ZONING ADMINISTRATOR'S REPORT (#5) #1778/#1779 ANDREW GOE'TTEN, 1385 FOX STREET - FINAL SUBDIVISION APPROVAL - RESOLUTION NO. 3377 Goetten left the table for the following item. Mayor Callahan moved, Jabbour seconded to adopt Resolution No. 3377 approving #1778/#1779 Final Subdivision for Andrew Goetten, 1385 Fox Street. Ayes 3, navs 0. Goetten abstained. MAYOR/COUNCIL REPORT (#6) PARK COMMISSION LIAISON SCHEDULE After brief discussion, the Council accepted the Park Commission Liaison Schedule as submitted. Kelley inquired about the responsibility of the City to inspect the Washington Scientific plant for hazardous chemical handling to ensure that they are being handled properly. Gerhardson responded that there are several agencies that monitor the handling of hazardous wastes, and those agencies conduct periodic inspections to ensure that there are no code violations. He noted that it was not up to the City to monitor this, as the City receives a report from the State agencies regarding hazardous waste inspections several times annually. Moorse concurred, and noted that this is done via field inspections which are done periodically by the State agencies. Jabbour commented that he felt it would be a good idea to monitor the plant to ensure that the inspections were being done and that hazardous materials were being handled properly. Mayor Callahan commented that the City does not have any criteria by which to regulate hazardous waste handling and Gerhardson stated that every company or business which uses hazardous chemicals is licensed by Hennepin County, and there is a tracking system in place to monitor those uses. Moorse stated he had contacted Washington Scientific, Industries (WSD and they had indicated that while orders were dow»i, they had reduced their number of employees as much as they intended to, and were simply waiting for more orders to come in. He stated they had indicated they were not going out of business. Jabbour commented he felt th'' City should send them a letter of support, as they were a major industry in Orono. MINUTES OF THE REGULAR ORONO CITY COUNCIL MEETING HELD JANUARY 10, 1994 MAYOR/COUNCIL REPORT CONTINUED Kelley noted that there was u movement afoot to have the ice facilities moved onto the school property to facilitate the ^Is hockey progrram. Nothing formal had been done yet, but he felt the Council should be aware of this movement. ENGINEER REPORT There was no Engineer's report. CITY ADMINISTRATOR'S REPORT (#7) LONG LAKE WATER QUALITY PUBLIC INFOR!^IATION CO^EvIITTEE Moorse reviewed the project and asked for Council input regarding appointing someone to serve on the Water Quality Public Information Committee for Long Lake. Mayor Callahan commented he felt they should give this matter some thought before deciding who would serve on the committee. He also felt it should be determined what the body was going to do before appointing someone. Discussion ensued regarding the various agencies involved. Councilmembor Hurr arrived at the meeting at 7:50 p.m. (*#8) PARK COMMISSION REAPPOINTMENTS Jabbour moved, Goetten seconded, to reappoint Richard Flint, Sysan Wilson and Sherokee Use to the Park Commission. Ayes 5, nays 0. (#9) 1994 APPOINTMENTS - RESOLUTION NO. 3378 Mayor Callahan requested that the Acting Mayor be changed from Diann Goetten to Gabriel Jabbour. Hurr stated she did not want to serve on the Cable Commission as she did not have cable television and she asked Jabbour to replace her on that body. Jabbour agreed. Hurr moved, Goetten seconded, to adopt Resolution No. 3378 as amended, designating selected appointments for the Year 1994. Ayes 5, nays 0. (*#10)ANNUAL PURCHASE OF NEW SQUAD CARS Jabbour moved, Goetten seconded, to approve the purchase of two police squad cars under the State of Minnesota contract from Superior Ford at a price of $13,951 each. (#15) SCHEDULE l^l^BLIC HEARING DATE FOR CDBG FUNDS Moorse stated that February 14, 1994 had been selected as the Public Hearing date to reallocate the CDBG funds which were allocated for developing a park plan for the City of Oronc, but which had not been used. These funds must be reallocated to another project from the same year, and staff proposed they be allocated to the Housing Rehabilitation program. These funds can be replaced with future CDBG monies for the development of a park plan later on. He noted that if the City agreed to accept the donation, a representative of the Council and the Park Commission should attend a meeting when and where the check would be presented. So that we may proceed with planning projects, it is necessary to meet in a work session with Council to di^uss the MSA street inventory, the financial condition of the program, the appropriate design for MSA roadways in Orono, and the City’s ongoing program of major roadway maintenance airi reconstruction. The MCWD is reqi^sting that the cities of Orono, Medina and Long Lake each appoint a representative to a public information committee that will work to educate and build support concerning improving the water quality of Long Lake. The Couik U tabled action on the appointment of a representative to the public information committee in order to obtain more information regarding the project and regarding the purpose of the public information committee. A summarj’ of the Long Lake water quality project, prepared by Mike Gaffron, is attached. One item in the project that requires more detailed review is the construction of a sedimenution pond in Orono just north of County Road 6, between Long Lake Boulevard and Tanglewood Road. This pond is to be designed to intercept nutrients from the creek before they reach Long Lake. The pond is proposed be 8 acres in size and 11.5 feet deep The projected cost is $1,300,000. This pond is in Phase II of the water quality implementation plan. At this point, the MCWD does not have funding for the pond and has not had any discussions with the owners of the land on which the pond would be constructed. This is an item that needs additional review in terms of benefit to water quality versus costs (both monetary and impacts on the area). Public Information Committee The purpose of the public information committee is to encourage public support and involvement in efforts to improve the water quality of Long Lake. The major emphasis of the public information program will be urban fertilizer and yard waste management, livestock waste management, and agriculmral soil conservation best management practices. The committee will have representation from the cities of Long Lake, Orono and Medina and from the DNR, the Hennepin Soil and Water Conservation District, the MPCA and the MCWD. The committee will meet every two months to set goals, develop a long term plan, and implement the plan in order to inform and educate the public on the water quality project and what they can do to help improve the water quality of Long Lake. « The city’s representative on the committee could be a couiKilmember, a staff person or an interested citizen. The Council may want to determine whether there is a citizen who lives on Long Lake who would be interested in serving on the committee. Fish surveys indicate mainly rough species (bullheads and suckers), with substandard counts of giinc fish (bass and northern pike). The watershed contributing to the lake is primarily woodland, cropland and horse pasture. • Blue-green algae blooms in the summer detract from swimming and are directly related to Long Lake’s phosphorus loading. • Dissolved oxygen is generally too low to support game fish. Reduemg the phosphorus load wiU raise the oxygen levels and enhance game fish populations. . The lake’s internal phosphorus load (from bottom sediments) and exte^ ^d (enterSg from the tributaries) are about equal, and account for 90% of the total phosphorus inputs to the lake. . Hydraulic residence time is short (1.3 years, compared to 25 years for ^e InLieionka); therefore phosphorus load reductions should show immediate water quality improvements. Current Maaag«nent Strategies The study indicated a number of lake managemem strategics already are practiced in the Long t watershed: Street sweeping. Stormwater maiugement. On-site sewage treatment controls Zoning controls. Algae control. Implementation Plan The implementation plan has the following objectives; • Improvement of aesthetic quality. • Restoration of swimmable conditions • Restoration of recreational fishery. An eight-acre sediment basin. 11.5 feet deep, is proposed m Orono ^ wtere the creek crosses (between Long Lake Boulevard and Tanglewood Road). • In this area the creek winds through wooded slopes. 17 ^ vard . This may have some impact on both summer and winter use of the lake. Project Costs The entire project is anticipated to cost $3.5 million. These meetings would educate the public on techniques they can apply to reduce nutnent loadings and improve lake and watershed aesthetics. Other topics, such as fishery management, might be incorporated. The meetings would also update the public on how the project is proceeding and answer questions they may have concerning the project or their possible involvement in it. As an element of the PubUc Information Program, the costs associated with the Committee will be approximately S 16.200 annuaUy assuming nine members meeting su times annuaUy; 10 hours per individual per meeting, and S25/hour plus 25 percent fringe benefits and other direct costs (mailing, printing, travel, etc.). Implementation of the specific activities recommended by the Committee will have separate costs. The annual cost estimated in Table 4 was 539,672 for year I of the program and 525,272 for each subsequent year. As discussed above, the specific tasks to be incorporated into the implementation of the PubUc Information Program will be determined by the Committee. J I 3. S<dimtntatbn Basica a. Mcmitcr.ng indicated that levels of phospnorus and sediments were rdadvely high at stream site S-3, where this stream passes under County Road 6 prior to discharging to the lake. A sedimentation basin wiU be created at this site to reduce sediment and nutrient loadings. The basin 'will be created in subwatershed LLC-7 just norA of County Road 6 (Figure 6). Approximately 10.0 acres of land will be fequired to create the 8.0-acre basin, and some I /4,0(X) cubic yards of soil will be removed to achieve an avenge depth of 11.5 feet. Once created, the peripheral area 'will be sodded to stabilize it and improve aesthetics. Indigenous wetland trees and shrubs will also be planted around the basin perimeter. . CL 4. The number of part time officers was increased from one to three in 1992 to increase the availability of part time officers. The part time officers generally work one or two 8 hour shifts per week subject to need and subject to their individual availability. The three part time officers each have other positions m the public safety field, cither full time or part time. Over the past year, two of the three part time officers have had limited availability. This has caused tte third officer to work a larger number of hours, sometimes 30 to 40 hours in one week. It is preferable, both from the city’s perspective and from the part time officer perspective, to limit the scheduling of individual part time officers to one to two shifts per week. Recommendation It is recommended that in order to increase the availability of part lime officers to cover open shifts, and to enable the work hours to be spread more evenly among the part lime officers, two additional part time officers be hired. The addition of two part time officers docs not require an increase in binding for part time officers. The part time officers will be scheduled within the current budget amount. City Administrator January 19, 1994 .4 SUBJECT: Use of Drug Forfeiture Funds % Background State law allows the polke to seize money and property that is related to violations ot drug laws. When the Court awards the nwney to the police, the County AKomey receives 20%, the State receives 10% and the police department may retain 70% to be used for specific law enforcement purposes. The money may be used as “buy money" for »Jditional enforcement, it may used to pay salaries for extra drug enforcement, it may be used for other drag enforcement or drug abuse prevention efforts, or it may be used for other general law enforcement purposes. During the past two years the only drug money used by the police department has been for "buy money" for drug dealing investigation. The current balance in the drug forfeiture fund is $10,3*98.58. An additional $4,489.10 will be added to this fund in the first part of 1994, bringing the total to $14,887.68. A policy and procedure is needed to provide guidelines for how the drug forfeiture money may be used and how its use is authorized. Proposed Policy and Procedure Regarding the Use of Drug Forfeiture Funds Policy; Drug forfeiture funds may be used tor law enforcement purposes including; "biy money" for drug investigation, expenses related to extra drug enforcement such as police officer salaries, other drug enforcement or drug abuse prevention efforts, minor capital itenK that are beyond the funding able to be provided through the regular budget, and other law enforcement related purposes. Procedure: In the case of "buy money" for drug investigations, drug forfeimre funds may be used at the discretion of the Police Chief . In the case of all other uses, the request for the expenditure of drug forfeiture funds must be approved by the City Administrator and authorized by the City CoutKil. This compares to a total investment portfolio, at cost, on December 31, 1992 of $8,745,203. Thank yfiU 1 LAKE MINNETONKA CONSERVATION DISTRICT MEMORANDUM TO: FROM; RE: DATE: LMCD MEMBER CITIES BILL JOHNSTONE, CHAIR OF LMCD LMCD DISSOLUTION RESOLUTION JANUARY 14, 1994 As many of you know, the Cities of Orono and Spring Park have passed resolutions requesting the dissolution of the LMCD. Several other member cities have expressed, either formally or informally, their support for the continuation of the LMCD. Under the LMCD's enabling legislation, Minn sota Statutes, Section 103B.605, Subd. 4, the LMCD "may be dissolved by a decision of the governing bodies of three- quarters of the municipalities in the district." The LMCD consists of 14 member cities. The Board of the LMCD believes that the question of dissolution needs to be resolved. Continuing uncertainty with respect to this issue serves no important purpose and impairs the LMCD's ability to carry-out its responsibilities. If the requisite number of member cities believe that dissolution is appropriate, then the decision should be made and alternative arrangements for management of the lake should be developed and implemented with appropriate legislative approval. Alternatively, if the requisite number of member cities do not favor dissolution, the Board believes that this decision should be made formally and documented. Members of the Board of the LMCD have discussed the issue of dissolution with their respective member cities and other interested persons. Based on those discussions, a substantial majority of the Board supports the preservation of the LMCD. At the same time, the Board is aware of the concerns and criticisms of some of the member cities and others and is committed to working with the cities to address the criticisms and concerns in a fair and responsible manner. Attached to this Memorandum is a form of resolution regarding dissolution of the LMCD. The Board of the LMCD requests that the city council of each member city that has not formally acted or the question of the LMCD's dissolution consider the resolution as soon as is convenient. If your city has taken formal official action on the question of dissolution, please send a certified copy of the action to the LMCD's offices for filing. I would be happy, as would each of the Board members, to discuss this matter further or respond to your questions. Recitals. The City is a member of the Lake Minnetonka Conservation District (the "LMCD") organized under Sections 103B.601 through 103B.691, Minnesota Statutes. Pursuant to Section 103B.605, Subd. 4, the IMCD may be dissolved by the decision of the governing bodies of three-quarters of the municipalities thereof. Certain cities within the LMCD have adopted resolutions requesting its dissolution. The Board of Directors of the LMCD has requested that all member cities take formal action on the question of dissolution thereof. 2. Determination and Decision. Yet nearly one out of every three Minnesotans said they were victims of cnme m 1992 and violent crimes committed by juveniles have increased by 60 percent since 1988. Too many people no longer feel safe in their homes, schools and communities. I believe the state must play a key role in reversing this alarming trend. In 1992 and 1993, our office worked very closely with the state legislature to implement a comprehensive package of laws which included longer prison . serious violent crimes including murder, rape and drive-by shootings; doubled fundmg for victims’ programs; and directed more resources .o key prevention programs for juveniles and children. But we must go further. This year I am asking the legislature to support a senes of measures which includes a mandatory minimum 15-year prison sentence for ^ose who commit three crimes against a person. CurrenUy violent offenders serve a wide ^ sentences. But in the case of the dangerous predators, sentencing has the potential to be woefuUy inadequate. Our aim is to incapacitate all violent offenders who haw demonstrated a pattern of predatory’ behavior and who threatM the safety ^ o^cn. U the legislature accepts our proposal, these dangerous repeat offenders wiU be locked up for at least 15 years, and perhaps longer. Three times, and they're out ♦ In addition, I have proposed to make it easier to certify a juvenile as an adult she commits a crime with a weapon. I want to eliminate laws that currently restrict those who work with youth from sharing critical informauon about potenUj^y dangerous and troubled young people. In addition, we must stop erasing juvemles when they reach age 18 and require prosecutors to pul>l;c‘y of times that gun possessions are plea bargained out of a cruninal trial. That is why I have also proposed the acation of summer service camps for at-risk youth, and have renewed our commitment to providing conflict resolution training in schools. We can make a real difference in the lives of young; people if we reach them early with effective intervention programs. Too many Minnesota children are learning violence everyday in their homes, neighborhoods and from the media, and too many women are quietly living the painful existence that comes with domestic abuse. 1 have pledged more resources to help children and serve victims in the next budget cycle. We all know that violence often begins at home and this is where it must end. Suffer sentencing, more accountability, an effective prevention agenda and a greater emphasis on services to victims will go a long way to curb violence. Still, government cannot change a culture. Carlson, joined by Independent-Republican legislators, today highlighted the major elements of his 1994 anti-crime strategy in a speech to the Thomas-Dale Block Club in St. Paul. Key components of the plan include esublishing a pilot youth service summer camp for juveniles and i proposal to require those convicted of a third violent crime to serve a minimum of 15 years in prison. “Throughout our violent crime conference last week, 1 repeatedly heard that Minnesota must maintain a Strong prevention agenda and reaffirm our values,” Governor Carlson said. This means we virill continue our major emphasis on children, and we will not be afraid to define and embrace those values that yield strong families and responsible communities. "At the same time, we must realistically deal with the here and the now," he said. Today 16-year-olds are arrested more than any other age group - this is a frightening signal that says violence is likely to escalate in the short-term unless we take action to stop it." Governor Carlson and Republican legislators propose the creation of highly disciplined summer service camps for young people who are identified as "at-risk" by coum and social service workers. Juveniles would engage in educational activities znd rigorous community service work for which they would receive modest compensation. Camps would give juvenile court judges an alternative sentencing option for young people who require close supervision yet demonstrate a willingness to improve. The Governor pledged to commit more state dollars to fund local police efforts to establish block clubs and expand community policing. "Organizations like block clubs bring neighbors together with neighbors and enable them to invest in their communities and truly make a difference." Governor Carlson also proposed a law which would guarantee that those convirtcd of a three crimes against persons a minimum mandatory sentence of 15 years. T’- ■ - X REPORT OF THE 1992 LAKE ACCESS TASK FORCE INTRODUCTION The Lake Access Task Force was authorized by a LMCD resolution in January, 1992. The purpose of this task force was to meet lake access objectives in the LMCD Management Plan for Lake Minnetonka. These policies and objectives for lake access are not new. The need for public access to the lake was earlier considered in the Governor's lake access study of 1983, and also in the Metropolitan Council Lake Access study of 1986. The goals adopted by the 1992 Task Force were to: 1. Affirm the goal of 700 car/trailer parking spaces for free public access to the lake. Establish standards for car/trailer parking. Conduct an inventory of existing car/trailer parking and also count potential car/trailer parking. Prepare parking agreements between the LM^D and the cities and/or agencies which operate the parking. Explore prospective access sites. Examine the possibility for commercial marinas to provide some free public lake car/trai]er parking. 2 3 5 6 The membership of this task force included representatives from member cities, representatives from agencies sharing responsibility the management of Lake Minnetonka, and members from interested citizen's groups. For a complete list, see Appendix _ _. Subcommittees of this group conducted detailed studies and submitted their reports to the Task Force. Meetings began in March of 1992 and continued through May of 1993. Staff from the LMCD ana the DNR assisted. Participants gave generously of their time and support. The LMCD Lake Access Committee drafted the final report of the Task Force. Appendixes to this report contain material to document: 1. Standards for car/trailer parking 2. Inventory of car/trailer parking 3 Model parking agreement 4. Access site criteria for evaluation 5. Roster of members 6. Proceedings summary 7. Public access map Goal of 700 Car/Trailer Parking Spaces The Task ^orce agreed with the goal of 700 rar/trailer parking spaces located at free public accesses to the lake. This agrees with the 1991 Management Plan. It is compatible with the standard of one parking place for every 20 acres of water surface. This is the standard for the DNR public water access program in the mecropoUtan area. It is also consistent with that adopted by the Metropolitan Water Access Coircnittee. This committee includes the Metro Council, the Department of Trade and Economic Development and the DNR. The goal of 700 was first established by the task forces of 1983 and 1986. It is conservative considering that the demand tor boating recreation exceeds 20 parking spaces per acre on most of the metropolitan area lakes. Compared to standards in other PJ^ts of the country, it is also conservative. Some states provide 1 parking space per 10 acres of water surface. The Task Force considered lowering the goal. The Lake Minnetonka Lakeshore Owners Association (LMLOA) suggested that 700 parking spaces would increase boat density and reduce the enjoyment of the lake by lakeshore users. After discussion the number was 700. Task Force data made clear that more than 700 car/trailers are par)tec[ on a good day at Lake Minnetonka. Subcommittees discussed equitable distribution of parking at Lake Minnetonka. The principle adopted in earlier task force reports was endorsed. Each city is encouraged to contribute to the overall goal. Standards for Car/Trailer Parking Earlier parking standards for reliable car/trailer parking £ -r Lake Minnetonka were reviewed. Standards are necessary to ma e accurate count of available parking spaces and to evaluate potential parking siaces. Changes from 1986 standards offer greater flexibility in counting car/trailer parking spaces, /jnong changes ^00 distance from an access was mere, sed from ^' ^00 feet to 2.000 feet; the full 700 parking space goal is through Sunday and on holidays; 350 parking spaces will be open 24 hours per day. The Task Force also agreed that accesses for which Packing agreements were made should meet the parking standards for public accesses to the greatest e.xtent possible. This was to insure minimum level of service quality. Consistency among accesses was found to be an consideration. Access design, how boaters are to use ®cce , location of parking, security of personal property and safety of boaters and their passengers were among considerations reaching agreement as to standards Parking spaces must standards. Ramps must be in a condition to allow safe, efficient use. Parkina Standards are listed in the appendix. Parking Inventory To determine the nijmber of existing and potential car/trailer parking spaces capable of meeting the adopted standards, data was gathered from a variety of sources and in a number of ways. Site lists were provided by LMCD member cities. Site visits were made and aerial photographs were used. Spaces inventoried included: - parking in on-site lots at existing lake access points - available on-street parking - off-site lots, public and nrivate - future additional committed spaces - potentially negotiable to 2000 feec - the original inventory totaled 735 The total potential car/trailer parking spaces certifiable to the new standards to 2000 feet was 735. (The original inventory is in the appendix.) Substantially higher numbers of car/trailers are being parked in public or private areas at peak times in good weather than the measured inventory has identified. This report adopts a new and lower inventory in an effort to be extremely conservative after consultation with Hennepin County and the cities. (Inventory and Footnotes.) The revised total inventory of 527 car trailer spaces represents parking that is available now, or that can reasonably be made available on a stable long-term basis. Approximately 440 car/trailer parking spaces are currently available for free public access within 2,000 feet of launch ramps. Of these, approximately 270 spaces are in public access lots or are under current agreement. An additional 170 spaces are in on-street parking sites dependent on agreement with local authorities. Approximately 88 future spaces are either committed or negotiable. This results in a total of 527 potential car/trailer parking spaces that are now believed to be available or planned and which meet the new parking standards. Some must still be built. Agreements need to be reached. The inventory also gives an indication of where the current spaces are distributed and provides some direction on where to concentrate on locating future spaces. Public Access Agreements One result of the 1986 task force was the improvement of tl^e process that secures parking spaces at or near existing public access sites. The Task Force continued this recommendation and developed a current model agreement form. The Lake Access Parking Agreement form and checklist for evaluating public access parking agreements are provided in Appendix _ _. These agreements should be between the LMCD and the local unit of government. The DNR Trails and Waterways unit will review and comrr.ent on these agreements. The DNR will also monitor the quality and effectiveness of the agreements in cooperation with the LMCD and the local unit of government. Some considerations in evaluating these sites are: - clarity of access design - how boaters use the access - location of parking - security of personal property - safety of boaters and their passengers - parking standards must be met j* • - launching ramps must be maintained in good condition The first agreement was in May of 1993 with the City Minnetrista. The agreement with that city was for a total parking spaces at the following sites in May of 1993. Williams Street in Halsteds Bay Tuxedo Boulevard in Phelps Bay Other sites also have a high potential for adding to reliable parking by agreement, namely: Hennepin County: . . ^ North Arm, Orono, County Road 51, potential of 98 spaces Spring Park Bay, Spring Park, with accompanying county maintenance yard nearby in Orono; potential 86 spaces Deephaven: . , -Carson's Bay, Minnetonka Blvd, potential of 70 spaces Wayzata: . , ,Wayzata Bay, County Road 16, potential 64 spaces Mound: . , , oMound Park Bay, Bay, potential of 48 spaces of 44 New Access Sites The Task Force recommends the following potential for becoming lake access sites. Criteria are provided in Appendix _ _. sites as having the The Site Evaluation - Tonka Bay City Dock, channel to Gideon's Bay - Timber Lane, Gideon's Bay, Shorewood - Mai-Tai Restaurant Site, Excelsior Bay, Excelsior - 456 Arlington Ave., Wayzata Bay (private residence), Wayzata - Pelican Point, Spring Park Bay, Mound - Lost Lake, Cook's Bay, Mound - Advance Machine, West Arm, Spring Park Gray's Bay Causeway The unimproved substandard public access on Trunk Highway 101 will not be redeveloped as planned. This represents a setback tor public access development. The 32 spaces planned for the causew y had been considered committed. The Minnesota Department Transportation has abandoned plans to improve the site. However, Wayzata and Minnetonka are continuing discussions about irrprovements at the site. Maxwell Bay Up to 60 additional car/trailer parking spaces may be provided when the launch ramp is in place at Maxwell Bay, Orono. This site continues to be examined. DNR Trails & Waterways and the City of Orono are negotiating to purchase alternate properties. Parking at the proposed launch ramp at Maxwell Bay, Orono, was not counted in the inventory total. Marina Potential for Lake Access Most marinas have potential parking areas during the summer months. At this time boat storage lots are relatively empty. Many now provide some boat launching service. These marinas could possibly provide some free service to the public. The operators or owners would expect some type of reimbursement. The Task Force identified six conditions and issues to be considered in determining the potential free public access use of marinas: - Ability to extend existing capacity. - Extent to which a marina already serves the public through fee paid access. (Fee paid public access does not meet the definition of free and open public access.) Attitude of nearby homeowners toward public access use. Duration of public use, considered for a trial basis only until proven feasible. Management issues, such as reserving parking for public use, and compensation to marina owner consistent with public access operations and public policy. Possible DNR funding constraints from annual operations budgets and overall cost effectiveness. CONCLUSIONS 1. Assuring free public access to Lake Minnetonka is the substance of this Task Force. Other access through fee-paid commercial docks and other riparian ownership must be balanced with free public access. 2. The goal of 700 car/trailer parking spaces is an achievable goal. The LMCD should continue to solicit cooperation and agreements from the cities and agencies in meeting the goal. 3. Parking standards are established in appendix 5. 6. 7. 8. Parkino inventory data indicates there are parking spaces now availabl'i or that can be made available which can meet the standards as follows: 266 existing in lots or under agreement 173 in use but not under agreement g8 future coiranitted or negotiable 527 total potentially certifiable Well over 700 car/trailers have been observed at or near launch rcurps when weather is good. Parking agreements must be negotiated to certify the 173 additional spaces now in use without formal agreements. Funding .must be made available to insure development of the new access sites at the Hennepin County Regional Park. A new public access at Maxwell Bay, Orono, requires successful negotiation and additional regional funding. To reach the goal of 700 car/trailer parking spaces, additional parking must be negotiated. Efforts to enlist cc^e^cial ri^rxnas in providing this parking are recommended. The remaining balance of the 700 free public jar/trailer parking goal can be met only by continued by responsible agencies. New access sites are locate, require good timing and access to adequate funding. This study adopts criteria for locating new sites. Car/trailer parking cannot be increased at existing ramps ealuy A review of quality and efficiency of sites may, however, lead to improvement in safety and effectiveness.
