The Orono Planning Conmisslon met on the above date with the
following nem^ers present: Chairman Kelley; Planning
Commissioners Cohen, Bellows, Hanson, Brown and Moos. The
following represented the City staff: Building and Zoning
Administrator Mabusth, Assistant Planning and Zoning
Administrator Gaffron and City Recorder Scheffler. CounciImember
Goetten was also present.

The Affidavit of Publication and Certificate of Mailing were
duly noted.
The applicant was present for this public hearing, as was
Mr. Gary Peterson, Mr. Jerry Sunde, his surveyor, and Mr. Steve
Schirmers, his septic consultant.
Building and Zoning Administrator Mabusth provided a brief
introduction of the proposed subdivision.
Chairman Kelley observed that the "flag lot" would not meet
the required lot width. Mabusth said that a lot width variance
would be required for that lot and that staff was presenting two
options for accessing that lot.
Mr. Doug Merz, 3195 Watertown Road, asked in what direction
water from the wetland flowed?
Mabusth explained that the water came from the north from
Claussen Lake and flows toward the south. Mabusth said that
there is a large wetland that drains from the Eisinger property
through a drainageway under the railroad tracks. The southern
one-third of the property drains to the south and then exits at
the southeast corner.
Chairman Kelley noted that the applicant is proposing to
install a retention pond to slow the movement of water leaving
the property.
Mr. Sunde said that the Minnehaha Creek Watershed District
will require the developer to not exceed pre-development
discharge. Mr. Sunde explained the applicant's proposal to
control drainage.
Ms. Carol Senn, owner of property to the west of Mr.
Carlson, asked whether the pond would be located close to her
property line. Mr. Carlson confirmed that it would be close to
her property line.
Mr. Sunde said that the pond could be located anywhere in

that area as long as it is far enough north so that it catches
the runoff.
Mr. Merz asked whether due to the lower water levels now
existing if the applicant's drainage plans would further slow the
runoff from Claussen Creek? Mr. Sunde did not believe it would
h-»ve any effect. Cuirman Kelley asked how nuch flowage there
was currently? Mr. Merz said that it was fairly dry. Mrs. Senn
added that in the Spring there is heavy flow coming from Claussen
Creek.
Mr. Scott Goldsmith, 265 Old Crystal Bay Road, said that he
had a flowage and conservation easement on his property that was
required by the City. Mr. Goldsmith said that water comes into
his property from the north and runs west.
Chairman Kelley asked how the slope of the lots would
facilitate septic systems?
Mr. Schirmers said that all lots would require mound systems.
He said he has found areas available that are at 6% slope or
less. Two lots appear to have future expansion sites within
areas at 7% slope. Along the perimeter of the wetland, erosion
has formed plateaus and will allow for septic systems being
placed at the base of the slope. He said that all of the lots
had been tested with the exception of Lot 8.
Assistant Planning and Zoning Administrator Gaffron said
that there are some steep slope concerns for Lot 8 where the
slopes are at 9t. He said that Lot 8 was questionable as a
building site. Gaffron said that he is also concerned about the
existence of only one primary and one alternate site being
available for the majority of lots. He said that during the
course of constructing the road, lack of extreme care by the
contractor could easily result in the destruction of one site or
the other, thus losing the buildability of the lot entirely.
Mr. Carlson said that he would take necessary measures to
assure that those sites would be protected.
Planning Commissioner Bellows observed that it would be
difficult to achieve access to the proposed attached garage on
Lot 6, Block 1, and yet avoid the septic areas.
Gaffron replied that indeed he had not yet received a
detailed report for each site and it is difficult to determine
any specific separation distances without that.
Schirmers said that there would be some room to slide the
systems around on Lot 6. He said that the slope would allow the
mound to wrap around to the west. Mr. Sunde said that the lot
was open and would allow for flexibility in the location of the
septic system.

Gaffron said that staff needs more tine to review this
aspect of the application once the detailed reports are
submitted.
Mr. Carlson asked that approval be given conditioned upon
approval being given by staff.
Mr. A1 Engleman, 315 Old Crystal Bay Road, said that he was
opposed to the road outlot being proposed to the east.
Chairman Kelley explained the policy of the City regarding
the need to plan for future roads.
Planning Commissioner Bellows said that the road being
proposed does not have direct access to the lots. She also said
that she questioned the buildability of two of the lots shown in
the plat. She said that she would have difficulty giving
preliminary approval of this subdivision without the septic
report. Bellows also said that she objects to the creation of a
flag lot.
Mabusth asked the Planning Commission how they felt about
the shared access being proposed for Lots 6 and 7 along the south
lot line.
Bellows said that there are many beautiful trees to the
south which will call for the road to be placed north of the
property line. This in turn will push the house lots further
north into the wetland.
Mr. Carlson disagreed with Bellow's opinions regarding the
proposed road. He said that he had gone to great lengths to find
the optimum plan for the road and there were no other options.
Planning Commissioner Hanson said that he had reservations
about approving a road that runs through the Orono designated
wetlands. He said that he may be able to approve such a
configuration, but did not like the concept of the additional
road beyond the end of the cul-de-sac needed to access the lot.
Hanson also said that he objected to the creation of the flag
lot and would have difficulty approving the subdivision without
having the opportunity to review the septic testing report.
Chairman Kelley said that the lot configurations bothered
him. He suggested that Mr. Carlson was trying to force too many
lots into this development. He said that he did not object to
the road running through the designated wetland. Kelley said
that he objected to the septic informtaion being incomplete and
the creation of the flag lot.
Mabusth asked Schirmers which lots would be considered to
have the most limited location for septic sites?

Mr. Schirmers pointed out specific lots on the diagram and
stated that because of the severe slope and poor percolation
rates some of the sites will be limited as to septic development.
Chairman Kelley asked how the City protects the alternate
sites from being destroyed for the purpose of constructing tennis
courts and other accessory structures.
Mabusth said that the City will have to warn the future
property owier, not only the developer of the need to protect
those site:;. Mabusth said that the City has not specifically
done this in the past although those concerns were always
addressed when accessory structure permits were requested.
Mabusth said that a copy of the mapping of the septic sites
approved with the preliminary subdivision would filed with a
covenant or another appropriate document.
The Planning Commission as a whole, with the exception of
Planning Commissioner Cohen, did not object to the road be
located in the designated wetland.
In regard to configuration as a whole, Cohen indicated that
he believed the plan was calling for more lots than the area can
efficiently handle. Bellows said that the < nfiguration as shown
would not get her approval, due to the flag lot and pushing the
parcel to its limit of development. Brown said that he would
vote favorably if it is demonstrated that the lots can handle two
septic sites and if there are no variances required. He also
conditioned that upon the septic being approved. Hanson said
that he had trouble with the northwest configuration, the flag
lot and that he felt the density was a bit too high. Moos opined
that the development was too dense for the topography and that
she too objected to the flag lot.
Ml Carlson asked the Planning Commission for direction and
more specific information as to what they would like to see him
do.
Kelley said that he would like to see all lots meet the
width standard, irrespective of configuration, including a direct
access to the lot.
Bellows summarized that the road through the wetlands is no
problem, but it must provide direct access to the dry buildable
portion of the lots.
The Planning Commission suggested that Mr. Carlson may have
to revise his proposal showing one less lot along the east side
in order to meet the 200* front width.
There were no further comments from the public regarding
this matter and the public hearing was closed.

Planning Comissioner Bellows, to table this application until
such time that the septic report has been reviewed by the staff
and Planning Coanission. Planning Coninissioner Bro*m questioned
how the City would protect the draintile or drainage ditches
running through this property? Mabusth replied that they would
be protected with drainage easements. Kelley placed the
applicant on notice that he should submit information pertaining
to the location of the draintile before coming back before the

Building and Zoning Administrator Mabusth explained that
staff's hardcover calculations had been incorrect due because a
portion of the 0-75' setback area was not included. Staff has
calculated that there will a 1.2% increase in hardcover in the
75-250' setback area. Mabusth said there will be a 1' to 1.5'
encroachment of the average lakeshore setback line.
Planning Commissioner Hanson asked Mr. Copley whether he
would be willing to remove existing hardcover in order to keep
the percent of hardcover the same?
Mr. Copley said that he would prefer not to remove any of
the existing hardcover.

Planning Coininissioner Brown said that, the existing
hardcover was 24%. He would be willing to allow the applicant to
increase to 25% which is the waxlnium allowed.
There were no comments from the public regarding this matter
and the public hearing was closed.

Planning Commissioner Hanson, to recommend approval of the
average lakeshore setback variance of approximately 1.5* and that
hardcover was to be retained at 2.5%.

explained the Pemberton's proposal to convert an existing grade
level deck into an addition to their dining room.
Chairman Kelley asked whether the Pemberton’s had received
any input from their neighbor to the south?
Mr. Pemberton said that he had spoken to his neighbors on
both sides and they had no objection.
Planning Commissioner Brown asked if there was existing
hardcover that could be removed?
There were no comments from the public regarding this matter
and the public hearing was closed.
Planning Commissioner Brown reminded Mr. Pemberton that
during their recent visit he had indicated that he would be
removing hardcover from the back of the house.
Mr. Pemberton said that he would be willing to "punch holes
in the plastic that is presumed to be underlying the rockbed.
Gaffron said that staff prefers to have the plastic removed,
since hole punching is nearly impossible to verify.
It was moved by Planning Commissioner Hanson, seconded by
Planning Commissioner Cohen, to recommend approval of this
application provided that the plastic underlying the rockbed in
the northeast corner of the property is removed. Motion, Ayes=4,
Bellows and Kelley, Nay, due to their preference to see hardcover

Assistant Planning and Zoning Administrator Gaffron
explained ♦•het Mr. Hibbs was requesting a hardcover variance to
enclose an existing canopy area. Gaffron said that there would
be no increase in hardcover resulting from the conversion of the
canopy/bi turn! nous area into a screen porch.
Chairman Kelley told Mr. Hibbs that he was concerned about
the fact that there was no existing garage. He said that more
than likely there will be a future request for a garage.
Mr. Hibbs replied that a tuck under garage would be most
practical for this property. He said if a tuck under garage were
constructed approximately 1,000 s.f. of bituminous could be
removed.
Planning Commissioner Cohen said that he would prefer to see
Mr. Hibbs make application for a garage prior to proceeding with
this application for the screen porch.
Chairman Kelley said that he preferred not to change
hardcover into structural hardcover.
Mr. Hibbs said that the hardcover already exists.
Planning Commissioner Bellows expanded on Chairman Kelley's
concern about converting hardcover into structi’ral hardcover.
She said that in order for the porch to be constructed, footings
would have to be poured which would make more permanent an
already excessive hardcover condition.
There were no comments from the public regarding this matter
and the public hearing was closed.
It was moved by Planning Commissioner Cohen, seconded by
Planning Commissioner Bellows, to recommend denial of application
#1453 requesting a hardcover variance to enclose an existing
canopy area. Motion, Ayes=5, Hanson, Nay due to his belief that

Mr. Allan Larson was present for this application.
Assistant Planning and Zoning Administrator Gaffron
explained that the applicant was tearing down an existing
structure and will require a side setback variance in order to
construct a new residence. The applicant owns two adjacent tax
parcels. Gaffron said that there is a large oak tree centrally
located on the property that the applicant wishes to preserve.
The applicant submitted 5 options showing various locations of
the house in relation to the tree.
Gaffron noted that once the existing structure is removed,
the City views the property as a new, buildable lot with the
capability to meet all setback requirements without the need for
variances.
Chairman Kelley and Planning Commissioner Cohen concurred
that there appears to be adequate area within the lot to meet
setbacks if plans are redesigned.
Mr. Larson disagreed, saying that there were many other

trees on the property in addition to the 38" oak tree. Mr.
Larson also said that locating the hourse elsewhere may also
create a problem with hardcover due to the need to make the
driveway longer. He said that locating the house as proposed
makes use of the more undesireable portions of the property. He
said locating the house so that it extends onto Lot 10 would use
portions of the property that would be best as lawn and tree
area.
Planning Commissioner Brown asked if there would be a need
for any variance if the applicant chose Option A. Gaffron
confirmed that no variance would be required.
Mr. Dick Hanson, 3826 Cherry Place, said that he had
reviewed Mr. Larson's plans and believes that the house would fit
very nicely.
Mr. Larson said that he preferred to use Option B as it
would allow for the most clearance from the tree.
Planning Commissioner Hanson said that he too would view
this as a "fresh start" and believed that Mr. Larson could
develop a plan chat would not require a variance.
Mr. Larson agsln stated that if he constructed the home in
such a way to require no variance, then hardcover would Increase.
Planning Commissioner Cohen pointed out that Option A did
not require a variance.
Mr. Larson said that would only allow 3' between the house
and the oak tree.
Planning Commissioner Bellows said that in her opinion.
Option B did not allow enough room between the house and the tree
either. She said that in order to build the house, there would
be a need to excavate much closer to the tree than 5'.
There were no comments from the public regarding this matter
and the public hearing was closed.
It was moved by Planning Commissioner Hanson, seconded by
Planning Commissioner Brown, to recommend denial of the side

Mrs. Brad ChiIdsr the prospective buyers of the property.
Assistant Planning and Zoning Administrator Gaffron
explained that this is an application requesting approval of an
after-the-fact structure-to-structure setback variance for a
detached garage. Gaffron said that approval of this variance
should be conditioned upon inspection by the City to verify that
appropriate fire walls exist in both garages.
Mr. Childs expressed his support for the approval of the
variance.
There were no comments from the public regarding this matter
and the public hearing was closed.
Planning Commissioner Cohe.; observed that the City had
written a letter to the Emfields on June 17, 1986 and questioned
whether anything further happened beyond that date?
Building & Zoning Administrator Mabusth replied that the
Emfield's building contractor was supposed to meet with the
City's Building Official, but did not follow through. Mrs.
Emfield said that the contractor had indicated that he had
followed through, but he had not.
There were no comments from the public regarding this matter
and the public hearing was closed.

duly noted.
Mr. and Mrs. Bichanich were present for this matter.
Assistant Planning and Zoning Administrator Gaffron provided
a brief explanation of this application for a side setback
variance to construct a second story addition. Gaffron also said
that the ex.^sting drainfield system is small and does not meet
the current codes, but it seems to be working. Gaffron also
explained the septic concerns involved with the proposed
expansion of this property (see MPG memo of 9/15/89).
Chairman Kelley asked Mr. Bichanich what the current use of
the guest house is and what he plans to do with the two lots?

Mr. Bichanich said that he intends to combine the two lots#
but he needs to refinance in order to do that. In order to
refinance# he has to make some improvements to the house. He
said that once the lots are combined and sewer goes in, he would
either incoporate the guest house into the principal residence or
remove it.
Chairman Kelley Indicated that he too had a concern
regarding the intensification of the use and the effect it will
have on the septic system.
Planning Commissioner Brown asked Gaffron if there was
another drainfield site on the property?
Gsffron replied th.nt it was very likely that a conforming
system could not be installed. He said that the soil type will
probably call for a mound system, but there is not enough area
with suitable slopes on the lot for a mound system.
Chairman Kelley questicied whether the combination of these
two lots could be a conditior of approval?
Gaffron and Mabusth believed that such a condition could be
part of the approval of the V£riance.
Mr. Bichanich presented a letter that he had received from a
neighbor supporting his application.
There were no comments from the public regarding this matter
and the public hearing was closed.
Planning Commissioner Brown indicated that he was concerned
about the septic system.
Gaffron said that the septic code is not part of the zoning
code. He said that he would have to take this issue to Council
for some direction.
It was moved by Planning Commissioner Hanson, seconded by
Planning Commissioner Cohen, to recommend approval of the side
setback variance to construct a second story addition. Kelley
informed the Bichaniches that it is really the intent of the City
to have these lots combined and the guest house torn down.

Assistant Planning and Zoning Administrator Gaffron
explained that the Mulvanny's were requesting an average setback
and hardcover variance to construct a room addition over an
existing deck. Gaffron questioned whether it would be possible
for the applicants to remove any existing hardcover.
Chairman Kelley asked Mr. Mulvanny what his hardship for the
variance is?
Mr. Mulvanny replied that their bedroom is 9' x 12' and the
kitchen area is also quite small.
Chairman Kelley asked Mr. Mulvanny whether he intended to
put a deck on the front side of the house?
Mr. Mulvanny replied that he had a deck for so long that he
would prefer not to have one any longer.
Kelley informed Mr. Mulvanny that if approval is given for
this application that it would preclude anyone from adding a deck
anytime in the future.
There were no comments from the public regarding this matter
and the public hearing was closed.
It was moved by Planning Commissioner Hanson, seconded by
Planning Commissioner Cohen, to recoiranend approval of the average
lakecnore setback. Planning Commissioner Bellows said that she
was having a difficult time finding a hardship for the variance.
Planning Commissioner Cohen said that he considered living with
less than adequate space to be a hardship. Planning Commissioner
Bellows asked Mr. Mulvanny how many bedrooms the house has and
what size they are. Mr. Mulvanny said that there were three
bedrooms, two of which are 10' x 10' and one is 9' x 12

The Planning Commission explained the City's position
regarding access, water & sewer and the 75' setback zone.
Chairman Kelley also noted that the applicant does not own all of
the property.
Mr. Franklin said that a purchase agreement had been entered
into with Mr. David Mess for the property at the end of the point.
Kelley said that he would not approve any hardcover
variances for this very sensitive property. Kelley asked the
applicants if they were familiar with the City's hardcover

Mr. Vogt said that he was familiar with the hardcover
ordinances, but was hopeful that the City would viev/ hardcover in
this application as a whole. He said that their proposal would
leave 70% of the area untouched.
Kelley said that the City would look at hardcover proposed
for each area. Kelley also observed that the applicant's
proposal called for more than 25% hardcover in the 75-250' zone.
Mabusth advised the applicant that the City's ordinances
would not allow for the consideration of hardcover coverage on
the parcel as a whole.
Planning Commissioner Bellows noted that the applicant's
proposal had not given adequate consideration to the 931.5'
elevation.
Mabusth said that accessing the property via a public
roadway had not been addressed, nor had the extension of sewer to
the proposed units.
Mr. Franklin said that with the tax structure as it is, and
the cost of the land, it would not be economically fea«iible to
build anything less than 10 units. Mr. Franklin said that the
area of Baldur Park upon which he wishes to build, is currently
littered with trash and is a trouble spot for the Orono Police.
He felt that his development proposal would be beneficial to the
City in many ways.
Chairman Kelley said that he did not believe that area could
support 10 units.
Planning Commissioner Hanson said that ht. too would have
difficulty recommending approval of the proposal as !*• is being
presented at this time.

It was moved by Planning Commissioner Cohen, seconded by
Chairman Kelley, to approve the minutes of the September 6, 1989
Planning Commission meeting. Motion, Ayes=5, Nays=0, Motion
passed.
PLANNING COMMISSION REPRESENTATIVE
It was agreed that Planning Commission member, Sarah Moos,
would represent the Planning Commission at the October 9, 1989
City Council Meeting.
