Also, he stated that in laying out the lot lines there are problems if the natural lot lines are not followed. When they first layed out the lots the average area was 2.3 acres excluding the wetlands, with some of the lots being less than two acres. He explained that on their first plan the access was on Dakota Avenue, but it was decided that any other access would be better than Dakota Avenue. JOHN HARTWELL (continued) #317 Nancy Gawron, 920 Dakota Avenue, commented there already is a traffic problem on Dakota Avenue. Mrs. Merrill Swanson, 1820 Lakeview Terrace, agreed there was a traffic problem there now Paul Meyer, 940 Dakota Avenue, asked how many homes could be supported without City sewer. The Zoning Administrator replied this had not yet been addressed. Mr. Adams responded that when someone comes in to build, they will check each building plan and septic system plan. The Zoning Administrator pointed out on the soils map which lots would support a septic system and which ones would not. Mr. Adams pointed out which lots the City Engineer stated would require a soil test. The Commission discussed the lay of the lots and any possible changes necessary so that all the lots would meet the two acre minimum lot size requirement. The Commission expressed concern that the City Engineer's letter of November 28, 1977 indicated the proposal not be approved because it was questionable that each lot could support a satis factory on-site disposal system, and now it seems he has changed his recommendation since writing the letter. The Commission questioned the validity of the letter. Mayor Van Nest explained that originally the City Engineer reviewed the Hennepin County soils map which only indicated very general information. If there were any questions at that time the City Engineer was asked to make a study, as was done in this case. He also explained that the letter was only given to indicate there should be more tests and suggested the City Engineer submit another report. JOHN HARTWELL (continued) #317 ^e Commission expressed concern that the proposed lots would be acceptable for a satisfactory septic system. The Commission discussed with the audience the proposed lots and the septic systems and any possible problems that could occur. Mayor Van Nest explained that with a two acre lot it is not necessary to have the entire lot acceptable for a septic system. He added that they wanted to make sure now the lots were buildable and suggested the City Engineer require additional information on the lots where there was a question. Kathleen Kensey, 14111 Albermarle, St. Paul, and Charles Dallar, 1810 Lakeview Avenue, expressed concern about the electric fence along the east and south sides of Outlot 2, Long Lake Country Club Addition. They felt the property owners whose lots would abut the fence might object to the fence and horses so close to their back yard. The Zoning Administrator replied he felt this was a legal situation which the property owners could resolve. He also had asked the City Engineer to submit another letter of his recommendation. It was at the City Engineer s suggestion that he call off his soil tests because it was felt they were not needed. The Commission expressed concern because the City Engineer had changed his recommendation from his first letter when he recommended not approving the subdivision. The Commission has received many letters from the City Engineer in the past, but this is the first time his recommendation has changed. They felt Tim Adams was entirely in good faith on his part, but they also felt there could be serious problems if the subdivision was approved and later it was found some of the lots were not buildable. The Planning Commission addressed Lot 24. Mr. Adams stated he had gone to considerable cost to prepare the alternative plans for Lot 24. The Commission felt precedent indicated they could not allow a one acre lot. They felt they should follow the precedent and require that Lot 24 meet the two acre minimum lot area requirement. Mr. Adams stated he was agreeable with that decision and added that he had done a great deal of homework in preparing these plans and felt some things just were not apparent from the City Engineer's first report. Commissioner Hassel moved. Commissioner Hurr seconded, a motion to table the Public Hearing for preliminary subdivision until a report is received from the City Engineer on the soil conditions of the lots indicating if the lots will support a satisfactory on-site disposal system. Motion - Ayes (4); Hammerel, Hassel, Hurr and McDonald: Nays (3); Hannah, Frahm and Wilson. The motion passed. After further discussion of the subdivision, the Commission retracted their motion to table the proposal. Commissioner Hassel secondea, a motion to approve the minutes of the Planning Commission meeting of November 7, 1977, as amended. Motion - Ayes (7); Nays (0). The motion passed. The Zoning Administrator stated the Council had^ referred this item back to the Planning Commission for their review of additional plans. He explaine , however, that he had received a call from Doug Carney that the plans were not ready. Since the Commission did not have anything more on this item it will go back to the Council. JAMES LAWRENCE 1550 SIXTH AVENUE NORTH SUBDIVISION (PRELIMINARY) #323 The Zoning Administrator stated he had not yet received a certified survey of the lot with proposed locations of structures, adding that he felt this was necessary so the access from Tonka View Lane could be properly reviewed. Also, he was not sure of the location of the access onto Co\inty Road #19 and a survey would indicate this. THOMAS LYON 4790 NORTH SHORE DRIVE VARIANCE - LOT AREA #333 Commissioner Hannah moved. VJarren Anderson was present and explained that they will be using the building as a church and school and when they sell their present church they plan to use that money to build onto this building. He also stated they will have grades kindergarden through the fourth grade and will have church on Sunday in the school until they add the new church. He explained they have a congregation of about 300 people. CALVARY MEMORIAL CHURCH 2420 DUNWOODY AVENUE CONDITIONAL USE PERMIT OWNERSHIP TRANSFER #340 The Zoning Administrator explained that this property is zoned residential and the hard cover cannot exceed 407o of the lot. He also reminded Mr. Anderson he will have to check if they will need setbacks or variances. He informed the Commission that all the surrounding neighbors had been notified of this meeting. Jack Niemi, pastor of Good Shepherd Lutheran Church, commented they were only looking for information at this point. The Commission expressed concern that the church provide sufficient parking plans and asked Mr. Warren if he had considered if there would be adequate area to provide sufficient parking for the new sanctuary. They questioned if the new sanctuary, existing school and required parking would fit on the lot. CALVARY MEMORIAL CHURCH (continued) #340 The Zoning Administrator informed the Commission that the property consists of three acres and referred to the Ordinance requirements, which require one parking space for each four seats. He pointed out that the building and parking area should not exceed 52,000 square feet, which would leave about 4,000 square feet for the new sanctuary. Mr. Anderson stated they did not have any parking plans at this time. Commissioner Hurr asked if busing was provided. Mr. Anderson replied they have a few parents who drive their children, but most students are bused. The Commission expressed concern about potential traffic problems and asked where the access would be located. Mr. Anderson replied the access would be on Dunwoody Avenue at County Road #15. It was suggested Church Lane be used for parking. The Commission pointed out, however, that Church Lane is private property and could not be used for parking purposes. The Commission indicated they wanted to know the size of the church, including the approximate dimensions of the building. Mr. Anderson stated they wanted to get this done as soon as possible before they exercise their option. Commissioner Hassel moved. HARRY GUSTAFSON 2515 KELLY AVENUE VARIANCE - LAKESHORE SETBACK #341 Mr, Gustafson was present and explained that his father owns this property and lives here. He also stated the new structure will be nothing more than a screened in porch. He explained they will be using screening for the structure with a sliding glass door and they will have four gutters wliich will go toward the back of the house. The area is only 14' x 16' and they will not be covering the whole boat house. He added that now it is a dangerous situation, but they feel the addition will be more attractive and will improve the drainage for the hard cover and that the neighbors will be able to see through the structure. Chairwoman McDonald commented it was a beautiful layout, but she did not see what hardship existed. The Commission expressed concern that the neighbor's view could be blocked by the new structure. The Zoning Administrator stated the highest point of the new structure will be less than 30 feet from the ground. Commissioners Hurr and Frahm were concerned about the fact the new structure would be less than 75 feet from the lakeshore. The Zoning Administrator stated there have been other requests in the past which have been addressed from the standpoint of the hard cover. The Commission cited a similar request where the applicant asked for approval to add a redwood deck which would have been less than 75 feet from the lakeshore and the Planning Commission denied the request. Mr. Gustafson replied yes, adding that his father would not add this structure if there had been any objections from the neighbors. The Zoning Administrator stated the neighbors had been notified of this meeting to discuss the addition. Commissioner Hassel moved, Commissioner Hurr seconded, a motion to reconmiend denial of the request for a lakeshore setback variance to erect an enclosed structure on top of an existing foundation because 1) no hardship existed; and 2) the addition would be an expansion of an existing non-conforming use. Motion - Ayes (3); Hammerel, Hassel, Hurr: Abstain (4); Wilson, Frahm, Hannah, McDonald. The motion failed. There was further discussion of the proposal. It was brought up that there are a number of existing boat houses where the property owners could ask for similar requests. Mayor Van Nest commented that this type of addition is opposed to the Ordinance, adding that in the past they have tried to remove these structures. The Zoning Administrator stated if the structure was destroyed over 50% by fire it could not be rebuilt. Regardless if the structure was permanent or temporary they would ask that it be removed. He explained that when the property originally was subdivided the new structure located north of this property was approved on the condition an existing cabin be removed which was less than 75 feet from the lakeshore. Mr. Gustafson stated they are considering the aesthetics and feel the addition will be very attractive. Commissioner Hurr moved. Commissioner Hassel seconded, a motion to reconsider the previous motion to deny the request for a lakeshore setback variance. Motion - Ayes (7); Nays (0). The motion passed. The Commission was concerned about setting a precedent for other existing slabs along the shoreline which also would be non-conforming situations. They also felt the addition would be a visual obstruction to the neighbors. The Zoning Administrator explained that Paul Raster was present and had an inquiry and would like some direction from the Commission, Mr, Raster passed out a survey of the property. Tile Zoning Administrator stated that Mr. Raster is proposing two properties with lake access. The present zoning is one-half acre minimum lot area and this property is one acre. Mr. Raster is trying to get two lakeshore lots. The require ment in this area is for 100 ft. of lakeshore and the lot has 152 feet of lakeshore. One lot be about 52 feet wide, Mr, Raster explained his request further. Mayor Van Nest stated the new Ordinance stated there must be minimum width at the building and at the lakeshore. The Zoning Administrator commented he had informed Mr, Raster of these requirements. The Commission felt the property should be divided so only one lot would have lake access and in turn would meet the minimum lakeshore lot width requirement. To divide the lot as requested would be against the Ordinance. Mayor Van Nest explained that this property along with the properties to the east were zoned commercial in 1968 and at that time there was approval for 80 units. However, these units were never built. In 1974 this area was rezoned to LR-lC. The proposal is to subdivide approximately 70 acres into twenty-five lots, of which two lots will be less than two acres and will require a lot size variance. The property is located off Brown Road and County Road No. 6, with the southeast corner of the property abutting Long Lake. Our comments are as follows: 1. Drainage easements have not been identified, but will be needed. In particular, easements will be needed along the drainage swale in proximity to Lots 12,13,22,23,24 and 25 and the swale in the back of Lots 18 and 19 and extending to the wetland. We also request a 10-ft easement along the south and east lines of the subdivision. 2. Based on the soil report included in the subdivision packet and the Hennepin County Soil Maps, there are potential problems with on-site waste treatment systems on Lot 4 through 9,12 and 13, 17 through 19, and 21. In particular, these lots have either steep slopes (in excess of 12%), unsuitable soils (high water table and unsuitable soil types), or combinations of these. The survey suilnnitted with the application appears to have been made some time ago. It notes the markers and dimensions of the subject parcel as platted, but fails to indicate the status of the right of A-;ays as constructed. If tliis right of way area were to l>e deducted, tlie total area would be reduced quite substantially. Although we generally require a current suiv^ey with proposals such as this, I felt it would be too costly to the applicant if the application were denied. If the variance is approved, however, it sliould be contingent upon the applicant providing a current survey to verify data si^nni'^tcd and eliminate tlie guess work. l-finimum lot area requirei:>ent in this district is 43,560 sq. ft. 'Hic area of this lot as shown on the survey is approximtely 22,000 sq. ft. This is questionable, however. That area u|X)n which the right of way exists (as shown on survey) should probably be deducted from the total buildable area. Access to County Road S19 wiild also create a problem. The limited vision around the curve of County Road #19 would only add to tlie current liazardoiis Tiaffic situation along the highway. Unless the owner can provide proof of some safer means of access to the property, I would hesitate recommending approval. Several other properties on this block will be providing access to Tonka V'^iew Lane located north of these properties by obtaining private easements. All setback requirements should also be addressed. Without a survey, the app^.leant was unable to indicate a proposed location from which we could determine if any setback variances might be necessary. This is a masonry stiaicture with a reinforced concrete flat roof currently used as a deck. The Gustafson’s are requesting approval of a variance to erect an enclosed structure on top of this existing foundation and reinforced deck. A review of the USGS guadrangle indicates the contributing watershed is approximately one square mile. This would indicate the depressions are functioning as retention basins, and as such fulfill one of the criteria for public waters. Therci-ore, we will require a permit application for the proposed subdivision. This jubdivision was approved subject to sc:veral conditions several years ago. All conditions were not met at the time, so the development has been at a stand still since that time. Sue Dongoske has siibjnitted the request to proceed with development. 'Hie proposal went directly to CoiuKil. Council reviewed the proposal and addi'cssed all issues noted on A1 Olson’s memo. Council was concerned with the marsh area and previously dredged chajinel. They referred tliis issue back to the Planning Commission for review and reconsTiendation. We should address the issues of wetlands, riparian rights, dredging, dock rights. Fjiclosed is a copy of the plat from our section maps as the applicajit has not pi'ovided us with a plat for ajiy review. V'e should have a copy of the plat to forward on to the Soil Conservation District for review and reports. PLANNING CarilSSION WORK SESSION - November 21, 1977 Reviewed plat as previously approved. Discussed wetlands and riparian issue as fomvarded by Council. Staff will request copies of plat, dredging documentation and any other data that might be necessary to review the riparian status of the individual parcels. Most of the discussion was in regards to determination of length of shoreline.
