Bracken, 1770 West Farm Road - Vacation of Drainage & Utility Easement - Public Hearing Pertinent Section of the Code - Section 10.12 List of Exhibits Exhibit A - Application Exhibit B - Property Owners List Exhibit C - Plat Map Exhibit D - Lot Line Rearrangement of Lot 16 Exhibit E - Bracken Property - Easement to be Exhibit F •* Survey With Building Permit Exhibit G - Staff Letter Vacated Background on Current Application: On December 10, 1984, the City approved a lot line rearrangement of Lot 16, the Farm at Long Lake, that divided the lot inuo three parcels for combination with three adjacent properties (see Exhibit D). The Bracken property. Lot 17, combined with Parcel A (north 104.72' of Lot 16) was issued a building permit per survey submitted with application (Exhibit F). The house was obviously placed over a portion of the existing drainage and utility easments located along the shared lot lines of Lots 16 and 17. Bracken had difficulty getting a mortgage because the title company refused to give clear title with the new house placed over an easement. Staff sent a letter to the title company advising that this specific section of the drainage and utility easement serves no public purpose in its present location and that the City would consider vacation (Exhibit G). Mr. Bracken has petitioned to vacate the 10 feet wide drainage and utility easement located adjacent to the shared lot line of Lots 16 and 17 (Exhibit E). The City will consider the need to vacate easements whenever the City is asked to approve lot line rearrangements in the future. Consider the problems with the Van Eeckhout lot line rearrangement application. The replat subdivision of Paul Boyke, for tonight's review, will also require the concurrent vacation of platted easements no longer functional in relation to newly proposed lot lines. The Lurton application, another application involving a lot lino rearrangement of platted lots also for review tonight, did not appear to require a concuri;ent vacation of existing easements . Staff Recommendations To approve the vacation petition of William Bracken for the vacation of a 10 feet wide drainage and utility easement along the shared lot line of Lots 16 and 17, Block 1, the Farm at Long Lake, finding sasaroent not currently occupied with utility lines nor a drainageway and finding no future public purpose of the easement area in its present location. At the time the adjacent property. Lot 16, Block 1, The Farm at long Lake was divided and combined with adjacent properties, the previously designated drainage and utility easements were not vacated nor were new easements along the new defined boundaries of the affected properties required. It would now appear that the new residence on combined Lot 17 and the north 104.72 feet of Lot 16 has been placed over the unused portion of the drainage and utility easements that once bordered the shared lot line of 16 and 17. It is the City of Orono's position that this specific section of public drainage and utility easements serves no public purpose in its present location and would recommend that the subject easements be vacated. Av erage Setback Line Variances - The applicant advises that his insurance carrier will not require fencing around the pool. Staff advised the applicant that a fence (not to exceed 3'6" in height) can be placed in the lakeshore yard up to the 75 feet lakeshore setback line. Such structures are not subject to the provisions of the average lakeshore setback/viewing standard. Martinson has advised, that at some future aate, he may wish to install a fence but it would not ei-.ceed the allowable height. It should be noted that the pool area is located approximately 95 feet from both adjacent residential structures (see Exhibit K). Staff would recommend that approval of these structures be conditioned such that no additions or modifications to the deck and pool will result in an increased vertical elevations* The deck and pool as proposed will create no viewing problems for adjacent neighbors. Accessory Structures on Thro ugh Lots - The deck tenn.^ s court structure i» now located 30 feet from the rear/street lot line. The zode requires 50 feet - there is adequate depth in the rear yard to meet the required setback without requiring the reroval of existing trees, compare Exhibits 6 J. Mr. Anderson, owner to the north, is still out of town and has yet to be contacted by the applicant. Prior to our first review Mrs. Bouchard, neighbor to the south, called to advise of her complete approval of Mr. Martinson's site development plan. The Bouchard residence would be 130 feet from the deck/tennis court with the rear/street setback at 50 ise® Exhibit K) - the Anderson residence would be 150 feet. «OI«- Zoning File #1110 March 5, 1987 Page 3 of 4 Martinson has attempted to respond to your concerns regarding the use of the court. He advises they will not use the court after 10 p.m. in the evening. Per Section 10.60, Subdivision 8, the lighting for the court must be shielded so that light beams are "not detectable at the lot lines". Mr. Martinson will learn very quickly of the tolerance levels of his neighbors. The very broad public nuisance sections of the municipal code will deal with any abuses resulting from the use of the court. On-Site Septic Testing - Mr. Martinson's on-site septic evaluator contacted my office to confirm there will be no problem in locating a sewage disposal system on the site. His preliminary inspection confirmed that the presence of frost prevented the testing of the percolation rate but that he was certain the recommended system would be a mound. Staff Recommendation: To approve lot area and lot width variances for the property located at 1840 Shoreline Drive to permit construction of a new residence finding that the size and width of the property is consistent with developed adjacent lots and exceeds the areas of the surrounding 1 acre per lot development of Fox Hills by 40 to 45 percent. To approve a conditional use permit for proposed accessory structures, a pool and deck tennis court, on a through lot, finding they meet the required 50 feet setback in both front/rear street yards and to grant a 60 feet setback encroachment beyond the average setback line for the pool and a 30 feet encroachment for the deck based on one or more of the following findings; 1. If the house was moved further north, it would require the total removal of the mature spruce trees at the rear of lot. 2. The setback lines of 500+ feet for the existing structures on the adjacent lots are unusual and place severe restrictions in the development of the middle lot. 3. The pool and deck structures are built at or below grade and will not create a lake viewing barrier for adjacent residences. 4. The on-site evaluator has confirmed that an on-site sewage disposal system can be installed on the site and that there is suitable area to install a furture alternate system. This approval is subject to the following conditions: 1. The accessory structures that encroach beyond the average setback line may never be altered so as to create a lake viewing obstacle for adjacent neighbors. 2. Applicant must obtain a permit from the public Works Department prior to the creation of a new curb cut. / ^0 y Zoning File illlO March 5, 1987 Page 4 of 4 3. Applicant must obtain a building permit for the installation of a dock. A permit for the dock will not be issued until a certificate of occupancy has been issued for new residence. 4. Applicant is placed on notice that the property is considered a through lot and that future accessory structures will require a conditional use permit and that these structures must meet a 50 feet setback from both front/rear street setback lines. 5. This court is shown 15’ from the sideline and will be constructed with a raised deck, approx-^ imately 2h' to 3' off the ground. In addition to this there will be a 10' fence around the deck. In addition to the fence there will be 3 light standards on each side of the court, ap~ proximately 10' to 12' in height. These lights will be directed inward to the court. The proponent agrees that there will be no play on the court after 10 P.M. in the evening. WOOD DECK The proponent proposes to build a wood deck on the south side of the house. This deck will be built within one to two steps of the ground. SWIMMING PCX)L The proposed site plan shows a swimming pool and surrounding concrete deck. I. #1115 - EASEMENT VACATION A 10' wide drainage and utility easement was dedicated to the public with the original plat of Brooks Green in 1980. That standard easement was 5' either side of the lot division line, and did not follow any established drainageway, but was merely intended to provide a functjonal corridor for utilities while serving no immediate dialnageway purpose, given the general topography of the site. Given that no utility or drainage purpose is currently served by the existing easement, it is appropriate as part of this replatting process to vacate the existing drainage and utility easement along the interior division line, in exchange for the granting of a similar easement along the re-platted lot lines.1 Zoning Piles #1115 & #1116 March 11, 1987 Page 2 Staff recommends approval of the vacation of the existing interior lot line drainage and utility easement. II. 11116 - LOT LINE REARRANGEMENT ISSUES A, Access to Westerly Lot. The applicant is proposing to construct a driveway roughly parallel to and northerly of the existing paved driveway, continuing along the north lot line and arriving at the proposed residence at a relatively high elevation. He is proposing this because a driveway along the south line of the property would be very steep, or would have to cut directly across the slope immediately below the existing house, which applicants feel would be a detriment to this unique property both aesthetically and environmentally. Staff agrees that, given the applicant's intent to construct a new home while maintaining an undisturbed vista of Lydiard Lake, the proposed driveway .location is perhaps appropriate but bears some discussion. Firsc, the proposed driveway must be located at least 26' from the wetland just east of the property. Secondly, staff has concerns about how the driveway will affect the developed properties to the north of Hollander Road, specifically Weinstein (259 Hollander Road) and Hill (235 Hollander Road). How will the driveway be graded into the slope, how will the downhill proper ’es be protected from the additional drainage, and what, if r.n •. -..reening is proposed (not required by code but still a consideration). Thirdly, staff notes the existing detached garage is about 30' from the north lot line; with the slope downhill from it, the applicant must protect t*’e garage stability while not affecting the downhill residences. Staff feels the northerly driveway proposal is logical and reasonable if the concerns expressed above be adequately addressed and solved. B. Lot Confiquration (Related to Access). Given the proposed house location and the location of the existing house and amenities, the north-south lot line is appropriate. However, you will note the original survey shows a 30' corridor along the north end of the property, which leads nowhere. Staff suggests it is appropriate to place this corridor at the south side of the proerty instead, thus maintaining a legal access to the existing easement road for future use if the northerly driveway easement becomes a problem in the future. SUMMARY A. Staff recommends approval of the vacation of drainage and utility easements along existing interior lot lines subject to granting similar easements along the newly configured lot lines. B. Staff recommends approval of the concept of a driveway easement across Lot 2 to serve Lot 1, only if the applicant can alleviate concerns of: i. slope stability, garage stability ii. drainage and runoff iii. screening and aesthetics C. Staff recciimiends that the westerly lot (Lot 1) be platted as a "flag" lot with 30' access corridor along the south end of the property. The typical lot width variance is appropriate to be granted. D. Staff recommends that a 50' radius portion of property centered at the southeast corner of the property be dedicated for future private or public roadway (or cul-de- sac) purposes. E. Staff recommends that a Flowage and Conservation Easement be granted over the portion of wetland within Lot 2, and this be shown as a drainage easement on the plat. F. Staff recommends that septic testing to locate an alternate drainfield site for the existing house on Lot 2 should be required prior to submittal of this application to Council for preliminary approval. Lot 3, and the adjacent property to the east. Lot 2 (review Exhibit B). The properties at that time were under single ownership. Leekly, Inc. was the contracting firm that developed b^th sites. The proje«"t consisted of the installation of a retention pond on the east. Lot 2, chat would drain to the west to another proposed retention pond on Lot 3. The plan provided for overflow drainage to run from the proposed second pond on Lot 3 south along a dra.nage swale to the drainage ditch at Cvunty Road 6. The pond on Lot 2 was installed in 1984 with overflow urainage channeled through underground tiles under an existing driveway and surfacing at the east border of Lot 3. The pond on Lot 3 was never constructed and currently, the drainage, now above ground, flows westward to swale area and then south to County Road 6 drainage ditch. Review of Current Application: The current owner of Lot 3, Construction Mortgage Investors, Co., does not plan to install the pond to the north of the residence and wants release from any obligations stipulated in the original conditional use permit and the Conservation and Flowage Easement taken over the proposed drainage area by the City. Staff has advised the owner that pei tne Code (Section 10.09, Subdivision 8 "A conditional use permit shall lapse one year following the date on which it became effected"), that is if a permit for the pond construction was not issued by October 15, 1985, the original conditional use permit was no longer valid on Lot 3. Zoning File #1118 March 4, 1987 Page 2 of 2 On the other hand, the Flowage and Conservation Easement was another matter and would have to be reviewed by both the City Attorney and City Engineer prior to any recommendation for action by staff. The drainage plan as approved by the City in 1984 was interdependent and not mutually exclusive. In other words, if the new owners of Lot 3 did not maintain the defined drainageway through their property. Lot 2's drainage would fail. The City Engineer, in his report, (Exhibit D), has recommended two courses of action. The first would be to simply modify the area restricted by the Flowaje and Conservation Easement providing protection of the drainageway and releasing the proposed pond area to north of line. The second option would call for land alterations on Lot 2 that would redirect overflow drainage from retention pond south to drainage ditch at County Road 6 (review Exhibit C) - note all drainage would be contained within Lot 2. The owner has decided to accept option one and has agreed to execute an amended drainage easement that would define and protect the current drainage pattern. The City Attorney has advised that a formal vacation of the existing drainage and utility easement held in favor of the City is required. It was first assumed that an amended easement could have been filed with the appropriate resolution by Council action. Staff has scheduled a public hearing for the formal vacation of the drainage and utility easement as described in the public hearing notice (Exhibit G). Staff Recommendation: To approve the vacation of drainage and utility easements as described in the Flowage and Conservation Easement and Waiver of Damages (Document No. 4944172) granted to the City of Orono over a proposed drainage area of Lot 3, Block 1, Willow Run, subject to the following conditions: 1. Payment by CMIC for all costs charged against the City as a result of this request. 2. Execution of a drainage easement over the now redefined drainage­ way that intersects Lot 3 to be executed by owner prior to Council action. LIST OF EXHIBITS Exhibit A - Memo and Exhibits of 2-12-87 Exhibit B - Notice of Planning Commission Action 2-19-87 DISCUSSION Staff viewed the site with applicant on 3-2-87 and noted the following: a) The existing house is 15'2" from the fence, which is inside the lot line. The extension of the house will not encroach on the required 10' setback. No side setback variance is necessary. The survey is not drawn correctly. b) The drainage swale at the side of the applicant's residence is appropriate and should be maintained, but does not appear to be a problem for either property. C) Applicant proposes to remove a total of 900 s.f. of existing rock-with-plastic hardcover, for a final 75'-250' hardcover reduction to 45.4% from 46.7% existing. (See Exhibit F). A reduction in the 250'-500' zone from 42% to 32% is also suggested by the applicant. D) Staff notes the existence of a drainage manhole in the dri eway which accepts a portion of the driveway runoff into a 55 gallon drum "french drain", hence reducing the impact of hardcover on the property by collecting a portion of the runoff and letting it soak into the ground. E) Average setback encroachment. Applicant feels that a reduction in size or a change in location of the proposed addition will not serve his purpose and intent for the addition. He is suggesting that the neighbor to the south has trees which already have the effect of providing a visual barrier, hence no substantial lake views currently enjoyed by the neighbor will be significantly impacted. -* Zoning Files #1106 March 13, 1987 Page 2 of 2 Staff would ask Planning Commission members to view applicant's property and also to visit the neighboring property to make your own determination as to the degree of view encroachment. The City rezoned the B-1 portion of the property to LR-IA in November of 1978 and concurrent with that rezoning adopted Resolution #961 (Exhibit F), establishing a lawful non-conforming commercial use on the now totally zoned residential property. The service station/car repair use has existed in one form or another up to 1983 when Craig Olson was granted a conditional use permit for the addition of transmission repair use. Intent of Resolution #961 & Non-Conforming Use Standards: The resolution establishing the legal non-conforming use of the property specifically spelled out limits and guidelines for the continued service station use but Item 6 of Section IV of that resolution notes the following: ”6. Other uses may be considered by the Council upon application and upon a finding that the proposed use is less non-conforming than the above permitted uses." This section has been the basis for similar ^iplications that sought to change the approved use to another commercial or non-conforming use. Paul Fahlin, a previous applicant, sought to relocate his bait shop operation to the subject property and maintain the gas sales. The application was denied, staff has enclosed a copy of that resolution noting the findings for denial (Exhibit G). In 1983, Council granted a conditional use permit to Craig Olson to allow the use to expand to limited transmission repair use. Review Exhibit H, the resolution that lists the required findings for approval of the intensification of the non-conforming use. The limited tranmission repair use was deemed compatible with service station use that had always existed on the property. Note that Council also responded to the economic pressures brought on by the oil crunch during that period of time for all independant small operators. Shull, 1125 Spring Hill Road Variances - Public Hearing/Resolution Pertinent Sections of the Code: A) Section 10.22, Subdivision 1 - Lakeshore Setback Regulations (amended) - Shall be 75 feet for all structures except that on lake- shore lots divided by a major thoroughfare, a lock box not in excess of 20 square feet in area and 48 inches in height is allowed on the lakeshore portion of the lot and requires a building permit from the City. B) Section 10.22, Subdivision 2 - Lakeshore Hardcover Regulations - No hardcover allowed within 75 feet of the shoreline of Lone Lake. Background on Application: In the summer of 1986, staff was asked by Council to review the many ramp-like structures that had been appearing along the shoreline, specifically the Casco Cove area on Casco Point. Clearly, this was not the only neighborhood where such structures were to be found - Casco Cove had heavy concentration of these ramps. The staff received complaints from neighbors concerning thiir *^iew of the lakeshore being blocKed with these "monstrosities". The ramps came in various forms of ugJy. Some were encased within a partial or total superstructure of odd planks/boards and others had huge brightly colored canvas coverings. These structures housed boats ranging in lengths of 20 to 40 feet for the whole year. The owners advised staff that the lake bottom cf the cove created major niiintenance problems because of the soft mucky bottom and presence of bank rats. Council ruled such structures were non-conforming requiring variances to hardcover and lakeshore setback standard. Review of Current Application: Mr. Shull is the first Orono resident to apply for a building permit to construct such a ramp. Per the Council's recent directive, Shull was advised of the need for variance approval. The ramp will consist of a track, six feet wide and fifty feet long. Note appoximately 20 feet of track will be on the land portion of the lakehsore. The remaining structure will consist of a cart and winch to convey the boat to and from the water. The boat will be stored on the shoreline during the warm months of the year. Hardcover, 75-250': Existing + 3700 s.f. or 21.1% Allowed 4375 s.f. or 25% Proposed + 4875 s.f. or 27.9% DISCUSSION Mr. & Mrs. Zullo are purchasing the property from Mrs. Stetler, and plan to raze the existing residence and construct a new home on the site. Since the lot is 100' wide where 140' width is required, the lot width variance is necessary. The required minimum side setback in this zone is 10', which the existing house does not meet. The new home is proposed to have a 12' setback on the west and 16' on the east. Staff recommends approval of t^o lot width variance. The second variance requested is for an 8' encroachment on the average lakeshore setback with the proposed deck. In viewing the site, and noting the topography, curvature of the shoreline, existing vegetation and existing views from the property to the east, staff feels that the 8' deck encroachment at a point 40' from the east lot line will likely not have a significant effect on the neighbor's lake views. We have not had any comment from the neighbor to the east. There will bo no apparent encroachment on any views of the westerly neighbor. Zoning File #1121 March Ilf 1987 Page 2 of 2 Thirdly, the applicant's survey (which we received with the house plotted on it 3-12-87) shows the proposed house, deck, and driveway being about 27.9% hardcover, over the 25% limit. This survey does not show any additional hardcover that would likely be taken up by sidewalks to reach the anticipated front entryway. Staff suggests that a reduction of the driveway to a minimal 25' X 30' apron and 10' driveway width will leave enough allowable hardcover to meet the 25% limits but it will be tight. Planning Commission should ask applicant whether there are any hardships to justify a hardcover variance; staff would recommend that no variance be granted for hardcover given that this is essentially new construction, and applicant should revise the driveway proposal and design an entryway area so that total hardcover in the 75'-250* zone does not exceed 25% (4375 s.f.). STAFF RECOMMENDATION 1. Staff recommends that the lot width variance be granted. 2. Staff recommends that the average lakeshore setback variance be approved as shown, finding no substantial encroachment on neighboring views of the lake. 3. The City staff has not been able to inspect the property over the winter months because of the obvious liability for the City. It is noped that the City staff will be able to get out on the island in early April or earlier if ice opens. The limited amount of time for the review of the current proposal by appropriate staff personnel will delay any final action on the part of the Planning Coirimission for the March meeting. In order to expedite the review process of the phased Comprehensive Cleanup, Temporary Improvement and Redevelopment Plan for the Veterans Camp, staff has divided the review into 3 phases: Phase 1 Temporary Conditional Use Permit for overnight camping with continued clean up program Planning Commission action April 20, 1987 - Council action - April 27, 1987. Phase 2 Conditional use permit/variances - staff's evaluation of proposed improvement of remaining structures and interim operation of day use/over night seasonal camp use (tenting and use of rehabilitated structures) - Planning Commission action May 18, 1987, Council action June 8, 1987. Phase 3 Conceptual Review/Direction to Applicant - Prior to filing of formal application for the future f^evelopment of 57 acre site. a) Amendment of RS District required b) Multiple variances to current RS standards c) Intent of RS District Planning Commission action conceptual recommendation May 4, 1987 Council action June 8, 1987 Background on Application - In 1985, the Veteran's Camp on Big Island was closed because of the potential health and safety hazards posed for the public who regularly used the facility. The structures were fire hazards. The entire facility had been allowed to deteriorate without any provisions for routine upgrading and maintenance. In that same year, the City commenced hazardous building proceedings against the State Department of Veteran's Affairs, responsible agent at that time. The Department of Veteran's Affairs has since relinquished all responsibility as trustee for the property. The Board of Governors of Big Island assumed complete responsibility for the property in late '85. On May 12, 1986 Council approved a temporary conditional use permit to allow work crews to camp o\ ernight at the facility. That same temporary conditional use permit's expiration date was extended by the Orono Council to December 31, 1986. The hazardous building proceedings have been placed in abeyance because our Council has been convinced of the good faith and commitment of the Veteran's group. Planning Commission should be advised that the clean up process does not require a conditional use permit, the overnight camping phase of the operation requires special approval. Review Exhibit I, a report by the new Board updating the City on the status of the clean up for the past year. Staff had originally planned to recommend action for the first review phase of the application - Temporary conditional use permit for work crew camping on weekends - but after reviewing the conditions of the original conditional use permit of 1986, staff realized or should I say remembered the difficulities involved with achieving the regular enforcement or supervision of activities on the island area. The applicant has to assume responsibility for getting staff people out on a regular basis for inspections. Gaffron advises that no one from the Camp has ever contacted him to confirm septic capabilities. The City cannot allow continued use of the Camp until septic tanks are uncovered and drainfield areas located. The Council did allow the repair of the lavatories for the use of the work crews. Ballantine Cabin, with bathroom fixtures, was allowed to be repaired for the sole use of the summer caretaker. Burning of the wooden debris did continue through the fall. The earlv winter freeze in November and the abnormal warm temperatures of the winter months have prevented staff from visiting the facility. An Orono resident who regularly hikes the lake Ig^ed advise that he had taken pictures in January of the Vet Camp. He otterea them to me and advised that he planned another visit in March and would again take pictures. The resident wishes to remain anonymous because he has "no axe^to grind".
