As we discussed on the phone it appears no variance is needed for your project. Since the deck is already
considered a structure (i.e. structural coverage) because it is at least 6' above grade and does not encroach
into any setbacks a roof is allowed. The new roof must not encroach into the average lakeshore setback or the
10-foot side yard setback.
In 2004 a variance was granted to allow construction of a larger front stoop including a roof. With the approval
of this variance 102 sq. ft. of hardcover was to be removed. I have attached a copy of the variance resolution
for your records. The hardcover removals are specified on page 3 of 6 and shown on Exhibit A.
Building permits that do not require any grading or engineering review require a $700 escrow. We hold the
escrow until the project is complete and the building inspector has given the final approval. Before we refund
the building permit escrow you will be required to submit an as-built survey, including as-built hardcover
calculations, showing the property is in compliance with the 2004 variance.
