Also present: Asst. Zoning Administrator A1 Olson. Chairwoman McDonald announced that this was the time and place for a public hearing on the petition of Kelley and Kelley for a subdivision of pr^erty located at 2325 Watertown Road. The Asst. Zoning Administrator presented the Notice of Public Hearing and the Affidavit of Publication. Mr. Olson stated that the applicant is requesting a division of his property into tliree parcels. Each lot would exceed the minimum 2 acre, 200 ft. lot width requirements. Mr. Olson also pointed out that although there are no wetlands on Lot 1 and Lot 2, a portion of the southeast comer of Lot 3 is designated as marshland on our wetlands map. Bruce Kelley was present. Mr. Kelley contended that there are no wetlands on this property. He advised that they are proposing to sell the large parcel. Discussed access alternatives and the desireability of one access directly from Watertown Road. Applicant says that this was not shown because it would interfere with the green­ house operations and septic system installation. After all the public were heard, the piblic hearing was closed at 7:40 p.m. After a brief discussion, Guthrie moved, Hannah seconded, to recommend approval of the preliminary plat subject to a park dedication fee. Chairwoman McDonald announced that this was the time and place for a public hearing on the petition of Hamilton Moran for a subdivision of property located at 2965 Casco Point Road. The Asst. Zoning Administrator presented tlie Notice of Public Hearing and the Affidavit of Publication. Mr. Ntoran was present. Subdivision is based on existing property on Casco Point Road which for many years has contained two separate homes. This subdivision would enable each dwelling to have its o\%ti property. Each lot would slightly exceed the 1/2 acre area requirement based on the street vacation request which is part of this application. Lot A meets the SO5 requirement for lot width at tlie shore but narroivs at the street. Lot B exceeds the minimum at the street but narrows to 20 it. at the shore. Chairwoman 'IcDonald closed the public hearing for the subdivision at 7:55 p.m. and opened the public hearing concerning the street vacation. HAMILTON M)RAN (cont inued) (#289) The Asst. Zoning Administrator stated that the proposed street vacation would involve a trade off between the City and Mr. Moran. The existing situation is that the platted location on Casco Point Road varies considerably from the actual location of the traveled road. The \^cation as shown on the map is the actual width of the pavement as it exists today and does not include any additional right of way or future utilities. There are locations on Casco Point Road where the platted road actually disappears and the traveled road is running entirely through platted property. This proposal as submitted is for a rearrangement of the property lines to reflect a 10 ft. offset frcwn the center line of the existing paved right of \<ay making a total of a 20 ft. roadway. City standards require at least a 50 ft. right of way for private roads and a 60 ft. right of way for public roads. Commission noted the recommendation of the city engineer requiring at least a 50 ft. width. After all the comments were heard, the piiblic hearing was closed at 8:18 p.m. The Commission continued discussing the proposed subdivision and street vacation. Commission recognized need for correct­ ing the platting problems and the necessity for having sufficient right of way width to be permanently adequate. Commission felt that the proposed 10 ft. offset from the existing centerline was inadequate and that the 60 ft. requirement for public roads should be considered. Commission noted that the size of the lots in this subdivision are based on a 10 ft. offset from the centerline. Expressed their concern about the area of each lot should a 50 ft. or 60 ft. road width be required. This information was not available to them at this time. After a lengthy discussion, Hannah moved, Hassel seconded, to table the subdivision and street vacation applications and request staff to come back with the respective lot areas using what­ ever assumptions are appropriate for us in a public road situation such as this. IVhen applicant was advised of this action, he informed the City office that because of prior commitments he would not be able to attend this meeting. Zoning Administrator advised that preliminary and final subdivision approval had been granted approx­ imately one year ago to this property. . Planning Commission advised applicant tliat it would be necessary to record access ea^ments for Lot A through Lot B and that Lot B would have no riparian rights. Hassel moved, Guthrie seconded, to recommend final subdivision approval as submitted subject to access easements being recorded for Lot A through Lot B, no riparian access for Lot B and a park dedication fee of $2,000. hfotion - Ayes (7), Nays (0). The Asst. Zoning Administrator stated that Mr. Rhode has submitted a new set of plans. He has rel(^ated the house so that the lake edge of the house is in line with the Becker house next door. The current proposal has been moved back 35 ft. from the original location. Jack Rhode, his architect Bob Peterson, and builder Jerry Guetzkow were present. Mr. Rliode explained that he was withdrawing his TC<‘{uest to use the existing structure as a guest house. He is now proposing to use this building for storage. In temns of the topo ­ graphy of the land, he preferred the original proposal and felt that moving the house farther back was a merit of compromise. Mr. Peterson advised that there would be more costs involved with the current proposal because the farther back you go on the lot tlie more fill itwill take. They expressed their concerns and objections regarding the proposal. Some of these were: IVhen was the land legally platted? It was their understanding that if the land was legally platted before the 1965 zoning, Orono policy would tend to grant variances. „ Did prior owner own the lot as an adjacent property. Lot in question was less than the 1 acre a^e^i and 140 ft. width requirements. His nearest neighbor is presently 140 ft. away, hhen he purchased his house he was advised by his attorney that the lot in question was unbuildable. He is opposed to the 26 ft. setback on Mr. Rhode's house. Becker's prefer the quiet and felt that the noise level would be increased. . A variance had been granted in October of 1974 to this property subject to no other variances being granted and the carriage house being razed. Mr. Becker felt this should be enforced. It is his understanding that a driveway should be 10 ft. from a lot line. Mr. Becker felt that the proposed driveway for the Rhode property was too close to the lot line. No more than 1 principal building located on tlie lot. He requested that the Planning Conmission should take these items into account when making their decision. After all the comments were heard frcm the concerned parties involved, the Planning Commission discussed the proposal before them. In addressing the points brought up by Mr. Becker, the Planning Conmission advised that the lot in question was a substandard lot rather than an unbuUdable lot. The variance granted in 1974 and the conditions set forth at that time were nov^r void. However, the sanie conditions could again be applied to this application. Due to the fact that Mr. Rhode has witlidrawn his request to use the existing structure as a guest house, there would be only one principal biiilding on this lot. Concerning the driveway being too close to the lot line, Orono code does iioL specify ajiy setback requiiemeiit. Commission also discussed the 75 foot lakeshore and average setback in relation to this property and the adjacent and nearby properties. Given all the facts, they felt that Mr. Rhode was cooperative in trying to resolve this matter. There were some negative feelings on the Commission with regard to the carriage house. Members Dunlap and Hunr felt that there was too much building bulk for the size of the lot and therefore the carriage house should be removed. Guthrie moved, Hosfield seconded, to recommend approval of the application subject to having a gravel driveway in recognition of the total hardcover on the planned house and existing building. Zoning Administrator explained that this application is for filling and grading within the lakeshore area. This area had been dredged one time before and h^ filled in over the years. Applicant is requesting permission to refill area so as to be level of adjacent properties and level off to make lawn area. Letter from engineer recommended that the area should be riprapped across the front prior to any filling. Mr. lietz was present. He stated that he was proposing to use sand or area like fill for the project. Planning Ccjmmission expressed concern about authorizing any filling xn the lakeshore area, but felt this would be the restoring of a natural situation rather than creation of an>Thing new. After some discussion, Hurr moved, Hassel seconded, to reccHTimend approval contigent on the fact that the shoreline be riprapped prior to any filling and that the type of fill be approved by the city engineer. Their request is for a conditional use permit for the keeping of a horse. Applicant owns 1.13 acres at comer of Watertown and Willow and has leased the adjoining property to the north which is 2.68 acres. Mr. 5 Mrs. Gonsolus, property owners across Willow Drive, were present and had some objections. Adjoining property asner Rusciano has submitted a letter of no objection to the inaintaining of a bam on this property. He is requesting approval of a conditional use pemit to use existing structure for retail tire and auto service. Discussed this proposed use as an allowed industrial use but a conditional B-1 use. Planning Commission felt proposal would be consistent with the area. Mr. Wear advised that this is intended to be a temporary use of the property and that his leasee will not have use of the land to the rear of the building. After some discussion, Hassel moved, Ilurr seconded, to reconmend approval of ^e conditional use permit with the understanding that the activity be conducted within the confines of the structure. A public hearing was scheduled for Monday, August 15, 1977, at 7:30 p.m. After a brief discussion concerning the joint meetings between Council and Planning Commission, ^^cDonald moved, Hr ;field seconded, to recommend that these proposed nn.r:tings be changed from Tliursday evenings to TTiesday evenings. Motion > Ayes (7), Nays (0). ^fe^i)er Dunlap notified the Commission that due to an increase in her activities she would have to resign frcwii the Commission. Coimission was very concerned about this and suggested that Menber Dunlap take a leave of absence for six months and review her situation at that time. ^fember Dunlap agreed. Hannah moved, McDonald seconded, to accept a leave of absence until January 1978, and review situation at that t^. As I was not present at their meeting, and they had questions concerning the matter, the request may have been denied for that reason. It is my understanding I cannot appear before the Planning Commission with­ out first the Council consider the variance request. Please consider either granting the variance (for reasons set forth below) or directing me back to the Planning Commission for a hearing. Justification for variance request: As a widower I live in my present (ten bedroom, ten bathroom) house with two sons. The need is apparent for smaller quar­ ters. Having lived there for 16 years, I would like to remain. The unusual terrain (steep hill) permits only the creation of an outlot that is itself unusual (long and narrow with only one suitable building site). Because of the magnitude of the present house it needs a certain amount of land to support its value. While this is difficult to quantify I believe the saleabil:ty of the present structure is impaired if another is located "too close". While the 20 foot variance is not much in actual distance, each foot is important for the reasons stated. The affected property to the North is owned by Woodhill Country Club and is wooded. The likelihood of its use appears remote although there has been talk of some day putting up member condominixoms. Box 66 Crystal Bay, Minnesota 55323 Dear Gregg: I recently attended a meeting of the Planning Commission at which Jack Rhode, the owner of a lot adjacent to my property at 3145 North Shore Drive, presented plans to build a house on the property. At this meeting the Commission came very close to voting in favor of al­ lowing him to build a house nearly adjacent to mine. Had this loca- approved, it would have been in violation of Zoning Ordinance 32 201 as well as the variance granted by the Planning Commission and City Council on October 15, 1974, and October 22, 1974, respectively. I have carefully read the pertinent sections of the Zoning Code of the City of Orono and know that it is the intention of the Code to protect property owners, such as myself. For example, the Code specifies that the effect on values and property in the surrounding area will be taken into consideration before variances are issued (32.240). The Code talks about the need "to protect adjacent property" (32.240)(e). The Code “disastrous affects of intense residential development Orono" and about the guiding principle of "avoiding the ill-effects of over-crowding" (30.030). The Code talks about "undue concentra^on of structures" (30.030). Further, the Code says that ex­ isting lots of less than one acre with sewer may be utilized for single family dwelling purposes without Council approval if the area is within o0% of the requirements of the Zoning Code (31.202). The Code says that a variance may not be granted as a "convenience" but only to alleviate demonstrable hardship or difficulty" (31.340). Mr. Novotny, adjoining property owner, was present. Hie Planning Comnission explained to him that this area was originally zoned 1/2 acre. This area was rezoned to one acre in January of 1975 with the understanding that it would probably be necessary to grant some variances. Mr. Keith Sjodin, Attorney for Waconia Homes, arrived and the Planning Commission discussed this proposal with him. Mr. Sjodin indicated Waconia Homes interest in purchasing Lots 6 and 7 to confcine with Lots 1-5 as two building sites. As with Mr, Doerfler, the Planning Commission indicated to Mr. Sjodin that regardless of idiat lot rearrangement was negotiated, only two building sites would be possible for the entire block (Lots 1-10). Proposed duck pond is l^ated only 50* from horse bam. Mr. Ledstron stated that this is really a muck hole and a hazard to the horses. A previous owner almost had a horse mired in the mud. He would like the go ahead to fill along the steep hill to elimmate the hazardous drop and excavate the muck area to eliminate that hazard. Hank Miahich stated that the Water­ shed District is in the process of designating flood and watershed storage areas. There appears to be some question as to vhether or not the location of the proposed duck pond lies within this designated area. The Council requested that ^e applicant obtain a report from the Watershed District as to whether or not this proposed duck pond would be affected by this storage area impounding project. After a brief discussion, Pesek moved, Woolley seconded, to table this application to alloiv staff to inspect by the next feting and a report is submitted from the Watershed District concerning the storage area. Attorney Lorens Biynestad represented Mr. Rhode who was sick. The Zonmg Administrator informed the Commission that the ^Tplicant is requesting approval to build on this sub­ standard lot. A variance on lot area and width would be necessary. There is no other land available. A conditional use permit would be necessary to keep the existing carriage house as second dwelling to be used as a guest house.
