RE: Biq Island ;- Record Lot #60
Dear Mr . & Mr s . Adar.ls
Thank you for your attention to the notice and forms I sent you
recently concerning the Big Island Zoning Ordinance .
You signed and returned to me form #1 which identified your property
and its size classification. This was intended to be returned only
if you found an error or disagreed with the information we had on
file concerning your property. You did not indicate what if any your
concern might be .
I have enclosed the entire information package again so you can review
it once more .
Your property is a small lot and a single tax parcel . It would be to
your advantage to consider completing the white variance resolution
form #2 . This is a legal document intended to be filed in the chain
of title of your property and designed especially to "grandfather"
building rights on existing small lots like yours .
If you have any questions about this, please call me at 473-7357 .
Returning the variance resolution is optional . There is no fee for
having the City record it at this time. If you want this to be done ,
please sign, have notarized and return it to the City before July l ,
1983 .

llear Isla~d La-downer :
The purpose of this letter is to provide you with information regarding
the recent zoning changes on Bib Island , and how these changes may
affect your property .
The new RS Seasonal Recreational zoning regulations aere established
by City Council adoption of Ordinance i246 on December 30 , 1982 . This
action also ended the development aoratorium that had been in effect
since November 9 , 1981 .
A summary of the ordinance is attached . If you are interested , a
complete text of the ordinance is also available for a nominal charge
of $3 . 00 to defer printing and mailing costs .
Your property is identfied in the ordinance by the Record Lot Number
shown above and on the attached blue oage . This identification is part
of a special section that inventories lot by lot the ownership patterns
and existing uses of island property . Based on this record , the ordinance
then "grandfathers" building rights for these Record Lots by making them
eligible for lot area variances . This means that for the first time
even if yor lot is less than five acres (or two acres under the previous
orJinance) that you may now build a new seasonal cabin , or if you already
nave a cabin, that it may continue to be used , improved , added-onto or
replaced oith a new cabin, subject to building permits and setback
regulations , e;.c . , but without questioning its use for building purposes ,
and without requiring any special City Council review.
7n order for you to automatically receive the benefits of t:e lot area
varianr_e , yo should review and complete the following before July 1 ,
1983 :
1 . Please verify the Record Lot information on the attached blue page
and notify the City if there is a problem or a change .

2 . If the Record Lot information is complete , please sign , have
notarized and return the white Variance Resolution . State law
requires that all zoning varian;.es be recorded with the Coun_y
Recorder in resolution form. Beurning this resolution is optional. .
ibut if }ou choose not to do so , you may be required to pay a fee
! and file a formal variance application in the future if you ever
, plan to do any building on the property . There is no fee for navin
this aatomatic variance recorded at ttiis tie .
3 . If your Recod Lot consists of tao or rore separate ta:_ parcels , a
green form ter requesting a co:.ibined assessren is enclosed . Pease
sign and return this to the City to allow your tat recorcs to be
chanoe3 into one parcel consistent with the zoning and to assure
the nost favorable tax rate possible .
4 . A conditional use permit issued by the City Council is required
for certain land uses in the RS District , including the following
residential uses :
a) If ,ou use or have used your cabin FQR MORE THAN 180 DAYS/ER.
b) If vou have ?`fORE THAfi ONE CABi.N on your propert} .
Refer to the enclosed yellow sheet for a definition of these uses
including a description of when a special permit is or is r.ot required
If you wish to apply for a permit , mark tne yellow page and rturn i*
to the City . We ill sencl you tne appropriate applicaion form by
return aai1 .
A postage-paid envelope is enclosed for your use in retu-rning tne above
forms to the City . If you have any questions about this , please all
Alan Olson or Jeanne Mabusth at 473-7357 .
On behalf of tne City Council and Planning Commission , I want to take
this opportunity to thank each and everyone of you whose interest and
participation this past year has helped so much in the completion of
this planning process . I have certainly enjoyed neeting all of vou and
learning so much about your island . I hope this last step can be kept
as simple as possible so that your property rights can be correctly
recorded for your future benefit .
Sincerely ,
