RE: Encroachment agreement, Right of Way
In 2009, as part of the review of a proposed septic system, it was noted that portions of
the septic system crossed platted but unimproved Right of Way (ROW) and an
Encroachment Agreement (Agreement) was to be signed. The Agreement was to inform
the property owner and future buyers of the property of the presence of the system in
the ROW.
Due to the time that has passed,the Staff, including the city attorney, has determined
that the costs associated with confirming title and collecting the appropriate signatures
did not outweigh the benefits to the city. It was also noted that small utility locates
would not search for private septic systems.
Future projects on the property should provide the necessary encroachment
agreement.
