Maple Avenue is platted as a 60' right-of-way but exists only as a gravel driveway serving two houses. The City has sewer and water Ines on or adjacent to the right-of-way. The abutting property owners are listed on Exhibit E for clarification purposes. Please refer to the petition (attachments to Exhibit A) describing the request for vacation. The Public Works Coordinator has expressed the following concerns: 1. Will require 20' width utility easements over sewer and water lines. 2. Planning Commission should address the private storm drain that collects runoff near Casco Circle and discharges onto the Barr property. 3. The City would be prudent in acquiring additional right-of-way along the narrow strip of Ivy Lane. Doubling the current width of 14' has been suggested# or based on the survey Exhibit I# perhaps a strip following the existing travelled roadway would be more logical. A portion of Maple Avenue at the northeast tip should not be vacated as it appears to be travelled roadway. Because Barr's three lots are not combined for tax purposes, Barr could conceivably sell off Lot 162 and it would be land-locked by the proposed vacation. A lot combination would avoid this. Tract V went tax forfeit in 1980 or sor and the DNR held up its resale to the public because it is more than 50* of lakeshore. However, correspondene in our files indicates the DNR has no real use for the property. In 1983, a bill was presented to the legislature to allow this lot to be sold. I do not know the current status of this; perhaps the applicant can shed some light on it. Regardless, vacation of parts of Maple Lane would increase the dry buildable area of lot 184 and Tract V, possibly allowing them to be combined into a single building site without variances required. A recommendation to approve this vacation should address the items discussed above, and should include the following findings: 1. The vacation does not affect access to or use of any adjoining property. 2. The City has not and does not intend to develop, improve, or use the property in any way except for utility or access purposes which are to be described as part of a Council resolution. 3. Box 66 Crystal Bay, MN 55323 RE: PARTIAL VACATION OF MAPLE AVENUE - TRACT 05, CITY OF ORONO (see Plat map attached) Page 1 May 25, 1984 We the undersigned, hereby submit a formal petition to vacate Maple Avenue. Along with the Plat m»ip, we have enclosed formal application and a certified properties* owners list. The proposal in this petition is to return the partially vacated Maple Avenue back to the respective abutting property owners and is made for the following reasons: 1. Currently Maple Avenue serves no useful purpose to the City of Orono or it*s abutting property owners; 2. Maple Avenue has become a thoroughfare for three wheel all terrain vehicles (ATV's), motor cycles and in the winter - snowmobiles. The missuse of Maple Avenue in this way leads these vehicles to trespass on the respective abutting properties; A 3. The abutting properties, as well as the piece of property owned by the DNR are subject to noise nuisance, invasion of privacy and, most important, destruction of foliage and ground cover, (spring rains and thaw brings mud and erosion, all of which is washed into Lake Minnetonka; 4. As owners of the abutting properties, we face possible liabilities when these vehicles trespass on our property in the event one of the drivers is hurt in any way; 5. If tlie vacation were approved, peace and (|uict would be restored, as well as the landscape, whicli we sought to enjoy when we purchased our properties; We would be most willing to grant the City of Orono an easement over the vacated portion of Maple Avenue for use in servicing any water/sewer systems. VHIEREAS, pursuant to Minnesota Statutes 282, the City Council has reviewed certain properties forfeited to the State for non-payment of real estate taxes, and ^. VJHEREAS, the City Council has decided to release for public sale Tract V, RLS 461, tax parcel 38/43088/6000. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Orono approves the public sale of Tract V, RLS 461, with the following stipulations to be entered in the chain of title: 1.The parcel exceeds the current minimum lot area required in the zoning district, but the lot depth is substandard under the current requirements and is not a buildable lot. 2. This applicant proposes to build a house on this lot with dry buildable area of 17,400 sf and 100* lot width, in a zoning district requiring 43,560 sf and 140* lot width. (Variances required: Area » 26,160 sf « 60%; width B 40* » 29%). The proposed house has been staked and would require no setback variances (note survey shows house staked at 34.5* from front line - applicant would move this to 35* required setback). Area within the 75-250* zone on this property is approximately 9,750 sf. Allowable hardcover would be 9,750 x .25 » 2,440 sft. The proposed house and attached garage total 1,680 sf-*-, allowing a hardcover driveway of 760 sf to be added without exceeding the limits. However, note that the existing gravel driveway serving 975* Wildhurst Trail (just east of the subject property) encroaches on the subject property as per the sketch (Exhibit E). This adds about 1,000 sf of hardcover into the subject lot rather than on the platted right-of- way. Also, a neighboring garage to the south encroaches on the right- of-way, and I also found our City sewer manhole to be within the subject property and not on the platted right-of-way as shown in the as-builts. Should this gravel driveway be considered in the hardcover calculation for this property? Does the owner of 975 Wildhurst have an easement over the subject property? What is the 10* easement shown on the survey, extending partway along the south line of the property? This lot was assessed for sewer as part of the 1970-LSl project and has a sewer stub available. We will require an easement over the sewer lines. Based on a review of the ownership, plat maps, and air photos, this would appear to be the smallest building site in the immediate neighborhood. The applicant was careful to comply with required setbacks for the principal structure, but it is now obvious that there is excessive hardcover on the lot. The applicant has proposed certain measures he feels will serve the intent of our hardcover ordinance, to allow slow infiltration of runoff into the soil rather than swift runoff directly to the lake. Note that the proposed driveways as shown on your site plan were reviewed with the building permit and are not necessarily a part of this application. After his original review of hardcover, the Building Official noted that some portions of the driveway area should be cut down to 10* maximum widths to keep under the hardcover limit, based on his original hardcover calculations. At this point, I cannot give a blanket recommendation to approve the Conditional Use Permit for the proposed landscaping because of the extensive hardcover. I would ask you to consider what course of action should be followed. Options may include: 1. Require applicant to file an after-the-fact hardcover variance application. This could be reviewed concurrently with the conditional use permit. Perhaps some compromise could be reached. 2. The Hennepin County Park Reserve District is requesting permission to restore the gazebo on the Noerenberg Park property on Crystal Bay. The gazebo is non-conforming by virtue of its location less than 75* from the lakeshore. Orono code requires a conditional use permit for continuance of the non-conforming use, and would require a variance to make repairs constituting over 50 pe^'cent of the fair market value of the structure, which would be applicable in this case. The gazebo is of historical importance as a landmark to the lake area, as noted per the attachment to the application. Also review the photos taken around 1960. Note from the survey that the Park Reserve has roughly 8,200 feet (nearly two miles) of shoreline bordering Noerenberg Park, with existing hardcover from 0-75', including the gazebo, of a small fraction of 1 percent. The planned reconstruction does not increase existing hardcover. The Planning Commission could recommend approval of this application by finding that: 1. Benson , As we discussed on the phone, the Hennepin County Park Reserve District is contemplating the restoration of the Gazebo in Noeren- berg Memorial County Park. We understand that restoration cannot occur without a permit from Orono. We further understand that a permit can't be granted unless the City Council approves a variance from the City zoning ordinance. The District believes that the unique architecture and historic nature of the gazebo merits such a variance and hereby requests the same. Restoration of the gazebo is consistent with the Master Plan prepared for the Park. The plan says: "The gazebo is an existing but somewhat deteriorated feature on the shore of Crystal Bay. It has become a lake oriented landmark and will be restored as an Important feature of the garden." The primary pathway system in the park will go right to the gazebo. The gazebo itself will provide an Interesting and pleasant place for park visitors to stop and look out over the lake or inland to the garden itself. In addition it will serve as a reminds;; of the lifestyle that the Moerenberg Estate typified. The District hopes to raise funds for the restoration thru public contributions.
