ZONING ADMINISTRATOR’S REPORT PERMIT Mabusth slated the applicant is requesting reconsideration of the payment of a sewer and water unrt charge for a second unit The City approved a multi-use dwelling application in 1993 McKinney ’s daughter. Gayle Siegler. and Attorney, Gary Eidsen, were present. Eidsen described McKinney ’s poor health and financial hardship Eidsen stated t^e ^ been no change in the multi use status of the property since 1962 which is the hal^k of this issue Eidsen stated the applicant has met the requirements of the conditional use permit, and the SAC and WAC charges are new charges, although there hw bw no changes in the use of the property Eidsen sees no basis for these fees^ The Waste Commission told applicant the charges should be grandfathered ^ disputes this citing an example in a follow-up letter of another property, which Eidsen says is not representative of this specific property Eidsen feels the charges are unprecedented, unwarranted, and create a hardship MINUTES OF THE REGULAR ORONO Cm' COUNCIL MEETING HELD ON SEPTEMBER 12. mT (Item #4 - McKinney - Cominucd) Cily Altotney Bairetl stated the City efToneously determined the number of units to be one, yean wg/o, and is now recovering the water and sewer access fees Barrett said the City is acting consistent with the statute and has the legal authority to recover said charges Mayor Callahan stated the Council will follow Barrett s advice that the City has the Milhofily to make these charges Councilmembers voiced their opinions with compassion for apphcwt's hardship, possible availability of grants, but felt a precedent would be set if tins charge was dismissed In response to Barrett's comments. Eidsen replied he feh the assumption of misassessment is not correct Neighbors, Mike Anderson, Greg Goodfellow, and Karen Cuff v oiced concerns over the fttiure of the applicant to meet all conditions of the conditional-use permit citing examples of illegal parking, bedroom sleeping arrangements without proper egress, and number of people dwelling in the residence Callahan stated the main concern here was the SAC charges. Mabusth said this was true but applicant must meet the conditional-use permit requirements as well. Mabusth stated an inspection found requirements completed and satisfory with the exception of a garage being misused as storage Gayle Siegler addressed the use of the garage stall as storage stating this will be remedied by winter Siegler instructed the tenants that the lower level was not to be used as a bedroom Callahan said the Council will not revoke the conditional-use permit as the applicant has the right to use the property as a duplex. Jrfibour stated the Council mend)ers will uphold the conditions of the permit Huir and Goetten agreed to enforcement and the need to set a time limit to meet the conditions Kelley asked that all matters be resolved by next meeting and for Mabusth to check that this was done Neighbor Anderson asked the opinion ot the City Attorney on the multi-use issue Barrett said pan of the problem with pre-existing use is in the zoning and arises not out of a City ordinance but with the Constitution of the United Slates The question is at what point a City would be found to have "taken" a property Barrett believes the continual use may raise that constitutional issue but within the context of our ordinances, as well as the constitution, allows continuance of use if used continually Because of this, the owner has the right to use the property as a duplex The device of a conditional-use permit is used by the City to know what the non-conforming uses are and what the dimensions and limits are of the use The neighbors asked for clarification of the best process in which to report violations of the conditional-use permit It was determined that phone calls tor expediency with follow-up letters for the City to have in print is the best method MINITES OF THE REGULAR OHONO CITY COUNCIL MEETING HELD ON SEPTEMBER 12. The Brown Road proiect should start this week. Goetten seconded, the approval of a joint meeting with the Park Conumssion for a work session to discuss, along with the consultant, the results of the park survey. The meeting is to be held Tuesday, 10/4/94, at 6:45 p m Ayes 5, Nays 0. r#19> CURBSIDE RECYCLING CONTRACT EXTENSION It was moved by Jabbour, seconded by Goetten, to approve a three-year contract for curbside recycliiig pick-up with E-Z Recycling for an annual amount of $65,075. As part of the tank removal process some contamination of soils from ftiel leakage was detected. In order to determine the extent of the contamination seven soil borings and four monitoring wells were installed on the site. Groundwater samples were collected from the monitoring wells in May and July of 1994. The findings from three of the monitoring wells indicate no problems with contamination. However, the findings from one of the wells indicate a higher level of contaminants than anticipated. Braun has recommended that two additional soil boring and one additional monitoring well be installed to fully define the extent of the contamination. Groundwater will be sampled and analyzed on a quarterly basis for one year. The estimated cost for this work is $12,302. Greg Browne, of Braun Intertec, will be present at the Council meeting to explain the findings of the Lnitial round of groundwater sampling, and the need for the recommended additional monitoring. Introduction Additional work is necessary a the City of 0>ono property located at 1285 Brown Road South because the full horizontal extern of groundwater contamination has not been defined for the area downgradient of a former 3,000-gallon unleaded gasoline underground storage tank (UST). Br^n Intertec observed the tank removal and performed the required sampling and analysis activities. Due to the expected request from the Minnesota Pollution Control Agency (MPCA) that long term groundwater monitoring be performed at this site, costs and a tentative timetable for a year of quarterly sampling have been included. B. Scope of Work Braun Intertec proposes the following scope of work to address the possible migration of dissolved-phase petroleum groundwater contamination downgradient from the area of die former 3,000-gallon unleaded gasoline UST: • A Monitoring well permit will be obtained prior to drilling activities. • Conducting two soil borings, at locations to the south of and parallel to Crystal Avenue, across the street from the site (south of monitoring well MW-4). The borings will be conducted to an approximate depth of 20 feet. • Should additional borings be required due to the detection of soil organic vapors in the two scheduled soil borings using the PID, charges will be assessed on a unit basis. • Collecting soil samples at 2.5 foot vertical intervals using a split-spoon sampler. • Field-screening soil samples for the presence of organic vapors using a photoionization detector (PID). • Collecting one soil sample from the boring which indicates petroleum contamination based on FID Jar-headspace readings. The soil sample will be collected from the inter\'al where the highest PID Jar-headspace reading was recorded above the water table. Should both borings indicate 'clean' conditions based on field readings, the soil sample will be collected from one of the borings from the interval directly above die apparent water uble. The soil sample will be analyzed for benzene, ethylbenzene, toluene and xylenes (BETX), methyl tertiary butyl ether (MTBE), gasoline range organics (GRO), orthophosphate as phosphorous, total phosphorous and total kjeldahl nitrogen (TKN). City of Orono Public Works Department Project No. CMKX-93-0163 September 14, 1994 Page 2 ! I A monitoring well (MW-5) will be installed in the soil boring which indicates ’clean- conditions. Should both of the soil borings indicate "clean" conditions, a decision will be made as to which boring the monitoring well will be installed. The monitoring well will be completed to an approximate depth of 20 feet below ground surface. The monitoring well will be developed by a Braun Intertw field technician the day following installation. A vapor risk assessment and survey will be conducted by a Braun Intertec field technician to assess the possible impacts of groundwater contamination to utility trenches and sewers. Monitoring well MW-5 will be sampled following development. The groundwater sample will be analyzed for BETX, MTBE, GRO, orthophosphate as phosphorous, total phosphorous and nitrate plus nitrite as nitrogen. A bailer blank will also be collected and will be analyzed for BETX. Upon receiving the soil and groundwater analytical results from conducting the two soil borings and the installation of MW-5, Braun Intenec will complete the Remedy Investigation/Corrective Action Design (Rl/CAD) Report in accordance with MPCA guidelines. It will be recommended in the RI/CAD that monitoring wells MW-3, MW-4 and MW-5 be sampled quarterly for one year following development of MW-5. ChstfgM associated with this task have been included in this cost proposal. Should the MPCA require additional wells to be sampled, and therefore, additional laboratory analysis, costs will be assessed on a unit basis. The groundwater samples collected from MW-3, MW-4 and MW-5 will be analyzed for BETX, MTBE, GRO, orthophosphate m phosphorous, total phosphorous and nitrate plus nitrite as nitrogen. A b^er blank will also be collected during each sampling event and will be analyzed for BETX. Monitoring wells MW-1 and MW-2 will be used for water level measurements only. Upon receiving each of the first three sets of quarterly groundwater analytic^ result, Braun Intertec will prepare Quarterly Monitoring Reports in accordance with MPCA guidelines. Upon receiving the groundwater analytical results from the final quarter of groundwater sampling, Braun Intertec will prepare an Annual Monitoring Report in accordance with MPCA guidelines. This report will contain recommendations based on the data collected to date as to a request for site closure, additional monitoring, or corrective action. Methods Soil Borings and Monitoring Well insullation The penetration test borings will be performed with a truck-mounted core and auger drill using 6 1/4-inch auger. All down-hole equipment will be steam cleaned prior to use, and clean auger will be used for each borritule. Sampling for the borings will be conducted in accordance with ASTM D 1586 "Penetration Test and Split-Barrel Sampling of Soils." Using this method, the bore hole will be advanced with the hollow-stem auger to the desired test dq>th. Then, a 140-pound hammer falling 30 inches will drive a standard, 2-inch CD, split- barrel samplCT a total penetration of 1 1/2 feet below the tip of the lead flight of the hollow- stem auger. The blows for the last foot of penetration will be recorded and are used as an index of soil strength characteristics and for stratigraphic correlation. Samples will be taken at 2 1/2-foot vertical intervals to the termination depth of the borings. The monitoring well will be constructed of two-inch schedule 40 PVC riser pipe and a 10-fooi, schedule 40, 0.010-inch slot screen. A six-inch protective casing with locking cover will be embedded in the surface seal around the monitoring well for protection. Soils Classification u i. Soils encoumered in the borings will be visually and manually classified in the field by the crew chief in accordance with ASTM D 2487 "Classification of Soils for Engineering Purposes" and ASTM D 2488 "Description and Identification of Soils (Visual and Manual Procedure)." All samples will then returned to the laboratory for review of the field classifications by an environmental geologist. Representative samples will remain in our office for a period of 60 days to be available for examination. Organic Vapor Screening During the field investigation, soil samples will be examined visually by an environmental geologist for staining or ether apparent signs of contamination. In addition, soils will be scanned for the presence of organic vapors using a PID. The PID will be equipped with a 10.2 eV lamp and will be calibrated to a benzene standard. Jar Headspace Procedures Soils recovered from the split-barrel sampler will be additionally analyzed with a PID using Jar headspace procedures. The jar headspace procedure consists of placing the soil sample to half-fill a 250 ml clean glass jar. The opening of the jar is subsequently covered with aluminum foil and the cap tightly screwed on. The jar is vigorously shaken for 15 seconds and allowed to set for at least 10 minutes. Following the 10-minute period, the sample jar is a«ain vigorously shaken for 15 seconds. The cap is then unscrewed and the PID probe is inserted one-half of the headspace depth. The highest reading observed on the PID is then recorded. Chemical Groundwater Sampling Groundwatff samples will be collected by an environmental geologist using clean, VOA glass, SCTew-top vials with Teflon*-lined caps, labeled, and transported to our laboratory under refrigerated conditions using Braun Intertec chain-of-custody procedures. Chemical Analysis All analyses are performed using EPA or other recognized standard procedures. Data will be reviewed prior to release. Specific information on standard operating procedures, detection limits, and quality control measures is available upon request. i E. The first choice is Neil Melton who currently is the director of the Center for Criminal Justice and Law Enforcement. That school is where the pre-service basic police skills are taught to future police officers. He has been a full-time instructor there for the past eight years. Prior to that, he was a full-time police officer with Bloomington Police where he served as a patrol officer, field training officer, and detective. He also served in Viet Mam in a military police unit. He has an excellent background of experience and training. The second choice is Bill Persell who has worked as a part- time officer for Oak Park Heights for the past ten years. He has performed 700-800 hours of uniformed patrol each year. Additionally he has worked nine years at the Minnesota State Fair doing uniformed foot patrol during the twelve days of the Fair each year. Mr. Persell previously volunteered as a police reserve for five years in Hew Brighton and five years in Minneapolis. He also served seven years with the Army National Guard and was a training NCO. He has solid experience doing exactly the type of general patrol that would be expected here in Orono. There were two other finalists who interviewed well and had good previous experience. David Rodriguez withdrew from the process when we asked him to complete the background investigation packet. Denise Gilbertson accepted a full-time position with the St. Paul Police Department. The other four finalists we did not feel were suitable for employment at Orono for a variety of reasons. I request that we ask for conditional approval from the council to hire Neil Melton and Bill Persell pending the successful background investigation and completion of physical and psychological tests. Once these two finalists are hired, we will have an est2d>lished eligibility list we can use during the next two years should additional openings occur. Command Responsibility The Fire Chief of Long Lake or his Deputy shall have the sole and exclusive right and responsibility to prescribe the manner and method of giving the alarm for fire within the Total Fire Service Area and to prescribe the manner and method of responding to calls and rendering the services contemplated. The said Fire Chief or his Deputy shall immediately upon arriving at the scene of any alarm or fire ernergency have the sole and exclusive responsibility and authority to direct and control any and all fire fighting and the emergency operations at such scene or scenes. 5. Volunteer Fire Fighters of the City of Long Lake Personnel assigned to provide fire protection services in the Contracting Cities shall be volunteer firemen of the City of Long Lake, which City shall assume all obligations wi^ regart to Worker's Compensation, Fvemen's Relief Association, withholding tax. Nature of Long Lake Undertaking In no event shall this agreement be construed to fix upon Long Lake any responsibility or liability to the Contracting Cities or to third parties which are greater or different in kind than the responsibilities and liabilities borne by the Contracting Cities if they were providing such services through their own fire departments. 7. Liability Insurance Long Lake shall carry liability insurance in the amount of $1,600,000.00 protecting itself against damage claims of its fire fighters for personal injury sustained while in service within the said limits of the Contracting Cities as hereto set forth. And further, Long Lake shall carry liability insurance in the amount of $1,600,000.00 saving both parties harmless so far as acts of the City of Long Lake, its fire department and its fire fighters are concerned. The cost of such insurance shall be a part of the costs attribLted to the operation of the Long Lake Fire Department and will be included in the Annual Operating Budget. Nothing in this contract shall be construed as waiving the statutory liability limits of any city which is a party to this contract. 8. Budget Package 8.1 Definitions A. The Annual Operating Budget refers to the calendar year budget of the Long Lake Fire Department during the first year of any three year period covered by this agreement. This budget will become the official Annual Operating Budget upon ratification by the Contracting Cities. The Annual Budget may include both operating and Major Equipment items and incorporates all costs of operations including, but not limited to. the rental of space for the fire department and discretionary funding gHbe Fire Benefit Association Retirement Fund. B The Year Two Budget refers to a single number, not to be exceeded, dollar amount which will be used as the budget limit for the next calendar year In the event the Annual Budget Package is not ratified by all Contacting Cities by October 1 of the first year of any three year period covered by this agreement. C The Year Three Budget refers to a single number not to be exceeded dollar amount which will be used as the budget limit for the next calendar year in the event the Annual Budget Package has not been ratified by ail Contacting Cities by October 1 of the second year of any three year period covered by this agreement. D. The Annual Budget Package refers to the grouping of the Annual Operating Budget, the Year Two Budget and the Year Three Budget which is submitted as a unit by the City of Long Lake for ratification by the Contracting Cities. The Annual Budget Package must be ratified by all Contracting Cities prior to October 1 in the year submitted to become the valid budgets for the following three years. The Annual Budget Package must be accepted or rejected in its entirety. 8.2 Budget Process By August 15 of each year during which this agreement remains in effect, the City of Long Lake will provide an Annual Budget Package covering the cost of fire protection for the next three calendar years. The budgets presented to the Contracting cities must have been presented to the Joint Advisory Committee prior to August 1 for discussion and review. Although it is expected that the Annual Budget Package which is provided to the Contracting Cities by the City of Long Lake will have the consensus support of the Joint Advisory Committee, that is not a requirement since each Contracting City has the opportunity for final ratification or rejection. 9. Temi of this Aoreement. This Agreement is for three contract years and covers the period January 1, 1995 through December 31, 1997. A contract year covers the period January 1 through December 31 of a calendar year. This Agreement will become effective upon ratification by the Contracting Cities of alt Its parts including Appendix C which contains the initial Annual Budget Package. The term of this agreement may be extended as described below. 9.1 On each occasion that the Annual Budget Package is ratified by October 1 by the Contracting Cities, this Agreement will be renewed for a total period of three contract years beginning with the contract year following the current contract year. The details of this process are covered in sections 9.2 through 9.5 following. 9.2 When during the first contract year of any three year period covered by the Agreement the Annual Budget Package is ratified by Contracting Cities by October 1, this Agreement shall be extended by one contract year. When during the second contract year of any three year period covered by the Agreement the Annual Budget Package is ratified by Contracting Cities by October 1, this Agreement shall be extended by two contract years. When during the third contract year of any three year period covered by the Agreement the Annual Budget Package is ratified by Contracting Cities by October 1, this Agreement shall be extended by three contract years. Annual Audit of Actual Costs The Contracting City understands and agrees that it impossible to project with complete accuracy the actual costs of labor and equipment as well as the service to be required by each Contracting City for the forthcoming contract year and thereby hereby agrees to a yearly audit to adjust the prior year's estimated cost of service as set forth above to the actual costs incurred by the City of Long Lake. On or before April 1 of each year the City of Long Lake will tabulate actual cost of the fire department budget fo^ the prior contract year and will submit to the Contracting Cities a summary of the actual costs. The actual costs set forth for the prior contract year may result in either a surplus or deficit with respect to that year's Annual Operating Budget. Any surplus shall be refunded to the contract cities in the same ratio as the cost allocation formula. Any deficit shall be funded by the contract cities in the same ratio as the cost allocation formula. It is expected that expenditures will remain within the Annual Operating Budget amounts and will only exceed such budget amounts in the case of an extraordinary event or when mutually agreed to by the Contracting Cities as provided in Section 12. 11. Contract Payments The City Budget Share(See Section 16.2) of each Contracting City shall be paid in equal quarterly installments on January 1, April 1. July 1 and October 1 of the next contract year by the Contracting City to the City of Long Lake. Unforecasted Expenditures Notwithstanding any of the above, the Contracting Cities shall have the right to be heard r<*garding any proposed expenditures which are not identified in the Annual Operating Budget and which exceed $5,000.00 . Notice of such proposed, non-budgeted expenditures shall be given in writing to the Contracting Cities prior to actual expenditures for such items and the Contracting cities shall thereafter have 21 days in which to approve or disapprove the same in writing and if there is no response which disapproves the expenditure, it is agreed that such proposed expenditures may be made and the cost thereof shall be included in the Annual Operating Budget as if ratified originally. 13. Arbitration If a Contracting City is aggrieved by the determination of the City of Long Lake as to the allocation of the actual costs of the prior year's service, the Contracting City may appeal said determination within 30 days after receipt of the City of Long Lake's audit. Said appeal shall be in writing and shall be addressed to the City of Long Lake asking for arbitration by a board of arbitration. The Board of Arbitration shall consist of three persons; one to be appointed by the City of Long Lake, one to be appointed by the appealing Contracting City, and the third to be appointed by the two so selected. The name of each arbitrator shall be submitted in writing to the other party. In the event that the two arbitrators so selected do not appoint the third arbitrator within 15 days after receipt of written notice of appointment of either of the first two arbitrator's, the Chief Judge of the District County of Hennepin County shall have jurisdiction to appoint, upon application of either the Contracting Cities the appealing Contracting City, the third arbitrator to the Board. The third arbitrator selected shall not be a resident of either Contracting City, and shall be a city manager or administrator. The arbitrator's expenses, not including counsel fees, incurred in the conduct of the arbitration, shall be divided equally between the parties to the arbitration. Notwithstanding that, the Cities of Long Lake and Orono extend to the City of Medina the Fire Protection terms of this Agreement during the years 1994, 1995 and 1996 with the following Special Provision to allow the City of Medina to review its Fire Protection requirements in more detail before committing to this Agreement for three years. During the Penod Covered (19.1), City of Medina ratification of 1995 and 1996 Annual Budget Packages is not required for the term of the Agreement to be extended. The names of the hunters have been selected in cooperation with the DNR from members of the Minnesota Bow Hunters Association. In following years hunters would be selected from four hunting organizations in the State which certify their members after completing training classes. The Park Reserve works with other cities including; Medina, Maple Grove, Dayton, Victoria and Minnetrista in hunting permits. These cities license the Park Reserve and the Park Reserve licenses the individual hunters. (The Park Reserve is treated as an individual licensing authority.) The ordinance amendment in 1987 allowing shot gun hunting in Baker Park included the conditions that all abutting property owners be notified by letter 10 days in advance and appropriate signage be posted around the boundaries to limit unauthorized access during the hunt. Although the proposed bow hunting site is owned by the Park District, this area is not open to the public although it is possible for the public to access this area.
