Correcti<m of stopping distances on Tows 3 and 6. 2. Installation of operator's stations which can view and control the entire lengidi of all tows. 3. Review of signing for confoimity. 4. Removal of brush and other tow line obstructions. 5. Maintenance of fencing and chalet access in good repair. Ihe applicant feels that the installation of operator stations are not necessary. I'm enclosing a copy of the letter from Mr. Bcmer confirming their view. He indicates that the ANSI standards provide for exceptions. If this is true, I believe the i^plicant should submit certification of an exception or variance from the qualified inspector or his agency. 1 have not received the application for a Conditional Use Permit for Phase II as of March 31, 1977. The license was approved completxon of five items recommended by you in vour report dated February 11, 1977. ^ The purpose of this letter is to place the City on notice of the fact that we did not and do not acquiesce in the condition re quiring installation of operator stations capable of viewing and controlling the tows. As you are well aware, the ANSI Standards provide for exceptions to general rules where facts indicate such exceptions are permissible. As you are also doubtless aware, the City of Orono has heretofore never required installation of such stations. The Council was informed of the excellent safety record of the dfea during its entire period of operation and was also in ormed that it is customary to operate rope tows such as those installed at Ski Tonka without operators. The Council had before It no evidence which indicated that this change in mode of operation or licensing requirements was necessary. Neither the Mayor nor any of the members of the Council indicated that there had been a change in circumstances which they believed warranted this new requirement. foregoing, it seems that the position of the Council on this Item is nothing short of artitrary and capricious. The proposal includes the proposed location of the main structure and two accessory structures. The location for the proposed tennis court is only 30* from the north lot line which runs adjacent to the private access road to the Van Eeckhout property. This access might at some time in the future become a public road to other parcels resulting from future subdivisions. Our ordinance requires a 50* setback from the road so the proposed location of the tennis court would require a 20* setback variance. I have not as yet received the topog and proposed drainage plans. A public hearing has been scheduled for April 18, 1977, at 7:45 p.ra. A Park Dedication Fee of $500 ($250/lot) would be forthcoming if the subdivision is approved. The application consists of three alternatives. Each oiw varies in the extent of riprap and seawall. The project would require some dredging also. Mr. Hartmann informed me the dredging consists of maintenance dredging mly, I have no way of confirming this without engineering reports. I also don't know the extent of dredging proposed. I don|t know exactly which alternative they mig^t favor. We might determine idiich one mig^t have the least impact before making a decision. The elevation plan of the proposed riprap indicates using the listing seawall as a supMrt for the proposed riprap. Rd. 6 and Co. Rd. 201 (Northeast quadrant). They desire access to either of the two points shown on the attached sketch. As discussed in our telephone conversation of 3/16/77, you asked If a driveway permit was on record for the previous owners or users of the property. I checked our files and found no permit, but this Is quite understandable because our driveway permit system has only been in effect for approximately 10 years. The existing drive was probably constructed prior to that time. limited volume of traffic using the access point, the Hennepin County Highway Division does not have any strong preference for either location. We would prefer the use of the existing drive to Co. Rd. 6 mainly because It Is a well access point, and no new construction would be Involved. If access to Co. Rd. 201 IS preferred by :he City then It should be specified that a fence or row of plantings be established along the right of way line of Co. Rd. 201 to prevent vehicles from crossing at any point other than the new driveway. This would also be not^ in the pennit Issued by our office. If the access to Co. Rd. 6 is not to be used It should be blocked by posts, and removed completely at the time of any major grading in the area. j The pennit, when Issued, will be on a temporary basis pending decisions on any pro posed construction of a partial or full campus. B consists of approximately three acres located at the Orono Public School complex and approximately 22 acres owned by JISD 287 located at the northeast quadrant of County Road 6 and 201 (City of Orono). The majority of comments which follow will concern the 22 acre parcel of land. Our application pertains _s_olely to enabling continuance of the specialty crop program farming operations and does not pertain to the potential West Campus ^ the smaller specialty building which have been discussed in the items are separate unrelated matters needing separate consideration at such time that an application would be submitted. The Specialty Crop program is part of our Department of Natural Resource and Environmental Technology. Specialty crop production consists of such areas as orchards, nursery stock, vegetables, sod, Christmas trees, small grains and annual and perennial flowers. Many small plots will continue ^ be developed so that the overall effect will be creating an aboretum. The land, therefore, will continue to be used for agricultural purposes as it has been for well over the past fifty years. All provisions of the conditional use permit Issued on May 10, 1976 (See attachment) will continue to be met with the exception that we are asking that the access point be reconsidered for reasons which will be explained below. We will need to continue to provide on the 22 acre parcel on a temporary basis satellite sanitary facilities and a mobile construction trailer for student shelter. Both items will continue to be screened by natural plantings. There will be neither student parking nor buildings constructed. Students will continue to park their cars at the classroom facility which is located elsewhere with transportation provided to the site by the district. • We are asking that the current condition which states that "there shall be no access to County Road No. 6 from the properties" be reconsidered. The exact reasoning behind this requirement is unclear. Three unique features of the * proposal are particularly attractive to the District. Private wni be coupled with District construction bonds to build the facility, it will be income producing, and there will be ng encroachment on other educational programs. Also, the potential effect on taxes is very small. Complete financial and tax questions and answers are detailed elsewhere. Answers to other General questions are listed below. ^ 1. QUESTION; Is this arena project really feasible?. ANSWER:Yes. Three separate feasibility studies have been conducted since 1974, the last one completed in December 1976 by professional arena consultant, A. J. Nicholas. All studies indicate a high use potential and financial soundness if placed on available, tax free land, as is being proposed. 2. QUESTION: Why the proposed location? ANSWER:It turns out the proposed location, just v;est of the high school, is ideal because utilities, parking, and other related facilities are already in place, mis ocation keeps construction costs to a minimum and offers easy access for maximum utilization. It also harmoniously tucks the arena right in with existing buildings. Construction people have said '* a perfect site." 3. QUESTION: With declining enrollments, birthrates, etc. will the facility really get used? ’’ ANSWER:Yes. Because there are no indoor facilities in the immediate area now, all the feasibility studies indicate existing programs will fill significant blocks of time immediately and grow, plus new programs added will quickly expand. The problem may become how to prioritize available time to available users. The ice will not be maintained during summer months nor will the arena be cooled during the summer. Electricity will be the primary energy used for lighting, operating blowers and ice compressors. On the other hand, energy being used by residents who are now driving literally hundreds of miles annually to reach distant indoor ice and tennis facilities will be saved. Since the need exists, a new facility will undoubtedly be built somewhere. Energy consumption would then occur elsewhere instead of here, but without the potential' reduction in transportation energy use. 8.QUESTION: Sports activities always seem to get the most emphasis. What about priorities for other possible programs and capital requirements for the District? ANSWER:New .^programs for sports activities or any other programs get off the ground and receive priority when interested people actively work, organize and pursue these new projects Such is the current situation on the arena project. People interested in other programs and projects are encouraged to undertake the necessary organizational and promotional efforts needed to develop broad support for their projects so that appropriate priorities for such projects can be established. 9. QUESTION: Young people seem to be given so much today and sometimes seem so unappreciative. Why should this effort be made to give them something else? ANSWER:This is an unfair generalization. An arena is something the kids can*t get for themselves. Providing a community facility where young people have nppertunities to develop a strong sense of self-image and achievement through physical fitness and individual/team skill and competitive programs is not just "something else," but probably one of the best things we can do for them. It will give partici pants and spectators a sense of pride in their school and community. Also, it will keep some kids "off the streets" who otherwise might be in trouble or causing problems for others. This can*t help but be a very positive program for the whole community. li;: -4- 10.QUESTION: Much is being said about tennis and other activities' for the arena, but isn*t this project really just for boys * ice hockey? ANSWER:No. It is true that boys* youth and school hockey programs will be significant arena users. However, there will only be ice for 5%-6 months, so the balance of the year there will be no skating activities, but rather tennis and other indoor programs. During the indoor ice season, adult, boy and girl "learn-to-skate," public open skating, figure skating, broomball, social skating and skating teams programs, both school and non-school, will all be introduced. QUESTION; Will the present outside neighborhood ice arenas be maintained? ANSWER:Enough will be maintained to provide for a well-rounded community program operating in conjunction with the new arena. Some experimentation will have to take place to determine outside ice demand after arena is operating. 12.QUESTION; The multi-purpose arena will be built next to the high school. Doesn't this mean the high school gets all the benefit — what about elementary and junior high programs? ANSWER;This is a community facility, not a high school project. It is fully intended that the arena be a teaching station and resource for all schools in the district with appro priate sharing of desirable schedules. 13. QUESTION; If my children participate in youth hockey or learn-to skate, does this mean all their activities will now be inside at the new arena? ANS\^R;No. However, through careful scheduling, the intention will be to get most Mound-Westonka users inside, with as many desirable hours as possible. All Mound-Westonka school (K thru 12) and youth programs will be given priority over users from outside the district. Desirable times will be scheduled on an equitable basis for all programs. Since weather won’t be a problem, seasons will be longer with many more hours available. Traveling teams would play ’’home** games in the new arena, but would still probably travel for ’’away” games. During summer hot periods many people may prefer to play tennis outside during the day. However, night tennis and rainy day tennis is possible during July and August. Experience has shown that inside summertime temperatures in these new opaque, insulated air structures are 10-15® cooler than outside temperatures. This is just opposite the experience of the old transparent air structures and a definite advantage on very hot days. 15.QUESTION; The School Board is discussing closing Elizabeth Gardner school. If the district can't keep this building open how can we consider constructing an arena facility? ANSWER:The.two questions are unrelated. On Elizabeth Gardner, the School Board is simply fulfilling its responsibility to achieve maximum utilization of school facilities and staff. If L.G. is indeed closed, other buildings P^GS^miably be used more effectively while maintaining quality of programs. The E.G. facility obviously cannot meet the needs for which the multi-purpose arena would be intended. The arena project is in no way dependent on the E.G. decision. Proceeds and savings accruing from the sale of E.G. (if ever sold) will go to the instructional program, not to the arena. 16. QUESTION: Will the passage of this bond issue affect other potential programs? ANSWER:No. Because the referendum is for construction bonds it will have no effect on current educational programs. Also, because of the favorable District debt structure, future capital proposals remain entirely feasible. In fact, passage of the arena bonds should encourage those interested in other projects by indicating that soundly conceived programs, coupled with creative financing, will be accepted by the community.
