Re: Permit Application— Lakeside Deck at 700 Big Island.
Dear Mr. Botham:
The zoning code review of your permit is complete. The building official is out of the o�ce until next
Monday so the building code review won't occur until then. In the meantime there are two items that
must be taken care of before the permit can be issued:
1. The zoning code requires that all "record lots" on Big Island be combined into one tax parcel before
a permit issued. (Record lots were established in 1983 based on platted lots in common ownership
in 1982. Together the two tax parcels owned by Recreation Point are one record lot.) It is also a
condition of the lot area variance granted in 1983. While the property owner signed a tax parcel
combination request form in 1983 they could not be combined because they are in different school
districts. Because moving a parcel from one school district to another is a rather involved process,
the City has developed a Special Lot Combination Agreement that ensures the two tax parcels are
not be sold separately, which is the goal of the tax parcel combination. The ab eement is enclosed.
Please have the appropriate person(s) sign it before a notary. (If it would be more convenient for
me to email it to someone, have that person send me an email.)
2. A permit may be required from the Minnehaha Creek Watershed District(MCWD). The City will
not issue its permit until you have obtained the permit or the MCWD determines none is required.
You should contact Steve Christopher, Regulatory Program Manager, at 952-471-0590 x207. I
contacted him to see if he could determine that a permit was not required, but he couldn't with the
information you provided us. He is expecting your call.
