The Affidavit of Publication ard Certificate of Mailing were noted. Diana Sieff was prasant. Mabusth explained the applicant requests approval of an after-the- fact hardcover variai » for the repair of an existing deck, and an expansion to the dock at the northeast corner from 6x20' to 14x20'. All improvements meet required setbacks. The applicant proposes the removal of an existing shed located in the 0-75’ setback zone, reducing hardcover from 2.3% to 0%, and 68 s.f. of concrete slab in the 75-250’ zone. There it a 92 s.f. increase of hardcover in the 75-250' zone. Smith questioned if the removal of the "oncrete pad near the detached garage, the walkway around the attached garage, and the rock by the northern drive would be possible. Sieff explained the rock was just left over and dumped directly on the grass but serves no purpose. The walk is used for the service door from the garage and also is needed to reduce erosion problems. Peterson inquired about the history of the property. Mabusth explained a variance application was approved in 1979 for the detached garage. All improvements proposed with this application ware completed in 1991. •jfilette asked if both drives were necessary. Nabusth advised a **Stop Work Order** waa never issued as decks were already repaired The Inspectors observed the new construction when visiting a neighboring property. Letters were sent to the applicant advising of the need for s building pernit. Sifeff stated she was notified oi for a perait after the const.^^uction was finished. Peterson inquired about the square footage of the walkway. Habusth said it is apiroxlaately 3*x 25*. Sieff asked that the application be tabled to allow her time to review possible hardcover reeovals. Taylor stated he would prefer not to have to do so leaediately, but It IS his intent to reduce the brick patio to install draintile and would be willing to reeove the slab. Mabusth stated the walkway la necessary to provide a safer access to the residence. Peterson asked about consents fros the neighbors. Iiabusth stated there were no cossenta. Snith asked if there was a chanc# to tnprove the appearance of the rock drive. Taylor said it is his intsnt to do so. « ith questioned the existence of the porch near the lakeshore. iHabusth explained the City approved the improvcnent of this structure in 1990 with the condition that it could not be converted to living space ar.d rldfflbinq could not be P’^ovided. It was Boved by Schroeder, seconded by Berg, to recomnend approval of Application S1840 for Jis Ta/lor, 1342 Rest Point Circle, for a side setback variance to allow the installation of a walkway to the existing deck, conditioned upon the resoval of bOl or more of the biick patio by August 31, 1993 and removal of the concrete slab by September 30, 1993. Ha asked if there ware a way to filter tha groundwater. Longaan stated they intend to extend the culvert under the drive and direct drainage to tha natural swala/aarsh area to tha northwest of tha drive. Mabusth asked about a retention araa to tha south of tha drive. Longman stated that was not their intent, and tha natural drainage pattern flows to the aarsh area. He stated the culvert has been in place since approxiaately 1920. He added tha Lauer property does not appear to be adding to the run-off. He stated it is their goal to grade the property so there is not water standing on the south side of the drive, but they are open to suggestions. Longaan noted Bruce Vang, tha City Inspector, did locate tha existing drive on aerial photoa. Schroadar called fot a recess rr*'a 8:0^ to 8:15 p.a. Mabusth pointed out the aerial photos indicate two driveways from the property. The property owner indicated he used the Icop portion of the drive for maintenance of the property near the lake, but the portion connecting the loop and the exit to the road was never used and became overgrown. It was K)ved by Peterson seconded by Lindquist, to reconnend approval of Application S1641 for Uilliaa and Lori Cornelius, 960 Tonkawa Poad, for hardcover and sstback varian'~es to construct a portion of the drive in the 0-'^5’ aone, subject to the City Engineer approving the drainage plan with the extended culvert and! analysis ot the landscape plan around the front of the house and no expansion of the existing drive in this area. Rowlette stated she is disappointed with the after-the-fact request and reiterated she would never have voted in favor of the original application had she known this, but would vote in favor at this tiee to preserve the trees. Ssith stated she is disappointed that the applicants art willing to consider alternatives. Hr. During the review of tha pravioua 3 lot subdivision, the applicant proposed a ratertion pond to the north. In the current review, the Engineer has suggested directing drainage to the south to Uatettown Road, which does not have drainage ditches to carry the run-off. Gronberg noted because of the neighbors* concerns tc the east, the existing tree buffer was left and the drainage swale was moved further to the west creating s larger than averdge drainage easeeent. He questioned if this area would be deducted troe the dry buildabie on those lots and telt that wjuld be a hardship. He questioned the purpose of the connection of the road to Ooldenview Drive. Mabusth replied this would be a part of the network of roadways. The City IS trying to connect the interior roads in the City. Lindquist questioned where the pond on Lot 8 will drain. Suess stated it currently dtains to the northeast. He added if the road were required to be extended, it would destroy on# of his lots and one of the possible lots on the Hal Ison property. He noted Mr. Kallson has slieady paid for a road. Goldenview Drive, and did not feel he would like to pay for anoiher. Mabusth noted that access can stil.^ be from Ooldenview Drive, but that access corridor to be platted at the time of a future subdivision would only be developed at the time the City found a need to develop through roads. Peterson asked about the septic sites. Peterson felt they should allow tne cul-de-sac and not require the extension of the road. Mabuath stated even if the Hailson property ware divided, the road would not necessarily be constructed as the property is served by Ooldenview. The next SMsting is scheduled for August 5th, 7:30. Saith reported the next Highway 12 Policy meeting is scheduled! for July 21st at 5:30 p.a. She asked when tha Conaission would begin reviewing other issues. She suggested they consider a survey of applicants to determine ii there are ways to improve service. Mabusth suggested staff develop a survey and present it to the Comeission for review. Schroeder nominated Smith to be the representative On Highway 12 issues and Peterson the representative on County Road 15 issues. One of the important considerations in patients like Mr. Taylor is avoidance of climbing stairs, particularly going (k>vn stairs is nechanically difficult for patients with knee probleas of his type. He's told me that he is planning an addition onto his home that may involve stairs, although with a variance he may be able to avoid this. Problems commenced when it was realized that the survey submitted with the previous variance application. Exhibit E show«l a loop driveway completely located out of the 0-75’ setback area.
