in Hennepin County. Each slope phase mapped within the area of the proposed development will be discussed separately. This Le at a 3 to 5 foot {h with changes in strength is adequate Page -9* POTENTIAL OF SOILS FOR ON-SITE WASTE TREATMENT According to the reconroended "Ordinance and Code Regulating Individual Sewage Disposal Systems" published by the Minnesota Department of Health in 1971 **No soil absorption system shall be installed in an area i^ere the watertable is at any time less than 6 1/2 feet below ground level or 4 feet below the bottom of the drain field trench". This line of thinlcing has changed somewhat over the past 6 years to re­ flect research results conducted in various areas of the county. The proposed Minnesota Pollution Control Agency WPC-40 "Individual Sewage Treatment Systems Standards" states only that "The bottom of trenches and beds shall be at least three feet above the watertable or bedrock** and allows for installation of additional innovative systems other than the standard subsurface trmich system to meet this recjuirement. An example of the innovative systems is the mound system. In the mound systm the seepage bed or trench is elevated by the use of sand fill to provide the 3 foot separation distance between the bottom of ^e seqpage trench and a barrier layer such as the watertable or bedrock. In the preliminary *'Recomn^ed Practices for On-Site Sewage Treatment Systems** prepared by the City of Orono the 3 foot separation distance is implied when the highest point of groundwater must be greater than 5 feet for installation of a standard soil absorption system. Concern about tMs minimum separation distance is due to the fact that it takes approximately 3 feet of unsaturated soil material to properly treat the septic tank effluent, toce the septic tank effluent reaches a watertable treatment of the effluent ceases. This results in the ores ence of a polluted water body near the surface. Additional iiqjuts of effluent and natural water in the area may result in surfacing of the effluent and/or the backing up of the effluent into the house. TTiis ere ates not only a nuisance to the home owner, but can also pose a health hazard if the surrounding area is well populated. The best indicator available for determining the maximum height of a seasonal watertable which often occurs in the soils of Hennepin COunty is the presence of soil mottles. Mottling is a distinctive coloration of grey with red and yellow splotches in the subsoil. Any investigation of a proposed soil absorption (treatment) system site should include a determination of the depth at i^ich soil mottles occur. With this back­ ground the potential of the original soils mapped in this development ar< for treatment of septic tank effluent will be discussed. Areas of Peaty muck soils indicated by dark blue on the accompanying soils werlay are found in wetlands. The watertable in these organic soils is above or near the surface the entire year. This water may persist for several months during the year. Installation of any subsurface soil absorption system in this soil obviously would not allow the minimum recommended separation The mound system is designed for soils with periodic high watertables. However, the watertable must not be higher than 2 feet below the surface for the mound system to function effectively. Installation of any soil absorption system on this soil type is not reconmended. Areas of Dundas and Minnetonka soils are indicated by the light blue color on the soils overlay. The maximum height of the seasonal watertable in this soil as indicated by the presence of mottles is usually between 1 and 3 feet. If the mottling occurs at less than a 2 foot depth installation of any soil absorption system is not reconmended. If the mottling occurs at a depth greater than z ^a mound system may function properly. Nessel soils colored light green on the soils overlay commonly have a seasonal watertable at a depth of 3 to 5 feet. If the soil mottling in­ dicates that the depth of the watertable is 3 feet the recommended separ­ ation between the bottom of the seepage trench and the watertable ca^t be maintained. In this case, installation of any subsurface system is not recommended. However, a mound system can function properly. If the mottling indicates the watertable present at the 5 foot depth then a shallow trench system could provide adequate treatment. The Hayden soil, colored medium green on the accompanying overlay offers the most potential for waste treatment. Presence of the seasonal water- table is often below the 5 foot depth. This ^Id allow the installation of the standard subsurface system. However, in many cases there is evidence of soil mottling at a 4 to 5 foot depth. This fact, coupled with the presence of the most premeable portions of this soil nearer the surface, means that a shallow trench system will probably function better than the standard system on this soil. Shorewood soils, colored light red on the soils overlay, coinnonly have a seasonal watertable at a depth of 3 to 5 feet. In addition, percolation rates on these soils are often in excess of 60 minutes per inch . For this reason an innovative mound system will function more effectively than either a standard system or a shallow subsurface system. Erin soils indicated by the medium red color on the soils overlay have a high clay content in the subsoil. This often results in percolation rates in excess of 60 minutes per inch. For this reason it is recommended that an innovative mound system be installed on these soils. These systems cannot be installed on slopes greater than 6 percent. Use of agricultural drainage tile for this purpose is relatively difficult for several reasons: i) the tile installed must be properly plac^ to in­ sure t^t the watertable is sufficiently lowered not to interfer with the system; ii) the tile lines must be properly maintained by some party, this includes the policing of the tile lines to insure that they are TOt dis­ turbed in any manner by the hcmieowners or utility companies; iii)^ the presence of these tile lines offer a convenient outlet for anyone in the future who has problems with their waste treatment system. An additional word of caution on using this type of arrangement, is that little research has been conducted on the functioning of these systems and there is some question as to how well they will operate. The area indicated as Borrow pit presents another problem for the location of an on-site waste treatment system. These systems are designed on the basis of natural soil characteristics. This means that these systems should not be constructed on filled areas. There are primarily two reasons for this. First, it is difficult to determine the pemeability of the filled area, which makes sizing the system very difficult. Second, if the fill settles, the distribution lines of the system will no longer be on grade which will result in unequal distribution of the effluent, localized over­ loading of the system and eventual failure of the system through lack of sufficient treatment and surfacing of the effluent. Fbr areas that have been graded it may be possible to have a soil absorp­ tion system installed if the minimum reconmended distance can be main­ tained between the seepage tren<^es and the watertable; and if the perm­ eability (percolation rate) is rapid enough. The chance of failure for the system is greatly increased however, since the more premeable portions of the soil have usually been removed by the grading; the separation dis­ tance has beOT recced and the likelihood of soil compaction during grading is high. Based upon the above ;»nsiderations it appears that there should be some rearrangem^t and recombination of the proposed lots. There are several lots present as platted that consist entirely of Glencoe, Hamel or Peaty muck soils which are not suitable for installation of any soil absorption system. In addition, there are large areas of steep sloped Erin and (4yden soils where installation of a system is not recommended. V. PUBLIC WATERS CLASSIFICATION There are four wetland areas indicated by the soils map. One of these areas is presently being utilized as a horse pasture and training ring. Any encroachment or alteration of the wetland requires a permit from ENR. For further clarification and confirmation of this designation Ron Hamack of the Metro Region Office should be contacted. VI.
