Member Frahm arrived at 7:40 p.m. Also present were Mayor Van Nest and Zoning Administrator IlanK iliuiicn. Mayor Van Nest opened the meeting by presenting John Guthrie witii a resolution of apjireciation for his^ years of service on the Planning Coimission, Tliis was Jr. Guthrie's last meeting and the Planning Commission expressed tlieir thanks for his contributions to tne Commission and the community. Ilurr moved, llammerel seconded, that the minutes of the Planning Commission meeting of October 3, 1977, be approved. Motion - Ayes (6), Nays (0). In light of tlie new material received (resolution prepared by attorney), Mr. Hacking requested that tliis item be clefsrrcd until later in tlie rnoeting when his client was present and he has liad a chance to discuss tliis with him. Tlie Zoning Administrator presented a copy of the fmial plat. A copy of tlie title opinion has been fon\rarded to tlie City Attorney for his approval. The Zoning Administrator stated that tlie access to Lot 1 has not been resolved, wliidi was a condition of preliminary approval. In a letter to the City Attorney, Thomas Maliler, attorney for Lucian Strong, suggested that an easement agreement be entered into witli tlie City to provide access to this lot. Mr. Strong was present. Tlie Planning Commission reviewed tlie final plat. After a brief discussion, Guthrie moved, Ilamncrel seconded, to recommend approval suliject to the conditions spelled out in Mr. Maliler's letter to the City of Orono wliich gives a detailed description of hov; the access easement w'ould be legally aandled. At the time of each previous application, tlie applicant had informed the Planning Commission tliat Mrs. Dongaske was not willing to sell Lot 3. Uiy is this lot now suddenly available? A residence could be located to meet all setbacl-i requirements, and the Zoning Administrator suggested tliat approval be subject to all otlier setback requirements being met. Ihe area is sewered, and there is no adjacent land available for expansion. Mr. Muliicli pointed out that access from this property to County Road t^l9 would be liazardous. Tliis is similar to the Lucille Olson property directly to the west. Mr. Muliich suggested that the applicant obtain an easement over the same access which we previously provided for Lucille Olson. Ms. Hemen was present. She informed the Planning Commission that an access easement would not be necessary as access can be provided from the rear of the lot to Tonka View via a platted Cit>^ right of way along Park Avenue and Adams Street. Richard Fulmer had been in the City office to discuss this application and requested to appear ]'>efore the Planning Commission to introduce himself and liis family. Mr. Ricliard Fulmer introduced liimself and his son and daugliter-in-law, Brian and Cathy Fulmer,who would bo operating the business. Tliis is their first venture of til is kind. Tlie maximum capacity of this facility would be 60 dogs. Picliard Fulmer advised that they have a scheduled closing date on this property for October 21. 'Tliey advised that a public hearing had been scheduled to give the neighbors and concerned public an opportunity to oxpress their comments. Tlie applicant indicated he would be willing to provide reasonable access for the public during daytime hours and would comply with any reasonable conditions the City might consider necessary after the public hearing. Tlie Zoning Administrator presented the plan for the proposed dredging of Lafayette Bay. lie advised that tlie certified property owner’s list which is a require ment of the application was not submitted until today so the neighboring property owners have not been notified. Some documentation of previous dredging approtnl was also requested to distinguish between maintenance dredging and initial dredging. To date, this has not been submitted. Mr. Sween, representing the Association, was present along with ^'r. Ilepp. Mr. Sween informed the Commission that ho had contacted the DNL and he was unable to secure tliis permit. In checking their microfilm records, they were unable to find any evidence that a permit was ever granted, lie further advised that he had contacted a dredging company and was given the name of Roy Roberts i.ho had been involwd in dredging many years ago. In talking with Mr. Roberts, he learned that the original dredging of this bay took place in 1930 or before. Tlie Zoning Administrator distributed a copy of the preliminary draft of a resolution received from Bruce >!alkerson earlier today. A copy has been mailed to Ron I la mack of the DNR. The Zoning Administrator stated that he liad talked with the IM^R and tliey indicated several suggestions, llieso 'Suggestions v/ere presented to the Council and taey recommended adopting a resolution stating tliat Orono would prefer a dock or access to the lake proper rather than any dredging or dockage in the channel, ^condly would be dockage at tlie mouth of the channel with a dock coming from the nearest point. Mr. Hacking informed the Comission tliat tncy had not received any notice of Council’s consideration of this matter ivhicli resulted in a resolution of direction to tlie Planning Commission. He said they were flying blind as thev just received a copy of tlie resolution tonigat and haven't had a chance to go over it thoroughly. All comncrcial and industrial constniction proposals require Planning Commission and Council approval before obtaining a building permit. The building elevation plans and site plan must be approved by Council. This proposal rec^uires approval of several variances also. 'Tliis area is zoned B-1. Tlie lot meets the area and width requirements. However, the proposed addition would not meet front and side yard setback requirements. Tlie setbacks as required in tJiis B-1 district: Front - 35 ft.. Rear - 35 ft.. Side - 15 ft. The setbacks as proposed: Front - 15 ft.. Rear - 30 ft.. Side - 0 ft. The proposed location is a continuation of the front and rear lines of the building extending to the west side lot line. The proposal would also require a variance from parking requirements. The extent of tlie proposed structure would eliminate practically all parking facilities on the property. Mr. Jolmson feels the municipal parking lot to the north of his property would provide adequate parking for his expanded operation. PLANNING CaWISSra MEETING - October 3, 1977 Mr. Stan Johnson was present. Planning Coianission recommended approval of side yard variance because proposal is consistent wdth neighborhood subject to Mr. Stan Johnson obtaining statement of no objection from owner of real estate office to the west. Also recommended approval for parking requirement variance because they felt adequate parking area would be provided in the municipal parking lot to the rear of the proposed project. The proposal consists of eight building sites. Altliougli tlio total area of each lot is shwvn on the preliminary plat, there is no indication of uetlands or diy Lildable areas on the individual parcels. Kc might consider this from the stand- point of both conservation easciiicnts and calculating dry buildable areas as required by code - 2 acres (87,120 sq. ft.). The proposed road, although exceeding 500 ft. ^ is indicated ^ ^VeWe wide. Our policy has been 60 ft. on roads exceeding 500 ft. in length, he ve been requiring easements on private access roads ^shich include tlie easement on the road and utility and drainage casements along tlie road. drainage easements should be determined after review and reconmiendation by the City engineer. I might also suggest the private access road be designated as single tract for simplification of description. The location of the Lawrence residence is indicated on the map. Hie access fr^ County Road 6 as proposed lies immediately west and adjacent to the Lee property. A park dedication fee of $250.00 per lot would be forthcoming upon approval of final plat. 'Hie property being offered for sale was Lots 8 and 9, Tonkaview Card..ns, Ih nnepin County, Minnesota. On these two lots two liouses had been constructed in accordance with the survey hereto attached and prepared by Gordon Coffin.^ After .attempting to sell the property as a single piece and being unsuccessful, Mr. Reiling was told that he should attempt to secure -a -oib- division of the property and sell them as separate parcels. Mr. Reiling contacted Michael Scheller and was told that since there were two l)Ouses on the property that he could sub divide and that bo could hire a stirveyor to draw the proper dividing line so that the bouses met the requirements of the set back ordinances for the City of Orono. Mr. Reiling followed the advice of the Building Inspector and obtained the survey and on August 21, 1975, sold that portion of Lots 8 and 9, lying southerly of the proposed dividing line to Ralph L. Halm and his wife, under a Contract for Deed. He continued to show the portion of the property lying northerly of the proposed dividing line and on April 1, 1976, the same was sold to Douglas Johnson. Both sales were made by Contract for Deed, the contract with Mr. Halm being dated Sept. mher 19, 1975, and the contract with Mr. Johnson being dated April 9, 1976. TJiese conveyances were made upon the reliance of the representations of Mr. Scheller that the subdivision .as proposed and laid out by Mr. Coffin was proper. Nothing further was done by Mr. Reiling or suggested to he done by Mr. Reiling. At the time of the closing on the Halm's purchase of their property located at 4470 Forest Lane, it was undeistood by all parties that you would secure the necessary approval of the subdivision. As you are aware, Mr. Halm planned on prepaying the Contract balance. When he chocked with the Village of Orono, he discovered that the subdivision had never been approved and, in fact, v;as advised that it probably would not be approved as it is presently subdivided. We are hereby tendering the balance due on the Contract in the amount of $9,902.62. m return, we expect a Warranty Deed and a fully-approved subdivision of Lot 8, Tonkaview Gardens. Reports resulting from re\’iew of the previous proposal several years ago revealed potential problems with development of steep grades, filling of marshland, problems with on-site disposal systems and traffic liazards from inadequate collector streets. It is not clear from this data what the proposed desig nated wetlands area would be. In our evaluation of the Previous proposal for this area by Centurion Company and Cheyenne Land Company in 1974 the two major wetland areas Cin Lots 1, 2 and 6, Block 2 and in Lots 4 and 5, Block 3) were to be preserved and we found this to be adequate with certain conditions. The current plat appears to delete one of these wetlands and would, therefore, be undesirable in our opinion for lack of flood storage and filtration capacity in spite of the reduction in number of lots proposed relative to the 1974 plat. Regarding on—site sewage disposal, our soils map shows this to*be generally an unfavorable area. I discovered that a copy of tlie plat map section v;as missing. I'm enclosing a copy of the plat inap with this r.)emo as we do on all such proposals. In checking the plat mp, some interesting (luestions came to my attention. Note tiie dotted line indicated by the arrow on the copy of the plat map. I have not had the time to review exactly wiiat tiis dotted line might indicate, but we might request the applicant submit some lata to clarify the status of all t’nis property. I'm sure the status will be cleared when tlie title opinion is reviewed by our attorney, but it would probably be less expensive and less time consuming now rather than after preliminary approval. I haven’t heard anything from tlie State Highway D-enarti'icnt regarding this proposal. I don't know whetlier Al lias sent tlicm a copy to review'. Tlie State Highway FJept. should be consulted. Ihey iniglit be interested in additional right of way. \'e might also consider easements for service roads or other access alternatives. We should also obtain some direction from the City Engineer for drainage from the property so we have no future problems wiien the residenttally zoned area is developed. V>’e should provide for drainage casements at tliis time. In checking the plat map, I also remembered that utility services are not provided by Orono in this area. V'e should also require some clarification on this issue. Some of tJie properties in this area are serviced from Long Lake. Tlicse have all required the approval from tlie City of Long Lake. We must remember tlie current status of the Long Lake Sewer Plant (capacities, adequacy of sewer line sizes and such). Access to the projX'rties should also be addressed. We should resolve any possible traffic problems before making any determination on the proposal. The re zoning proposal appears favorable. 'Tlie B-1 zoned area currently described splits tlie Bill Wear property. It would seem to make more sense to follow a given straight line for zoning purjxises whenever it might be possible. If a given straight line is established today, I beliero we would eliminate any future controversies with other property owners in the imiTiediate B-1 district. All three parcels would retain water frontage, ^lere are no existing structures on the property. Tlie abutting land is ol^aled by the Hemepin Coi-Jity Park Reserve Board. The low or marshy lands along the shore are not included in the area calculations. Subdivision considerations should ^clude dock restrictions over the shoreland marshes including ojx^n space and o^nge easements over them and a park dedication fee.
