ACTION ITEMS (#2) #1975 LARRY ANHALT, 2190 WAYZATA BLVD. - APPEALS CONTINUATION OF PUBLIC HEARING - 7:00-S;05 P.M. The Applicant was present Mabusth said this application has been taken in as an appeal because of the many land use issues that must be resolved before a formal application can be filed. The plan calls for a commercial use of Outlot E, Sugar Woods, in BI zoning district. The Manning Commission is asked lo determine if the proposed use is consent with intent of B-1 code for a "garage” use. There b also the issue of a partially platted east/west road to the north of the property, and City's plan to seek a fintd access to east at North Brown Road. The conceptual site plan conssts of a showroom, an office area, garage, and car wash. One third of the structure will be for office and showroom use with the remainder for the garage and car wash. The applicant advised the showroom will house such items as tires, exhaust systems, and brake systems. One major issue im olves a conflict with plat nups presented with information. The right- of-way issue needs to be solved. Staff provided an ^::diibit depicting the various options .foi ^ig«^-or>way dedications. The City Engineer and Mn/DOT say that a C/D line is beii^ in the I9f'5 improvements. The plat map for the County shows the right-of-way as an E/F line. According lo Dennis Hill of the County’s Property Description Office, we should go with the right ot-way we depicted by the C/D line in lieu of that shown on the current Count> p!dt map. Hwy 12 at this location will have a median in the center probablv mm to left or east. Sid Rebers, along with hb legal representative, Greg Poe, were preseiit. Rebers originally owned 41 acres from Sugu Woo^ to Hwy 12. Poe discussed why it was his opinion that the east/west. Anhalt's business. Pro Tire and Exhaust, is a retail/installation operation mvolving what he called quick items, tires, shocks, struts, exhaust, aligmnents, and oil changes. The plan is for a garage consistirig of four, east fruring bays and a car wash for hb clientele, not for the general puUic. The location would provide good exposure bdi% located on Hwy 12. It should be noted that the site allows adequate room to move the proposed building to the rear as Mn/DOT b taking additional land for rq^-of-way. Anhalt is asking for clarification from the Planning Commission on the zonii^ issue in order to proceed with site planiiifq$ Mabusth reviewed the intent of the BI sales district that encourages commodities or services for the surrounding neighborhood and may adjoin a residentbl area. It must be serviced by municipal water and sewer, and direct highway access is needed. The garage use b listed under the conditional use section of the code and includes repair of cars, which rmist be totally enclosed. The rear and front setback requirements present no problem. The Applicant was present Mabusth said the Applicant has come back with a new plan which does not encroach the btulT area The proposed house has been downsized, and the gan^ has been relocated to the west side and reduced to two stalls. The proposed house %vill be located 25’ from the street lot line where 35' is required. The setback from the existing traveled road wifi be 46' and at 42' if Tortkaview Road is upgraded at 28' width, as proposed by the City Engineer. The setback from the l(/ grassed boulevard of the upgraded road is 32' fttm the north side, where 35' is required. Peterson, who was one of three commissioners who reviewed this application at the laat meeting, recalled that if a variance was to be needed, preference was to the street aide and not to the bhifT area side. A main concern was with the drainage for the proposed plan. Rowlettte was concerned that no water goes down the hill on the she. Nohui said a landscape stabilizatkH) plan would be needed along with a drainage plan designed by a prcdessional engineer. Schroeder read a letter addressed to the CHy from Dave Stockdale of Edgewori Buttders, the contractor for the appheation, to be included as part of the public record, stipulating confirmation that proper construction procedures were followed for the retaining wall as required by the City. Mabusth said the application was an emer^ncy situation that devek^wd after the November Piaimii^ Commission meeting requiring the City to make a decision without firA ccMnii^ before the Conunissicn and Council for approval It was discovered that the retaining wall at the top of the bank leading to the lake was in a near state of collapse and measures needed to be taken immediately to safeguard bank before spriiig thaw and rains. The contractor failed to call for inspections during the reconstruction of waOs, although, contractor did work with the City Ei^ineer on the project. Since inspections would not confirm that the wall had been installed as required, the Engineer asked that a letter be aibmitted for the record. There wo-e no public comments. Berg reported having received complaints over the depth of the pond. It was clarified that the pond will gradually deepen to approximately 6* to 8*. It was noted that eight neighbors have signed letters giving thw approval of the pond as loi^ as the pond conforms to rqpilatiofn stipulated by the MCWD, Corps ofEngineers, and the City of Orono. The Affidavit of Publication and Certificate of Mailing were noted The Applicant was present This application is for a proposed office building on the west side o€ Shadywood Road on lot I of Leach Addition Subdivision A comprehensive plan is included for lot 2 of Loich Addition for anotho^ office building, both projects located within the B4 aoning dislikt, and a duplex in the LR>IB zone. The subdivisioa was approved in W78 with a 24* access and utility easement to serve readential lot aloi^ northwest lot line of tot I. Mrixisth sakl the property was the subject of a review in 1980 for an office building, wfatoh never transpired. The Applicant is proposing a I25'x42’ single story office buUdii^ with a south-fitting walkout. Mabusth noted that the parking stalls on the plan were not sufficient for the maximum use potential that a buikbng of this size would demand Although the Appbeam's pUn for the tower level involves storage only, the Chy looks at what the potential use could be in the future for determiniiig parkii^ stalls. If the bufldii^ w»e a sii^ story only, Utt number of stalls would satisfy Chy orditumc^. The pfauis shows 25, 9\I8', stalls The code calls for stalls at 9^c20^. This is a senshive area where drainage is concerned. There is a 12" culvert which drains to the southeast to Lafiiyette Marsh subdivision. Plans for this site must include drauu^e calculations for determining runoff that will leave site at developed level. A retention arm must also be included on this she. It should be noted that hardcover is less than 35% whhin the SOO to 1000' zone Ordinance Section 10.56 allows for hardcover controls for propoties located in commercial zones. The application was tabled at the November meeting at the request of the City because of the complexity of issues to be addressed and we also lacked a quorum. The appli^tion will be the first item to be addressed on this agenda. The original October packets have been recopied for your convenience. There is only one new issue that staff would like to address. That is the issue of the Impact of the proposed 1995 Mn/DOT improvements of Highway 12 upon the property. The City has received severe* conflicting exhibits that suggest various acquisitions of right-of-way by Mn/DOT. F^t the site plan is inaccurate as it does not reflect the 10’ dedication of right-of-way at the time of the Sugarwoods platting defined as a line drawn between A and B (Exhibit T). In reviewing the current Mn/DOT improvement plans. Exhibits W and X. the right-of-way is shown per Lines C and D. Compare Exhibits U and V. 1989 right-of-way line is completely different from the one shown in the current plat map for 1994. Dennis Hill of the County advises Aat this will more than likely be corrected as he has no proof in his files that such an acquisition has been made in 1994 by Mn/DOT but Mr. Rebers should be able to provkte further cl^fication on this matter. All documentation submitted with a formal application must include accurate dimensions reflecting Mn/DOT’s adjusted right-of-way. Review of Appeals Application The first issue that must be addressed is the issue of the use and whether it is compatible or permitted within the B-1 Zoning District. Staff, once again, strongly suggests that you visit the site of the Pro Tire and Exhaust operation at 571 Tamarack Avenue in the Long Lake Industrial Park. The proposed business use shows a retaU operation with show room and office areas with a garage and car wash to rear (review Exhibit N). The acce» onto Highway 12 is a major concern. We have forwarded the site plan to Mn/DOT for their review but have not yet received their comments. Until the application has been reviewed and approved by MnDOT, we cannot determine if the site plan is feasible. We are certain that access to Highway 12 will be more restricted in the future. The City should plan for an east-west frontage road between North Brown Road and Old Crystal Bay Road (sec figure 1, it is only a schematic). When this road is completed, the commercial area along the north side of Highway 12 would access to the north. The proposed site plan should show how the future access would be orientated. The Highway 12 safety improvement project scheduled for 1995 will include a median on Highway 12 that restricts the access to right-in and right-out only. These improvements will likely require additional right-of-way along the north side of Highway 12. If the new access to Outlot E is approved by MnDOT, we would recommend that it be a shared access with the adjacent property, and that it includes a right-turn lane. This would require that a 40 X 50’ right-of-way be acquired on the lot line for the access (see figure 2). Any changes m the right-of-way would change the setback locations and impact the site plan. Prior to the development of the commercial portion of this property# the existing intersection at Brown Road and Highway 12 shall be improved so that safety concerns associated with the current use and future increased use of this intersection are addressed. Configuration of the frontage road and North Brown Road would be determined at the time of development. Frontage road access to Highway 12 could either be opposite Brimhall Avenue in Long Lake# and/or on Willow Drive opposite the frontage road between Willow Drive and Old Crystal Bay Road. The property north of the commercial area would be single family with sewer and water planned for the area. With sewer and water services available to the property# the owner could submit a 1 and 2 acre mixed single family density alternatives for Council consideration. As is noted on page 28* it is anticipated that this MWCC force main will not be utilized for service in the area* with some noted exceptions. This is in part based on the fact that Orono was in opposition to installation of the subject force main* and the fact that the operating capacity of the line* will probably allow for only 50 units for that section between Old Crystal Bay Road and the Long Lake pump station. The anticipated net increase in units for this area will b^^j in the range of approximately 500 {600 total units in the Medina/Orono/Long Lake line, minus 116 units currently allocated to the City of Orono). It is anticipated that the net addition of 500 units will not be of significant impact either to the interceptor system discharging to the Blue Lake Treament Plant nor to the plant itself* given that this change would be while there are upgrades anticipated at the Blue Lake plant. 3. TRANS PORTATION One of the primary goals during this study was that any altered development should be of a nature that would pay for improvements to the corridor. The primary improvements would be installation of frontage roads both to the north and south of Highway 12* together with improved intersection control* at least .at the intersection of Willow Drive and Highway 12. The surveyor for the subdivision advised applicant that the City Attorney for Orono required that the MWCC easement be shown on the plat as a drainage and utility easement. In reviewing the subdivision file, there b no reference as to the existence of the easement nor b there recordmg of any written discussion noting the existence of the easement. There is nothing in the exchanges between suff and the City Attorney that would have suggested conditioning approval on the casement being shown on the final plat. The easement certainly wouldn ’t have been designated as a drainage and utility easement Init rather as a utility easement with the document number of the easement recorded on the plat. Review Exhibits B and E, the MWCC has released all interest in the easement. The original release agreement was sent to the law firm of Fredrikson & Byron for filing against the Chain of Title of the property. It is not clear whether this has been completed by either the applicant or the current owner. The City sees no public interest being served by the existence of the easement. We recommend that the 35’ drainage and utility easement be vacated and that easements be retained as shown on the staff sketch. Exhibit G. I J Zoning File #1981 January 9, 1995 Page 2 Status of Application At the November 21st meeting of the Planning Commission, the three members in attendance advised applicant to request tabling application until the January meeting providing applicant additional time to develop an amended plan that would address the following concerns of the members: 1. Need to reduce the footprint of residence noting that three-car garage appeared excessive. 2. Members preferred a street setback variance rather than encroachment of the bluff areas of the property . Members did not specifically specify how much of a street setback variance would be acceptable. They also encouraged applicant to relocate decks and staircases out of the bluff area and bluff impact zones (30’ from top of bluff). Review of Revised Plan Applicant has reduced footprint of residence to approximately 30’ x 60 ’. The attached garage has been reduced from 3 to 2 stalls and has been relocated to the west side of the residence. The principal .and accessory struchires will be located out of the bluff impact zone and the principal structure will be located 25’ from the street lot line. The structure will be located 46 ’ from the existing travelled road. Review Exhibit I, Gustafson notes in his report that if Tonkaview Road is upgraded, it will be installed as an urban section at a 28’ width measured to the inside of the curb with 10’ grassed boulevard areas. The proposed struchire will be located 42’ from the improved road and 32’ from the grassed boulevard area (refer to Exhibit H). In his report, Gustafson goes on to ask that upon application for a building permit the applicant provide detailed grading and drainage plans for his review. He also notes ^t there may be retaining walls along the north property lines because of the steep topographies. The Engineer ’s report does not note the need to redirect drainage from roof away from the steep bank elevations. Staff suggests that all or the majority of roof drainage be directed towards the roadway. Applicant ’s building plans must provide information on how roof drainage is to be directed towards road and away from the north and east lot lines. Issues for Consideration 1 Has applicant addressed the concerns of the three-member Planning Commission? Zoning FUe #1981 January 9, 1995 Page 3 2. 3. Do members have any questions concerning Section 10.03, Subd. 15 (B) that would allow applicant to extend a ground level patio into street yard area? The patio may be extended as long as it docs not encroach into the bluff impact zone. Non-encroachments may extend into required yard areas but not required setback areas (i.e lakeshore setbacks, average lakeshore setbacks, bluff setbacks). Does this proposal for development appear feasible for the property? Is it too ambitious or excessive? Note hardcover is at 16.8% where 35% would be allowed. She was advised by her contractor of the need to replace existing retaining wall prior to the spring thaw and rains. Mrs. Yorks was advised that there were no future meetings of the Planning Commission for ’94 and that the first meeting of the year in 1995 would not be until January when it would be impossible for the contractor to proceed with retaining wall replacement. Staff advised that the City Engineer would make an inspection of her lakeshore yard to determine if there was a potential for serious collapse of the lakeshore bank based on the condition of the wall. Upon the City Engineer ’s inspection of the Yorks ’ property, he determined that there was indeed a great potential for the collapse of both wall and the steep bank. Mrs. Yorks was then advised that the City could issue no building permits until a conditional use permit review was completed, but that if she had to proceed that it would be advisable that she submit a conditional use permit application and provide all the necessary information for the Engineer to complete his review of the new construction. Gustafson approved the final specs and plans submitted by the Allan Block Corporation, review Exhibits C, E, F and G. Applicant was advised of the need to first complete the filing of a conditional use permit application and to also await the final review comments of the City Engineer before construction of the wall could begin. The wall was constructed sometime in late November or early December. Unfortunately, the contractor failed to ask for inspections of the project zs it was being installed. The Engineer recommended that if the wall was to be installed at a height greater than 4 ’, additional layers and depth of geo-grid were to be used. The Engineer also notes in his letter of January 11th, Exhibit D, the following should have been implemented: 1. Bond beam or bridged construction in front of existing trees. 2. Granular backfill in the bridged areas. 3. 14 inches of buried block (18 inches required at increased height) Gustafson contacted the contractor who advised he was not aware that he had to call for the inspections but noted that photos were taken during the construction of the walls and that to his knowledge, based on field notes, that all of the requirements set forth in the City Engineer ’s review were carried out. As Gustafson has no way of confirming that these were achieved, he Zoning File #1896 January 11, 1995 Page 3 advises that the City should require a written statement from contractor confirming that all of these had been completed as a result of the increase in height. The Building staff confirms that the contractor did provide the required erosion control during construction. It was observed from another property when completing another inspection. The Building staff was not involved in the inspection of the retaining walls as building permits were not issued nor do they routinely complete such inspections when the Engineer completes the strucniral/engineering review. The City Engineer will complete inspection involving land alterations proposed under a conditional use permit. Upon your inspection you will note that the landscaping beneath the steep banks of this wall have been protected. The wall, although close to 7’ in height at the western edge, will not be observed because of the plantings within the steep bank and also the color of the stone used is neutral gray. Staff would caution members that if you proceed to step down the stairs to observe the wall at the base to be most cautious as the steps were slippery and difficult to descend because of the storage of portioas of dock on stair structure. Issues for Consideration 1.Staff is placed smack in the middle (or our Mayor Butler would say " between a rock and a hard place") when dealing with emergency siuiations in the late fall of the year such as in this case. There is no way to provide the necessary land use review to meet the winter deadline. If this applicant was delayed to the end of January, there would be no way to ensure against the collapse of the wall and bank this spring. Staff could have advised the person to proceed on their own and deal with the penalties as they come but we feel it imperative that the City Engineer provide his review and guidance for the reconstruction of walls where there is potential for a serious collapse which was the c^ for this property. How would the Planning Commission advise staff to proceed with these matters? 2. Other issues raised by Planning Commission. Planning Commission Recommendation Your recommendation to approve must include the following conditions required by staff. 1. 2. Applicant ’s contractor to submit for both City and applicant a letter confirming that all additional improvements as set forth by the City Engineer in his report of January 11, 1995 have been fulfilled as a result of the increase in height of the retaining wall that is in excess of a height of 4 ’. On January 5th we inspected the completed retaining wall at the Yorks residence at 2825 Casco Point Road. Neither the applicant or the contractor contacted the City for Inspection prior to or during construction. The height of the completed wall is two to five feel taller than shown on the approved plans. The plans show 4-feet of exposed wall. We had noted in our previous reviews that "if the height of the wall changes at any time during construction, additional geogrid must be included for support of the wall." The contractor should provide information confirming that additional layers and depth of gcogrid were used to construct the wall due to the increased height. Other aspects shown on the approved plans that should have been inspected include: • bond beam (bridged) construaion in front of existing trees • granular backfill in bridged areas - 14 inches of buried block (18 inches required at increased height) The contractor should provide the City with photographs taken during construction, revised plans showing changes in design and any other Information that would document what steps were taken to reinforce the wall at the increased height. Dear Mr. Stockdale, Our in-house engineering staff has reviewed the proposed segmental retaining wall which is to replace an exist.ing treated timber retaining wall. While it is true that no failure has occurred and your proposed walls do not substantially change the current wall geometry, this does not assure future success as this assumes a static condition and future conditions could change. Furthermore the construction of said wall(s) is on an overall slope and any design can address internal and external wall stability but not overall slope stability. For these reasons we suggest the following to insure that the replacement wall not exacerbate the current stable condition. 1. All walls should be geogrid reinforced to insure Internal and external stability. 2. Geogrid reinforcement will necessarily require ‘'benching" of the reinforced zone into the existing slope geometry. 3. To insure no future changes in the soil in the reinforced zone: a. use free draining material (limited to 5% fines) in backfill/reinforced zone and leveling pad. b. place drainage tile behind the base course of block zuid also at base of the reinforced zone where it meets the retained soil - all tile draining to daylight. c. backfill the top 6" (below top soil) with impermeable clay soil to prevent surface drainage into reinforced zone. d. grade to prevent surface ponding above walls. 4. Because of the slope at the toe of the wall(s) it is recommended that a minimum of 2 courses of block be buried or H'/7 embedment depth which ever is greater, course buried block for the top 2'wall is adequate. Your proposed construction procedures are appropriate. I recommend excelsior netting be dormant seeded for Spring germination of appropriate vegetation. 6. All block and grid installation in accordance with the specifications in the Allan Block Design Manual. 7. I have included the engineered wall details for the a 6'wall which represents your major wall including buried block. In sxjmmary; said walls can be constructed as designed with the understanding that design parameters are for internal and external stability only and no provision for overall slope stability. As you noted, the slope has been stable and it is reasonable to assume it will remain so if conditions do not substantially change; the most critical condition being ground water. For this reason we have recommended the above procedures which we feel will insure that no hydrostatic pressures develop and selected backfill will insure soil uniformity and performance. Said construction neither improves or diminishes the global stability of the slope but given that you will be eliminating the most probably failure scenario, your approach is entirely appropriate with the disclaimer that should the total slope fail, sail failure would likely include the retaining walls. Mr. Gustafson of Bonestroo and Associates has apparently expressed concern over the effect of the "weight" of the soils on the slope. This is a legitimate concern. I feel the existing walls suggest adequate bearing capacity and slope stability and the proposed design parameters above will improved the current situation and reduce the prospect of future failure. All of the work commenced without a building permit. 'The project was shut down by the building staff. When a survey was obtained by the owner, it was t Zoning File #1987 January 11, 1995 Page 2 discovered that the existing structure is only 4.7’ from the side lot line, review Exhibit B. A 14’ unimproved alley separates the property to the immediate north. Upon your inspection note the privacy fence installed within the unimproved right-of-way. The neighbor to the immediate north has provided an acknowledgment form and has voiced no concern with the proposed reconstruction of the three season porch in its former envelope. The three season porch is 10.9’xl5.3’. The struchire not only serves as a three season porch but provides an enclosed entrance to the lower level basement. Pillar began to make repairs to foundation and decided to replace the foundation. With foundation repairs he found the stud walls and siding needed replacement. The renter advised of a leak in the porch roof and when the roof was inspected for repair decided that it too should be replaced. Applicant advises based on the approximate age of the house and the condition of the structure that the three season porch had probably existed for fifty years on the property. Mr. Pillar, the applicant, is the owner of the property but does not reside at the residence. The structure is a rental property. The owner resided at the property approximately five years ago. The 14’ unimproved alley provides an additional buffer to the residence to the north receiving most impact from the structure located 4.7’ from the side lot line. The structure has existed on the property for over fifty years. , The structure provides an intemal/enclosed access to basement level. If unimproved 14’ alley was vacated, this property would receive benefit of the entire 14’ right-of-way because the alley was dedicated with the platting of the Casco Heights plat in 1911. Issues for Consideration 1. Could structure have been rebuilt on property meeting required side setback of 10’? On your inspection note location of windows to immediate south of the three season porch. Also internal access to basement is through this portion of residence. It is located approximately 130 ’ along the channel side and 60+’ within the west street yard. Portions of the fencing were either repaired or replaced sometime within the summer of 1994. The newly constructed fence was observed by the Inspection staff. The applicant was advised of the need to apply for a variance. The entire fence is located within the 75’ setback area. The applicant has provided 1988 photos of the former fencing taken at the time of an appraisal of the property. Hardships are reviewed as follows: 1.The Narrows Channel is a high traffic inlet/outlet between the Lower Lake and the Upper Lake. There is a need for both visual and noise protection from the noise of the boat traffic and sounds of the boaters that pass through the channel. 2.The Channel is heavily trafficked both in the summer by boaters and the winter by snowmobilers. 3. 4. 5. The Fence is at least 15-20 years old and suffered damage from frost heaves and lack of general maintenance. The Fence is parallel to the narrows and between Lafayette and Carmen Bay across from the Tonka Bay Fishing Park and in front of the Narrows Bridge on Shadywood Road. The residence was purchased and remodeled with permit, after purchase in July, 1993. The Fence was repaired and partially replaced in June, 1994. A variance was not requested since we were not aware it was required to repair and/or replace an existing fence. HARDSHIP DESCRIPTION OF UNUSUAL PROPERTY CONDITIONS; The following is a summary of unusual property conditions which we believe are pertinent. 1. Our property is located directly on the West side of the na^:-ows channel between Lafayette Bay and Carmen Bay on Lake Minnetonka. The narrows channel is a high traffic inlet/outlet between the lower lake and the upper lake. The Fence, which is wood with vertical slats (stockade type), is approximately 6 to 6-1/2 feet high, provides significant noise protection from boat traffic and boaters going through the channel (see attached photo's) in summer and from snowmobile traffic in winter. It also provides significant visual privacy for our back yard and side yard from passengers on boats and snowmobiles going through the narrows. Other private property on the narrows channel have similar fencing. We understand the Fence was initially built to provide privacy and noise protection. Elimination of the Fence would significantly reduce the value of our property. 2. Located directly across from our property is the Tonka Bay Fishing Park (see attached photo). The Park allows for fishing along the East side of the narrows channel from under the Narrows Bridge all the way to the Northeast point of the narrows (all other property on the narrows, including ours, is private and are non-fishing areas). The Fence provides noise protection and visual protection from people fishing in the Park. The Fence also assists in the enforcement of posted no fishing zones on our side of the channel. The Park is heavily used and crowded with people fishing throughout the summer. This flooding makes it virtually impossible to access our driveway at times and for local traffic to pass. We applied for and were granted permits from the MCWD and Corps of Engineers for excavating the pond for rea.sons of aesthetics; environmentalism, (fill had previously been placed in this portion of this property years ago, and now is home primarily to the exotic "purple loostrife;" and water storage. Applicant had applied for a conditional use permit for the restoration of a guest house on his property in the summer of 1994. He continued to work on the restoration of the shoreline of his property receiving pemuts from the Watershed District for installation of a sand blanket arid rip rapping of eroding shoreline. He expanded the permit with the Watershed DisLict to include the excavation of the pond in the street yard and was also advised to proceed with the permit process with the Corps of Engineers. Applicant had also been in contact with the City for the past year dealing with the flooding problems of Kelly Avenue and the proposed realignment of his driveway. Driveway improvements involve placing of berms and plantings within the unimproved portions Zoning File #1989 January 11, 1995 Page 2 of the Kelly Avenue right-of-way. Mr. Stoddard had unfortunately assumed that his contact with the Public Works Department had covered any other necessary local government approvals. The building inspector stopped the project and appropriate erosion control measures were taken. Applicant immediately filed the necessary conditional use permit. The area to be excavated is not a designated wetland and is located out of the proposed storm water improvements for Kelly Avenue, review Exhibit L. Gustafson reports that the proposed project will have no negative impact on proposed Kelly Avenue storm water improvements. The area to be excavated is not a protected wetland of either the City, State or Federal authorities. The pond will provide additional retention of runoff within the area. Gustafson cautions about proposed landscaping improvements within the unimproved portion of Kelly Avenue noting that large boulders or trees should not be planted within the right-of-way. John Gerhardson will work with the applicant to ensure that right-of- way is protected. It is doubtful whether the 5’ + high berms will be allowed but this must be resolved by the Public Works Director with the applicant. The pond will be approximately 60 ’x60 ’ and will result in the dredging of some 600 cubic yards ot fill. The excavated fill shall either be used in the grooming of the sides of the pond and fc*- the additional landscaping within the street yard of tlie property. Any remaining fill will be removed from the site. Issues for Consideration Applicant ’s addendum notes the purpose of the creation of a pond is for aesthetics, retention of surface runoff and environmental as site had been previously filled and is covered with purple loostrife. The Engineer confirms that the excavation of the pond will have no impact on the future storm water improvement plans for Kelly Avenue. 1.Do Commission Members have any other concerns, i.e. safety, location of 6 ’ to 8’ pond adjacent to roadway, need for physical barrier? 2.Any issues to address concerning the circumstances of the dredging of the pond without the necessary permit approvals from the City ... As we said, the warm, dry season doesn't appear to be coming which has somewhat taken care of this problem in past years. Instead, there has been up to one foot of standing water in the road which has resulted in cars getting stuck in an attempted "shortcut" over my lawn, resulting in tow trucks ripping up more of my yard. We cannot get to our mail boxes except by four wheel drive, and on one occasion, guests had their car flooded as the water came up over the sill in their car door, resulting in a sprained ankle when abandonment was necessary. I could go on but my intention is not to gripe, but to hopefully propose and be part of the solution. In our discussions, 1 understand a costly alternative consists of a storm sewer which would mean both allot of time, and money assessed to homeowners. I would like to propose a quicker, less costly fix which would consist of raising the road slightly in the affected area. As one of the main property owners affected due to my driveway access. I urge expedient road repair before someone is injured due to faulty car brakes which are affected tremendously when driven through one foot of water. This can potentially result in a huge liability to Orono of which you knew of previously, however haven't yet remedied. -Cars have stalled in the middle of the road for hours; -Our newspapers get randomly delivered, and then usually wet. I can only retrieve it with my vehicle; -Our mail is wet every day and sometimes illegible due to cars splashing it; -Our yard gets wrecked from both water ponding and cars driving over our property trying to avoid as much of the pond on the road as possible; -Three instances have been r;ported to me plus my experience of nearly having an auto accident because our vehicles brakes have been affected from driving through the water. The brakes get so saturated, that it takes nearly four times the distance to stop. By this letter, I am notifying you of your party to this danger and liability; -On one occasion, a tow truck was necessary to remove a vehicle stuck in the mud in my yard as they tried to avoid the road; -Water has entered more than a few cars from the door sill of visitors. Sometimes they do not even attempt to come up my drive, either electing to park at my neighbors, or not stop altogether; -I have witnessed over 100 vehicles elect to make a U-tum in the middle of the road than to drive through the water. As you can see, this is not only a nuisance, but what I believe a potentially huge liability for the city of Orono. The water on the road in front of my house is well over one foot deep. Our beautiful City of Orono contains many great roads and I am proud of the way they are maintained and the results of our Public Works Department. I understand you do not have the resources to fix every problem which pops up from timc-to-time, but the flooding on Kelly Avenue is a reoccurring problem. In addition to the marsh which is the source of this water, the storm sewer adds water to the problem periodically, as evidenced by water streaming from the top of the manhole. I hope you will devote your attention to remedy the problem by raising the road in this area as soon as possible. I have enclosed a copy of my letter to you from last summer. I have been very patient with your efforts to date. I wonder how patient Orono's "tax collector" is? Allowed height = 30’ Proposed 26Vi’ measured to the mean or average distance between the highest point of the peak and the ceiling joist of upper level at the low or south side of walkout. Section 10.61, Subdivision 6 (F) - Parking stall size. Required = 9’ x 20’ Proposed = 9’ x 18’ Variance required. Section 10.61, Subdivision 5 (B) - Required side setback for parking. Allowed = 3’ Proposed = 25’ Side = 12’ (based on 18’ parking stall length shown on plan) Note parking stalls open out onto lot line. Zoning File #1991 January 12, 1995 Page 5 to Carman Cove. Approximately 9 of these acres drain directly to the tile system while the runoff from the remaining 37 acres ponds in the wetland area located in Lot 3. The wetland has a storage capacity of approximately 2.75 acre-feet. When the capacity is exceeded, the wetland floods across Kelly Avenue to the west to the drain tile system. During the 1978 subdivision review it was noted that drainage from the development of this subdivision must be directed to the southeast comer of the property and away from Kelly Avenue. Now with the Marsh at Lafayette subdivision, the property is no longer just an open vacant area but is now residemially developed and the sending of uncontrolled amounts of mnoff to the site may have a major impact on that developntent. It will be unperative that retention be provided on this site. Applicant’s engineer must provide the necessary hydraulic information to ensure the protection of the Marsh at Lafayette development. Sewer and water assessments have been paid for Lots 1 and 2. Each lot has been assessed two sewer and two water units. Issues for Consideration 1.The County should review all access proposals to this site. In the earlier review it appeared that the County would have no problem with a shared access at the shared lot lines of Lots 1 and 2. If all access to the site is via one access, then are we dealing with a private road? 2.The parking layout must be redesigned so that an access roadway is not located to the immediate rear of the parking stalls. Remember Lot 3 can be developed as a duplex unit. The use of the road will be intensified. Access cannot be achieved via Kelly because of the wetland. Parking stalls must be redesignated at 9’ x 20*. 3.Loading berth should be required and designated on plan. What is ^Planning Commission ’s recommendation concerning net fl^«- area for building - to cwt^ needs for one story use or two story use? ' 4.Concrete curb and gutter should be designated on plan for the direction of the drainage. The plan shows the office buildings with a shared parking lot and one access out to Shadywood Road (Co. Rd. 19). A typical commercial site plan would have a separate access and parking lot for each lot. The commercial buildings and parking lots do not ai pear to meet setback requirements. The access to the duplex is through the parking lot and sh<i.red commercial access. The City Code allows that a two unit duplex may be served by a shared driveway. However, this driveway must be separated from the commercial access and parking lots. «50u.'f^ ^ , 'Tl.’ The proposed drainage on the site is directed to the noi theast to an existing culvert. This concept is acceptable. Drainage calculations should be provided for the site. A storm water sediment pond may be needed near the oor^ast comer of the site due to the increase in hardcover. The proposed access location appears to have adequate site distance but must be reviewed by Hennepin County. The County may need additional right-of-way along Shadywood Road (42-feet recommended).
