This includes the property north of County Road #6 and east of Homestead Trail and also a small portion of Orono School property near Lake Classen (the same areas as last year). I'm enclosing copies of the new application, attached letter and Council minutes of May 10, 1976. The current application includes a request for use of an existing access from County Road #6. In reviewing this with the County, it appears this access has been in existance for many years. PLANNING OOMMISSIQN MEETING - April 4, 1977 Work Session only. Planning Commission reviewed application with John Lobben. Mr. Lobben assured Commission that this application was a separate matter from yo-Tech proposal. Same basic application as approved last year. Only difference is proposed new access off County Road #6 which appears to have been "in existence for ipany years. He stated that Clark Engineering is researching ^e possibility of providing a bridge over the creek for access for the farm equipment from the Medina area. He was then asked to explain the point of access for tTBctOTS and other faim equipment. He infoirned us they were considering using the old bam in Medina for storage of farm equipment and no access would be necessary from City or County roads. They would travel back and forth over the farm land between Medina airJ Orono. He also mentioned a bridge over the drainage- way • When the plans for the proposed bridge were completed he submitted an application to the MCWD. Holmquist informed him of our new policy agreement whereby all watershed applications in Orono must be submitted through the City. The bridge, which will be used for agricultural equipment, is needed to connect neighboring fields separated by a creek. This study is to determine the maximum height and width the creek will rise at the proposed bridge site for the bridge during a potential 100 year storm. The report is divided into two (2) areas of study. The first is the determi nation of the peak rate of flow in the design storm by the proposed bridge site. The second area of study is the determination of the maximum height and width the water in the creek will rise at the peak rate of flow. DETERMINATION OF THE PEAK RATE OF FLOW The Rational Method was used to find the peak rate of flow during a potential 100 year storm. This method calls for the drainage area to be broken down into the different types of runoff based on its imperviousness. The imperviousness,which is the maximum rate of runoff compared to the average range of rainfall, was base on the future development expected in the drainage area. Gayle’s is now requesting renewal of this approval and approval of the 1977 marina license also. building plan is a little smaller than the one proposed in 1975 Dimensions in 1975 were 142’ x 90'. The current plan is 120’ x 90'. ® inspection of the property to determine if he has ful- filled his obligations for the 1976 license. A1 reports that the trees have been planted, but they are somewhat small (our ordinance does not specify size). One being riprap rather than a seawall. The proposal was renewed in 1976. The low water level of the lake along with the erosion of silt through the years has created a problem for this year’s docking operations. The applicant is, therefore, requesting approval for the removal of the erosion and installation of riprap to protect against further erosion. He contends that this removal of silt is a shoreline maintenance project only. He has submitted several j^otos as evidence. The specifications for the project include removal of the silt from the property. Maps and specs are enclosed. I'm also enclosing copies of the Council minutes of Septenfcer 23, 1975. I don’t know the status of the docks that exceed the IMCD 200' limit. I believe LMCD has decided to enforce this limit this year, 1 don’t know if any of the marinas are objecting to this enforcement. Don Murphy of the Hennepin County Pii>lic Works Department just called me on March 15, 1977, to confiim their intent to cooperate to some extent on projected improvements along County Roads abutting marinas. County procedures involve T^re departments and more red tape before decisions are reached. PLANNING COhMISSION fCETING - March 21, 1977 Work Session item. Paul Kenpf was present. After reviewing his proposal, the Planning Comnission requested that the applicant submit a report fixmi the Minnehaha Creek Watershed District concerning the extent of build up of the eroded materi^. The applicant was forewarned that the only dredging that would be permitted was that portion that has eroded through the years. The Conmission also requested that the applicant submit a copy of the action taken by the LMCD at their mating this week regarding dock lengths. The Coimdssion reconmended that the City Engineer supervise this dredging. PLANNING CCMNnSSICN KEETING - April 4, 1977 Three parties representing nearby property owners were in attendance. They were especis'^ly concerned about the dredging and the affect this would have on the neighboring properties. It was suggested that the applicant include in his proposal consideraticxi of reducing the dock lengths to the 200’ LMCD regulation to justify the proposed dredging for docks that would be lost in the cut back. The applicant felt this was unjust and at present would not consider cutting back the docks. The following is a discussion of the salient impacts of the proposed action. The parameters in the attached table have been reviewed and considered in arriving at the preliminary determination stated below. 1. Social Effects Archaeological and Historical Values - As required by our regulations, this public notice has been sent to the Advisory Council on Historic Preservation, the National Park Service, the State Historic Preservation Officer and the State Archaeologist. The latest version of the National Register of Historic Places has been consulted and no properties listed on or eligible for Inclusion on the Register are located in the project area. Presently unknown archaeological, scientific, prehistoric, or historical data may be lost or destroyed by the work to be accomplished under the requested permit. 2. Economic Effects It has been determined that the proposed action would have a minor beneficial impact upon property values. 3. Alternatives to the Proposed Action Other than the no action alternative, i.e., denial of the permit, there appear to be no reasonable alternatives to the proposed action. 4. Determination Our preliminary review Indicates that the probable impacts of the proposed action are minor in nature and will not significantly affect the quality of the human environment. Therefore, an environmental impact statement will not be prepared. This preliminary determination may be reversed, if warranted, as a result of information provided by Federal, State, and local agencies, comments from the public, and any new information brought to light.
