REGULAR PLANNING COMMISSION MEETING HELD JULY 18, 1977 The Orono Planning Conmission met on the a^ve date after a special public hearing held by Council with the follw- ing members present: Chairwoman McDonald, Members Hosfield, Hannali, Hurr and Hassel. Also present: Zoning Administrator Hank Muhich and Building Inspector Tom Jacobs. Chairwonmn McDonald announced that this vas the time and place for a Public Hearing on the petition of William Kelley for a subdivision of property located at 2340 Fox Street. The Zoning Administrator presented the Notice of Public Hearing and the Affidavit of Publication. Applicant is requesting approval of a subdivision of one 28.6 acre parcel into four lots, each of which would exceed the minimum 2-acre and 200 ft. lot width require­ ments. The Zoning Administrator stated that the sub­ division would be subject to a park dedication fee in the amount of $1,000.00 ($250 per lot). The Planning Commission was presented with a copy of a letter from the City Engineer recommending his approval of the sub­ division. Bruce Kelley was present. There were no conments from the public and the hearing was closed at 8:20 p.m. Planning Commission noted that each of the proposed lots of this subdivision could again be divided in the future. After a brief discussion, Hannah mov^, Hurr seconded, to recomnend approval of the preliminary plat as submitted contingent on payment of the park dedication fee and subject to all necessary easements. Motion - Ayes (5), Nays (0). Qiairwoman McDonald announced that this was the time and place for a Public Hearing on the petition of Conley Brooks for a subdivision of property located at 1125 Spring Hill Road. The Zoning Administrator presented the Notice of Public Hearing and the Affidavit of Publication. This request is for a subdivision of 20+ acres in order to build a new dwelling on the eastern paix»l. Co»mcil granted approval for construction of the new dwelling on June 13, 1977. Proposed division woi^d create two parcels, each of v4iich would meet the minimum 2-acre and 200 ft. lot width requirements. The Zoning Admin­ istrator stated that access for the second parcel vrould require County approval. Subdivision vould be subject to a park dedication fee in the amount of $500.00 ($250 per lot). Kevin Regan of the Sun Newspaper was present and received a copy of the minutes of the July 5, 1977 meeting. The Zoning Administrator infoimed the Coinnission that Mrs. Burger was present and requested that this item be delayed until Mr. Burger arrived. The Zoning Administrator presented a copy of the certified letter smt to Home Federal Savings 8 Loan Association informing the applicant that the proposal would be up for action at this meeting. No represen­ tative was present. Hassel moved, Hann^ seconded, to recommend denial of the lot area and width variance as no hardship was demonstrated. Motion - Ayes (5), Nays (0). The Zoning Administrator reminded the Commission that they had recommended preliminary approval of Mr. White's subdivision request at their meeting of July 5, 1977. At that same time, Mr. White was requesting a rear yard setback variance for construction of a new dwellpg. This setback variance had been tabled for more information at the last meeting due to a lack of ^rerentation. The Zoning Administrator advised that John Pillsbury, Jr. had called and expressed that he had no objection to this variance. Mr. White was not present. A 20 ft. rear yard setback variance is requested for the proposed house. It was the general feeling of the Conmission that there is enou^ land to locate the house to meet the requirements. After a orief discussion, Hosfield moved, Hassel seconded, to recommend denial of this variance on the basis that no hardship was demonstrated. He also presented several i^otographs of the property. Planning- Conmission reviewed proposal before them which includes construction of a garage whidi would extend in front of the existing house resulti^ in a reduction of an existing front yard setback conbined with the opening of the garage d(x>rs very near to the street. Ihe Conmission discussed with Mr. Stewart the possibility of revising the proposal to increase the street setback to eliminate the safety hazard. They suggested increasing the setback to a miniimm of 25 ft. idiich would allow for a turn around on his property. Applicant agreed to meet with staff to design new prt^sal. Hannah moved, McDonald seconded, to table this application pending receipt of revised propiosal. Motion - Ayes (5), Nays (0). Planning Commission reviewed final mylar presented by the Zoning Administrator. Final plat would be subject to a Park Dedication Fee and the necessary easements as required for preliminary approval. Easements not shown on the final plat would be included in the title opinion. Although they would not be addressing the subject of riparian rights, the Zoning Administrator wanted the Conmission to be aware of the fact that the Burger's are requesting reconsideration by the Council of the lakeshore privileges on the lakeshore property across County Road #84. After researching the status of the property, it appears the Berger's actually own no shore­ line. Hassel moved, Hosfield seconded, to recommend approval of the final plat subject to the following: (1) (2) (3) (4) Access easement for adjoining Lot 52 from County Road 84. The new proposal consists of relocating the garage on the north side. Present proposal would require same variance as approved previous.ly only on the opposite side. Mr. Kuglin*s brother was present. He explained that this is a family project and there was a misunderstanding among the family and they received approval to locate the garage on the opposite side. After a brief discussion, Hassel moved, Hannah seconded, to recommend approval subject to obtaining a letter of no objection from neighbor prior to Council meeting of July 25, 1977. IVhile checking the site, I suggested an 8J5 ft. setback to maintain a minimum setback of 20 ft. between structures on neighboring properties. He agreed to do this. The site plan also shows the garage to be 22* X 26 but he informed me he would be willing to limit the size of the garage to 22* X 22*. Following are the factors: 1. The application is in response to urging by the Zoning Administrator, the Planning Commission, and the City Council at meetings in connection with the (granted) Moran application for a garage variance, when the inaccuracies of the Flat at the Hennepin County Register of Deeds were made manifest by the Moran survey; and applicants were requested, as the City had. no budget to do this, to provide at the O'wners' expense, an accurate survey and proper lecgal description of the actual road and the proT^erties to be vacated, v-ith all three properties concerned joiniiir in this so the City could talie action to correct the City and County Records to conform v/ith location and usage existing since the road wa-s put in circa 1931* Tnis has been done per application, at considerable expense of time and money to applicants, to do something ’which it appears should have been done by the township or county back in 1931* -i: 4 ^ i 4 n dt 2. At the same meetings, the Morans ’were urged to divide the Moran property to •orovide a seiarate taxable lot for each of the tvro residences that have existed on «lk A the property since circa 19C5-1920, with one or the other being lived in by owners and the other rented since about the late thirties; and the only costs mentioned to the Morans in this connection were that of the application fee and the rather considerable extra survey and legal v:ork required as com-ared with continuing the present "Gran'-’father" status.
