The existing structure meets the required setback from the newly created lot line. The lowland that appears on the plat is not a designated wetland nor does it function as one. The City wi II ask that a 20 ' wide drainage easement be taken along the ditch areas where drainage comes from vest through culverts (See Exhibit E). The City will ask that portions of the property shown as part of the right-of-way of County roads 84 and 51 be dedicated on the plat. The City has been asked to approve sewer service to Lot 2. Lot 1 is already served as are a 11 the other propert i 3tothe north (See Exhi bi t C) . The new home at 1150 Old Crystal Bay Road was connected to sewer earlier this year. In 1963 when the sewer project was constructed, all properties along the gravity line were assessed lateral charges and stubs provided along property lines. The subject property has two sewer stubs. One already serves the existing residence (See Exhibit D) . All existing residences were permi t ted connect ions--the new home at 11 50 Old Crysta 1 Bay Hoad was approved for service early this year by the Metropolitan Waste Control Commission--the line is now owned by MWee. It would appear that the MWCC will approve a new connection if "connection conforms to the City's Comprehensive Sewer Plan." This confirmation must appear in a separate City resolution. Staff suggests the following findings; 1. The sewer project was assessed and constructed in 1963 prior to adoption of Orono*s Comprehensive Sewer Plan. 2. Stubbs are provided in gravity line for new lot. < ' #872 Breckenriclge Development Corp Page 2 October 18, 1984 3. Rural standards still apply to property. 4 . Courts appear to not support the denial of a sower connection when properties are assessed for specific sewer projects. 5. Property could sustain an on-site septic system if required. Staff recommends approval of a two lot plat application of Breckenridge Development Corporation finding all standards of the RR~ IB zoning district have been satisfied and that the City approves a sewer connection to existing metro gravity line based on the findings noted above. Approval is subject to the following conditions; 1. Payment of a $225 sewer unit charge with building permit application. 2. Dedication of right-of-way for County roads 84 and 51 as shown on plat. 3. Designation and dedication of 20* drainage easements along east and south property lines. 4. Payment of park fee for newly created lot at $200 5. Access to new lot must be approved by Hennepin County Highway Department--access permit must be submitted with building permit application. In all "R" Districts no accessory building shall exceed 1,000 square feet of floor area except barn, stable or greenhouse. D. Location. No detached garages or other acces sory building shall be located nearer the front lot line than the principal building on that lot except on lots which have frontage on a lake. No principal building shall be located closer than 75 feet to the natural ordinary high water mark of a lake abutting the property. This lakeshore setback shall be determined as the mean horizontal distance between the natural ordinary high water mark on the lakeshore and the allowable building line. 2. Any application for a variance from the requirements of Item 1 above shall be referred to the Minnehaha Creek Watershed District for its approval before final action by the Council. No fences, structures or planting more than three feet high in the ”R” District on corner lots shall be permitted to obstruct traffic visibility within a triangular area defined as follows: “Beginning at the intersection of the projected curb lines of two intersecting streets, thence thirty feet along one curb line thence diagonally to a point thirty feet from the point of beginning on the other curb line, thence to the point of beginning. This Zoning Chapter shall require a permit for all structures including utility poles, and right-of-ways which are an integral part of a system for public transportation, as for transmitting power, water, heat, communica tions, gas or sewage by any public utility. The Council shall grant a conditional use permit only after a showing that the public safety, health and welfare will not be harmed by the essential services. Subd. 18. Farming. All farms in existence on January 1, 197S shall be permitted to continue operation subject to the following conditions: A. No new "stock farms" shall be created or existing stock farms enlarged more than twenty-five percent (2' t) in animals over one year old except under the provisions of a conditional use permit. In considering any such permit, the maximum number and type of animals to be kept shall be determined. The site design and method of operation shall be reviewed and the Council shall find that the proposed "stock farm", if in existence, will not in its opinion be detrimental to the public safety and the general welfare. B. The establishment of any new building for the housing of animals or fowl shall be located 150 feet or more from the nearest offsite residence. C. Products produced on the farm may be sold at retail. One temporary roadside stand may be established for conducting such business. No accessory building or structure, unless an integral part of the principal building, shall be erected, altered, or moved within ten feet of the principal building. Subd. 13. Garages. Accessory buildings which are for the storage of automobiles shall have the doors thirty feet or more from the property line when said doors face on a public alley or street. Subd. 14. Yards and Open Spaces. A. Reduction Prohibited. No yard or other open space shall be reduced in area or dimensions so as to make such yard or other open space less than the minimum required by the Zoning Chapter and if the existing yard or other open space as existing is less than the minimum required, it shall not be further reduced. B. Application to Only One Dwelling or Group. No required yard or other open space allocated to a building or dwelling group shall be used to satisfy yard, other open spaces, or minimum lot area requirements for any other building or dwelling group. Subd. 15. Non-Encroachments. The following shall not be considered to be encroachments on yard requirements: A. Chimneys, flues, belt courses, leaders, sills, pilasters, lintels, ornamental features, mechanical devices, cornices, eaves, gutters and the like, provided they do not extend more than 1-1/2 feet, olf-street parking except as hereinafter regulated. B. Subd. 2. Lakeshore Hard Cover Regulations. Within 75 feet of shoreline there shall be no excavating, filling, hard cover, temporary or permanent structures. Within 75 to 250 feet of the shoreline there shall be no greater than 25% hard cover. Within 250 to 500 feet of the shoreline there shall be no greater than 30% hard cover. Within 500 to 1,000 feet of the shoreline there shall be no greater than 35% hard cover. Subd. 3. Tree Removal Regulations. No trees within 75 feet of the shoreline with the diameter of six (6) inches or more shall be removed without first obtaining a permit from the Council. SBC. 10.23. The "LR-IA” Ore Family Lakeshore Residential District is intended to provide a district which will allow a combination of low density residential development and limited agricultural activity. Planned residential developments may be allowed by conditional use permits. The proposed land use may not endanger the quality of storm water runoff into Lake Minnetonka or Long Lake. The walls and steps are in place now and were constructed without City review or permits. A short synopsis of this project follows: The City issued a permit for 101.4 feet of rip-rapping to Bill Niccum of Minnetonka Portable Dredging Company for this address on September 22, 1983. The application noted only 30* would be rip rapped at this time, no time frame stated for completion of the rest. Early this summer staff was notified by a Planning Commission member of the apparent violations of tree cutting within 75* of the lake and construction of retaining walls. Staff's subsequent investigation revealed 2-24’*+ stumps which appeared to be rotting and if recently cut, must have been dead trees. stumps greater than 1/2-2“ diameter were apparent on the slope. It is not known whether any larger trees were cut and stumps removed at the crest of the hill. The rwr.er states that only sm^ill brush was removed from the slopes in order *‘ree what was there*'. As of today there appears to be roughly 50 pe» fc w*nt co’.er again established over the slope. There is no evidence of erosion of the slope occurring. Retaining walls (“planters") and steps had also been constructed. The owner stated that he had been told by his contractors that all required permits had been obtained. The retaining walls are located on the approximate center of the shoreline, made of 6" timbers. I would estimate the hardcover at about 250 sf including steps and tops of planter timbers, or about 3 percent in the 0-75* zone. The steps are obviously necessary in order to have access to the dock. Note however that this property also has a large dock southeast of Fagerness Point Road with relatively level lake access. r No evidence has been presented to indicate whether the retaining wa? Is are necessary to stabilize the bank, or whether they are designed and constructed for that purpose. I measured the slope at about 70 percent (19* of drop in a 28* run) which without some stabilization seems quite precarious. The submitted plans do not indicate the depth of the walls or how they are anchored into the hillside. The applicant has give me the impression that these walls are for aesthetic purposes and to help stabilize the stairway and not necessarily the hill. The planter terraces may have some benefit in slowing runoff which otherwise would run right down the hill. On the other hand, will retention and absorption of this runoff in the planter boxes cause saturation of the slope and possible sliding? The City Engineer has reviewed the plan presented and recommends that the owner substantiate the stability of the slope by submitting a report and recommendation from a qualified soils engineer. The rip-rapping done in 1983 appears to have been necessary to stop erosion and undercutting of the banks. Approximately 30* of rip-rap was done, but the remainder appears to be needed as soon as possible. Staff recommends that the applicant be required to submit the bank stability information as recommended by the Engineer.
