Also present: Mayor Van Nest and Zoning Administrator Hank fluhich. Chairwoman McDonald announced tliat this was the time and place for a public hearing on the petition of the Colpepper Land Co. (Neslund) for a subdivision of property located at 40 N. Orono Orcliard Road. Tlie Zoning Administrator presented tlie Notice of Public Hearing and the Affidavit of Publication. The Zoning Administrator informed the Planning Coi^ssion that the applicant had submitted a revised preliminary plat as requested at the work session of the last meeting desig nating the marshland on the plat. Ron Bastyr, the engineer, ivas present. The Zoning Administrator stated that this was a revised 2-acre pro posal of the previous 1-acre subdivision proposal denied by Council several years ago. Current proposal consists of 17 2-acre lots excluding wetlands. Tlie Commission noted that the proposed road runs through the wetland area. Tl\e engineer explained tl\at they plan to go tlirough tlie wetlands for this road, but felt that because of tlie good land it was a necessity and they would do enougli cutting around the wetlands to end up with tlie same area in sq. ft. of wetlands. He also advised tliat tliese 2-acre lots were designed as sucli so that if the sewer came through p'ts area at some later date, these lots could then be subdivided into 1-acre lots. Mr. Bastyr presented a topog of the area indicating tlie proposed grades. The proposed dwellings would be built on the high points of tlie lots, Tliey are proposing •to fill some wetlands and other than that, they are proposing to maintain the site in its natural state. Tlie Commission ex"pressed tlieir concern about the problems tliat could result from home sites on some of the existing steep grades and the filling of some of the wetland areas for the proposed road. The Zoning Administrator advised that he had contacted the Hennepin County Soil fj Eater Conservation District and requested a report from them on the soil conditions in regard to on-site septic systems. Tliey advised that it was difficult at this time to investigate. Jolin Gridley, representing Mr. Vetter, was present. Tlie Planning Connission advised him that 2 acres of dry buildable land are necessary in a non-sewer area to support an on-site septic system. Tlie Connission suggested tliat the developer recalculate to determine how much land is above 932 to arrive at the number of lots tliat would be available. John Christian of the Hennepin County Park Reserv^e and David l\Ver of the Metro Park Commission were also present. Mr Christian requested that the matter be tabled tc allow tliem to negotiate with Mr. Vetter whom they haven’t been able to contact. He stated that the Park Reserve has been working witli the Metro Park Commission in teirns of acquirinr tliis property as part of the Arthur .Mien hild- life Sanctuary. Mr. Gridley stated that he was aware that at one time the Park Board expressed an interest in tins pronerty, but indicated at that time that tliey did not have the funding for this pro]ierty. Mr. V.Ver explained that lie was one of many jieople involved in instigating tlie purchase of a piece of property on Big Island for the Artliur Allen Wildlife Sanctuary with the exception of this piece of property before the Commission at tliis time. Tliey would like some more time to talk with Mr. Vetter to discuss whether tivo or three lots would be available as this could have an affect on Mr. Vetter's prive. The pulilic hearing was closed at 8:35 p.m. Tlie Zoning Administrator advised tliat the Hennepin County Soil and Water Conservation District would be willing to investigate some of the out-of-site areas if they were to receive some reimbursement. Tlie Planning Comission felt that it was extremely im|X)rtant that a determination made that tliere are 2 acres of land per site that is suitable for an on-site septic system, and that it would not be unrea sonable to require a fee from the subdivider in order to obtain this information from the Soil r, Water Conservation District. Soundings indicating the depth of the cliannel have been submitted by the developer. Tlie proposed dock as shoivn on the map was originally proposed and denied. Tliis consists of a dock extending^ straight to the cliannel from Ix)ts 3 and 4 with an additional 200 ft. mooring dock parallel tc the channel. The dock for mooring would necessitate dredging along the channel for accessibility. Mr. Haclcing advised the Commission tliat the DNR had indicated to tliem that they objected to the alternate proposal pre viously approved by Orono in wliich tlie dock ran out to and along the channel and tlien jogged back 20 ft. and ran parallel to the cliannel to the main lake. Tlie DNR objected to tlie entrance to the lake in tliis proposal because of the spawning area. This matter will be before the Council at their meeting of August 8, 1977. COUNCIL MEETING - August 8, 1977 Tabled on request of applicant. Applicant and attorney feel City does not have the authority to require conservation casement over wetlands and 20 ft, access easement along west side of wetlands area. STAFF - August 15, 1977 Jim Robin (472-1060) called me this a.m. He infonned me that Mr. Jacobs or his representative approached him regarding revising the proposed plat somewliat to possibly eliminate the easements as stipulated by Council. Mr. Robin is not familiar with our ordinances and procedures, but he wants to be present at the Council meeting when the proposal comes up for discussion. He requested I place the matter first on the agenda so he might be present. He has a previous commitment to attend a school board meeting as he is a member of the school board. I informed him I would try to list this matter as the first item of my report. It was also brought to my attention today that Mr. Sheldon Jacobs had some commun ication with the Watershed District. It was related to me that he was infonned that the Watershed District had no projected schedule on the French Lake project. He was also of the understanding that the Watershed District had more or less concluded that the proposed dam would provide adequate storage if it were located along County Road #51. I later called John Holmquist to confirm these conclusions. Mr. Holmquist informed me that Mr. Jacobs had probably misinterpreted some of the information he had relayed. Mr. Holmquist confirmed the communications with Mr. Jacobs. However, he said the actual location of the Cm had never been determined. The Watershed studies to date indicate a dam constructed along County Road #51 would facilitate. Tlie City of Orono, however, has some reservations as to this location. The City feels adequate storage might not be pro\'ided if located along the highway. The City feels that riparian access is not endangered because the property owner can extend docks to navigable water witliin the authorized dock use area, and has in fact iTK>re than 30 boats currently docked at the existing facilities. The City fin^ no evidence of any previous attempt to control iTinoff and siltation which may have contributed to the applicant’s current desire to dredge. 9. The City questions the need to dredge the entire shoreline if a lesser amount can be dredged to provide access to a launching area. The City questions the applicant's desire to indiscriminantly dredge the dock use area when boat storage can be more environ mentally provided by some onland storage system. The City questions the permanent need to dredge when the applica tion comes in a low water year. The City questions the very operation of a commercial marina on this site. The area was zoned for this use because of a long existing fishing boat rental operation on the site. The support ing structures were destroyed by fire in January 1977, and the only current land use is the non-conforming slip rental of water space not supported by any public facilities or services. The City feels tliat this site is unsuited to any expanded, commercial use because of the limited traffic access to the area, the surrounding residential land use, the extremely low' level of the land, the lack of any sanitary sewer or projected construction of same, the questionable on-site sewage treatment capability, and the naturally shallow, eutrophic and remote nature of Stubbs Bay. The City has not yet received any information regarding fish and wildlife habitat affects anticipated by this proposal. The City is adamantly opposed to any improper dredging method and to any on-site spoils disposal within the Lake Minnetori'a watershed. The City feels that any dredging ?*’’ lowed must be contingent upon proper riprapping and runoff fiit.nition system installation to forestall additional dredging v?.* j future. This residence, located on approximately 70 acres of rolling, wooded farmland in what is now the Village of Orono, was purchased in the 1930's by the Hartwell family. Over the years, the Hartwell's enjoyed many summers on "The Farm" while over seeing a small dairy operation year round. In 1970, John Hartwell and Tim Adams undertook to winterize the original homestead and establish a facility for boarding horses - steps which led to year round enjoyment of "The Farm's" environment by more and more people. In 1977, Hartwell and Adams formed a Partnership to preserve and further develop this unique environment for up to 20 additional families interested in building a home at "The Farm." "The Farm" is blessed with natural amenities - including frontage on Long Lake, natural wetlands, two creek beds providing natural drainage, several distinct wooded areas (including a "sugar bush" of Maple trees over looking the lake), and rolling pastures that have, over the years, provided feed for "The Farm's" animals and open space for children of all ages. The property lacks a garage. He is requesting City approval to add a 24' x 24' detached garage on the property. This district is zoned for 2 acre, 200 ft. lots. The subject lot is slightly larger than 1/2 acre and is 50 ft. wide. The necessary variances would be IH acres for required area and 150 ft. from required width. Side yard setback variances would also be necessary as the required setback isr 30 ft. and the proposed garage would be only 4.5 ft. and 21.5 ft. from the two side lot lines. Necessary setback variances: 25.5 ft. and 8.5 ft. A variance from the required distance between structures would also be necessary. Our ordinance requires a distance of 10 ft. between struct axes. The proposed location is only 5 ft. from the existing home. To locate the proposed garage per code would necessitate extensive removal of numerous trees and bushes. I have already informed the applicant that if this variance were granted, the garage would have to be treated like an attached garage. The State Building Code r^uires fire code sheet rock on the wall nearest the residence for safety from fire. The applicant assured me he would conply. The property to the south (Lots 7 and 19) is combined and is now occupied by a house. The property to the north (Lots 4^5) is combined and previously was occupied by a residence which was destroyed by fire several years ago.
