Also present: Mayor Van Nest, Zoning Administrator Hank Muliich and Asst. Zoning Administrator .Al Olson. Absent: Members Ilurr and I lass el. Chairwoman McDonald announced that tliis was tlie time and place for a public hearing on tlie petition of Donald Eckstrom for a sulidivision of property located at 2140 Sixth Avenue N. Tlie Asst. Zoning Administrator presented the Notice of Public Hearing and the Affidavit of Publication. This oroposal consists of a division of 5.14 acres into two lots, botli of idiich would exceed the minimum 2 acre lot area and 200 ft. lot width requirements of tlie RR-IB zone. There are no wetlands on the property. Lot 2 has an existing access drive and any new drive onto Lot 1 would require a permit from the County. Mr. § Mrs. Eckstrom and tlieir realtor agent Har>' Weinzierl were present. Also present was Mr. Paul Phillips, neighbor to the west. He expressed his concern alxiut tlie well located within 50 ft. of the northwest comer property line and possible seepage problems. He also inquired about restrictions regarding horses. Al Olson informed him that horses are allowed in this area. However, horses require a minimum of 3 acres in this zone and a variance and conditional use permit would be required by separate application. There appears to have been some confusion on tlie legal description. Mr. Phillips was wondering wliat assurance he had that the survey is correct. He was advised tliat there was no way to assure him of this until the hard- shells were submitted. Because of the liazard involving the hill, Mr. Phillips was also concerned about the access for Lot 1. Access for tliis lot would need to be approved by tlic County. Chairwoman McDonald announced that this was the time and place for a public hearing on the petition of Louis Oberhauser for a PRD application, Land Use Plan Amendment, Rezoning and Street Vacation of property located Summit Station (Herrick Circle). Tlie Asst. Zoning Administrator presented the Notice of Public Hearing and the Affidavit of Publication. Mr. Olson informed the Commission that this application involves several different items: a resolution amending tlie land use plan witliin the framework of tlie comprehensive guide plan, an ordinance rezoning the Herrick Circle property from RR-IB to R-L\, a resolution vacating Herrick Circle and a resolution approving Summit Station. Mr. Olson reviewed the subdivision for those numbers who were not familiar with tlie application. The subdivision involves planned residential development along the Wayzata Country Club with six single family lots. The concept was previously approved by Planning Comnission and Council. Some members of tlie Commission were uncertain as to jast what they would be acting upon, ^tayor Van Nest explained to tliem tliat there is a legal process of vacating the existing plat (Herrick Circle) formerly approved. Tlie reason for vacating the existing plat is that ive have approved a new plat. 'Flie new platting is consistent with prior approval. Tliere were no comments from the public and tlie public hearing was closed at 7:50 p.m. The Planning Commission continued discussion on tliis matter. The street in the new plat is a private road with an under lying easement to the City - in the old plat it was actually a dedicated street. Mr. Lee Primus was present. Mr. Olson stated tliat the owners of Ski Tonka liave made a new application for the Conditional Use Permit pursuant to Council request. The slopes liave been in place since 1973, but they liave not been authorized for use by the City. If approved, tlie new phase, as well as the old phase, would need to meet all the requirements of licens ing including safety measures and lighting. Present application consists of approval to use tlie existing 4 tows only on the cast slopes. These new runs would not make a change in the parking area and would utilize the existing access. hhen asked about the unautliori zed construction and expansion of the east slopes, Mr. Primus replied that he had installed tliis without a permit because he was unaware a permit was required on "farm property” and because he hoped use would be authorized soon. The Planning Commission noted previous complaints from neighboring residents concerning tlie surmer operation. Mr. Primus explained to ^e Commission that this had nothing to do with the operation of Ski Tonka. This problem involved renters and that tliis matter was being resolved. Mr. Pt Mrs. Brooks, property owners to the south, were present. They objected to this proposal because right out the front of their house are the tows and lights. Tliey felt that tlie operation defies the law. Tlie Planning Commission informed them that the building of ski area was legal. Mr. Primus lias a legal riglit to request a conditional use permit to expand the facility. This expansion would involve four more ski tows and hills to the existing operation, llie ski area is open until 10:00 p.m. Any further expansion of this operation would require another public hearing. An application has not yet been made to the City. Note that the proposed spoils disposal location is on property adjacent to the lake. STAFF - August 10, 1977 Note the enclosed letter to NIr. ^k:Cleary indicating concerns with the spoils disposal and siltation control. The indicated disposal now is in an area to the rear of the proposed building site with possible use as future fill around the building. Mr. McCleary has indicated that he will be investigating off site disposal, but he is presently planning to use a land based backhoe (dragline?) for the work which would facilitate on-site disposal. The shore is now unapproachable and tlie launching ramp is completely unuseable. Tliere is no riprapping in place now am'where along the area proposed to be dredged. Riprapping or otlicr siltation control measures should be considered for prevention or reduction of future problems. Apparently due to the low water the dock structure is still arranged as in previous years rather tlian according to the revdsed 1977 design. P1A'\NING COVMISSION MITiTING - September 6, 1977 Ron Ilamack of the DNR was present. He noted tliat uork was begun witliout a permit and was stopjied by the DNR who have tagged for same. He stated that tliey liave asked for further information and will pass same along to the City. The applicant was not present and no additional information had been given to Staff. Planning Commission tabled for further information on establishing need, on establishing extent and on clarifying erosion control and spoils deposit location. STAFF - September 14, 1977 Discussed application with Mike Nfueller of tlie DNR. They will \s*ait for MGVD to act and the MCWD will wait for Orono, so we have the first step. DNR's conservation officer tagged this job when he discovered dredging in progress earlier this year. Mueller stated that he had mixed feelings about the application, 'fhere has never been a previous permit and there may be ways to arrange the docks without dredging or with dredging of only a partial area instead of the entire shoreline. Mueller's inspection was made before the 8 inch rain when the shore and ramp were most exposed. He feels they have enough information on hand, but he hasn't yet heard from his fisheries experts. The total property is 19.88 acres and each proposed lot would exceed tlie minimum 2 acre, 200 ft. width requirements. Approval would be subject to a park dedication fee of lh% of the land value or a minimum of $1,500.00 for the 6 lots. % Copies of this have been sent to the City Engineer and Road Supervisor for their comments on drainage and access. It is suggested that the drainfield be designed using the average percolation rate of 5.6 mpi. For the planned three>^^mif house, the recommended drainfield absorption area should b^Wsquare feet. We recommend that two septic tanks be used. The first slTould have a capacity of gallons (min imum) and the second should have a capacity of fromQSO^to 1,000 gallons. The attached figure shows schematically thel^drainfield layout. Remarks Of necessity, the area of the boring in relation to the area of the site and the depth of the boring is limited. Johnson Property on North Arm Lane Orono, Minnesota As you requested, a soil boring and percolation tests have been taken to assist in evaluating soil types, soil absorptivity, and ground- water conditions for the design of an individual sewer system on the above property. The boring and percolation test locations are shown on the attached sheet and are at locations discussed on August 20, 1977. Surface elev ations are referenced to the ground elevation at the east corner of the proposed house (assumed as 100.0). Investigative Methods The soil boring was taken on August 21, by 1\ inch hand auger to a depth of 8 feet. Soils were classified in accordance with the U.S. Bureau of Chemistry and Soils classification system. The boring was probed at completion and two hours later for the presence of groundwater. Percolation tests were run in 6 inch diameter holes in accordance vcith the procedures recommended by the Minnesota Department of Health. In accordance with standard procedures, the holes were allowed to soak overnite. Results The log of soils encountered in the boring is shown on the attached soil boring log sheet. Groundwater was not encountered in the boring. September 26th ■ “.I ■ ■%' Planning Commission and Council Hank ^kJhich, Zoning Administrator April 27, 1977 SUBJECT: Engner Johnson - 360 North Arm Lane Subdivision (Preliminary) This is a proposal to divide the 6 acre parcel resulting frexn the subdivision of 10 acres approved by Council on November 10, 1975 (copy of minutes enclosed). At the time this was approved, we also approved a variance of 29* from the width requirement on the south lot because of a natural tree boundary. We failed to provide an easement for possible future widening of North Arm Lane. The original plat shows North Aim Lane to be 33' wide. This, of course, is a result of incomplete data indicated on the plans. I believe we all took this as a half of a 66' right-of-way. Our new ordinance will provide for this. This plan is preliminary only. It indicates minimum two acres on each lot. I believe some revisions will be nerp«;sary hewever. We should provide an easement lo.. North Arm Lane which is a public road. We usually require 60' width for public roads. We could provide similar easements on properties along North Arm Lane as they are subdivided so we can eventually have adequate width for a road and utilities. The private road shown on the plan is only 33' wide. Although this road provides access for only one lot, I wonder if we shouldn't require 50' as we do on all private roads. If we do require these additional widths, the dimensions of the proposed lots would change in order to provide the necessary mininum 2-acre area. The larger lot consists of som.e wetlands and also includes the same channel that runs through the Victoria Grain property. I do not have the area of the wetlands. The channel is an issue we must consider again. We should stipulate that only the one lot has riparian rights and only if the channel is determined navigable and part of the lake. Mr. Johnson has submitted a copy of the 1968 State permit for dredging. Is this channel legal? The permit indicates the dredging permit was conditioned on approval of all other riparian oi%T»ers. Up until now, everyone has indicated to me that Mr. Boeye (previous owner of Victoria Grain Property) never agreed to this dredging. The cover letter of the permit application also indicates a requirement of notificaticHi before commencing with dredging. I have no document confirming this inspection or investigation. No Park Dedication Fee was ever collected on the previous subdivision of the property back in November of 1975. Records indicate the Park Dedication Fee was waived until we amended this ordinance. The previous subdivision was up for action the same time the A1 ^Vhitman subdivision pr^osal was up for approval. We waived the fee until we would be able to determine a satisfactory formula. STAFF - July 14, 1977 Lee and Brent Primus met with the Zoning Administrator on July 13, 1977. discussed proposed ordinance amendment. They were not too happy with any of the regulations. They felt we were being to restrictive. They interpreted the ordinance as a design to simplify citing of violations. It appeared they would prefer striking out most of the regulatory measures. They will be meeting with me again next week so we can write up some of their suggestions. They requested deferring the issue until the Council meeting scheduled for August 8, 1977. STAFF - August 4, 1977 There lias been no additional input from the Primus's as of this date. The redraft of the proposed ordinance dated June 30, 1977, includes a provision for the operator to provide a certificate of insurance at a very late date (after license approval - just prior to operational permit issuance). This change \>as made after discussion with Richard Primus with the intent of reducing his insurance costs while retaining adequate public safeguards. COUNCIL MELTING - August 8, 1977 Lee and Richard Primus were present. Tlie Council informed tliem a Conditional Use Permit application for Phase 2 would be required before licensing of Phase 2 could be considered. Informed the Primus's that previous conditional use application was void because conditions were not met at the time the previous application was approved. We came from the sea, and that, psychologists, sug gest,' is perhaps why we enjoy going back so much, a primal com pulsion to visit the place we came from. Or maybe psychologi.sts are putting on airs; maybe it is only that beaches can be pleasant places. Yet, wTiile more than half the na tion’s population lives within an hour’s drive of the Atlantic or.Pa cific Ocean, the Great Lakes or the Gulf of Mexico, many Americans cannot use the shore. Much of the coast is private pi-operty. Much has been developed. Much has been de.stroyed by dredging and filling. Little public access exists, and often the routes are demean ing — a rough road, a narrow, weedy lane. Many municipal beaches bar nonresidents. m The result? We drive many miles in hot cars to the few public beaches; *ve crowd onto the dirty sand; we sit there, sweating, drinking our beer, cooking our ribs, like extras waiting call in a DeMille movie, like refugees wait ing for an evacuation ship. Whefl' private citizens are able to seize so'much of the coast, the public is gravely injured. Property laws have been narrowed many times to benefit the public. This mu.st continue. It is concern that limits us, not law. the contiguous United States — about 3 percent of the coast. Local and state parks increase the amount of mainland shore open to the general public, but only to about 4 percent. Of the 6,000 miles of New Engfand coa.st, only aKaiit 5 percent is open to the general public. The great barrier beaches of the Atlantic and Gulf are largely developed. A tiny fraction of the Gulf shore is open to the public, and while public areas Increese markedly on the West Coast, as maby as 200,000 people may cram onto a few miles of beach in southern California on a pleasant weekend. A nuclear- power plant is under construction at Indiana Dunes National Lake- shore on Lake Michigan. The most progressive state is Or egon, where about 60 percent of the coast is under public owner ship. Moreover, Oregon defines a beach as running not to the mean high-tide line, as in md.st coastal states, or the normal high-water mark, as in the Great La ’KCS, but to the Vegetation line, Texas allows the public to use a number' of Gulf beaches to the residents are barred. There are summer people who belong to the wild waves of the sea or to the drifting timelessness of rivers and not to our still, green, southern Wisconsin lakes. “These people" are all right. We tolerate them up here, so long as they don ’t make a point of their strange tastes. But when j they start to complain about the heavy , weeds that wrap around you like slippery • arms, well, we just don ’t ask them back. ! To each his own water. ; As summer ends, once more with sad* I ness, I can think of nothing better to con- ; template than our lakes, these quiet, Mid western mirrors of tree crowns and sweeping stormclouds. I am, I admit it, defensive about our lakes, about our form of water. My family came here, to Lauderdale Lakes, more than 50 years ago, when the only roads were gravel and cow dung. There were In dian mounds around the lakes, which were as clear then as Alpine rain catches. ^ We hullt each new little part on the house ourselves back then. Today, the in- . vading newcomers pay $110,000 for only a small lot. Can we ever really accept these nouveaux riche? But, the lakes — that’s the important thing. Every spring, we rush down to study the water. Is it as clear as last year? How much have the weeds encroached this year on the sand dumped years back on the ice in winter In order to form sandy beaches by spring? t - ‘ You see, you have' to take care of the lake. This year, each weekend, we so care fully moved large pieces of asbestos with rocks on them from section to section of the beach. The asbestos chokes the weeds and, when you move it, the weeds simply drift away. But other things are drifting away, too — that’s the sad part. Some lakes, like nearby Delavan, are so polluted from poor use of fertilizer, badly placed septic tanks and generally poor land planning that they have become filled with algae. Dead. Wisconsin is tougher than almost any other state on ecological questions. At present, the Department of Natural Re- ' es is using NASA satellite reports that identify areas down to 20 acres in size. By putting these images through computers, the department can tell how turgid the waters are becoming. Every year, the department tells me, the waters are becoming a little worse, al though they do have various plans to re verse the trend, such as lowering the ground water level in some lakes in order to compact the sediment at the bottom of the lake, or even using chemicals.
