RESOLUTION OF THE CITY COUNCIL

A RESOLUTION GRANTING
AN EXTENSION TO
CONDITIONAL USE PERMIT FOR PUBLIC SERVICE STRUCTRE
FILE NO. LA23-000035
WHEREAS, the City of Orono (hereinafter the "City") is a municipal corporation organized
and existing under the laws of the State of Minnesota; and
WHEREAS, the City Council of the City of Orono (hereinafter"City Council") adopted land
development regulations for the orderly, economic and safe development of land within the City; and
WHEREAS, Metropolitan Council is the owner (hereinafter the "Owner") of the property at
3447 Crystal Bay Road, legally described as:
That part of Lot 3, Block 1, Wiley's Park, Lake Minnetonka, lying Southerly of a line drawn
from a point on the Easterly line of said Lot 3, distant 35 feet Northerly of the Southeast
corner of said Lot 3, through a point on the Westerly line of said Lot 3 distant 73 feet
northerly of the Southwest corner of said Lot 3;and that part of Lot 4, said Block 1, Wiley's
Park, Lake Minnetonka, lying Southerly of a line drawn from a point on the Easterly line of
said Lot 4 distant 83 feet Northerly of the Southeast corner of said Lot 4, through a point on
the Westerly line of said Lot 4 distant 113.5 feet Northerly of the Southwest corner of said
Lot 4, Hennepin County, Minnesota. (hereinafter collectively the"Property");
and
WHEREAS, the City Council granted a Conditional Use Permit, LA21-000070, for lift station
via Resolution 7235, which had an expiration date of December 6,2023; and
WHEREAS, City Staff granted an administrative extension included in Resolution 7235; and
WHEREAS, on July 24, 2023, the Owners request an extension to December 6, 2024; and
NOW,THEREFORE, BE IT RESOLVED the City Council of the City of Orono does hereby
grant a 2nd extension CUP, to expire December 6, 2024 unless a building permit has been
obtained.
ADOPTED by the Orono City Council on this 24st day of July, 2023.
