The Orono Planning Commission met on the above date wit>' the
foI Iowing members present: Chair Charlie Kelley, Ed Cohen, Candace
Rowlette, Jeff Johnson, and Stephen Peterson. Maureen Bellows
arrived after the vote. Charles Schroeder was absent. The following
represented the City Staff; Planning and Zoning Admtnistrator
Michael Gaffron, and City Recorder Teri Naab. Chair Kelley called
the meeting to order at 7:00 p.m.

STUBBS BAY/MUSA BOUNDARY REALIGNMENT -
PUBLIC HEARING 7:00 - 7:08 P.M.
The Affidavit of Publication and Certificate of Mailing were noted.
Gaffron explained that Comprehensive Plan Amendment No. 4 Is an
amendment to include the Stubbs Bay project area within the
Metropolitan Council’s urban service area boundary. The area
includes 137 property, 12b of which are developed, and 12 vacant
lots. The City is not proposing to change any district boundaries
or zoning standards. The amendment is to meet the criteria set by
the Metropolitan Council requiring a plan amendment to show the
boundaries of the MUSA line as the City continues to sewer various
i jrtions of the City. He noted that in the past the City has gone
ahead with a project and later applied for the amendment to the
Comprehensive Plan. The Metropolitan Council has now asked that In
the future amendments be requested prior to commencement of a
project.
Johnson asked the time line for the current MUSA boundary line for
the City.
Gaffron stated that the City has not adopted a specific "Year 2000"
MUSA per the Metropolitan Council’s schematic. He said that the
Stubbs Bay area is the last of five areas identified in the 1980
Comprehensive Plan, which were generally expected to be sewered by
the 1990s. He noted that the City does not have any plans for
future amendments. He explained that Comprehensive Plan Amendment
No. 3 has not been adopted by the Metropolitan Council as they have
requested additional information, and intend to address the issue
of 64/640. He added that when North Oaks recently went through the
same type of request the City will soon be going through, they were
eventually allowed to continue with their current development of
1 to 1 1/2 acre unsewered development without a problem from the
Metropolitan Council.

Discussion
This is a public hearing to consider inclusion of the Stubbs Bay
sewer project area within the Metropolitan Urban Service Area (MUSA)
boundary. The MUSA line is a boundary established by local
governments and Metropolitan Council to define those areas which are
or will be served by the metropolitan sewer system.
In 1980 Orono defined its MUSA boundary to include only those
areas currently sewered. Subsequent amendments to the MUSA boundary
were approved by the Met Council after construction of the MinnetonJca
Bluffs, West Ferndale/Marinas/Orono Lane, and Crystal Bay sewer
projects.
While the City in the past treated such MUSA amendments as an
after-the-fact housekeeping process, the Met Council is indicating
that Stubbs Bay and all future MUSA amendments must occur before sewer
construction. The Metro Waste Control Commission, which has
jurisdiction over the Metropolitan sewer mains which serve Orono,
indicated they would not grant approval to the MPCA to issue Stubbs
Bay or future sewer project permits until a MUSA line amendment was
approved by the Met Council.
Because of the immediacy of the Stubbs Bay project, staff
provided Metropolitan Council with all the information needed to
process the Stubbs Bay MUSA boundary revision, and the Met Council
granted approval of this amendment on July 23rd subject to the City's
completion of the public hearing process. This amendment will be
presented for adoption by the City Council at their August 10th
meeting.

MUSA Boundary Anendment
The attached map and legal description indicate the proposed new
MUSA boundary. Only properties which were included in the Stubbs Bay
project area are involved. Although no future sewer extensions are
anticipated to be needed outside the current boundary, any future
expansion would require a future MUSA line amendment. Also, the
capacity of the system downstream from Stubbs Bay would limit the
number of additional future units to fifty or less in this area of
Orono .
Note that while the Stubbs Bay MUSA boundary amendment is
considered as Comp Plan Amendment No. 4, Comp Plan Amendment No. 3
(which updates the Comprehensive Sewer Policy Plan and adds other
already sewered areas to the MUSA) has been delayed since earlier this
year pending staff submittal of additional requested information,
which has recently been submitted. It has been indicated that Comp
Plan Amendment No. 3 will result in a Met Council review of our rural
development policies (2 and 5 acres zones versus Met Council's "64
units per 640 acres" policy).
Notice for the August 3'*d public- hearing has been published and
notice mailed to neighboring cities, although such mailed notice is
likely not required since there is likely no effect on those cities.
The public hearing process is required for any amendments to the
Comprehensive Plan, as Indicated on page CMP 10-3.
Staff Recoanendation
Staff recommends that Planning Commission forward a
recommendation to Council for approval of inclusion of the Stubbs Bay
sewer project area within the MUSA boundary, per the attached map and
legal description.

A RBSOLOTION APPROVING
PREHENSrVB PLAN AMENDMENT NO. 4

WHEREAS, in June 1980, the City Council of the City of
Orono (hereinafter the "City") adopted a Community Management
Plan (hereinafter "CMP") to provide for the orderly development
of the City. An integral part of that plan provided that sewered
areas of the City be included within the Metropolitan Urban
Service Area (hereinafter "MUSA"); and
WHEREAS, the CMP identified five specific areas within
the rural zones of the City as requiring Alternative Waste
Management Stnd.er to review existing sewage disposal problems
and investigate alternatives. One of these five areas is the
long-established Stubbs Bay neighborhood, an area of existing
residential development; and
WHEREAS, in 1988 the study entitled Stubbs Bay
Alternative Waste Management Study found that extending municipa
sewers to the Stubbs Bay area was the only acceptable and/or
feasible alternative for long-term waste treatment and disposal
in consideration of the options set forth in CMP 6-44; and
WHEREAS, as a result of further review in 1991 and
1992, the Orono City Council expanded the Stubbs Bay Sewer
Project Area to include the "Cygnet" rural one acre development
located immediately northeast of the Stubbs Bay area (see Map 12,
CMP 6-42) and the Oxford Road development immediately southeast
of the originally defined Stubbs Bay area, which abutts the
lakeshore of Stubbs Bay; and
WHEREAS, in July 1992, the City filed an amendment with
the Metropolitan Council providing for the inclusion of the
Stubbs Bay Sewer Project Area within the MUSA; and
WHEREAS, written notice was sent to surrounding local
units of government and other affected jurisdictions requesting
written comments by August 10, 1992 but no oral or written
comments have been received by the City; and

WHBRBAS, on July 23, 1992 at a regularly .\cheduled
meetingr the Metropolitan Council approved the Comprehensive Plan
Amendment to include the Stubbs Bay Sewer Project Area within the
MUSA boundary as proposed by the City.
NOW, THKRKPORE, BB IT RBSOLVBD that the City Council of
the City of Orono hereby amends its Community Management Plan by
designating the Stubbs Bay Sewer Project Area (legally described
and mapped per the attached Exhibit A) to be within the
Metropolitan Urban Service Area, finding that:
1.The Amendment meets the intent of the basic goals,
objectives and policies set forth in the 1980
Comprehensive Management Plan.
2.The Amendment is consistent with the goals, objectives,
needs and desires of Orono residents.
3.The Amendment is consistent with the planning goals and
objectives of Orono*s municipal neighbors.
Adopted by the City Council of Orono, Minnesota this
10th day of August, 1992.
