Gerhardson Title Public Works Director Administrator Reviewed:Agenda Section: Public Works Item Description: Community Development Block Grant 1995 For 1995 the City of Orono will receive $23,918 from the Community Development Block Grant Program (CDBG). The following is the recommended allocation of the CDBG funds, as indicated in the public hearing notice: We Can $ 1 *500 Westonka Intervention 1.500 Interfaith Outreach and Community Partners (lOCP) 1,500 H.'.;-.ing and Rehabilitation 16,418 Sewer Connection Grant 3,'nil The Council may change this allocation based on information received at the public hearing, or based on other perceived needs. We Can, Westonka Intervention and lOCP are public service organizations and have been funded from CDBG for several years. Housing Rehabilitation has not been funded for two years and there is a waiting list for funds. The allocation for the sewer connection grant anticipates a new sewer project resulting in an additional need for connection cost assistance. Also be advised that there is a balance of $19,999.72 in the Stubbs Bay Sewer Connection Grant program. That program is now in phase two. Hennepin County has sent out four applications to-date and has not received any completed applications back. Residents in the Stiibbs Bay sewer area have until June 30, 1995 to submit an application for a lump sum amount toward the total cost of the connection. If the full connection grant allocation is not used, the Council will be able to reallocate those funds to other approved uses. Our continued growth indicates the increasing need for this service which allows the elderly to remain living independently in their familiar community. Sojourn has been awarded a 25 passenger Wheel Chair equipped vehicle from the Minnesota Department of Transportation to be delivered by the fall of 1995. The Minnesota Department of Transportation grant for this vehicle covers 80% of it's cost of $38,000, with a 20% match of local funds. Sojourn respectfully requests that the city of Orono make a generous contribution toward the $8,000 local portion due for this vehicle. The residents of the City of Orono would be able to offer the vehicle to both the public and private groups of its citizens for group use. We sincerely hope that the city of Orono will strongly consider our proposal and continue to support Sojourn's efforts to serve the older residents of the community. '•* FEBRUARY 15, 1995 TO: CITYOFORONO RE: BLOCK GRANT FUT^IDING AMOUNT: $1,800.00 Recent changes in state statutes on domestic assault and abuse necessitates your police department to develop a policy that will: 1) meet state law; 2) provide for uniform handling and reporting of domestic abuse and assault cases, which should include a copy of all such cases be faxed to Westonka Intervention; 3) dispose of cases in a way that will keep them from reoccurring; 4) provide a body of language that can be modified to meet specific changes in existing laws. As the law states, each city must align itself with a project for handling domestic assault and abuse cases within their city. Research has demonstrated that arrest and incarceration coupled with intervention was the most effective way of dealing with domestic abuse and assault cases. As in the past, Westonka Intervention will continue to assist your police department to provide the vehicle in which to handle those domestic abuse and assault cases. Although 440 clients, have been served though Westonka Intervention, it must be remembered when reviewing these statistics that ongoing support is a very necessary part of the program and advocates may work with victims for several months. At present Westonka Intervention has 438 files a large percentage of which remain open and active. With this support, our clients are changing their situation and are living healthier lives. • i * i, , • * Working with local police departments, Westonka Intervention Project, Inc. serves the communities of Mound, Mirmetrista, St. Bonifacius, Orono, Long Lake, Minnetonka Beach, Spring Park, Maple Plain, and Independence. Mabusth reported that this application is for an after-the-fact conditional use permit and variance to reconstruct a retaining wall in a lakeshore yard. The wall was found to be on the verge of collapse and required immediate attention. Applicant contacted Staffs who inform^ Applicant that the soonest the Planning Commission could act on this issue would be at their January meeting. This work could not be performed during January or February, and the potential for collapse of the wall and the bank when spring rains arrived resulted in the need for immediate action The City Engineer inspected and reviewed the property and concurred with the engineering plans A complete application was filed before proceeding and building the wall in November. The only issue is that the City was not contacted during the construction, so the Engineer was unable to verity that all guidelines of the Allen Block Co. were followed during the installation. The Engineer required the Applicant's Contractor to confirm in a letter that all requirements were met in building the 8’ high wall. The Planning Commission at their January meeting concurred that the wall needed immediate attention and that the Staff responded correctly under the circumstances. The Planning Commission recommended no penalty fee be assessed on the building permit due to the emergency situation Hurr questioned waiving the penalty fee showing concern for setting a precedent, citing an example of a security house that was an after- the-fact application. At that time, the applicant was required to pay a penalty fee. Planning Commissioner Rowlette responded that since this was an emergency situation and unique circumstances required the action and the applicant first sought help from the City, they felt that no penalty should be assessed. Goetten asked to show in the resolution that this was a unique situation and needed to be considered on a case basis. Rowlette cited the example of the rains in 1987, where the City responded during the emergency situation by waiving penalty fees. Rowlette said this application is consistent with that situation. Kelley moved, Hurr seconded, to adopt Resolution #3520 for an after-the-fact conditional use permit/variance for David Yorks at 2825 Casco Point Road, without penalty as per the Planning Commission recommendation. SEVTRINSON, 2S00 SHADYWOOD ROAD - VARIANCES - RESOLUTION #3522 Mr. and Mrs Severinson were present. Mabusth reported that the Applicant installed new sections of 6-7 privacy fencing and repaired other sections of fencing without obtaining a building permit. This fence is located on property that is adjacent to both the Narrows Channel and county road. The code allows for 6' high fencing within street yards of lakeshore lots adjacent to county roads. The Applicant did not realize a permit was needed to replace and add new sections of fencing. Hardships were listed for the Applicant. Mabusth said the Planning Commission voted 5 to 2 for approval with the minority opinion opting for a combination of lower fencing with shrubs Mabusth said that there is shrubbery in place that does obscure the fence from tite lagoon and noted that the county road at that location was high minizing visual impact of fence at that height. Applicant Severinson said he replaced 70% of the fencing. It started as a repair job but due to the amount of heaving, he was unable to only repair it. The fencing is a stockade type, the same as the original Hurr moved, Kelley seconded, to approve Resolution #3522 for Kenneth and Eileen Severinson at 2800 Shadywood Road. Ayes 3, Nays 0. (#7) 3585 SIXTH AVENUE NORTH - HOME OCCUPATION LICENSE RENEWAL LICENSE The Applicant, Mr. Meinhardt, was present. Mabusth reported that the application was for a renewal of a home occupation Ucense. The 3-acre property is located on CoRd 6, adjacent to a residential area, next to the Park Gun Club, and with Hennepin Parks to the north. Council was informed of recent problems the Applicant has had, primarily with the loss of his wife. Mabusth presented photos taken during an inspection for the license renewal showing commercial trailers parked outside and to the rear of the bam. The license requires these vehicles to be stored inside. The commercial vehicles were found to be owned by the Applicant's son, and a letter was sent asking for removal of vehicles from outside the bam area It was noted that an employee was also parking his personal vehicle at the rear of the bam. The license required that this also be parked inside when the employee picked up his work vehicle. MINUTES OF THE REGULAR ORONO CITY COUNCIL MEETING HELD ON FEBRUARY 13, 1995 (#7 - Home Occupation License Renewal - Continued) The home occupation code states that no employees are allowed to work inside the home, only the owners. During the wife's illness and after her death, a nurse had assumed secretarial and phone duties for half the day. Mabusth reported that Staff recommended that the application be granted conditional approval allowing a six-month period for the applicant to resolve the secretarial and vehicle parking issues due to the hardships involved. Hurr was told that there were approximately three licenses within Orono where variances had been approved. Mabusth said that this should be discouraged, and the applicant would be encouraged to seek other alternatives. Hurr moved, Goetten seconded, to conditionally approve the home occupation renewal license for Ben Meinhardt at the property located at 3585 Sixth Avenue North for a six- month period (August 13, 1995) and to direct Staff to submit a status report on the final resolve of the business operation and to further determine if the use involves violations of the code and if variances would be appropriate or acceptable to the City. Ayes 3, Nays 0. MAYOR/COUNCIL REPORT Goetten reported that she would be attending the meeting in Long Lake with Mn/DOT on the Hwy 12 issue and had received an update from Mayor Todd OIsoil Hurr "Mid she would be attending a hearing on Wednesday, 2/15/95, on Lasher Landing. ENGINEER REPORT (1^8) KELLY AVENUE DRAINAGE City Engineer Glenn Cook presented the Council with a draft assessment roll for the propos^ storm drainage improvements on Kelly Avenue, north of Carman Road. The assessments do not include costs for raising the elevation of Kelly Avenue or replacing the sanitary sewer in the area. Two options were developed. One assessment roll was divided on an area basis over the entire property that has direct runoff to the drainage area. The other option was assessment based on the type of land use, residential or commercial where commercial properties would be assessed twice that of residential properties. This was determined by the fact that commercial properties generally have twice as much hardcover as residential properties. The formulas were developed with the amount of runoff and land taken under consideration. Cook reported that any decision made would more than likely be considered as the policy to be followed for future projects MINUTES OF THE REGULAR ORONO CITY COUNCIL MEETING HELD ON FEBRUARY 13,1995 (#8 - Kelly Avenue Drainage - Continued) Another OKetii^ with the neighbors involved wiD be held to review construction and assessment options. Moorse said a puUk bearing would allow the Council to hear what people expect and what type of assessment policy would be consdered reasonable. Moorse noted that it is easier to make a case for a sanitary sewer or a road assessment than for a stormwater project assessment Barrett responded that residents look at what increase this would provide in the value of their property, and the claim would likely be that this would result in no difference in their property's value. Moorse reported that the proposed assessment could be paid all at one time or over a period of time. The cost for the City in the proposed assessment roll would be 20% of the total project cost. Moorse asked the Council to consider what percentage is reasonable for the City to pay, 20% or 30?^o as in the Stubbs Bay sewer project. Cook and Gerhardson will inform Council of the results of the neighborhood meeting. Ayes 3, Nays 0. (#10) 1995 INSURANCE AWARDS Moorse asked for Council's recommendation for approval on insurance awards for 1995. It was noted that the property and casualty premium costs have decreased for this year. Moorse said this was because of the City's experience rating and the experience of the people involved in the pool There were no changes in coverage and competition was not felt to be the reason for the decrease. Kelley asked that the employees involved be recognized for the signi6cant role they play in limiting costs that afifect our taxpayers. Hurr moved, Kelley seconded, to award the insurance eflfective January I, 1995 as follows; to the League of Minnesota Cities Insurance Trust for the comprehen^ve municipal property and casualty package S65,505, for umbrella excess liability $21,549, for petrofund reimbursement $821, and for open meeting law $789; to Western National Insurance Group for boiler and machinery $33 1; to the St. Paul Fire and Marine Insurance Co. for small computers $500; and to the United Fire and Casualty for surety bonds, $1,700. The applicants proposed a 10’ x 14’ three season porch within the existing building envelope of lakeside deck requiring approval of hardcover variances within the 75-250 setbac area side setback variance, average lakeshore setback variance and a variance to allowed area of st’nictural coverage for the property. Applicants have rethought their need for additioi^l living space at the lakeshore side of the residence. The three season porch will not provide additional area for their dining room nor for a large piano in their living room. The ^^ended plan calls for a 5’ x 26’ expansion of the second floor at the lakeside and a matchmg 5 x 2o extension of the existing lakeside deck. Review Exhibit E, note lakeside addition has been designed at a 45 degree angle at the sides minimizing any sighting impacts upon the residence to the north, the residence receiving the most impact by the average lakeshore setback. The addition will not require a side setback variance as all improvements are located out of the 10’ setback area (Application #1945 also involved a side setback variance). Adjusted todcover ifnow at 45 « wiU, Uk removal of 333 s.f. of plastic underlmer and 246 s.f. of paved area and the addition of 105 s.f. of new deck area and 30 s.f. of patio stones to replace paved patio. Application #1945 was approved with an adjusted hardcover at 45.5% within e 75-250’ setback area (current application 45.3%). Structural coverage is up 1%, existing at 19.3% and proposed now at 20.3%. Request for Council Action continued page 2 of 3 February 27, 1995 #1994 Robert and Velma Wolff. 4450 Forest Lake Landing Statement of Hardship Applicants suggest that many of the hardships stated in the original approval resolution. Exhibit J, still hold true for the amended proposal. Applicants also note that the second story 5’ addition has been angled at the sides to minimize any sighting problems for the residence to the north and in addition the current improvement does not require a side setback variance as Application #1945 would have required. Planning Commission Recommendation The Planning Commission recommended unanimous approval of the amended variance application as shown on Exhibit E, maintaining hardcover at 45.3%. The enclosed approval resolution has been drafted per the Planning Commission s unanimous recommendation. COUNCIL ACTION REQUESFED: To either adopt or amend the enclosed approval resolution. A RESOLUTION GRANTING VARIANCES TO MUNICIPAL ZONING CODE SECTION 10.03, SUBDIVTSION 14 (C), SECTION 10.22, SUBDIVISIONS 1 (B) AND 2 FILE NO. 1994 WHEREAS, Robert L. Wolff and Velma A. Wolff (hereinafter "the appli^-nts") are the owners of the property located at 4450 Forest Lake Landing within the City of Orono and legally described as follows: Lot 11, Tonkaview Gardens, Hennepin County, Minnesota (hereinafter the property"); and WHEREAS, the applicants have applied to the City for variances to the Municipal Zoning Code to permit construction of a 5’ x 26 ’ principal structure addition and a 5’ x 26 ’ lakeside expansion of an existing deck requiring approval of the following variances: Section lO.O"^, Subdivision 14 (C) - Lot coverage/structural variance. NOW, THEREFORE, BE IT RESOLVTID by the City Council of Orono, FINDINGS This application was reviewed as Zoning File #1994. The property is located in the LR-IB Lakeshore Residential Zoning District requiring one acre in area. The property consists ot 10.586 s.f. or .24 acres. The Orono Planning Commission reviewed this application on February 22. 1995 and recommended unanimous approval of the variances as amended, based upon the following unique findings and hardships: The City has received no negative comments from the neighbors to either the nonh or south. The structure will have a minimal impact on the residence to the south. The residence to the north will not be impacted by the addition because of the 45" angle at the side. B The residence was constructed prior to the current lakeshore, shoreland standards. C.The property docs not meet the current standaids of the LR-IB zoning district requiring one acre in area. The subject property consi-ts of 10,586 s.f. The required lot width is 140’. The average width of the subject property is 54’. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variances would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the applicant, but is necessary to alleviate a demonstrable hardship or difficulty; is necessar>’ to preserve a substantial property right of the applicant; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. Page 2 of 6 5. The City Council has considered this application including the findings and recommendations of the Planning Commission, reports by City staff, comments by the applicant and the effect of the proposed variance on the health, safety and welfare of the community. CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants variances to the Municipal Zoning Code Sections noted above that would permit the construction of a 5’ x 26 ’ addition to the lakeside of the existing residence and a matching 5 X 26 ’ extension to the lakeside of the existing deck approving an intensification of a portion of a structure that encroaches the average lakeshore setback line by 28 ’. lot coverage variaiice for an inteasification of structure where excesses of 461.1 s.f. or 4.3% exists and a Iwrdcover variance within the 75-250’ setback area of 1,379 s.f. or 20.3%, subject to the following conditions: All hardcover removals as shown on Page 6 of this resolution shall be removed prior to the framing inspection for the new construction. Applicant shall contact Building staff to confinn hardcover removals. Authorities granted by this resolution run with the property not with the applicants, but are permissive only and must be exercised by application for a building permit within one year of the date of Council approval, or this variance will expire on that date (February 27, 1996). Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. The undersigned applicants have read, understood and hereby agree to the terms of this resolution and on behalf of themselves, their heirs, successors and assigns, herebv agree to the recording of this resolution in the Chain of Title of the propert>. 1. 2. 3. 4. Required = 10’ Existing = 6.5’ Proposed =6.5’ Variance = 3.5’ or 35% NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono. FINDINGS This application was reviewed as Zoning File #1945. The property is located in the LR-IB Lakeshore Residential Zoning District requiring one acre in area. The property consists of 10,586 s.f. or .24 acres. The Orono Planning Commission reviewed this application on July 18, 1994 ^d recommended approval of the variances as amended, based upon the foUowmg unique findings and hardships: A.The City has received no negative comments from the neighbors to either the north or south. The structure will have a minimal impact on the residence to the south side. The residence to the north will not see the porch as it is located at southeast side of the residence completely out ot the view of the residence to the north. B The residence was constructed prior to the current lakeshore/shoreland standards. C.The property does not meet the current standards of the LR-IB district requiring one acre in area. The subject property 10,586 s.f. The required lot width is 140’. The average width o subject property is 54’. Page 2 of 6 I r««ua: CITY of ORONO RESOLUTION OF THE CITY COLTMCIL NO. 3 4 5 6 The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variances would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the applicant, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the applicant; and would be in keeping with the spirit and intent of the Zonino Code and Comprehensive Plan of the City. 5 The Citv Council has considered this application including the findings and recommendations of the Planning Commission, reports by City staff, comments by the applicant and the effect of the proposed variance on the health, safety and welfare of the community. CONCLUSIONS, ORDER ANT) CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby urants variances to the Municipal Zoning Code Sections noted above ^at would construction of a 10’ x 14’ three season porch at the southeast comer of the existing deck approving an intensification of a portion of the stmemre that encroaches the average lakeshore setback line by 26 ’, a side setback variance of 3.5 ’ or 35%, mtensification P°^ton of the struemre that encroaches the required side yard, lot coverage v^ance ^ intensification of structure where excesses of 464.1 s.f. or 4.3% exist, and a h^f^lcover van within the 75-250 ’ setback area of 1,390 s.f. or 20.5%, subject to the followmg conditions. 1 All hardcover removals as shown on Page 6 of this resolution shall be removed prior to the framing inspection for the new constmetion. MN 55323 C355 February 22, 1995 Minnehaha Creek Watershed District 15500 Wayzata Boulevard Suite 617 Twelve Oaks Center Wayzata, Minnesota 55391 Dear MCWD Board; At its January 23rd meeting the Orono City Council discussed the draft cooperate agreement for the Long Lake Improvement Project and identified a number of concerns. The Council reiterated its support for a project to clean up Long Lake, but suggested that ^s proj^t could be done without a complicated agreement. The Council ^^S^ested ^^y portion of the agreement is that which specifies the details of the project and how the MCWD will proceed to accomplish the project. The CouncU suggested that all of the items beyond page 7 were unrelated to the MCWD’s ability to accomplish the project, and so could be elumnated wi^out affecting the accomplishment of the project. Comments regarding each of the sections unrelated to the accomplishment of the project are as follows: Section 3.2.1, The requirement regarding the preparation of a local water management Dlan is redundant since, as the agreement indicates, this requiremem already exists in state statute The requirement that cities submit their plans prior to the construction of the project improvement changes the time line provided for the water management plan in state law. and could very well unnecessarily delay the construction of the project. Section 3.2.2. Several years ago the city agreed to provide a representative on a information committee whose responsibUity was to disseminate information on a variety ot best management practices. This prior agreement makes this language redundant. Section 3 2.3. At the Council meeting Mayor Callahan indicated that prior discussions concerning the project indicated that the MCWD would cover all costs for the first slx to ten vears. There would then be discussions to determine the ongoing costs and who should pay ror them. The MCWD has not provided information on the extent of the sediment remova cos . Section 3.2.5. Cleaning the fish barrier is a minor item that the city should be able to accomplish with in*house staff. Telephone (612) 473-7357 • FAX 473-0510 Minnehaha Creek Watershed District February 22, 1995 page 2 Waier qualitv monitoring may bn a good idea, but if the MCWD agrees to conduct the monitoring the city does not need that agreement m wntmg. Section 5 0 The citv is very uncomfonable with the creation of. or membership on a large advTsorv committee made up of major regulatory agencies. These de«lop a life of their own that is in conflict with the purpose and goals of the project and the interests of the individual committee members. Section 6. Orono is not opposed to the MCWD Board appointing the Project Manager. This item does not need to be a pan of the agreement. Section 7. If the aereement is simplified as the city proposes, the need for a dispute resolution procedure mav be eliminated. Also, since the city is opposed to the project committee, it would also be opposed to that comminec havmg a role m a dispute resolution process. An additional revision to the agreement is to add lan^ge to Section 3.L10 to mclude snecific mention of the conditional use permit required from the City of Orono for Ae cLimentation Dond Also in Ae same section, it is unclear what Ae lang-aage m Ae last phras mtX m "eeds to be clarified to indicate dtat apy Sctsion to use S city's powers of eminent domain wUl be made at the sole dtscreurn of the city. Dan had been a member of our j^K'lice reserve unit several years ago and continued to know our officers in his capacity of a Long Lake volunteer fire fighter. Gib just wanted to do something in return for the years of friendship our officers had shared with his son. The vest was issued to Officer Mike Carlson. I have attached a copy of my "Thank You" letter to Mr. Reed. • • February 7, 1995 Mr. Gib Reed 345 Russell Lane Long Lake, MN 55356 Re: Donation for officer body armor Dear Gib: I want to thank you for your most g*?nerous donation $3^^ for the purchase of body armor for Officer Mike Carlson.
