REGULAR PLANNING CO^MISSION MEETING HELD JULY 5, 1977
Orono Planning Conmission met on the above date with the
following members present: Acting Chairwoman McDonald
^mbers Hosfield, Guthrie, Hurr and Hassel (arrived 7:40).
Also present: Asst. Zoning Administiator A1 Olson.
Hosfield moved, Guthrie seconded, that the minutes of the
Planning Commission meeting of June 20, 1977, be approved
as corrected.
Motion - Ayes (4), Nays (0).
Because of a lack of representation. Chairwoman McDonald
postponed the public hearing scheduled for 7:30 until
later in the meeting.
I^. Ekeberg was present and is requesting approval of a
lot area and width variance for an addition to the lake
side of existing home. A variance was approved in 1974
home. The Asst. Zoning Administrator stated
that the addition would meet the required side yard and
lakeshore setbacks.
After a brief disaission, Guthrie moved, Hurr seconded
to reconinend approval of the lot area and width variance
given the fact that the addition would not obstruct the
neighbor's view of the lake and it does not encroach on
the lakeshore setback requirement.
Motion - Ayes (5), Nays (0).
Asst. Zoning Administrator explained that applicant is
requesting a lot area variance for proposed addition to
fisting home. All setback requirements would be met.
Ihe applicant has indicated that he would eventually
remo\^ existing garage and replace with a new garage north
Mr. Uloth was present. Planning Commission addressed the
removal of the existing garage. Applicant expressed his
^tentions to remove garage within three years if
fimncially about to do so. Commission encouraged this
application stood on its own merits.’
Planning Commissiqn advised that the existing three
separate parcels would need to be combined into one
iM^iicant agreed to do so.
After a brief discussion, Hosfield mcved, Hurr seconded
to recommend approval on the condition that the lots be'
combined and proposed addition meets all setback require
ments. Planning Conmission encouraged the removal of

Mr. 5 Mrs. Ste\/art were present. Planning Commission dis
cussed their request for construction of an addition and
detached garage. Proposed addition on rear of hone meets
all setback requirements. Hwever, a lot area and width
variance would be necessary.
There was a lengthy discussion concerning the proposed
location of garage so close to the street. Because of
the steepiess of present driveway, the Stew’art^s would
like the gaiage located as far forward as possible to
reduce construction problems. Existing drivew'ay would
be filled in. The Asst. Zoning Administrator suggested
locating the garage in line with the home with the
garage doors opening off the south side thereby allow
ing a turn around and reducing the visibility problems
on the road. The Stewart’s felt this would be too
costly. The Asst. Zoning Administrator stressed that
foundation provisions ;>:id costs would appear to be
very similar whether the garage is located as shown or
would be located farther back over the existing drive
way. Applicant was also concerned about using his
existing steep driveway in the winter.
After some discussion, Hassel moved, NfoDonald seconded,
to reco)i«iieT- i approval of the small rear addition to
the home and also approval of the indicated location
for the garage with the desire that the applicant
investigate the possibility of relocating the garage
doors and drive access from the front (west) to the
south side.
Motion: Ayes (3), Nays (1) - Hurr, Abstain (1) - Guthrie.
Mr. Olson presented the mylars and hardshells and stated
tliat the final plat is the same as preliminar)’’ previously
approved. Planning Commission reviewed letter from
County Highway Department requesting an additional 17 ft.
of right of way. Determined that the additional right of
way on the narrow access drive would be a hardship to the
applicant at this late date.
Hosfield moved, Hassel seconded, to recommend approval of
the final plat subject to a park dedication fee. Motion ■
Ayes (5), Nays (0) .
Asst. Zoning .Administrator stated that applicant is
requesting approval of a lot area variance for construction
of a new home. Application was tabled several times.
Council requested that the applicant provide a purchase
agreement showing his interest in this matter.
For the first time since the April ISth work session,
John Gullickson, Jr. was present. He presented a
purchase agreement dated March 1, 1977; application is
dated March 25, 1977.

a new dwelling on Lot 2. TTiis is adjacent to vacant Lot 1
(our file #250) which is the subject of a similar request.
Planning Commission addressed the ownership history of
this lot and the unsucce;3sful attempts to combine it with
the adjacent, vacant lot.
After a brief discussion, Hassel moved, McDonald seconded,
to recommend approval of the lot area variance based on the
following:
(1) No other variances required.
(2) Lot in single separate o\^mership since April 1967.
(3) Lot is sewered and serviced with public streets.

Applicant was not present. Acting Chairwom^ ^fcDon3^d
opened the public hearing regarding the petition of
Robert White for a subdivision of property located at
320 Woodhill Road. The Asst. Zoning Administrator
presented the Notice of Piiblic Hearing and the Affidavit
of Publication.
Mr. Olson stated this is a combination of a subdivison and
variance request. Existing 5 acre tract is proposed to be
divided into two parcels each of which would exceed p^e
2 acre minimum requirement. The irregular lot line is a
result of the sharp hill crest at this location.
Planning Commission was concerned with the access problems
on Woodhill Road. They wanted to ensure that access would
always be over the existing driveway and that no new
access would be developed.
Commission discussed variance request for proposed house.
There were some questions regarding future development on
the golf course property. Commission could find no basis
for granting a setback variance for proposed dwelling.
Planning Commission received copy of engineer’s letter
recommending approval of the subdivision and septic system
application.
Public hearing was closed at 8:35 p.m.

recommend preliminary approval of the subdivision subject
to maintaining the existing access, to provdding private
easerrents for tlie access drive to each lot, and to a
park dedication fee. Variance request was tabled for
more information.

Hosfield seconded, that staff notify applicant by
certified letter advising that if we do not hear
from tliem we would assume they have abandoned the
application and would take action.

Applicant is request variance for an addition of ^
enclosed porch to the rear of their house. Addition
would not encroach on any existing setbacks. Variances
are required for lot area and the existing front set
back.
After brief discussion, Hosfield moved, Guthrie seconded,
to recommend approval on the basis that all setback
requirements are met.
Motion - Ayes (5), Nays (0).
A public hearing was scheduled for ^fonday, July 18, 1977,
at 7:45 p.m.
Mr. Home was present. He is requesting approv'al of a
screen p>or(Ji addition to his home. Addition would meet
all setbacks including the 75 ft. lakeshore setback.
However, proposed porch and existing home are set closer
to the lake than the neighbors homes, particularly the
neighbor to the south. Neighbor most affected has
indicated no objection.
Hassel moved, Guthrie seconded, to recommend approval of
the lot area and width variance with the understanding
that the adjacent property owners have no objections and
proposal meets the side yard and lakeshore setback,
requirements.

The Wyatts eure requesting a subdivision of

With this proposal they are also requesting a Conditional Use Permit to
move in another house and garage (guest house) onto the south lot, which is
already occupied by a residence. The Guest House would require a Conditional
Use Permit. The Wyatts, however, have submitted a letter assuring us they
would remove the existing residence within 18 months. (We should include
this as a condition.)
The proposal as submitted would meet all setback requirements.
A Public Hearing for this proposal has been scheduled for July 19, 1976.
PLANNING (DNfdSSION MEETING - July 19, 1976
Mr. IV)'att wis present for the Hearing. He explained that his mo'^er had
recently died and because he works and is a student he needed this amount
of time to remove her belongings and the existing residence. The Planning
Conmission recommended approval of this subdivision and to grant the 18
month variance request. This is subject to a Park Dedication Fee.

Approved preliminary subdivision. Delayed action of Conditional Use Permit
until applicant submits title opinion to the City for Legal Department to
complete with stipulation requiring removal of old structure within 18
months.
PLANNING CaWISSION MEETING - Septenber 20, 1976
Planning Commission recommended denial of the fmal plat on the basis ^^t it
is not a legal plat and does not meet final requirements. The plat submitted
by the Wyatt's was a copy of the preliminary plat. Tlierefore, signature of
the surveyor was also a copy. Plat does not have the necessary property
description and space for signatures. The proposal does not meet the subdi
vision exceptions as a variance would be required for the lot that does not
meet the minimum zoning area requirement (39.02p. The Zoning Administrator
informed the Commission that the surveyor, Arleigh C. Smith, had voluntarily
surrendered his Certificate of Registration to practice land surveying as he
is facing charges of incoin}'>etency. The hVatt's were advised to make the
necessary' changes to meet the requirements and to bring the plat back to the
Commission.

of eighteen months from the date of this resolution,
the guest house must be completely removed.
2. In the event that the guest house is not removed
bv that time, the City of Orono is given the right
to enter on the property, with or without noctice,
and destroy the building and assess the cost thereof
against the property. The applicant and the property
owner agree to hold the City harmless from any and
all liability for that action if such action is
necessary to effectuate the terms of this conditional
use permit and resolution,
3. The applicant shall provide prior to any granting
of this permit and placement of the additional
home on the property, a title opinion brought up to

opinion shows all the owners of the property

In discussion, Gullickson, Sr. stated that he wanted a decision on the bulldability
of his Lot 2. He also stated that Gullickson, Jr. had "dropped out" of the applica
tion. Gordon Thomspon said that he wanted to take over the application on Lot 1, but
that the application before the Commission was not his. Planning Coii^ssion adivsed
