Enclosed is the data requested by the Staff and the Planning Commission regarding the geothermal heating system proposed for Che William Ulrich A residence. f n 1. DNR: Contact was made with John Fax of the DNR and the appropriate information submitted. We were issued the Appropriation and Use of Water Permit 86-6178, which authorizes the pumping and discharge of 11,000,000 gallons yearly. 2. PCA: Discharge application forms were completed and sent to Gary Kimble of the MPCA. The MPCA is presently seeking authorization to issue a general permit program for discharges less than 100,000 gallons per day which constitutes a negligible environmental impact. Per my phone call with Mr. Kimble, August 4, 1986, we have satisfied the necessary requirements, and the PCA will advise if any changes occur. 3. LMCD: Clifford Keep, acting as our agent, has corresponded with Frank Mixa and the LMCD. Mr. Mixa stated that they have no jurisdiction in this area, and feels the other regulating agencies will answer any environmental concerns. The following information has been gathered from experts involved with geothermal heating systems: 1. & 2. Average dally discharge/peak discharge (in gallons pef hour), and velocity of discharge as it enters lake through perforations: These two items are explained on the same graph and also on the information submitted by Terra-Therm, Inc. ^ Supply line specifications — casings, size, depth of well, aquifer tapped, effects of water table: e,{U,-f5 H , t The supply of water will be taken from a private well. The well consists of 8 — 6” casing and a total depth of 322 feet. The aquifer tapped is the Prairie du Chien Jordan aquifer. In item //9, the well record states that static water level is 65 feet. This means water is sitting in the casing 65 feet below land surface. Item #10 states that water level remained at 65 feet after a 20 hour period of pumping at 200 gallons per minute. Conclusion: neglible drawdown after extended pumping schedule. 4, if Page 2AUG M 19 mu seven countyThe Prairie du Chlen aquifer supplies the 3,000 square miles, » ground water pumped for public water suppl^T 7 ^nn gallons are pumped dally from this aquifer. That Is approximately /,500 times more water than we are using. These figures clearly reveal the magnitude of the Jordan aquifer and the gallons of water available. The U.S. Geological Survey, titled: "Water Resources Investigations Report 83-4237", talks of the hydraulic connection" of area surface lakes and th.s underground water supply. This "hydraulic connection" completes a cycle of water being extracted for public consumption and replenished by these surface lakes. The pologlc cross-sectional .nap verifies the location of the Jordan aquifer and Lake Mlnnetonl^ above, thereby allowing this hydraulic connection to occur. The geothermal heating system now becomes an effective environmental heatinp and cooling alternative by re-cyling water used. 4. Pump size — specs on pump: Red Jacket brand, submersible pump. 10 horsepower. Three-phase power. Pumping capacity of 150/gallons per minute. 5. Method of anchoring ends of discharge line: Since the discharge pipe has been re-designed to go to the lagoon, anchoring to lake does not apply, but a similar anchor and stand will be used in the lagoon, drawing is included. 8. Natural drainage system of the Ulrich property and adjoining properties would be over extended and undue erosion of said properties could.occur. 2. Wayzata, MN 55391 Dear Mr. Ulrich: PERMIT 86-6178, ONE ^VELL, HH^INEPIN COUNTY Enclosed is Permit 86-6173 which permits the appropriation of water for the purpose of heating and cooling on a continucxis basis in Section 8, T117N, R32W. Please read all the conditions of the permit, especially Condition 3.b. This requires you to record the amounts of water appropriated. A Water Use Report will be sent to you each January for reporting the amounts for the previous year. The report must be submitted with the processing fee by February 15 of each year. The fee schedule is $5.00 per each permitted ten million gallons or fraction thereof. The permit authorizes the appropriation of 11 million gallons per year; therefore, the annual processing fee is$15.0Q. Do not send the report and fee until notified. Failure to submit the report and fee can result in the termination of the permit. Pursuant to Minnesota Statutes, Section 105.44. Subds.3 and 6, the applicant, the managers of the watershed district, the board of supervisors of the soil and water conservation district, or the mayor of the city may demand a hearing on the Permit provided the demand for hearing and the bond required are filed with the Commissioner within 30 days of receipt. A corporate surety bond or equivalent security in the amount of $500.00 must accompany the demand for hearing; however, the applicant may be responsible for hearing costs up to $750.00. No bond is required of a public authority which demands a hearing. If no demand for hearing is made or if a hearing is demanded but no bond is filed, the Permit shall become final at the expiration of the 30 days and no appeal may be taken to the State Court of Appeals. Bond forms will be supplied at your request. The Minnesota Pollution Control Agency (MPCA) is presently seeking authority to administer a general permit program for heat pump and non-contact cooling water dischargers from the U.S. Environmental Protection Agency. A general permit is a generic permit that allows us to process dischargers of a similar nature without issuing individual permits, thus saving processing time. In order to meet heat pump general permit criteria the discharge must be less than 100,000 gallons per day and not use water treatment additives chat we would regulate. The MPCA is presently accepting permit applications for dischargers in this category in the interim until final program approval is received. We presently have several hundred applications for heat pumps and non-contact cooling water discharges that fit into the general permit category. We anticipate that there are many more heat pump dischargers that we need to ■•locate. Enclosed are two copies of a Shortform C discharge application and one set of instructions. The average daily discharge at -18® would be 2,106 gal. per hr., or 35 gal. per minute. Based on information from the U.S. Weather Informational office we spend only 50 hrs. in this design condition. Assuming an incoming water temperature of 50®. The discharge water temperature in the heating season will be 39 to 400. Assuming an incoming water temperature of 50®. In addition, a representative from DNR's section of Fisheries will be visiting the site this week. Several issues/questions have surfaced since your application was submitted of which I would like to advise you. 1. A previous permit application (#80-6006) was submitted by David Dunlap for the purpose of dredging the same lagoon. Fisheries review at that time indicated ideal largemouth bass spawning habitat. The permit was limited, therefore, to excavation of the entrance of the lagoon. Fisheries review this week will attempt to prove or disprove the previous opinion. 2. DNR regulations limit the depth of dredging for navigational channels from the shore (for recreational watercraft) to 4 feet [Minn. Regs. 6115.0201, Subp. 4A]. Although greater depths have been authorized for docking of keel boats, the navigability to the mooring location was not an issue. 3. I am not aware of a permit issued for the existing permanent dock. This application can include the review of the dock in its existing configuration or, if desired, in a redesigned version. 4. The approval of the retaining wall should not pose a problem except that retaining wall permits require title-registration. The outlet pipe for the groundwater heat pump is of concern to DNR as well as the City of Orono. Although I understand that the manufacturer claims no impact to thickness, we are concerned about liability. We therefore encourage redesign of the outlet system to the lagoon area where there will be less chance of public use of the lake surface. Thank you for your consideration of these matters. Item 1 - Conflicting Survey r Mr. Golden has submitted a survey dated in 1950 that shows his property to wholly contain his garage with 2.7 feet of setback. A 1971 survey submitted by Hanson shows Golden's garage 0.25 feet over the line into Hanson's lot. The garage has not moved. Item 2 - Lawsuit Ovei. Hanson's South Lot Line In 1971, Mr. Hanson rued his neighbor LaQuey to the south because of a similar conflict in lot lines. LaQuey apparently had a survey done which showed his lot line overlapping onto what Hanson felt was his property based on old survey stakes. The district court ruled that there was no basis to revise anyone's legal description, no basis for "adverse possession" and that the line as shown on LaQuey's newer survey would stand. Hanson concurrently had his lot re-surveyed and it, too, showed that the old stakes were apparently wrong. Mr. Hanson's new survey, as a result, also showed that the old pins between Hanson and Golden were apparently wrong. Tiiem 3 - Golden's Objection Regarding Lot Line Location Golden, in his objection, is relying on a 1950 survey which he accepted as correctly representing his property boundaries when he bought the property. He stated he was told by someone that his lot line was not ^>^anged as a result of Hansons suit with LaQuey. It is apparent that tie legal descriptions did not change, but that the original survey pins apparently were placed incorrectly based on a problem with a reference point in Spates Avenue. It is likely that if Mr. Golden would have a new survey done, it would show the lot line consistent with Hanson's survey. It appears likely that Golden's garage is over onto Hanson's property. Zoning File #1056 August 14, 1986 Page 2 Staff Recommendation Regarding Survey : It is staff's opinion and recommendation that the variance request be reviewed under the assumption that Hanson's survey is correct. Golden's Objection Regarding Open Space» Sunlight. Etc. Mr. & Mrs. Golden object to the proposed garage location, which is requested by Hanson on his survey as 6* from the line at the northwest corner of the garage and about 8* from the line at the northeast corner. The Goldens maintain a garden up to the chicken wire fence and feel the garage placed that close to the line will be a detriment to their garden. Staff Recommendation Hanson's claimed hardship is that to move the garage over to the 10' setback line would mean a sharper angle required to enter and exit from the garage. In order to recommend approval. Planning Commission will have to find that this hardship justifies the variance request in spite of the neighbor's objections. A recommendation to deny would have to make the opposite findings. We have located at least 3 of the drainfields, and they appear to be 18"-24” below the surface. Since the stairway is designed to be not more than 6" into the ground, we anticipate no problems as far as disruption of septic system. The landscaper informs me that all installaticn will be handwork, with no heavy equipment on the site. The landscape architect has indicated that the stairs and landings can be constructed with pervious, non-hardcover platforms, hence the proposed hardcover will consist only of 6" wide ties as a framework or retaining wall system. This reduces the total proposed 0-75' hardcover from 9.2% to 4.8%. The applicant has had the property lines staked, and a certificate of survey is forthcoming. The property lines are approximately as shown on the site plan submitted, hence we expect no problems with 'incroachment into the fire lane/access to the immediate west of the property. Staff Recommendation: Based on the revision to reduce proposed 0-75' hardcover to 4.8%, staff recommends approval, finding that the steep slopes are a hardship that necessitates the stairway, and that the retaining walls are necessary for protection of the property and its occupants. There are two old railroad tie walls existing now, one around the lindens on the east side near the lake, and one higher up, on the west side. There is a rail fence now along both sides of the lot near the lake. The existing steps on this steeply sloped lakeshore yard consist of 8"x 8" railroad ties, 6' long, placed every three feet with gravel/grass between them. These ties are starting to decay, so the request to replace them is understandable. The tie walls along either side near the lake are intended to be about 12”-18" high to remove the existing drop-off near the fence which is dangerous to mow when the grass is wet (see exhibit F-1). The tie wall enclosures around the linden trees are starting to rot and appear necessary if the trees are to remain there. The stairway is proposed to be constructed using stringers and wooden treads, although it is not clear exactly what portion of the steps will be hardcover. The two landings 4'xl6' and 8*xl2', are not finalized as to surface material, according to the landscape planner. This would have an effect on the percentage Zoning Pile #1046 July 18, 1986 Page 2 of 2 of hardcover in the 0—75' zone. We normally allow a maximum 4*x4* landing if it is 100% hardcover for lakeshore stairs such as these. There is a concern that the stairway and upper landing will be over the existing drainfield lines. We know that the general location of the drainfield lines is downhill from the house and running across the slope, but we don't know how deep or how long they are. The house was built on this 9,700 s.f. lot (0.22 acre) in 1972 with a variance. The existing drainfields are undoubtedly less than 75' from the lake and are currently working well with no visible seepage or discharge, but no possible way to replace the system other than a holding tank if future problems occur. Staff Recomendation - It appears that the proposed walls are intended for (and necessary for) either safety purposes or to preserve existing features such as trees and slopes. The slope is steep enough that a stairway is a reasonable request. Staff does not see the necessity of the two landings but would find them less objectionable if they are constructed with a permeable fill to minimize the hardcover. Approval might be conditioned upon: 1. Providing suitable erosion protection measures as required by City Inspector during construction. 2. Itairway construction to be at shallow depth only, to avoid conflict with drainfield lines. Strongly recommend no heavy equipment. 3. Since applicant has not provided an actual certificate of survey, and because this is adjacent to City fire lane and lake access, which has had encroachment problems before, a survey should be required in order to verify the lot lines and keep all improvements within the property boundaries. 4. Review of Uses Prior to 1963, the property served as both principal residence and grocery store. In 1963, the City assessed 2 residential sewer units against the property. Mr. Jungquist replaced grocery store use with a dry cleaning plant and maintained 2nd floor apartment as principal residence sometime in 1963 through 1976. In 1971, the City assessed 2 residential water units against the property. In 1976, Mrs. Bjork assumed ownership via a contract for deed. The address file for the property provided staff with additional information on the history of the property since 1976. Review Exhibits F, G & H. In 1976, the commercial use did not exist and 1980 repermitting confirmed that a commercial use still did not exist. Per Sections 10.03, Subdivision 5 A through J - a commercial use would not be allowed to be resume within the structure. The permits and floor plans confirm that permits were issued to convert commercial area of structure into a mother-in-law apartment. Note the permits state that apartment could not be used as rental apartment. A conditional use permit was not required in 1976 - Section 10.20, Subdivision 3 (G) requires a conditional use permit for guest apartments - the code has not been amended since 1976. The applicant's son has advised that at one time Mrs. Bjork attempted to sell the property as a duplex and the prospective buyer sued when advised by the City that structure was not considered a legal duplex. When the original permits were issued in 1976 and once again in 1980 to the Bjorks, the City was advised that one of Mrs. Bjork's sons would reside in the second floor apartment with his family and Mrs. Bjork, because of he' age, would reside in the first floor apartment. Neighbors have confirmed that Mrs. Bjork has resided in the apartment until her move to Spring Park. Staff has no information on the use of the second floor apartment from 1976 to present. Staff has had at least 2 contacts from prospective buyers, within the last few years, interested in the use of the structure as both a residence and space for home occupation. Unfortunately, the home occupations did not satisfy standards for such use. i Zoning File #1059 August 13, 1986 Page 4 Questions that must be resolved for applicant prior to presenting property for public sale. 1. Does the property qualify for duplex credit? a) Adjacent to commercially used property (legal non- conforming use - upholstery shop) property is not adjacent to a commercial district as required in Section 10.20, Subdivision 3 (I). b) Duplex section does not establish need for area or width standard but Section 10.03, Subdivision 4 would require that property meet all zoning standards to permit a change or intensification in use - property is substandard in area and building is located within right-of-way of County Road. c) Does the fact that the property was assessed 2 water units and 2 sewer units have any bearing on this issue? Assessme its were based on existing uses - residential units because property wai located in residential zone. d) Had the City made any commitments to applicant since acquisition of property that would suggest duplex use was a legal use for property? City has consistently advised applicant that converted commercial area to mother-in-law apartment was to remain non­ rental unit. City failed to ask for the necessary conditional use permit to allow the guest apartment - may have been deemed a less intense use of limited property than a commercial use - similar commercial use would have been allowed if one year had not lapsed since dry cleaning plant use ceased operation. e) Can you make the necessary findings that would support the position that would find the installation of the second residential unit in 1976 as a continuation of a non- conforming use. Staff did not ask for a conditional use permit for the non-rental apartment nor for a conditional use permit to allow the continuation of a non-conforming use. Per Section 10.03, Subdivision 5 (A) the non­ conforming use may not be changed to another non-conforming use. The new use would not have been approved. Prior to the 1967 Zoning Code there were no standards for non- conforming uses - the change in use from grocery store to dry cleaning plant required no zoning review. Staff had originally advised applicant's son that a review of the files and code may have supported this position but we can not make the necessary findings. Zoning File #1059 August 13, 1986 Page 5 If Planning Commission finds that property qualifies for duplex credit, you may consider the following findings: 1. Property was assessed for 2 residential sewer and 2 residential water units. 2. Second floor apartment area created prior to zoning and building standards (allowed mixed residential and commercial use) • 3. Property has immediate access to County Road. 4. External appearances of house suggest single family residential use. 5. There is adequate room on site for off-street parking. If Planning Commission finds the property does not qualify for duplex credit, you may consider the following findings: 1. Property is not adjacent to commercial district but adjacent to a commercially used property considered a legal non-conforming use. The objective behind all zoning standards for non-conforming uses is that the use fade away and permitted and conforming uses within the specific zoning district be established. 2. The property is severely substandard - property lacks 14,456 s.f. of required area, house encroaches right-of-way of County Road. 3. Safety becomes even more of a concern with increased or intensifed use of property. Accesses to and from property increased. 4. Permits for guest apartment clearly advised applicant that unit could never be used for rental purposes. 5. Such use would be in conflict with the intent and purpose of the LR-lC Zoning District.
