payable in 1998. ID 07-117-23 12 0016.
Dear Sir:
We recently received an estimated market valuation of
$260,000. In 1997 we payed taxes on a valuation of
$245,000.
We wish to protest this increase based on the fact that
conditions have not changed in the structure of our home,
and also that the city storm sewer on our property (built
without a permit) has caused us hardship (ie. accumulated
silt from the storm sewer has caused flooding in our yard).
In 1996 we received a reduction based on this hardship.
Because this situation still exists, we believe that our
valuation should remain at $245,000.

To whom it may concern:
With the recent increase in the estimated market value for the above referenced property to
$472,000.00, there is reason to believe this property is overvalued. 1 have retained an appraiser,
Paul Loftgren, to perform a private home appraisal. If his appraisal confirms over valuation,
then 1 plan on appealing to the Hennepin County Board of Equalization. It would be preferable
to try and handle this at the local level, but unfortunately, the appraisal will not be completed by
April 23.
1 will be out of town April 23, and will therefore be unable to attend the hearing. Unless I hear
differently, 1 will assume this letter will be sufficient to keep my case open.
Please give me a call if 1 need to be doing anything else.

I am absolutely astounded that this appeal is necessary and that it was also necessary for
me to appeal last year’s valuation to the Minnesota Ta.\ Court If you read the definition of
“Estimated Market Value,” it provides the market value shall be the “most probable price that a
well-informed buyer would pay a well-informed seller without either party being forced to buy or
sell.. . This is what the property would likely sell for ...”
In November of 1996 I purchased the above property for $305,000. The property had
been on the market for I believe nine months or more and in October there were 5 or 6 interested
parties. A bidding war ensued and I acquired the property at the highest price I would have paid
for the property. Other bidders’ oflers were in the mid-to-high $200s $305,000 was the price the
property sold for and you are bound by the legal definition of “Estimated Market Value.”
Assessors use formulas which in this case were flawed The market determines true value
and in this case it was my purchase price. If other properties are valued at 90% of market, my
property should have a value for tax purposes of approximately $275,000.

1 would like to appeal my 1997 value for taxes payable in 1998. The key reason is the difficulty
(and reduced price) a number of people on my street, in my block have had selling their homes
o\er the past few^ years. 1 suspect this difficulty has to do with the fact that the lots are virtually
unbuildable or expandable without a variance due to hardcover zoning restrictions. Although it
has been possible, historically, to get limited variance relief, there is no assurance, to a buyer, as
to the future availability of variances. In addition, there are significant lead times associated with
such variances. Virtually my entire lot is within 75 feet of the lake, in which, there is a no-more-
than-zero hardcover requirement. My next door neighbor at 815 Partenwood has been trying to
sell their house for over a year. They started at o\ er $800,000 and have gotten no takers for the
past four months at the current price of $500,000. fheir frontage and square footage are
comparable. 1 understand that 900 Partenwood .sold within the past year for $657,000 and is
comparable. 1 am aware that the property at 850 Partenwood sold at a price substantially below
its asking price about three years ago. I know that there have been other Partenwood
transactions, but am not aware of the details. I do not believe that other transactions that have
occurred with area hi>uses or lots not as severely restricted as mine should be used as
comparables for assessmetit purposes, particularly since there are \ery good comparables on my
block.
An appropriate discount for restricted buildability should be established and applied permanently
to m\ property. I would propose that a $610,000 market value (93% of the 900 Partenwood
value of $657,000) be applied as my 1997 Estimated Market Value instead of $762,000 as
proposed. This represents an approximate 20°/o discount which i would like to document as an
appropriate discount lor this and future assessments.
