ROLL CALL
The Orono City Council met on the above-mentioned date with the following members present: Mayor
Lili Tod McMillan, Council Members Lizz Levang, Aaron Printup, and Dennis Walsh. Representing
Staff were City Administrator Jessica Loftus, Finance Director Ron Olson, Community Development
Director Jeremy Barnhart, Senior Planner Michael Gaffron, City Planner Melanie Curtis, Public Works
Director/City Engineer Adam Edwards, City Attorney Soren Mattick, Consulting City Engineer David
Martini, and Recorder Jackie Young.
Mayor McMillan called the meeting to order at 7:00 p.m., followed by the Pledge of Allegiance.

PRESENTATIONS
3. COUNTY ROAD 112 TURNBACK PROJECT
Kristy Morter and Mike Turner with the Hennepin County Transportation Department were present.
Mike Turner stated since they were before the City Council last winter, they have been working with
Hennepin County on several processes and are now approximately 60 percent done with the design.
Turner indicated this project runs the complete length of County Road 112, from its westerly border out at
County Road 6 all the way to its connection with Old Highway 12 on the east by Wayzata. Last winter
the Council approved a preliminary layout, and since then the project has been broken out into three
construction phases. Phase one goes from Willow Road to Cemetery Road. Currently that project is
scheduled for construction in 2017 and will be completed in 2018. Phase two is from Cemetery Road to
the connection near Wayzata, and phase three travels from Highway 6 to Willow Road.
Turner noted last winter they talked about some discretionary improvements by the City in conjunction
with this project. The first item on the cost spreadsheet relates to additional lighting and accessories
along the corridor. Essentially this item relates to the installation of street lighting that matches the
proposed street lighting Long Lake is considering. The indications from Long Lake are that they are
interested in lighting their segment. It would amount to seven or eight lights along the north side of
Highway 112 from Willow Road to Brown Road.

Turner stated last winter the Council indicated that they may be amenable to that. Turner stated they
have gone through a process of identifying the streetlight concept that would best fit the corridor and be
consistent with the lighting chosen by Long Lake.
Turner displayed a picture of the light pole that is under consideration. Turner stated this light pole is
similar to the light poles Orono installed in Navarre. The light pole has options for a flag mount, a banner
mount, and also includes a separate circuit for electrical.
The next item is utility burial. The Council’s indication last winter was that expensive and they were
uncertain whether to proceed forward with that item. Turner indicated they have put a little more research
into the costs for that. The cost for burying the overhead power lines along the north side of the corridor
from Brown Road to Willow Road would be approximately $350,000.
In addition, the Council also had a significant discussion last winter about whether or not an entrance
monument into the City would be appropriate, which would likely be located at the intersection of Brown
Road. Turner noted Long Lake is considering installing a monument in the southeast quadrant of that
intersection. The costs for that monument have been estimated and would be approximately $83,200.
Turner displayed a picture of a possible monument that could be installed. Turner stated the Council
should decide whether or not they would like to add that to the plans.
McMillan asked when they would like an answer from the City Council.
Turner stated they are in the process of developing the 90 percent plans and that they would appreciate an
answer in the next four to six weeks.
Walsh asked if the monument would be constructed on City property.
Turner indicated it would be included as part of the project and that the cost is approximately $83,000,
which includes the engineering and construction costs. Turner stated at this point it is unclear whether it
would be on county or city property and they would have to identify how it fits into the existing right-of-
way.
Walsh asked if it would preclude the City from doing it at some point in the future.
Turner stated that is a possibility.
McMillan noted the north side of Brown Road is Orono and the south side is Long Lake.
Levang commented that could be confusing with two monuments.
McMillan noted the City Council initially talked about this and they were not really interested in the
monument. McMillan stated it is something that could be added later.
Walsh asked if Hennepin County would be interesting in financing the additional lighting and the burial
of utilities.

Morter stated the County would participate on the lighting with the City, but that the burial of the
overhead utility would be 100 percent borne by Orono.
Walsh asked if Hennepin County would finance that item.
Morter stated as it relates to the lighting that would be included in the plan. Morter indicated Orono
would need to do a separate agreement with the utility company and would have to be borne by the City.
Turner stated part of the question goes to the timing of the City’s contribution of money. Turner stated
the City’s contribution should be part of the agreement with Hennepin County prior to final plan
approval. Turner indicated he is not familiar with the timing of the money outlay and when the City
would need to pay the County.
Walsh stated if the County had some flexibility and would be willing to carry the costs over 10 or 15
years that would be helpful to know.
Morter stated typically the agreement asks for 95 percent of the costs once the contract is awarded, but
that they are open to discussing different options for the City to make it work.
Levang asked if Orono’s portion of the additional lighting and accessories would be $89,600 plus the
$26,300.
Turner stated it would be. Turner stated the County would participate in the cost of the poles, the wiring,
and the lights. The other accessory pieces, such as the banners, the flags, and the electrical circuit would
be Orono’s responsibility.
Walsh stated if the City could receive some financing from Hennepin County that would help impact his
decision rather than the City having to come up with $550,000 in the next few months.
Levang stated she is not interested in the utility burial or the monument. Levang indicated she is fine with
the lighting since it will provide continuity with Long Lake
It was the consensus of the City Council to proceed forward with the lighting.
Walsh asked if the utility company would receive any benefit from burying the utility line such that they
would be interested in partnering with the City on the costs.
Morter stated the utility companies feel it is easier to maintain them if they are overhead.
McMillan requested Mr. Turner talk briefly about the road closure.
Turner stated as they have gone through the advisory committee process, Long Lake has raised some
concerns based on some changing parameters. The project advisory committee reviewed the layout that
was presented to the City Council last winter, which was based on what was known about the corridor at
that time. Since that time more detailed designs have been completed and the County has gained a better
understanding of the slopes, the type of retaining wall that would need to be constructed, and the impact
to the roadway that would have and whether the road would be able to stay open during construction.

Turner stated the original concepts were indicating it was probably going to be a long-term closure of the
roadway along the lake in Long Lake to get that piece constructed. As a result, Long Lake has raised
some concern with the road closure and Hennepin County is currently in the process of re-evaluating to
see whether there are any options and/or additional expenditures that will need to be made as part of the
project in order to keep the roadway open at least one lane in each direction.
In addition, there is also potential development on the east side of the lake on the north side that was not
anticipated last fall. Turner stated they will probably need to revisit whether or not the trail proposed out
of Long Lake will be on the south side of the road as originally proposed or on the north side. Turner
indicated the development of Birches on the east side of the road has changed their philosophy a bit and
that they are currently looking at that and will keep everyone informed.
McMillan stated the advisory committee is working hard to see if the trail can be constructed on the north
side, which would allow the trail to be located along the lake. McMillan stated she appreciates MN/DOT
being open to different ideas.
4. TOUR DE TONKA – 8:00 P.M.
Tim Litfin, Minnetonka Community Education, stated this year’s Tour de Tonka will occur on August 1.
Last year there were six different rides as part of the Tour de Tonka with four going through Orono.
Litfin noted all riders made it through the event safely.
Litfin stated the Tour de Tonka has been going through Orono since the first year of the event and that
they would like to continue working with the City. Litfin stated riders continue to come to the Tour de
Tonka from all areas, and that while they celebrate all the riders, in particular they celebrate the ones who
come every year. A number of local communities participate in the event, including Orono, Long Lake,
Minnetonka, and Minneapolis. The age of the riders is also spread throughout all the ages, with the oldest
rider being 86, who participated and finished the 100-mile ride.
Litfin stated the event helps benefit the ICA Food Shelf. Litfin stated Orono has an outstanding Police
Department and that they appreciate their help in keeping this event safe every year. Litfin stated the
Tour de Tonka has a 16, 28, 49, 57, 77, and 100 mile rides and that the riders will be going through
approximately 20 communities this year. Litfin noted Trinity Lutheran Church is the rest stop in Orono
and that he would encourage people to come to that rest stop to talk with the riders. In addition, the event
has had a number of sponsors as well as volunteers participate, which has helped make the event a great
success over the years.
The City Council took no formal action on this item.
PLANNING COMMISSION COMMENTS – CHRISTOPHER McGRANN, REPRESENTATIVE
McGrann stated he had nothing to report but would be available for questions.
PUBLIC COMMENTS
Scott Gronholz, 2008 Sugarwood Drive, stated his comments pertain to the proposed Mooney Lake
development. Gronholz indicated he met with the developer at the property in late February, early March,
and at that time discussed a shared vision with the property owner. The vision was to preserve the prairie,

develop some lots on the lake, two lots in the woods, and two lots on the upper portion of the preserve.
Gronholz stated they viewed an initial plat that not only met every code and ordinance; it actually
exceeded the City’s requirements. Gronholz indicated this piece of property could really hold up to 30
lots and still meet every City requirement but that the property owner and developer chose to only
propose 11 lots to again meet their vision of preserving the prairie and not have the development become
an eyesore in the community.
Gronholz stated as a result of sharing the same vision as the property owner and developer, they signed a
purchase agreement for one of the wooded lots in the proposed development. Shortly after signing the
purchase agreement for the lot, they listed their current home for sale in early April and were very
fortunate to come to terms with a buyer toward the end of May. On May 18, the Planning Commission
discussed this plat for preapproval. There was a good discussion on some items to be tweaked and the
Planning Commission then tabled the application.
On or about June 4, Gronholz indicated he and his wife heard that a revision of the development was
being made that included removal of the lot on which they had a purchase agreement and an additional lot
had been added to the southern part of the development in the prairie. Gronholz stated since this was not
consistent with the property owner’s desire or vision, he was curious to know why the change was made,
especially since the initial plat met every City requirement.
Gronholz stated his understanding of the change was that the Mayor of Orono had provided guidance to
the property owner and developer on how the plat should look to obtain approval from the Planning
Commission and eventually the City Council and that it appears the Mayor placed a higher value on
preserving the woods and less value on preserving the prairie, which was the exact opposite of the
property owner’s vision.
Gronholz stated the nature of how this change in the plat has occurred has raised a few questions and
concerns for him personally. Number one, why was a plat that conformed to City requirements changed
when it met the vision and desire of a private property owner and developer? Two, why is the Mayor of
Orono unilaterally changing a development plat prior to a public hearing or the City Council’s review of
the application and final plat approval? Three, why does the Mayor have the authority to impose her
personal preference in changes to a plat prior to final approval by the City Council?
As a result of this unusual change in plat design, Gronholz stated he would recommend the following two
steps be taken: The City Council should review both the initial plat design as well as the final plat design
for final plat approval; and if the initial plat meets all City requirements, it shall supersede the revised
plat. Secondly, as a judicial agency, Gronholz stated he believes at a minimum the Mayor should recuze
herself from the final plat vote as well as any other Council Member who has influenced changes from
that initial plat.
Gronholz stated in closing, he and his wife have retained counsel in an effort to resolve this matter and
protect their rights and it is their hope and desire that the issue be resolved without filing any motions or
complaints against the City of Orono.
PLANNING DEPARTMENT REPORT
5. #15-3716 DALE GUSTAFSON O/B/O MARK AND KRISTEN ANDERSON – 3850
WATERTOWN ROAD, CONDITIONAL USE PERMIT – RESOLUTION NO. 6516

Mark Anderson, Applicant, was present.
Curtis stated last June the City Council granted approval of a conditional use permit to allow for the
import of approximately 10,000 cubic yards of fill to the site. This grading was to correct an erosion
issue, to create both a level paddock for their horses west of the barn, and create a more gradual slope
from the barn to the wetland to east in planting a crop.
During the course of the project, the amount of material imported to the site exceeded the approved
amount by 7,000 cubic yards. The property owner has provided a revised plan, which addresses the
additional fill brought to the site and further requests approval to import approximately 3,000 cubic yards
more to complete the project.
On June 15, the Planning Commission held a public hearing where they heard from the applicant and
members of the public. The Planning Commission voted 6 to 0 on a motion to approve the CUP to allow
the importing of 10,000 cubic yards of material, with 7,000 cubic yards being after the fact, subject to a
number of conditions that are outlined in Staff’s memo.
Staff recommends approval of the CUP subject to the conditions as recommended by the Planning
Commission. An approval resolution has been drafted for Council consideration. Curtis noted the
Minnehaha Creek Watershed District still has a requirement for a restoration plan to be submitted and
approved before work can begin on the property. Tonight the Council should consider adopting or
amending the approval resolution. The property owner is present this evening
Levang noted Item No. 6 on Page 2 of the Planning Commission recommendations refers to a 60-day
limit on the hauling activity. Levang stated she understands the hauling will not begin until Staff receives
the right documentation and a preconstruction meeting is held. Levang asked what the process will be if
the project takes more than 60 days and whether the applicant will have to apply for an extension.
Curtis indicated the applicant should notify the City ahead of the 60 days expiration and then Council will
consider an extension or allow Staff to extend it. Curtis stated the Planning Commission was clear about
wanting an end date for the neighborhood, which is why it was incorporated into the conditions.
Levang stated it seems that the 60 days is more than reasonable given the length of the project, but that
she had a concern that a process be in place in the event the project exceeds the 60 days. Levang asked if
that should be included in the resolution.
Mattick stated the resolution could spell out what the process is. Mattick stated the applicant could
provide a 10 to 15 day notice if the project is going to exceed the 60 days. Mattick stated Staff could
extend it by another 10 to 15 days if the Council determines that is appropriate.
Levang asked whether Item No. 9 regarding the retaining walls is a second violation.
Curtis stated to her understanding the walls were constructed during this process and permits were not
obtained. Curtis indicated the retaining walls were not included in the original plan. The applicant has
now resolved that and has submitted the required information to obtain an after-the-fact permit.
Levang asked if there is a double fine associated with the after-the-fact variance.
Curtis indicated there is.

Levang commented she was a little dismayed there was another violation and that it feels like this
property owner seems to not keep to the City ordinances.
Curtis stated Staff hopes to, at the preconstruction meeting, have a conversation about any anticipated
next projects so that everyone can be on the same page with the property owner and work with him to
obtain the proper approvals and permits.
Levang asked if they will also be talking about Item No. 12 at the preconstruction meeting, which is
communicating with adjacent property owners.
Curtis indicated they will be.
Levang asked if Staff is amenable to adding some language to Item No. 6, such as notify Staff at least 10
days in advance of the 60 days expiring, with Staff being allowed to extend the project for X amount of
time.
Barnhart stated he would be comfortable with that amount of discretion but that anything more than 10 or
15 days would likely impact the neighbors and that he would bring it to the Council.
Walsh commented that makes sense.
Levang noted one concern that was raised at the Planning Commission was locating clean fill and that the
Planning Commission strongly suggested that be lined up. Levang asked whether the applicant has been
able to secure the fill yet.
Anderson stated there are a couple of items he would like to discuss. In regards to Items 4, 5, and 6, those
all deal with length of time and that he has been very eager to complete this project. Anderson stated
starting in November of last year, they pleaded with Staff to get the topsoil laid down and since then they
have been addressing every concern the City and Minnehaha Creek Watershed District has had.
Anderson stated in their view they have addressed every single obligation that has been raised and that
they would like to complete the project as quickly as possible.
Anderson stated as it relates to the time restrictions that are set for hauling and the time restrictions that
have been set for equipment on site, he would like to make a note that this is a working farm. Anderson
stated a corn crop and vegetables have been planted in the front and that there will be tractors operating
periodically. Anderson stated he is not sure how someone would distinguish a tractor that is cultivating
corn with a tractor that is moving fill.
Anderson indicated he looked at the City ordinance and it says that power equipment is allowed to be
used from 7 a.m. to 10 p.m. during the week and 8 a.m. to 8 p.m. on weekends. Anderson stated if it
makes sense, he would like to comply with the City ordinances as they are written since that way the
project would be finished a lot quicker. Anderson stated the hauling and site equipment should coincide,
because if the hauling happens and there is no equipment to move it, that will delay the project. Anderson
stated there is only so much room in that area and the fill has to be spread when it is delivered.
Anderson stated as far as lining up fill, it is a process because the fill has to be obtained within a certain
distance from the site because otherwise it will not work. Anderson indicated he did not know until

recently if this project was going to continue and that once he has a start date, he can start seeking the
clean fill. Anderson stated in his view 60 days is a really tight schedule, especially if there are restrictions
on the time from 9:00 to 5:00 during the day and that regular operating hours as set in the ordinance
would be more appropriate. Anderson indicated it may take two to three weeks from when he has an
agreement to get the fill and the equipment lined up.
Anderson stated to address the retaining walls; it was his understanding that a retaining wall less than four
feet did not need a permit. Anderson indicated the retaining walls were constructed by Brian Butterfield,
who is one of the neighbors, and that it was an oversight. Anderson stated there were two items that may
not have been met but that they were an oversight.
Levang asked if the work hours were for the neighbors because the hauling up to that point had been
bothersome and excessive.
Curtis stated that is accurate. Curtis noted the power equipment time allowance that Mr. Anderson quoted
is for lawn mowing and that type of equipment and that construction activity is permitted Monday
through Friday from 7 a.m. to 8 p.m. and weekends and holidays is 8 a.m. to 8 p.m.
Levang asked if the Planning Commission was willing to allow hauling on the weekends.
Anderson asked what the City is going to do if they are doing field cultivation and somebody calls
because they hear a tractor at 6 a.m.
Curtis stated she will be able to visually tell the difference between field cultivation and equipment
operating in the project area. Curtis stated it may take some additional Staff oversight in order to ensure
the schedule is met. Curtis stated the City typically will receive calls regardless in situations like this.
Curtis stated she would suggest the applicant source his materials and that Staff can be flexible with the
preconstruction meeting and when the hauling will start but that there just needs to be a mutual
understanding. Curtis stated the preconstruction meeting could be held the day before he is ready to start.
Anderson stated given the hour restrictions, he would say 120 days is more realistic because there will be
rain delays and clearing the mud off the record. Anderson stated if the City would like him to stay with
the 9 a.m. to 5 p.m., he would request 120 days. Anderson indicated six out of the seven neighbors have
come over and spoke highly of the project and that everyone wants it done. Anderson noted there is one
neighbor that has voiced concern about equipment and he reached out to the City but not him personally.
Anderson indicated they will go as quickly as they can, but to put a 9:00 to 5:00 and a 60-day limit on it is
not realistic.
Christopher McGrann, Planning Commissioner, stated the restrictions were placed in order to handle
some of the complaints of the neighbors. McGrann asked if it could be 8:00 to 6:00. McGrann stated in
his view 7 a.m. to 7 p.m. is unrealistic for the neighbors. McGrann indicated he would be willing to allow
hauling from 8 a.m. to 6 p.m. McGrann asked if that would help.
Anderson stated he is attempting to deal with everyone’s expectations and being realistic on the project.

McGrann stated if it goes to 120 days, the City will likely hear more questions from the neighbors, which
is why the 60 days was selected. McGrann stated he would prefer to go longer hours with the shorter
time period.
Anderson stated when the fill becomes available, they will move the fill. Anderson noted the contractor
for Watertown Road approached him about fill, but because the project was not yet approved, he was not
able to accept it.
McGrann stated he would rather have expanded hours than an extended time period.
Walsh noted at the Planning Commission meeting the applicant did not express any concern with the 60-
day time frame.
Anderson indicated that was the first time he heard about that. Anderson asked if they could make the
hours consistent during the week and on the weekends and have it from 8 a.m. to 8 p.m., which is what is
allowed in the ordinance.
Curtis stated at this point it is up to the City Council to decide what they feel is appropriate.
David Martini, Consulting City Engineer, stated in his view the 60 days seems more than adequate to
move 3,000 cubic yards. Martini stated the issue is that the timing is more related to obtaining the fill
when it is available from a single source. Martini stated the reality of when this can be done is related to
when and where the material is available. Martini stated if the material is available, 60 days should be
enough time to move the material, but that what could happen is that 100 yards of material might become
available from one place, it is moved to the site, but then it might be another 20 days before they are able
to get more material.
Levang stated the City is trying to avoid the starting and stopping of the hauling, but that she is hearing
that is not possible at this point.
Anderson stated he is not sure when he can start, and once that is determined, he can start picking up the
phone and finding fill.
Walsh stated he would rather have expanded hours than an expanded time frame.
Printup stated he is okay with the expanded hours. Printup questioned what the City should do to avoid
the stopping and starting of the hauling.
Walsh stated everyone will need to move as quickly as they can and that the City Council can include the
language suggested by City Attorney Mattick.
McMillan asked if he has any identified sources for the fill at this time.
Anderson stated he does not at this time outside of Watertown Road, which may no longer be available.
Levang suggested changing Point No. 4 to read, hauling will be allowed between the hours of 7 a.m. to 8
p.m., but equipment will be allowed from 8 a.m. to 6 p.m.

project within 60 days and that Staff can authorize an additional 10 to 20 days depending on what the City
Council is comfortable with. Anything over that would require the matter to come back before the
Council.
Levang stated Point No. 7 would be changed from 8 a.m. to 6 p.m. and Point No. 13 would be limited to a
total of 60 days.
Mattick stated as it relates to Point No. 13, the applicant could provide Staff with 10 days notice and Staff
can extend it another 10 days or whatever number the Council is comfortable with, with any additional
extensions requiring Council approval.

Gaffron stated the applicants are here tonight seeking final plat approval. This is a 46 lot plat for the
Lakeview Golf Course property. Gaffron noted the Planning Commission and City Council have actually
been reviewing this application for the past year through a variety of different processes, which also
included a Comprehensive Plan Amendment and rezoning.
Gaffron stated the Council looked at this application in March and May of this year, with a few minor
changes being made to some of the documents, including a draft development agreement that was
reviewed last month. The parameters for ownership and maintenance of the private park have been
outlined in the development agreement. In addition, the requirement to use the new drain site on Lot 17
has been added to the development agreement.
Gaffron pointed out the location of the new drain sites.

The applicants have applied to the City for permits for the site preparation work needed before
improvements can begin, namely mercury remediation for the greens and demolition of the clubhouse and
other buildings. Gaffron indicated those permits are ready to be issued.
Gaffron stated the development plans have undergone a few minor engineering revisions since the May
Council meeting based on comments from the MCWD and the City Engineer and it appears that all
engineering issues have been or are in the process of being addressed and will be resolved to allow for
final plat approval tonight.
Hiller stated he appreciates the City’s patience in dealing with this application and that they are anxious to
get started.
Levang thanked Mr. Hiller for finding the alternate septic sites.

10. #15-3759 REQUEST FOR ORDINANCE RELATED TO VACATION RENTALS
Barnhart stated the practice of renting a person’s home for vacationers is becoming more prevalent, and
that over the past several weeks, Council Member Walsh has received complaints regarding the use of
single-family homes for vacation rentals. City Code does not currently regulate the use of a home for
short or long-term rentals.
In addition, Staff has learned that some property owners purchase a home for the primary purpose to rent
it on both a short and long-term basis as income property. A cursory review of these sites found 6-15
properties on each site advertising Orono, including one site on Big Island and another single room.
The concerns raised are related to noise, number of guests, neighborhood traffic, parking, and guest
safety. Barnhart stated enforcement will be a challenge, similar to the provision that prohibits the rental
of boat slips. Staff must periodically review advertisements and craigslist to find sites, which could use a
considerable amount of Staff time.
Barnhart stated Staff would like some feedback on how they would like to proceed on this issue.
Printup asked if this would cover vacation rentals as opposed to someone just renting a house.
Walsh stated it would be short-term rentals, such as daily or weekly.
Barnhart stated the City has heard more recently about weekly rentals and that currently the City does not
really regulate rentals. Barnhart stated it is also hard to regulate ownership of a house. Barnhart stated
the more recent issues have dealt with situations where people come for a vacation and the neighbors
experience problems.
McMillan noted the City does not regulate year-long rentals currently. McMillan stated in her
neighborhood they have two rentals homes and that they have experienced issues periodically but those
related to homes that were rented for a year-plus. McMillan stated she is sure the short-term rentals are
happening more on the lake.
Walsh stated some cities regulate hotels, which are short-term rentals, but that the hotel has to be eight
stories or higher. Walsh noted one of the other cities just took their hotel regulations and amended them
to cover short-term rentals. Walsh stated there would need to be appropriate zoning in order to have a
hotel, but that amending those existing regulations made it easy to deal with the weekly or daily rentals.
Walsh stated this is more of a summertime issue, but that he is aware of a person who has someone
renting their house out every week two doors down from him. Walsh indicated that person has had to
deal with the traffic, noise, and lack of regular maintenance on the home.
Printup stated he would be interested in hearing more about this.
Walsh stated with the Internet, there are a number of sites where people can advertise their homes for
rent.
McMillan asked if there is anything under the City’s regulations relating to noise or nuisance that could
help to address some of the issues. McMillan asked if the complaints are related to noise or destruction of
property.

Walsh stated to his knowledge it was the noise and the different cars coming through the neighborhood.
Walsh indicated that a resident is experiencing it weekly right now.
Barnhart stated perhaps before Staff drafts an ordinance, the solution may be as simple as contacting the
people who are advertising on these various sites and encouraging them to be a good neighbor. Barnhart
indicated he did a search of five or six major Internet sites and that he found five or six homes in Orono
that were being advertised.
Printup asked if the homes had the same addresses on the different websites.
Barnhart indicated he did not get into the details of the rentals but that based on his brief review, it
appeared they may be different homes.
Printup stated he likes the idea of putting the property owner on notice.
Mattick stated currently the home is being used in a residential way but not the same as owner occupied,
which is where the potential conflict comes in. Mattick stated conceivably people tend to behave
differently if they are simply renting versus someone who lives there year-round.
Levang stated she would be okay with putting this on the master agenda list, and when the joint Planning
Commission/City Council meeting is held, this item can be prioritized. Levang stated the first step may
be to contact the property owners and encourage them to be a good neighbor.
McMillan stated she would hate to be really restrictive on long-term rentals but that the short-term is a
different situation. McMillan stated she also is not aware of how often this is happening.
Levang stated having Staff check the websites periodically is also not a real good use of staff time.
McMillan stated if there is a problem, it is likely one or more of the neighbors will complain.
Levang noted there is a complaint form on the City’s website and that might be part of the education
piece as well.
PUBLIC WORKS DIRECTOR/CITY ENGINEER’S REPORT
11. SPEED STUDY FOR CSAH 151
Edwards stated the City has received a request for a speed study on CSAH 151 based on their perceptions
of speed and increased traffic. The State Commissioner of Transportation sets speed limits. In order to
initiate a speed study, the City would need to request one by resolution from Hennepin County, who
would, in turn, request the State to conduct one.
Edwards stated some of the factors the State looks at when they set a speed limit is the road type and
condition, access points, existing traffic, control devices, crash history, traffic volume, and sight
distances. Based on the routine speed of the traffic, it is possible the State could decide to raise the speed
limit. Edwards indicated he did look at some of those factors and was informed by the Orono Police
Department that there have been eight reportable accidents since 2005 on CSAH 151 and five of the eight

related to drivers being under the influence. There were also several deer strikes but not necessarily speed
related or related to the geometry of the road.
Edwards indicated he also asked the Police Department to conduct a speed study of their own. The
equipment is currently monitoring the westbound traffic, but for the eastbound traffic, the study found
that 85 percent of the drivers averaged 47 miles per hour in a 45-zone. Edwards indicated he also looked
at the annual average daily traffic data study that was performed in 2001 and it showed that there was an
average of 1,260 vehicles a day, and in 2013 traffic count was at 1,100. Edwards indicated the City does
not have any more recent data.
Edwards stated his recommendation at this point would be to wait on a traffic study until development on
the Lakeview site is in full swing. Edwards stated another concern raised in the letter related to
construction traffic, which could be enforced with different mechanisms.
McMillan stated that makes sense and that she is fine with what Staff recommends. McMillan requested
the information be passed on to the resident.
The City Council took no formal action on this item.
*12. WATER TREATMENT SYSTEM IMPROVEMENTS – PAY REQUEST NO. 3

Levang stated she did look at the Vogel website that is based out of Becker, Minnesota, and that they had
a couple of items on clearance. Levang stated she was not able to obtain the prices and that they are
supposed to be e-mailing those to her. Levang stated in her view it would be worth it to talk with them
since they are a somewhat local company and that they had similar designs to what the Council has been
considering.
Walsh stated he consulted his wife and daughter, who indicated they like the holly, the stockings, and the
snowflakes.
Levang stated she prefers the snowflake rather than the traditional wreath.
Printup stated he likes the holiday theme or winter theme.

McMillan stated she was thinking of picking out a single snowflake and that they could perhaps mix and
match them. McMillan suggested doing five single ones at first, which are cheaper than some of the more
elaborate decorations.
Levang noted the LEDs are also more expensive.
Edwards indicated he will display five different snowflakes at the Safety Day event.
PUBLIC WORKS DIRECTOR/CITY ENGINEER’S REPORT, CONTINUED
Edwards noted construction has begun on Stubbs Bay Road. There was a couple days delay due to
weather but work has now begun and is progressing nicely.
The Public Works Department is currently doing sewer cleaning in the Rest Point area. Edwards stated
there were some mix-ups on scheduling with the residents but that process has now been revised.
Edwards indicated they were perhaps a little overambitious on how much could be done in a single day
and that they have built in additional time in the event any issues arise.
Edwards noted every year the City does routine maintenance on all of the City’s lift stations and that work
is approximately half-way completed at this point with no major issues found at any of the lift stations.
Edwards reported the Public Works Department patched the culvert on Old Crystal Bay and that they will
be doing a more permanent patch shortly.
Edwards stated STS has begun their work clearing brush and work has been performed in front of City
Hall and at Summit Beach and some of the other parks. Edwards stated the port-a-potty at Summit Beach
will now be more visible in an effort to deter vandalism.
McMillan noted the City continues the process of fixing the erosion that has been occurring on Orono
Orchard Road. McMillan noted this is the third time it has been redone and that some fabric has now
been placed down.
Edwards stated that was based on Council action that was taken last year.
McMillan asked if the City is paying for that.
Edwards stated the City is.
McMillan stated there appears to be a design flaw in that area from the beginning and that she is hopeful
the grass becomes better established.
Edwards stated it was supposed to be completed last fall, but due to weather, it was deferred until the
spring.

Walsh stated he attended the Planning Commission meeting on Monday and that Commissioner John
Thiesse made a great statement that it is not the City’s job to design the house or to tell someone what to
do.
Walsh stated at the March Planning Commission meeting, he witnessed George Stickney present his
development near Lake Mooney on behalf of the Dayton family. Walsh noted Mr. Stickney is proposing
to develop 11 lots rather than maximizing the site and that the plan was conforming in every way. Walsh
stated beyond some little tweaks, the plan looked great.
Walsh stated before the next Planning Commission meeting in June, Mr. Gronholz reached out to him and
talked about some issues that were going on with the project, such as a potential lawsuit. Walsh stated
due to his concerns, he decided to meet Mr. Gronholz out at the site along with the developer and that he
found out there was some interference in the project, which was disturbing to him. Walsh stated he was
told the Dayton family wanted to preserve the prairie and that they made it very clear at the March
Planning Commission meeting that they did not want any more houses in the prairie. Walsh stated that
plan ran into an issue with Mayor McMillan, who had a different idea to save the trees.
Walsh stated to go and meet with a developer and a property owner and to push an agenda on behalf of
the City Council or under the threat and guise that the application will not get through the Planning
Commission or City Council if it is not done her way is unprecedented interference as far as he is
concerned.
Walsh stated in addition, after the March Planning Commission meeting, Council Member Levang was
lobbying the developer to change his plan
Levang stated that is not true. Levang noted George Stickney was shaking his head indicating that that is
not true.
Walsh stated the Mayor should recuse herself from any votes on that application.
McMillan stated Council Member Walsh is out of bounds. McMillan noted this is the Mayor/Council
report and that he should be talking about the community.
Walsh commented this is about the community.
McMillan stated she is not sure what developer’s meeting he is talking about. McMillan stated in her
view Council Member Walsh is out of bounds.
Walsh stated in his view the Mayor was out of bounds and interfering with an application that is in front
of the Planning Commission and the City Council.
McMillan asked Council Member Walsh to show respect for the process.
Walsh stated the Mayor should look in the mirror a little bit. Walsh stated he would encourage the
Dayton’s and Mr. Stickney to bring back their original proposal for preserving the prairie and have an
honest public hearing at the City Council level.

Walsh stated they maybe should bring out the four-page letter that the Mayor wrote to the landowner as
well and read it out loud. Walsh stated the Mayor met with them and interfered with the process on
behalf of the Council.
McMillan stated she wrote a personal letter to the property owner, which had nothing to do with the
application. McMillan stated it was her personal handwritten note to the property owner. McMillan
indicated she was asked to come and meet with her and that she generally meets with constituents.
McMillan noted she did not meet with the developer but that Council Member Walsh indicated he did
meet with the developer. McMillan repeated that she was personally asked to come to the property
owner’s house and that she did not reach out to her.
McMillan stated in her view nothing will be accomplished tonight by discussing this.
Walsh stated the Mayor should recuse herself from the application.
McMillan noted the application is not before the City Council tonight and that nothing will be resolved
tonight by discussing this. McMillan indicated she does not know anything about a purchase agreement.
Walsh stated in his view the Mayor has brought a black cloud over the City of Orono in terms of integrity.
McMillan requested Council Member Walsh show respect for the Council. McMillan requested Council
Member Walsh to move on.
Walsh stated he is sad he has to bring this issue to the table but that it is happening behind the door and it
is not transparent.
McMillan asked Council Member Walsh if he is finished.
Walsh stated he is.
Levang reported there was a Park Commission work session recently and that they talked about the
adopt-a-park program, which will be tweaked at the July meeting. The Park Commission also discussed
having a dog park.
Levang stated the City will not have to pay for the burnt port-a-potty and that will be replaced. Levang
stated it was the feeling of the Park Commission that if it happens again, they probably will not replace it.
Levang stated part of the tree work that is happening at the parks is to make the aesthetics a little better
and that this port-a-potty will be more visible in the future. The Park Commission decided not to put an
enclosure around the port-a-potty so it will be more visible.
Levang noted the Park Commission will be meeting the first Monday of July and that she will be in
attendance.
Printup stated over the last year or so the Highway 12 Safety Coalition has been meeting, and that the
Minnesota Metro Toward Zero Deaths Initiative recently recognized the Highway 12 Safety Coalition.
Printup stated as the Highway 12 Safety Coalition continues, it is important that Orono support their
fellow cities to the west.

Levang stated they know there have not been any deaths since the rumble strips have been installed but
questioned whether there have been any accidents.
Printup stated further west there are already rumble strips along the shoulders. Printup indicated he is not
aware of whether any accidents have happened, but that it was a good move to have them installed thanks
to the generosity of a Delano company.
McMillan reported the Minnehaha Creek Watershed District will be starting the process of updating their
Comprehensive Plan and that she has volunteered to be on the policy committee. McMillan stated Orono
is being represented by Bob Bean on the technology advisory committee. McMillan indicated the policy
committee consists primarily of mayors and council members. McMillan stated it seems like the
Minnehaha Creek Watershed District has the right philosophy going into this update.
McMillan stated she attended John Barton’s retirement party. John Barton started out being the water
resource manager for Three Rivers Parks. McMillan stated she worked with John on the LMCD on the
invasive aquatic species. McMillan noted John was with Three Rivers Parks for over 30 years and that he
has been a wonderful resource for Orono, Lake Minnetonka, and the whole park district.
CITY ADMINISTRATOR’S REPORT
Loftus noted the public safety open house is scheduled to take place on July 11 from 9 a.m. to 1 p.m. A
number of activities are planned for the event, including tours of the newly remodeled facility and a
helicopter landing/demonstration..
Loftus stated the Communications Committee worked on shortening up the intergenerational report and
that report will be available on the City’s website soon.
Loftus stated the City may want to consider whether they should continue holding their annual photo
contest. Loftus noted this is the ninth year for the contest but that this year they received only six entries.
Loftus stated she will probably ask that Communications Committee to look at that program and come up
with some recommendations for whether the categories should be reduced or changed or whether the
contest should be discontinued. Loftus indicated she will bring the committee’s recommendation to the
City Council.

1. WeCAB Request
Terry Blount of WeCAB made a short presentation and distributed informational
brochures to the City Council on the transportation services provided to people who are
unable to drive in the Westonka area. The organization is comprised of volunteers who
contribute their time to provide transportation to medical appointments, shopping and
errands in the local community. Mr. Blount is asking Council to consider a donation
towards their non-profit organization.
2. Goals
Council continued the 2015-2016 goals discussion from the May 26th Council Work
Session.
The Comprehensive Plan will require a pro-active plan and will need to be addressed
when system statements are received sometime next year. Council discussed the need
to understand housing mix and locations. Affordable housing and homes for residents
that want to downsize in the future need discussion to determine whether there is a
problem, the scope, and bring about possible solutions. Council should have a response
for the MET Council on Orono’s available housing since they work with communities to
plan housing needs.
Council discussed the goal to streamline the building permitting process. Community
Development Director Barnhart will review the process to determine if there are ways
to make the process more efficient. Council discussed the issue of residents with small
do-it-yourself projects and how the permitting process should be less cumbersome. If a
defined objective is determined for the permitting process then consideration to
appoint contractors and residents to a committee for their input would be helpful.
Barnhart also stated that the City Code updating is in progress and on -going for 2016.
A project goal for 2016 is a second North well which Council agreed is a must do goal.
The Wayzata fire service contract was discussed along with costs and how best to meet
the response needs of the residents. Council agreed that cooperative efforts and
sharing resources is an on-going must do.
Technology issues include the storage of electronic data. Council will have information
to discuss regarding use of Cloud storage back-up in July.
3. Street Funding Discussion
The street funding discussion resumed from the May 26th work session. The City’s road
repairs exceed funding. Council would like to know the levy impact on what is currently
planned for 2016. Public Works/City Engineer Edwards is directed to break out the costs
for Chevy Chase Road, Fox Ridge Road, Tamarack Drive, Hunter Drive, and Watertown
Road.
4. 2016 Budget Overview
Council reviewed the 2016 budget timeline. Discussion ensued regarding the repair and
preventative maintenance of the roads which includes seal coating, crack sealing, mill
and overlay, routine winter maintenance and the impact for a road improvements levy.
Inspection service fees were a topic of discussion and the contracted services of Metro
West. There may be changes in the next five years since the owner of Metro West is
nearing retirement. At that time Orono will need to consider how best to provide
inspection services for the community.
Budget discussions will continue at the July 27 Council Work Session.
5. Compensation Study Draft Report – 6 P.M.
Abdo, Eick & Meyers LLP, presented a draft Compensation Study Report commissioned
by the City Council. After reviewing the draft study Council requested the communities
used to determine the market analysis be re-done using communities with populations
between 5,000 to 10,000 rather than 7,000 to 15,000. Abdo, Eick & Meyers will bring
back the results and present at the next Council Work Session in July to determine next
steps.

Summary of Review Activity to Date
Sketch Plan PC Review, March 16. This property was the subject of a sketch plan review for an
11-lot subdivision at the Planning Commission in March 2015. Although this was an informal
review, not a public hearing and not subject to public notice, members of the public were present
and allowed to speak, and written public comments were received. Applicant subsequently
withdrew the sketch plan application and it was not brought forward for Council review.
Preliminary Plat, PC Review, May 18. An application for preliminary plat approval was reviewed
by the Planning Commission at its May 18 meeting. The proposal (referenced in this memo as
Plan A) was for an 11-lot subdivision consisting of seven lakeshore lots (Mooney Lake) and four
off-lake lots, all to be served by septic systems and wells. Access to two lots would be
individual driveways directly to Hunter Drive; an additional two lots would access via a private
road/driveway extending northward from the intersection of CR6 & North Ferndale Road; and
the remaining seven lots to be served by a private road following the route of the existing
driveway off of County Road 6 and extending northward. At the public hearing there was
significant comment from the public with regard to saving the Big Woods area located in the
north central portion of the property. Planning Commission ultimately tabled the application,
specifically requesting:
1. Applicant to introduce more formal covenant or easement language, depictions and
specificity regarding the proposed non-buildable areas within individual lots. Additionally,
identify with clarity the specific building zones within each of the wooded lots, and better
document the limitations placed on future property owners regarding clearcutting.
2. Applicant to provide more detail regarding the future intent for preservation of the prairie
areas. There was a significant level of frustration expressed by the Planning Commission that
the proposed preservation measures described during the sketch plan review have, with the
preliminary plat, been diluted to become characterized merely as “the developer has no plans
to develop the two large outlots and no interest in developing the two large outlots”.
See May 18 PC minutes for additional detail.
Preliminary Plat, PC Second Review, June 15. Applicant submitted revised plans and supporting
information on June 8, which was included in the June 15 PC packet but had not been reviewed
by the City Engineer prior to the June 15 Meeting. At the June 15 meeting Planning
Commission reviewed a revised proposal which responded to the previously expressed public
concerns by removing one of the proposed lots from the Big Woods area and adding it to the
prairie area abutting Hunter Drive. This revised plan is referenced as Plan B in the documents
attached to this memo.
Planning Commission generally found the revised plan to be a significant improvement over
Plan A by reducing the tree removal impact on the Big Woods area. PC recommended that due to
the location of the new lot along Hunter Drive within the very visible prairie area, substantial
vegetative screening along the south and east borders of that lot should be required to help
maintain the open space views of the prairie.

An added point of discussion was whether there was potential to relocate the cul-de-sac further
south and avoid the impact to the Big Woods. The applicant has now submitted a Road Option
B which places the cul-de-sac just south of the woods at the bottom of a slope. The result is
slightly less impact in terms of tree loss, but the tradeoff is that this creates a site layout with
three lots (6-7-8) being accessed via a shared 20’-wide private driveway located within a 50’-
wide road outlot, extending from the cul-de-sac. This preserves trees but leaves the proposed
driveway at a 12% grade which is slightly steeper than the 10% maximum grade recommended
for a private driveway, while just meeting the 12% maximum slope the subdivision code allows
for a private road. The southerly option may result in less potential impacts on the septic sites
for Lot 5.
Staff noted that on Lots 2, 5 and 8 there was a potential lack of separation between the proposed
driveways and the mound drainfield locations. It appears these issues can be resolved by slightly
relocating driveways on Lots 2 and 8, and by shifting the secondary septic site on Lot 5.
The applicant has provided draft covenants to be enforced by the intended Home Owners
Association which provide for limitations on tree cutting and other disturbance within specified
and mapped portions of each lot. Applicant was asked whether he would be willing to grant to
the City preservation easements within individual lots to provide an extra measure of protection
over and above those protections. He indicated he would prefer to not grant such easements, but
noted that in the Big Woods, 100% of the owners would have to agree to any changes.
Applicant’s attorney noted that any one owner could take an enforcement action, and that there
are restoration obligations established in the covenants (see Draft Covenants within
Conservation Design Report).
Public comments at the June 15 hearing included concerns about preserving the water quality of
Mooney Lake. It was noted that all City and MCWD requirements regarding stormwater
management will have to be satisfied. Additionally, Mooney Lake is a Recreational
Development Lake and the minimum setback from the OHWL for structures is 100 feet. All
proposed septic system drainfield sites appear to meet or exceed the required setbacks from the
lake and wetlands.
Applicant noted that MCWD approval of the wetland boundaries was anticipated in June. As of
this writing, the City has yet to receive a Notice of decision regarding the wetland boundaries.
This is a critical item and Planning Commission indicated Council review of the preliminary
plat should not proceed without it.
The Planning Commission on June 15 voted 6-0 to recommend approval of the subdivision per
the revised plan, subject to the staff recommendation (items 1-3 below) and an added condition
requiring screening for Lot 3 Block 2:
1. Further review by the City Engineer may result in additional items needing to be addressed.
2. Applicant to address the potential conflicts between septic sites and driveways prior to
Council review.
3. Preliminary plat review by the City Council should not move forward until/unless
documentation is provided confirming that the MCWD has approved the wetland
delineation boundaries.

Recent Submittals
The applicant’s recent submittals include the revised plans depicting Plan A with road options A
and B, and Plan B with road options A and B. Also included are color depictions of the proposed
covenant restrictions, and an analysis of the tree impacts for the two Plan B road options. A
revised and updated Conservation Design Report is attached as Exhibit H.
Conservation Design
The updated Conservation Design Report is based on the Plan B lot layout. Council is requested
to review pages 1-5 of this report to gain an overview of the natural resources on the site and
how they are proposed to be preserved, impacted, or managed. The draft Covenants and
associated descriptions and exhibits have been included in the Conservation Design Report.
City Engineer Comments
The City Engineer has now reviewed the information submitted in June and July; his comments
are attached as Exhibit C. Staff will provide an overview of those comments at the meeting.
Park Commission Review
The Park Commission reviewed this subdivision at its July 6 meeting and concluded that because
the property abuts County Road 6 and a proposed trail along CR6 is indicated in the CMP
Comprehensive Trail Plan, it would be appropriate that a 10’ easement for trail purposes be
requested along the south boundary of the property, as well as Park Dedication Fee required for
10 new lots.
It should be noted that nearly all property abutting County Road 6 will be within one of the two
Outlots that are not being developed. Applicant should be asked whether he is in the position to
grant the trail easement at this time; it may have to wait until such time that those Outlots are
further developed, if ever.
Public Comments
Exhibit I contains written and emailed public comments received throughout the review process.
Issues for Consideration
The preliminary plat application has been reviewed by the Planning Commission and is
forwarded to the Council for review. Staff would suggest the following questions or issues be
considered by the Council:
1. Revisions to the original plan resulting in Plan B were viewed by the Planning Commission
as an improvement to the subdivision which will lead to reduced impact to the Big Woods
area. Absent any City codes that specifically protect the Big Woods from development, and
noting that the property owner’s greatest desire is to preserve the established prairie area,
does the current plan layout provide an acceptable compromise between the desires of the
applicant and property owner, and the desires of some members of the public?
2. Similarly, do the proposed covenant limitations on tree removal within the Big Woods lots
adequate preservation measures? Does the Conservation Design Report provide sufficient
justification to support the impacts to the Big Woods?

3. The expected location of a house on Lot 3, Block 2 will be in the open field 250’ east of
Hunter Drive. This will be quite visible from County Road 6. Does Council agree that the
prairie area views from County Road 6 toward Lot 3, Block 2 need to be protected by
establishment of a vegetated screening buffer along the south and east boundaries of that lot?
4. The relocation of the cul-de-sac from uphill in the Big Woods to a southerly location at the
base of the slope in the open field, has pros and cons in relation to functionality as well as
tree preservation. The applicant should be asked to comment on the positive and negative
aspects of either option.
5. Does council have any concerns about having 3 lots being served by a shared driveway
extending from a cul-de-sac when none of the 3 abuts the cul-de-sac?
6. Planning Commission did not support Plan A but did support Plan B. If for some reason the
applicant proposes to revert to Plan A, staff would recommend that this be referred back to
the Planning Commission for further review.
7. Are there any other issues that need to be addressed?

If Council determines that proposed Plan B is acceptable and can reach a conclusion regarding
the cul-de-sac location, staff will prepare a resolution for preliminary plat approval incorporating
general and specific conditions of approval for Council consideration at the July 27 meeting,

George Funk and Judy Rogosheske are requesting preliminary plat approval that would split
their 6.85 acre lot on the east side of Old Crystal Bay Road into two lots, the smallest being 2.01
acres dry, and the largest being 4.37 dry. Both lots meet minimum size and frontage
requirements.
Lot 2 as proposed contains the existing single family structure and accessory buildings, including
a 1008 square foot garage north of the house. The size of this garage requires a 30 foot setback
from the property to the north. The revised plan provides that setback, following direction of the
Planning Commission.
The existing septic system that serves the house will be modified to serve the newly created lot 1.
Both sites provide the necessary two septic systems, and these systems meet requirements.
Access to the lots will be via Old Crystal Bay Road. The existing horseshoe drive is being
retained to serve lot 2, and a new access about 75 north of the lot line will serve lot 1.
There are three wetlands within the plat; all are providing a 20 foot buffer.
The Comprehensive Plan shows the need for a trail along Old Crystal Bay Road. The Planning
Commission and the Park Commission recommend that trail be provided as an easement, as
there is no direct connection on either adjacent property.
The Planning Commission report provides the full analysis of the project.
Planning Commission Review Notes Noting that the lots meet minimum requirements for size
and frontage and provide necessary building sites and septic system locations, the Planning
Commission reviewed primarily three issues: the garage setback; the trail; and the preservation
of trees as contemplated by the conservation design analysis. Their comments were incorporated
in the revised plan, dated June 23, 2015.
COUNCIL ACTION REQUESTED
Staff and the Planning Commission recommend approval of the Preliminary Plat subject to the
provision of a trail easement to permit the future construction of a trail along Old Crystal Bay
Road. The Park Commission recommends acquiring a trail easement along the east side of Old
Crystal Bay Road.

A RESOLUTION
APPROVING A PRELIMINARY PLAT
FILE NO. 15-3740
WHEREAS, George C. Funk and Judy A. Rogosheske, a married couple
(hereinafter the “Developers”) are the owners of the property within the City of Orono
(hereinafter the "City") addressed 540 Old Crystal Bay Road and legally described as Lot 1,
Block 1, White Oak Overlook, Hennepin County, Minnesota (hereinafter the "Property"); and
WHEREAS, on April 22, 2015, the Developers filed a complete application with
the City for preliminary approval of a two (2) lot residential plat of the Property; and
WHEREAS, after due published and mailed notice in accordance with Minnesota
Statutes 462.358 et. seq. and the City of Orono Zoning and Subdivision Codes, on June 15,
2015 the Orono Planning Commission held a public hearing regarding the application at which
time all persons desiring to be heard concerning the application were given the opportunity to
speak thereon; and
WHEREAS, on June 15, 2015 the Planning Commission reviewed the
application and recommended on a vote of 6 to 0 that the City Council grant preliminary plat
approval; and
WHEREAS, the City Council reviewed the proposal at a regular meeting held on
July 13, 2015, and hereby makes the following findings with regards to this application:
FINDINGS
1. This application was reviewed as Zoning File #15-3740.
2. The Property is zoned RR-1B Single Family Rural Residential District, which requires a
minimum lot area of 2.0 acres and minimum lot width of 200'. The Property totals 6.85
acres in area of which 6.38 acres is considered as dry, buildable land and 0.47 acres is
wetland.
3. The Property is guided in the 2008-2030 Orono Community Management Plan (CMP) for
single family residential use at a density of 1 unit per 2 acres. The proposed layout
contains 2 residential lots on 6.38 non-wetland acres, for an overall density of 1 unit per
3.19 dry acres.
4. The proposed plat includes 2 residential building lots, each of which will be accessed via
private driveways extending easterly from Old Crystal Bay Road. Lot 2 will utilize the

existing driveway currently serving the Property and Lot 1 will construct a new driveway.
5. Proposed Lot 1 contains 2.01 dry buildable acres; and proposed Lot 2 contains 4.37 dry
buildable acres.
6. Lot 1 is proposed to have 213 feet of frontage along the Old Crystal Bay Road; and Lot 2
will have 783.28 feet of frontage along Old Crystal Bay Road. Each proposed lot
contains a building site which meets the RR-1B setback requirements of 50’ front and
rear and 30’ sides.
7. The proposed lots will be served by individual on-site sewage treatment systems and
private wells. Each lot has been tested and shown to have primary and alternate
conforming septic system drainfield sites.
8. Three delineated wetlands exist on the Property. One wetland straddles the lot line
between Lot 1 and the neighboring property to the north, another straddles the lot line of
lot 2 and the neighboring property to the east. The third is located in the southern third
of Lot 2. All wetlands will be subject to the standard wetland preservation requirements
including granting of Wetland Flowage and Conservation Easements.
9. The Planning and Park Commissions recommended the Developer grant a 10-foot
easement along Old Crystal Bay Road for future trail purposes. A trail easement will be
granted as part of the subdivision along the westerly 10 feet of the Property for potential
future City trail construction.
10. Both proposed lots will contain suitable area meeting all established setback
requirements to allow the construction of single family residences.
CONCLUSIONS, ORDER AND CONDITIONS
NOW, THEREFORE, BE IT RESOLVED, that based upon one or more of the
findings noted above, the City Council of the City of Orono hereby grants Preliminary Plat
Approval for a 2-lot plat per the Preliminary Plat survey/drawing by Gronberg & Associates
dated 6/23/15 and attached hereto as Exhibit A, subject to the following conditions:
1) The Preliminary Plat approval granted by this Resolution shall expire one year from the
approval date (July 13, 2016).
2) Approval is subject to Minnehaha Creek Watershed District (MCWD) approval and permits
as required. Final plat approval shall not be granted until the Developer has provided
evidence that all required MCWD permits have been obtained.
3) Development Fees.

a) Park Dedication Fee. The development is subject to the standard Park Dedication Fee
for 1 new lot x $5,550.00 per lot = $5,550.
b) Storm Water and Drainage Trunk Fee. The development is subject to the standard
Storm Water and Drainage Trunk Fee of $3,840 per acre x 2. total acres (Lot 1 only) =
$7,680 (*Fee will be determined based on the current Fee Schedule at the time when
the final plat application is made.)
4) Approval of the Final Plat is subject to compliance with the existing and ongoing
recommendations of the City Engineer.
5) In order to facilitate preparation of the final documents, as soon as feasible, the Applicant
shall submit to the City written legal descriptions for all required easements as noted herein.
6) Easements Required.
a) Drainage and Utility Easements shall be dedicated to the public on the final plat 10'
along all exterior property lines, and 5' either side of interior property lines, except
such easements shall be increased to accommodate drainage where required,
subject to City staff approval.
b) A Wetland Flowage and Conservation Easement shall be granted over wetlands and
wetland buffers on the Property.
c) A Public Trail Easement shall be dedicated over the westerly 10 feet of the Property.
FINAL SUBMITTALS
The following list of final submittals must be submitted to the City at least four (4) weeks prior to
the regularly scheduled Council meeting on the second and fourth Mondays of the month.
These submittals are as follows:

George Funk and Judy Rogosheske, Applicants, were present.
Barnhart stated the applicant is requesting preliminary plat approval to create one new 2.01 acre dry
buildable lot from the original 6.85 acres. The existing house, garage, and other structures would remain
on the one lot and the new lot to the north, Lot 1, would be vacant. Old Crystal Bay Road forms one
boundary and Fox Street is the other major road in the area.
The proposed subdivision is in conformity with the guiding for this area and generally conforms to the 2.0
acre dry-buildable and 200-foot width standards of the RR-1B zoning district. The existing septic system
site that serves the house will be used to provide service to the lot to the north and the proposed
alternative site will be located on the north side of Lot 1.
The main issue Staff has identified concerns a future trail along Old Crystal Bay Road South. The
Comprehensive Plan identifies a trail along Old Crystal Bay Road on the west side. The Planning
Commission should discuss the merits of an easement for trail purposes adjacent to Old Crystal Bay
Road.
Another issue identified is the fact that the existing garage has a 15-foot setback and the ordinance
requires a 30-foot setback. Staff has visited with the property owner about adjusting that line and it can
be accommodated to meet the setbacks. The applicant has requested some feedback from the Planning
Commission on that item.
The last issue is that the septic system is within the setback line of the property line to the north, and the
applicant has indicated he can adjust that line.
Access will be off of Old Crystal Bay Road. A Conservation Design Plan was completed per City
ordinances and identified tree areas that should be preserved and a couple of wetlands. The Conservation
Design Plan did identify those wetlands and the retention of the drainage ways to continue to feed those
wetlands. The trees largely consist of maple and white pine.

The applicant will be required to pay a park dedication fee and stormwater and trunk drainage fee.
Staff recommends the Planning Commission discuss the following issues:
1. The proposed separation between the garage and the northern property line.
2. Preservation of trees and natural amenities.
3. The trail along Old Crystal Bay Road.
Lemke asked if there is still plenty of room for the lot if the line is adjusted.
Barnhart indicated there would be.
McGrann asked if there will be an easement for the driveway.
Barnhart stated the driveway would either need to be adjusted to accommodate the setback for the garage
or the line would need to shift to the north in order to accommodate the driveway.
Leskinen asked if there will be a second curb cut for the other lot.
Barnhart indicated there will be.
Leskinen asked if there are any issues with an additional curb cut on Old Crystal Bay Road.
Gaffron indicated it is a city road at that point.
McGrann asked what Staff would like from the Planning Commission in terms of the trail. McGrann
asked if the trail would be on the west side of the property.
Landgraver noted it is on the west side of the road.

Barnhart stated it would be appropriate to discuss the trail in regards to easements if it is going to be
located outside of the right-of-way. The challenge Staff has in terms of requiring it is that there are not
trail sections to the north and south, but in Staff’s view it would be appropriate to acquire an easement at
this point.
Schoenzeit stated the City has been pretty consistent in collecting those trail easements.
Thiesse noted there is a trail to the north and the Planning Commission would be amiss if they did not
request an easement.
Judy Rogosheske, Applicant, stated they have a more recent plat that does not show the line going
through the driveway.
Rogosheske stated she would like to speak to the 15 versus 30-foot setback. Rogosheske stated they do
not want to have to apply for a variance and that they were originally told it was 15 feet. Rogosheske
stated it is her understanding the ordinance says if the structure is 1,000 square feet or less, it has a 15-
foot setback.
Curtis indicated that is correct.
Judy Rogosheske stated their garage footprint is 1,008 square feet, which in round numbers would be
1,000 feet. Rogosheske noted it is not a home but a garage and that in her view the 15-foot setback would
be appropriate. Rogosheske stated the other reason it would be appropriate is if the City requires 30 feet,
they then would control the woodlands all along the south facing part of the new owner’s lot.
Rogosheske stated they do not have a view to the north, so they would have no issue with the 15-foot
setback. Rogosheske stated in her view it would be far more important for the owner of the new lot to be
able to control the existing trees in that area.
Rogosheske stated they do not want to have to apply for a variance so they will submit to the 30-foot
setback if that is what the Planning Commission determines appropriate, but that they would request the
15-foot setback.

Rogosheske stated they are all for trails, and that when they originally purchased the property 33 years
ago, they actually owned Old Crystal Bay Road because there was never an easement granted.
Rogosheske stated they eventually did give an easement to the City and that they would appreciate a bike
path along the road
George Funk, Applicant, indicated the line would move a little bit if they are required to go with the
30-foot setback. Funk stated the lots would have a cleaner look with the 15-foot setback and it would also
give more flexibility to the homeowner.
Funk stated they will submit a new survey before to the City Council meeting. Funk stated the driveway
access is actually an old farmer’s access road. Funk stated that road actually goes down and has a dip in
it. Funk stated access to the north may be an issue, but the elevation of Old Crystal Bay Road was
lowered by two feet. Funk stated if the driveway is put on grade, which their driveway is, it should be
almost the same view, so it should not be a problem. Funk stated they were going to include a split
driveway but Staff said it would have a better chance of being approved if it is not a split driveway.
Lemke asked if the 1,008 square feet was a mistake.
Funk stated that was his mistake, and that they originally took the size of the garage with the siding on it,
and the surveyor said it is the footprint of the concrete block that is measured.
Leskinen asked if they will require a 15 or 30-foot setback.
Barnhart stated anything above 1,000 square feet would require a 30-foot setback.
Chair Leskinen opened the public hearing at 8:35 p.m.
David Harmon, 505 South Old Crystal Bay Road, stated he and his wife are in support of the application
and that in their view another home will have any adverse impact on them. Harmon stated they are
looking forward to having another family in the neighborhood.

Chair Leskinen closed the public hearing at 8:36 p.m.
Leskinen suggested the Planning Commission start with the garage setback.
McGrann asked what options the Planning Commission has.
Landgraver stated it would either require a 30-foot setback or require a variance application.
Leskinen stated it would be easier to move the line than the building. Leskinen stated since this is a new
lot, the City would not be willing to create a substandard lot, and that the size of the building could either
be reduced or the line changed.
Schoenzeit noted it will be a much sharper angle. Schoenzeit asked if the lot line rearrangement would
impact the septic site.
Barnhart stated if the line is shifted over 15 feet to the north, it would not really impact the septic site in
terms of serving the lot to the north. If the line is shifted to the other side of the septic system, that lot
would become too small.
Landgraver asked where the line would intersect on the right-hand side. Landgraver asked if that is a
wetland in that area.
Barnhart illustrated on the overhead where the line would be.
Thiesse asked if the City has any criteria about a newly created lot having an old septic site.
Barnhart stated the City has a report on the septic system and the septic inspector is comfortable with that
report.
Schoenzeit stated the other issue is the trail easement and that it is the practice of the City to collect those
at the time of new subdivisions.

Leskinen stated it appears the Planning Commission is in agreement that the line should be changed and
that a trail easement should be obtained.
Thiesse stated he does not see a big need to require conservation of the trees and that the property owners
can preserve them on their own.
Leskinen stated it did not sound like it was a very significant tree stand.
Landgraver asked if the City in the past has required a conservation easement and a prohibition on cutting
down of trees for smaller subdivisions.
Barnhart stated the Conservation Design is triggered by the size of the lot. Barnhart stated his
understanding is that the significant features of a Conservation Design are not usually found on the
smaller sites.
Schoenzeit moved, Thiesse seconded, to recommend approval of Application No. 15-3740, George

Matt Johnson, Applicant, was present.
Barnhart stated the applicant is requesting variances in order to remodel the existing home by gutting the
interior, expanding the second floor to cover the first floor footprint, shifting the bay window, and adding
a fireplace cantilever. The exterior changes are located within the side yard setback and within the
required 75-foot setback from Tanager Lake. The property is located on the west side of Shoreline Drive.
Barnhart stated the applicant is proposing to make some minor modifications to the existing two-story
house. The existing setbacks are 24.9 feet from the north property line and 26.8 feet from the lake at the
closest location.
Barnhart noted his Staff report states there is a 43.6 feet setback from the lake when it is actually 53.6
feet.
The applicant is requesting a variance to construct a 2-1/2 story building within the lakeshore and side
setback. The purpose of the interior modifications is to primarily enhance the livable portion of the
structure, add room for adequate width, hallways, ceiling heights and stairwells. Based on the
configuration of the lot and building, the applicant is not able to make any modifications to the exterior of
the building without impacting some of the setbacks. In the review of the application, Staff is supportive
of the variance.
Barnhart displayed a view of the lakeside portion of the house and pointed out the location of the bay
window and the portion of the structure that would be new. Barnhart displayed pictures of the structure
from different sides of the structure. In terms of adjacent property impact, the biggest impact will likely
be to the property to the south, with minimal impact to the property to the north. The proposed side yard
setback will not be decreased at grade and the subject property provides 97 percent of the separation
between the two buildings.
Staff finds that the location of the existing home, which currently encroaches into the 75-foot setback and
the side yard setbacks makes it difficult to make modifications or additions to the home. The structure is
roughly centered on the property. The age and construction of the existing structure makes full use and
enjoyment of the property challenging. Staff recommends approval of the variances to allow construction
of the addition as proposed.
Schoenzeit asked if Sheet A5 depicts a four-story house.
Barnhart stated based on the preliminary review of the plan, Staff believes it meets the height and story
requirements, but that he has not done the final calculations for the building permit. Barnhart stated it is
somewhat challenging to judge the height just based on a review of A5.
Schoenzeit asked if there is a spot on A5 where the grade is depicted.

Barnhart indicated they would need to look at the survey for the location of the grade. Barnhart indicated
the storage area will not have any windows so it will not be considered a floor. Staff is confident that this
will meet the 2-1/2 story requirement.
Thiesse asked how old the existing structure is.
Barnhart stated his understanding is the original portion of the structure was constructed in the 1920s and
added on in the 1990s.
Thiesse stated he is basically wondering about the foundation.
Barnhart indicated he does not know the location of the original structure foundation.
Matt Johnson, 1432 Shoreline Drive, stated the portion that is being removed from the house was
constructed in 1920. The house underwent a major remodel in 1990 when the north side addition was
done. When that addition was done in 1990, they redid the foundation, and that portion of the house will
remain.
Johnson stated what they are left with on the 1920 portion is a story and a half, with a ceiling height in the
upper level of 6’4”. The door jambs go down to 6’2”. Johnson stated his son is tall and cannot walk in
the upper level comfortably. Johnson indicated there is not a good way to redo it without starting over.
Johnson stated in his view the picture that was included in the packet might be easier for everyone to see
the grade. Johnson stated the main level above grade does look high in that one picture, but the other
pictures will show that it is approximately four steps to the main joist.
Johnson indicated one story will be added above the 1920s portion and that they will be utilizing the
existing attic trusses. The structure in that area has a flat roof and no insulation currently.
Johnson noted the property to the south is an uninhabitable house that is owned by the marina.
Schoenzeit asked if this investment implies that they have reached harmony with the neighbors.
Johnson stated the reality is that he has to fix the property up to make it more livable and that he has
wanted to do this project for the past three years. Johnson stated given the problems with the marina, he
wanted to be careful, but that they love where they live so they have decided to go ahead with the project.

GRANTING VARIANCES
FROM ORONO MUNICIPAL CODE
SECTIONS 78-305
FILE NO. 15-3748
WHEREAS, John B and Sherri A. Thiesse, Husband and Wife, (hereinafter
“Owner”) is the owner of the property located at 3855 Bayside Road within the City of Orono
(hereinafter "City") and legally described as: Lot 063, Auditors Subdivision No. 203,
Hennepin County, Minnesota EXCEPT that part thereof contained within HENNEPIN
COUNTY AND STATE AID HIGHWAY NO. 84, PLAT 91, Hennepin County, Minnesota,
according to the recorded plat thereof, (hereinafter "the Property"); and
WHEREAS, Sharratt Design and Construction, LLC, (hereinafter the
“Applicant”) on behalf of the Owner, has made application to the City for a variance from
Orono City Code Section 78-305 in order to construct a new residence on the Property
consisting of 37.45 feet of width and 0.2 acre in area where 2.0 acres in area and 200 feet in
width are required;
WHEREAS, the Applicant, has made application to the City for variances from
Orono City Code Section 78-305 in order to construct a new residence 12 feet from the rear,
street lot line where a 50 foot setback is required; 7 feet from the north side lot line and 10.3
feet from the south side lot line where 30 foot setbacks are requried; and
WHEREAS, after due published notice and mailed notice in accordance with
Minnesota Statutes and the Orono, Minnesota, City Code, the Orono Planning Commission
held a public hearing on June 15, 2015, at which times all persons desiring to be heard
concerning this application were given the opportunity to speak thereon.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono,
Minnesota:
FINDINGS
1. This application was reviewed as Zoning File #15-3748.
2. The Property is located in the LR-1A zoning district, where 2.0 acres is the
minimum lot area and 200 feet is the minimum defined lot width.
3. The Planning Commission reviewed this application on June 15, 2015. The
Planning Commission voted 5 for and 0 against on a motion to approve the

variances for the new home based on the following findings:
a. The Property has approximately 37.45 feet of width and 0.20 acre in
area.
b. The Owner proposes to connect the new home to City Sewer.
c. The Owner proposed to construct a new single family home on the
Property. The variances are in harmony with the general intent and
purpose of the Ordinance.
d. The variances are consistent with the comprehensive plan.
e. The Owner has established that there are practical difficulties.
f. The Owner proposes to use the property in a reasonable manner not
permitted by the official controls.
g. The size and width of the Property are circumstances unique to the
Property not created by the Owner.
h. The Owner’s request will not alter the essential character of the
neighborhood and will result in minimal negative impact on adjacent
properties.
i. The special conditions applying to the structure or land in question are
peculiar to the Property or immediately adjoining properties.
j. The granting of the application is necessary for the preservation and
enjoyment of a substantial property right of the Owner.
k. The granting of the proposed variances will not in any way impair
health, safety, comfort or morals, or in any other respect be contrary to
the intent of this chapter.
l. The granting of the requested variances will not merely serve as a
convenience to the Owner, but is necessary to alleviate demonstrable
difficulty.
m. The variances to redevelopment of the Property will alleviate a
practical difficulty inherent to the Property and not created by the

Owner.
4. The City Council has considered this application including the findings and
recommendations of the Planning Commission, reports by City staff,
comments by the Applicant and the public, and the effect of the proposed
variances on the health, safety and welfare of the community as well as the
impact on properties in the vicinity.
5. The City Council finds that the conditions existing on this Property are peculiar
to it and do not apply generally to other property in this zoning district; that
granting the variance would not adversely affect traffic conditions, light, air nor
pose a fire hazard or other danger to neighboring property; would not merely
serve as a convenience to the Owner, but is necessary to alleviate a practical
difficulty; is necessary to preserve a substantial property right of the Owner;
and would be in keeping with the spirit and intent of the Zoning Code and
Comprehensive Plan of the City.
CONCLUSIONS, ORDER AND CONDITIONS
Based upon the above findings, the Orono City Council hereby grants variances from Orono
Orono City Code Section 78-305 in order to construct a new residence on the Property
consisting of 37.45 feet of width and 0.2 acre in area where 2.0 acres in area and 200 feet in
width are required; and variances from Orono City Code Section 78-305 in order to construct
a new residence 12 feet from the rear, street lot line where a 50 foot setback is required; 7
feet from the north side lot line and 10.3 feet from the south side lot line where 30 foot
setbacks are requried; subject to the conditions listed below:
1. Council approval is based on the survey and building plans submitted by the

Mike Sharratt, Applicant, was present.
Barnhart stated the applicant is requesting variances in order to allow redevelopment of the property. The
applicant is proposing to demolish the existing one-story structure with a detached garage and
constructing a new two-story structure with attached garage. The lot is substandard due to size and width,
and the house as proposed encroaches into the average lakeshore, side yard, and street front yard.
Barnhart stated the average lakeshore setback line clips the edge of the existing home, with approximately
72 square feet lakeward of the setback line. The proposed project will be clipped by the line in
approximately the same area. The project attempts to mitigate the encroachment by trading house
encroachment for approximately 58 square feet of deck on each of the top two floors. The neighboring
property most subject to impact is the property to the south.
Maintaining the required 30-foot side yard setbacks renders the property unbuildable. The proposed
improvements center the garage on the lot and move the living portion of the house marginally closer to
the north neighbor.
Staff finds the lot size and lot area are pre-existing conditions and not caused by the applicant. In
addition, Staff finds that the proposed improvements are consistent with the character of the
neighborhood and the applicant has made an attempt to mitigate or minimize negative impacts to the
adjoining properties. Further, it does not appear that the adjacent property owners will be adversely
impacted by the redevelopment of the property. Staff finds there are special conditions relating to the
existing home and property which support granting the requested average lakeshore, side yard, lot size
and lot area variances.
Planning Staff recommends approval of the variances to allow redevelopment of the property as
proposed.
Landgraver asked if the applicant is staying within the portion that clips the average lakeshore setback
and not expanding it.
Lemke noted they are moving it back slightly.
Leskinen stated there is a reduction in the encroachment.
John Thiesse, Applicant, stated they did pull the house back and that the original deck was actually ten
feet back from the existing deck. Thiesse indicated they have worked hard to fit the structure in with the
area that is left and that it is a very difficult site.
Mike Sharratt, Designer, stated they have worked very hard on this project and that they did not want to
ask for anything more than what is absolutely necessary. Sharratt pointed out where the deck has been
pushed back ten feet further. Sharratt stated they also connected the garage to the house and left the
existing footprint of the house in the location it was. Sharratt stated the dimensions are the same for the

house and garage. The garage has been pulled further away from the street to 12 feet where it is presently
at approximately 6.5 feet.
Sharratt stated given the constraints of the site, this is a very reasonable proposal.

Thiesse stated the house next door is a foot lower and they experienced no water in their basement last
year. Thiesse indicated the water came up on their neighbor’s yard but did not enter the house.
Landgraver stated the applicant has done a good job at minimizing the negatives.

Background
The property consists of two adjacent tax parcels, each with existing residence structures which
will be removed. The southerly parcel (185 Old Crystal Bay Rd. N.) is the former location of the
Stubbs Bay Movers enterprise, which had used the site for man y decades for operating the family
building-moving business. A number of outbuildings exist on that property and will also be
removed.
The applicants propose to develop the property with 6 single family lots which will be served by
a private road to be named Lillian Lane in honor of Lillian Stubbs. The development will be
served with private septic systems and wells. Septic sites have been tested and reviewed, and
have been located in areas that have not been compacted or disturbed by past industrial activity.
Planning Commission Review
Draft minutes of the June 15 Planning Commission meeting are attached. Planning Commission
reviewed the proposal and found that it appeared to be compliant with code requirements. The
primary point of discussion was whether there should be an extension of the proposed road to
connect with Wear Lane North, which abuts the south boundary of the property.
It was noted that while it has been City policy to create corridors for such connections where
feasible to allow for future through roads or provide access to neighboring undeveloped property,
the need for such a connection is not apparent at this site. Additionally, it was noted that due to
the shape of the property, the location of Wear Lane North, and the subdivision lot layout which
is predicated to a great extent on the location of wetlands and available septic sites, creation of a
connecting corridor would result in one less lot, or a proposed lot would be split in two by the a
corridor. Finally, neighbors from Wear Lane North commented that they have no desire for a
through road connection. Planning Commission concluded that a connecting corridor should not
be required.
Planning Commission suggested that the applicants consider having a Phase I Environmental
Study completed. While there are no known issues with the site, the use of the Stubbs property
as a base of operation for a building moving business for many decades suggests that it would be
prudent for the developer to learn of any unknown issues.
Park Commission Review
The application was reviewed by the Park Commission on July 6 to confirm whether there is a
need for park land at this location. The Comprehensive Plan does not indicate the need for a
park at this location, and it was determined that a Park Dedication Fee in lieu of land dedication
would be appropriate. Park Commission also considered whether it was necessary or prudent to
acquire a 10’ trail easement along OCB Road for future trail use. On a vote of 5 -2 the Park
Commission recommended that no easement is needed because there is already a trail on the east
side of OCB Road, and it’s unlikely there will ever be a need for a parallel trail on the west side.
Project Details
Detailed review of individual lot and private road layouts as well as stormwater management is
contained in the PC memo. The Conservation Design Report provides plans for vegetation
management and discusses how the site layout will preserve the limited amenities on the site.

City Engineer Comments
The City Engineer provided general and detailed comments prior to Planning Commission
review and the applicant is preparing a response to those comments. It appears that most if not
all of the Engineer’s comments can be readily addressed.
Grading of Building Pads
Developer has been made aware that City determinations of building height and number of
stories (limited to 30 feet and 2-1/2 stories) rely on the use of existing grades. Staff has been
advised that a revised grading plan that does create building pads establishing ‘new existing
grades’ for certain lots is forthcoming.
Establishment of Required Yards
As noted in the PC memo, Lots 1 and 6 are corner lots with their defined front yards abutting Old
Crystal Bay Road. The applicant has depicted both lots as having their front yards as the frontage
abutting the private road. Given the layout of the subdivision, it would be appropriate to
specifically and formally define the yards for setback purposes for Lots 1 and 6 as those
proposed on the preliminary plat. The north and south yards will be considered as front and rear
yards; the side yards abutting OCB Rd. will be considered as side street yards; and the yards
abutting the west boundaries will be considered as side yards.
Landscaping Plan
The applicants have provided a landscaping plan for the private road boulevard (PC Exhibit B-8)
as well as along Old Crystal Bay Road. While the plan appears to meet the overall requirement
of 1 tree per 40’ of frontage, it clusters many of those trees (lilacs and crabapples) along OCB
Road at the site entrance rather than spacing them along the private road. Subdivision Code
Section 82-226(b) would give Council discretion to allow this, rather than specifying a uniform
‘urban boulevard’ character:
(b) Shade trees planted by subdivider.
(1) As a requirement of subdivision approval, the city may require that the subdivider plant
shade trees on the property of the subdivision. Such trees are to be planted within five feet of
the right-of-way of the roads within and abutting the subdivision, or, at the discretion of the
city, within the right-of-way of such roads. One tree shall be planted for every 40 feet of
frontage along each road unless the council, upon recommendation of city staff, shall grant a
waiver.
Council should discuss and conclude whether any revisions to the landscaping plan are desired.

The applicants are requesting a side setback variance to allow changes to accommodate a 2nd story addition
over the existing home within the 10-foot setback; a rear setback variance to accommodate the same second

Planning Commission Recommendation
On June 15, 2015, the Planning Commission held a public hearing and reviewed the application including the
evidence submitted. Following the public hearing the Commission voted 6 to 0 on a motion consistent with
the staff recommendation as follows:
1. Approval of side, rear and lake setback variances allowing for the construction of the proposed
second story improvements to the home; and
2. Denial of the portion of the requested lake setback variance to allow further structural
encroachments within the 75 foot setback.
Following the Planning Commission’s direction, the applicant prepared a revised plan and survey which are
attached as Exhibits A and B. Note that the revised survey, conducted by a different surveyor, reflects slight
differences in the lot lines. The applicant’s revised plan continues to reflect the clipped corners on the lake
side of the home footprint to eliminate the average lakeshore setback encroachment as well as the following:
Revision to the most lakeward portion of the 2nd story to not expand further into the 75-foot setback
than the existing 2nd story. The proposed 2nd story will mirror the modified footprint yet be set back
65 feet from the OHWL. Due to the clipped corners, the proposed footprint setback will be increased
from 48’ to 53.3’ from the OHWL;
Movement of portions of the 2nd story addition streetward to reduce expansion lakeward; requiring a
rear setback variance to allow a 21 foot setback where a 30 foot setback is required in order to build

Planning Staff Recommendation
The applicant has addressed the primary issue that Staff identified regarding the further lakeward
encroachment. The remaining variances appear to be supported by practical difficulties inherent to the size of
the property and the shape and location of the existing structure on the lot. Staff recommends approval of the
lake setback, rear setback and side setback variances as requested with the revised plan.

The property is zoned RR-1B (2-acre single family) but is guided in the CMP for multi-family

Applicant has provided two additional conceptual sketches depicting (D-1) a single-family
layout with 65’-wide lots at a density of 3.0 units per dry buildable acre, and (D-2) a 102-unit
multi-family development of attached townhomes in groups of 4 and 6 units, with a density of
8.0 units per dry buildable acre.
To help visualize the density, Exhibit D-4 is an aerial view of a development in Plymouth
suggested by the applicant as illustrative of single family homes with 5’ side setbacks (10’
between buildings) as would be proposed with applicants’ initial 51-lot layout. The site is located
in the NE quadrant of Schmidt Lake Road and Peony Lane. A few blocks east on the north side
of Schmidt Lake Road on Jewel Lane, setbacks are 6-8’ (15’ between homes) similar to what
would result from the applicants’ D-2 concept plan.
Issues for Discussion
A list of potential items for discussion entitled Summary of Issues for Consideration appears on
pages 8-9 of the Planning Commission memo. These items were reviewed by the Planning
Commission, and should also be addressed by the City Council.
COUNCIL ACTION REQUESTED
The goal of this review is to provide the developer with an overview of the pertinent City
ordinances and how they affect the proposed plat, and to discuss the strengths and weaknesses of
the proposal. The “Summary of Issues for Consideration” reveals a number of issues with the

Purpose.
Staff seeks direction to amend the requirements for a survey on lots less than 2 acres.
Background. On May 11th, the Council amended the requirements of a permit application.
These changes included allowances for a site plan to be prepared by a licensed professional to be
submitted in the place of a survey for building and grading permits; and provided allowances for
an exemption for projects of smaller magnitude that meets certain defined minimum criteria.
During the review of that ordinance there were some concerns that the ordinance did not
adequately address the needs of lots less than 2 acres.
In response, staff has prepared an ordinance for discussion purposes that allow the flexibility, as
well as minimum information necessary to responsibly review an application. The proposed
language provides flexibility for smaller projects that are well within the required setbacks on
any lot that has an as-built survey on file. Further, it is staff’s goal to maintain a consistent level
of requirements, to avoid a number of differing regulations that may confuse users.
Key points: 1. As built survey. In situations where an as-built survey is not present, a survey or
site plan will be required.
2. Building vs structures. Building foot print (Decks, sheds, building additions)
would need to be less than 200 square feet. Non-building structures (patios, etc) are
not restricted by the size limitation.
3. Average Lake Shore setback. Average Lake setback will impact building
location, and is typically shown on a survey. An as-built survey is a snap shot in
time, and neighboring properties may have made modifications that impact the line
on the subject property. Rather than exclude all lake shore lots, the ordinance seeks
evidence that average lake shore line is met. This evidence is expected through
aerial photos or site inspections.

AN ORDINANCE AMENDING THE ORONO MUNICIPAL CODE
BY AMENDING SECTION 86-68
REGARDING SURVEY REQUIREMENTS
THE CITY COUNCIL OF ORONO ORDAINS:
SECTION 1. Section 86-68 of the City of Orono Municipal Code is hereby amended
by adding and deleting text within Sections 86-68 (b) as follows:
(b) Surveys required:
(1) Initial survey or site plan. Any building, zoning or general permit application for
construction of a new structure, or expansion of an existing structure or land alteration
shall be accompanied by a certificate of survey or site plan drawn to scale prepared by
a person registered by the Minnesota Board of Architecture, Engineering, Land
Surveying, Landscape Architecture, and Interior Design. A certificate of survey or site
plan shall conform to the City of Orono Survey and Site Plan Requirements.
a. The certification of the plan by a licensed professional may be exempted by
the city engineer if the project meets all of the following:
1) An existing As -Built survey exists for the property;
2)0) Property is located outside the Shoreland Overlay District;
3)0) Property is not subject to the Stormwater Quality Overlay District;
4)0) Property contains 2.0 acres or greater in area;
5)2) Proposed project exceeds the required setback requirements by
150%; and
6)3) The project does not result in more that 200 square feet of new
building footprint.
7)4) Evidence that the Average Lake Shore setback is met is provided.
(2) Foundation survey. A foundation survey shall be submitted to the city for review and
approval, unless exempted by the building official, upon completion of the foundation
work for all buildings and all additions to buildings. The foundation survey, prepared by
a Minnesota Registered Land Surveyor, shall certify the lot dimensions; front, side,
rear, lakeshore, and wetland setbacks; and foundation elevation. A foundation survey
must be submitted before proceeding with framing or further construction. In lieu of a
survey a letter prepared by a Minnesota Registered Land Surveyor containing the
same information as a foundation survey may be submitted.
(3) As-built survey. An as-built survey, prepared by a Minnesota Registered Land
Surveyor, shall be submitted to the city for review and approval upon the completion of

all buildings and all additions to buildings, unless exempted by the building official. The
as-built survey shall certify the final topography of the site; verify drainage patterns;
and provide hardcover calculations for lots in the Shoreland Overlay District. An as-
built survey must be approved before the issuance of a certificate of occupancy. In the
event that weather or other conditions prevent the completion of an as-built survey at
the time the Certificate of Occupancy is requested, applicant shall provide a sufficient
financial guarantee and establish an escrow agreement to ensure completion of the as-
built survey.
SECTION 2. EFFECTIVE DATE: This ordinance shall take effect immediately upon
its passage and publication.

The City has a drainage and utility easement over a portion of this vacant Stonebay lot to
accommodate an existing municipal water line and hydrant. The easement encumbers a triangular
portion of the property. Wooddale Builders (Stonebrook Development LLC) plan to build on the
property and have designed a house that avoids encroaching upon the easement, except for two
small roof overhangs as depicted on the attached drawings. Planning Staff, City Attorney and
Public Works Director have reviewed the proposed encroachment and have concluded it is so minor
that allowing it via an encroachment agreement would be appropriate.

1. Purpose. Gain Council authorization for Pay Request #6 of the Navarre Street Light and
Sidewalk Project.
2. Background. At the February 10, 2014 Council meeting, the Council awarded the contract
for the Navarre Street Light and Sidewalk Project to MP Technologies in the amount of
$581,762.78. The project entailed replacing 35 street lights, all the light wiring and bases, and
removing and replacing approximately 10% of the existing sidewalk in the Navarre area. The
project is complete.
3. Funding. This project is funded from the Community Investment Fund. Bolton & Menk has
reviewed the pay request, verified the quantities and recommends payment in the amount of
$13,876.81. This brings the total amount paid to MP Technologies for the project to
$570,526.40

Item Description: Appointment of 2015 Golf Course Employee

1. Purpose. The purpose of this action item is to gain Council approval of one seasonal
employee for the Golf Course not already approved at previous Council meetings.
2. Compensation. The pay range is proposed to be from $8.50-$10.00 for the Clubhouse
Attendants and Maintenance Assistants and a pay range of $15.00-$18.00 for the Assistant
Superintendent and Clubhouse Manager. This represents a 0% increase over the 2013 pay rates.
Seasonal employees are excluded from PERA membership if certain conditions exist.
Employees can be hired under the maximum earnings provision which limits annual
compensation to $5100 without any restrictions on the number of months worked or on a 6
month timeframe where the employees work for no more than 185 days. All seasonal employees
will fall under the 6 month PERA Classification.

The City has received a donation in the amount of $1,640.00. The donation is for the purchase
of a picnic table and associated installation costs at Crystal Bay Park. By accepting this donation
the City is agreeing to install these amenities at the specified location.
Authority for cities to accept donation is granted by Minnesota Statute 465.03 which authorizes
Minnesota cities to “accept or devise of real or personal property and maintain such property for
the benefit of its citizens in accordance with the terms prescribed by the donor.” All donations
must be accepted by resolution with a 2/3 vote of the Council.

WHEREAS, The City of Orono is generally authorized to accept donations of real and
personal property pursuant to Minnesota Statutes Section 465.03 for the benefit of its citizens,
and is specifically authorized to accept gifts and bequests for the benefit of recreational services
pursuant to Minnesota Statutes Section 471.17; and
WHEREAS, Sarah and John Lindahl wish to make a donation of $1,640.00 to the City;
and
WHEREAS, the donation will be used to purchase a picnic table for Crystal Bay Park;
and
WHEREAS, The City Council finds that it is appropriate to accept the offered donation.
NOW, THEREFORE, BE IT RESOLVED BY the City Council of Orono, Minnesota
that the City acknowledges and accepts the donation from Sarah and John Lindahl
for purchase of the identified equipment to be installed at Crystal Bay Park.
