Perry and Debbie Perry, husband and wife, and Harold and Ann White, husband and wife. Ownership and lot line location have been settled by the parties as part of a lawsuit. This settlement will make the existing lino parallel Willow Drive rather than run at an odd angle. The attached Coffin survey shows the existing lot line and the new proposed lot line with legal descriptions for the required conveyances between the parties. No new building sites are created nor is any lot placed sub tandard as a result of the relocation of the common boundary. The average existing density is 3.48 acres/building site (11.89 acres - 25 properties) excluding the two lots in question. Based on the above, a case can bo made <*ither way i.e. a significant percentage of neighboring properties are equivalent or smaller t’nan the proposal; yet the proposal yields 2 lots significantly smaller than the average lot area. 5.v;hat equivalent applications may have set a precedent for tiiis application? The Lorge properties (2695-2697 Casco Point Road) come to mind, with existing lots of about 3.4<3 acres (house) and 3.44 acres (vacant) and leaving a setback of ^ 6' for the existing house. As you are probably aware, this was the subject of a lawsuit wliich was f) nully settled in favor of the applicant, allowing construction on the 3.44 acre lot but w i th no other variances granted. Planning Commission Members: I have applied for a building permit for construction of a new home on Lot 21 Shadywood Addition which is lo cated adjacent to 1810 Shadywood Road. This building permit application has been referred to the Planning Conmlsslon for recommendation because the lot which was platted in 1928 no longer meets the minimum lot size requirement of the new subdivision ordinance which was subsequently passed by the Orono City Council. There are seven 60 foot lots in a row in this area which are all below the size required by the new subdlviaion or- « dinance and have homes constructed on them. Some of these homes were constructed or remodeled after the adoption of the new ordinance but permits were granted because the lots were existing before the new ordinance was adopted. Most of these existing homes located north of the prop erty in question cannot meet the minimum ground cover re quirement of the new ordinance. The construction on the lot lying iomedlately adjacent to this site greatly ex ceeds the ground coverage requirement of the subdivision ordinance being almost double the coverage proposed on our lots. I have purchased Mr. and Mrs. Donald Johnstone's home on lot 22 and the adjacent lot 21. This purchase is contingent upon my receiving a building permit for construction of a new home on lot 21, If this permit is not granted it will ; I L_ _ _ _ _ Page 2 be economically unfeasable for me to meet the Johnstone's asking price for the two lots. It is my intent, if the sale is closed, to build a new, quality home on lot 21 and to re model the existing home on lot 22, Both of these homes will feature quality construction and will be designed with ex- eriors which will be a credit to the neighborhood. I have remodeled and constructed many homes in the Lake Minnetonka area which l.ive been attractive improvements to the neighbor- hoojs. This can be attested to by many of my previous customers and neighbors of these home owners. This project will also be an attractive addition to the neighborhood. The construction which we propose will meet all of the set back reqx. irements of your new ordinance and will also meet the ground cover requirement in the 75 to 250 foot zone which was previously questioned at your last meeting. These two lots are the largest of the seven 60 foot lots in the immed iate area. The only item in question is allowing the building to proceed on lots which are below the size required for new subdivisions. Since these lots are larger than any of the 60 foot lots north of them on which homes were built or remodeled and since the l^ts have been platted prior to the adoption of your newest zoning and subdivision ordinance we feel that it would be a definite, discriminatory hardship on the Johnstone's to deny the building permits on either lot. The Johnstone's purchased these two separate building lota at different times and have purposely maintained the separation of properties from a tax standpoint as well as assessments. They have paid non homestead real estate taxes for the past 40 years on lot 21 and have paid a full assessment for sewer and water mains on both lots. The plant service charge for lot 21 will be paid at the time of issuance of the building permit which is normal proceedure. This is a serious problem. We see an antidote for one of these houses on Lake Minnetonka. We wish to restore the house sack to its ori{jinal ^^randur which will be enjoyed by many people in the future like others have in the past. lor years in tukope the owners of castles and lar^e homes have allowed paying iiouse guests to come and stay in their homes to help maintain the estate. This is where the new concept of a Bed and Breakfast was born. Lvery state in the Union prides itself with historic areas and homes, bed and breakfcTts dot the country in these historical sites. Concentrations of B&B*s are on the east 'ad west coasts. In Minn esota there are sixteen historical hones and buildings being used as a private home and a B&b. '’’here is a b&b Registry in Minnesota with 40 locations and 80 rooms available. One is even located in the Minnetonka Beach area. Two new BitB*s are planning on opening soon in the area, one in the Rierce-Wyer Rouse in Kxcelsior and one in the Burweil Rjuse in Minnetonka Mills. nrr r. -rio/ W ♦ 4, W BED AND BREAKFAST? WHAT IS IT? A Bed and Breakfast is a private home (almost exclusively in a residential area) in which the owners allow people to be their house guests for a fee by prereservation. The type of house guests wnich generally stay in a B&B are 25-80 y.o. in the middle to upper income bracket. They are looking for a quiet* romantic, home as a retreat or place to celebrate a special occasion ie. honeymoon, anniversary, or birthday. Included with the lodging is generally an over view of the home end areas history, and a full breakiast. The rooms vary in decoratiens and whether or not they have a private or shared bath. There are as many types of B&B's as there are B&B’s. We are planning a B&B similar to Thornwood in Hastings, Overlook Inn in Stillwater, and Pratt Tabor Inn in Red wing. The similarities are: the B&B live in the house, and the house does not have a commercial kitchen (they serve a he.rty continental breakfast). In the summer sit on the front porch with a (^lass of ice tea and in the winter sit around the fire place with a cup of hot chocolate and talk with your hosts about the area, history of the house, and local spots of interest. To bed in a nice clean room with antique furniture, down quilts, fine linei, ., and the smell or fresh flowers. Without the noise of television or the worry of phone calls. Sweet dreams. Awaken your own. Dress and go down stairs to the smell or fresh brewed collee and hot rolls. Sit in the dining room or front porch and enjOj. Af :.er breakfast the next day check out of the b&b by 11:00 a.m. to travel home very relaxed and content. / pr CONSLUSlOl We feel this house with its unique desijjn, water tower and location, would be ideal for our horse and a B&B. We feel because of the size of the house, the property, the limited amount of bouse guesws that the only changes anyone would see or hear is that tlie house would be restored beautifully with new paint and landscaping and the laughter of our childrens voices. The pur pose of this letter is to formally respond to this proposal. STATEMENT: ^ owners of property located at 1950 Heritage. iHy atid _! are commit ed in our opposition to this proposal. While we would gladly consider any "new" facts as well as attempts by the Kauls to meet any specific concerns we might have regarding details of renovation or operation, our opp osition centers on the principle of the proposal. DISCUSSION: So that the Council and the Kauls have the opportunity to understand the nature of our opposition, wo list below several issues that are important to us: 1. Wo purchased our property in reliance of Orono's zoning laws as they govern our neighborhood and the protection they provide over our property values. In accordance with this reliance, we undertook a two yea’' project to make substan*-ial improvements to our property. (For the same reason v/o also op posed the request by the Andersons to sub-divide t.neir property creating a sub-standard lot). In granting the Kaul proposal, the Council would clearly be submitting other property owners to the risk of lower property values. It is inconceivable that a ^t,B" would have anything other than a negative impact on the value of other properties. This is simply a risk we should not be asked to take. more Orono Council, pg. 2 2. Any business, including the kind proposed by the Kauls, necessarily involves traffic, noise, lights and facilities over and above those required by a single family dwelling. We simply do not want to be subjected to this. - 5 bedrooms moans 5 cars - according to "A Weekend In The Life Of A Person Staying At A B&B”, we - an e.xpect each vehicle to make a mina.mum of 2 round trips per day. That’s 20 vehicles entering or leaving, before laundry and before the Kauls own travel. - the plan places the parking lot and cars directly in front of our property, in full view of our kitchen, dining room, living room and family room. 3. Commercial use of this property can only give new ammuni tion to those who would push for installation of a sewer system in Orono. In conclusion, we would bo happy to have the Kauls as neigh bors and welcome the restoration of this property. However, we oppose the use of this property for commercial purposes. Yours truly. As President of Foxhill, I wish to express my opposition to the proposed commercial use of 1900 Shoreline Drive as inconsistent with the residential character of the area. While commercial areas are nearby, we are concerned about increasing the scope and area of such activities.
