There are no designated wetlands located wi thin the property but staff is aware of a drainagway that comes in f i om northwest and runs down the east side of Lot 2 up to the culvert in Lot 3. Drainage then runs to a low point on the east side cf White Oak Circle. Surveyor must designate drainageway on plat as drainage easerricnts—minimum width of 20' . Rogosheske f- Statement of White Oak Circle Homeowners Orono Planning Commission “ 17 September 19&^ Re: White Oaks Overlook, proposed subdivision for George C. Funk and Judith A. Rogosheske of Tracts E and C, Registered Land Survey No. 13^0 and Lot 19, Auditors Subdivision No. 2?9- The undersigned residents of White Oak Circle have certain concerns regarding the proposed development of additional building sites on White Oak Circle. 1. Water Drainage Regrading of the proposed property may affect water drainage. A serious problem already exists in the rear of the Dougan and Marler properties on the south side of White Oak Circle. At the tine of the spring snow melt and after heavy rains, water crosses underneath Old Crystal Bay Road to the rear of the Dougan property, ponds there over approximately a one acre area and flows across the Marler property to the marsh south of the Marler property. Currently, the surface flow comes near to both the Dougan and Marler septic system dralnflelds. The situation became so bad in May of 198^ that the water table rose above the level of the Marler drainfield. During an attempted pumpout of the drainfield, water was actually observed flowing from the drainfield into the Marler distribution box. Accordingly, we are very concerned that any changes to the land which m.ay accompany construction may adversely affect water flow by restricting drainage. We request that the Planning Commission not permit any changes tc the water flow because of the proposed development. Also, we request that an inspection of the water flow in the proposed development be made after construction of homes by a professional engineer. We propose tliat if, in his opinion, any Impediments to the water flow were created as a result of the development, they be corrected before occupancy permits are Issued for each house. The then-current occupants of the Marler and Dougan houses will hire the engineer and pay his fees. 2. Parking of Contractors* Vehicles During the construction stages of the three buildings, we expect that there will be nearly continuous parking over extended time periods by contractors' vehicles at the south end of White Oak Circle. These vehicles will represent a ha?;ardous nuisance. We request that the commission require that contractors' vehicles be parked off White Oak Circle and on the construction site property . 3. Stress upon White Oak Circle drive due to heavy construction equipment traffic. a. The homeowners 1 i sted /s1gning below have assumed responsibility for maintaining and repairing White Oak Circle even though the drive is owned by the original developer, C.E. Van Eeckhout. We have, in fact, spent $6,^00 to date, in repair and maintenance of the drive. We have also contracted each winter for snow removal. Therefore, we consider White Oak Circle "our drive" even though it is owned by the original developer. b. There is an Easement Purchase Agreement between the developers, George C. Funk and Judith A. Rogosheske, and C.E. Van Eeckhout, owner of Track I - White Oak Circle. The purchase price Is $6,000 for an access and utilities easement . We have exper’lenced damage to the drive In the past by heavy construction machinery being hauled over it. That damage prompted the repair and maintenance cited above. We request that the commission request the subdivision owners to provide a "construction road" on the south side of their property, allowing heavy equipment to pass in and out directly from Old Crystal Bay Road without using the White Oak Circle drive. In the event this is not done, we request that the commission require the $6,000 purchase price of the easement be set aside in escrow to repair whatever damage may result from contractors' use of the street. We also request. In the event heavy construction equipment traverses White Oak Circle drive, that the normal and usual Orono city restrictions as to load limits on city streets in the spring and fall also apply to Wliite Oak Circle. Possible Extention of White Oak Circle The present White Oak Circle ends in a cul-de-sac. There is currently a 60 foot road easement which is an extention of White Oak Circle between Plat and Plat H. In the event that this easement is to be used as an access road to any of the developed property, we request that it be constructed to the same road standards as White Oak Circle and not to ordinary "driveway" standards. The topography of the land, the existing road layout and the present hcmesltes' locations, are such that a simple "driveway" would detract from the beauty and character of our neighborhood. Mabusth Page 2 July 26, 1904 Subdivision is an extremely old subdivision, and was originally platted on February 21, 1893, by Mr. and Mrs. Curtis Coffee, Mr. Walter Webb, and Ms. Laurti Jones. The platters had a vision of a tasteful development of Cryst«il Bay, and obtained approval for the plaiting of 41 buildable lots on Crystal Bay. The original proprietors had the intention of allowing 41 homes to be built on the lake, with all of the lots having the feature of lakeshore property. The original plat sets forth the length of lakeshore for each lot, and the varying lengths are as follov/s; Feet of Lakeshore Number in Original Plat 50 55 60 75 91 .4 6 4 27 3 1 1 have enclosec’ a copy of the original plat for your review. John Ericsop has been a citizen of the City of Orono since the mid 1940's. John's parents acquired two lots in the Shadywood Subdivision in 1947. I have enclosed photocopies of the original Certificate of Title regarding the acquisition. As you can tell from the legal description of the properties involved, two lots were acquired by the Ericsons. John and Barbara Ericson acquired the subject properties in 1901, purchasing the lots from John s parents. Again, from the clear language on the deeds, the two lots were conveyed. I have enclosed a copy of that Certificate of Title as well. It is interesting to note that of the 41 lots originally platted in Shadywood, 27 of them have 60 feet of lakeshore. The Ericsons' existing home (on lot 4) has 60 feet of lakeshore. The home for which the variance is requested has 65 feet of lakeshore (60 feet from lot 3 and 5 feet of lot 2 which t)>o Ericsons also own). From a review of the original plat, the first 27 lots in a row all contain 60 feet of lakeshore. Perhaps the most striking or dominant trait of the character of this neighborhood is the fact that all of the homes sit on lots containing 60 feet of lakeshore property. In addition to the Orono Municipal Code, the Ericksons' request for a variance is subject to Minnesota Statute 462.357, which has been characterized as the enabling legislation for all municipal zoning ordinances. Stat. 462.357, Subd. 6 establishes the statutory guidelines regarding variance requests. This statute allows municipalities to hear requests for variances from the literal provisions of the ordinance in instances where their strict enforcement would cause undue hardship because of circumstances unique to the individual property under consideration"... The term "undue hardship" is— defined in the statute to include the situation where, "the plight of the landowner is due to circumstances unique to his property il2±_^T*^^ted by the landowner^ and the variance, if granted, will not alter the essential character of the locality." (Emphasis added.) With the historical perspective in mind, and with the statutory requirements of variance procedure being understood, T will now respond to the seven (7) reasons you have cited in support of your recommendation for denial: 1.To Approve Lot Area and Lot Width Variances Concurrent with Subdivision Application Would Establish a Negative Precedent. The This reason for denial is not valid under Minn. Stat. 462.357. A response is expressed there. 7. b) The granting of such variances would change the character ol the immediate surrounding neighborhood. This reason is absolutely untrue. Every lot in the neighborhood has 60 feet of lakeshore. The proposed use is not only totally consistent with the existing neighborhood, it is also totally consistent with the year-old plat which gives rise to the neighborhood, intended use fits perfectly with the existing homes and would be naturally compatible with tlie surrounding area. 90 The To really put the matter into proper context it is noteworthy that the proposed homo would sit on a 19,500 square foot lot. This is certainly an ample sized lot for the construction of a home in accordance with the plans filed by the Ericsons. This was clearly contemplated to be an acceptable lot size when the land was originally platted. Approval of this variance and subdivision application would be in conflict with the intent of the zoning code and Comprehensive Plan of the city. This general statement is hard to respond to because of its lack of specificity. As discussed above, the proposed use fits the applicable plat and matches well with the neighborhood. As citizens of the City of Orono, the Ericsons should be allowed to utilize this unique piece of property. If the Orono ordinances must be construed, they must be done so under the policy of being strictly construed against the City and in favor of the jjroporty owner. See Frank*s Nursery Sales, Inc, v. City of Roseville, 295 N.W.2d 604 (Minn. 1980). Such a construction of the ordinances would indicate that the variance request should be granted. Also, since the subject property abutts the lake, the recent policy of the Supreme Court regarding lakeshore property must be followed. In Girvan v. County of LeSueur, 305 Minn. 175. 232 N.W.2d 88B (1975), it was held that lot size requirements and front and rear yard requirements of zoning ordinances must be applied to lakesliore property in a manner designed to recognize the use and development of the property and to avoid absurd results. Counc i Itnomber Grabek asked the County why they are proposing 1.58 acres when they know that it is a 2.0 acre minimun. Grabek asked if the 1.58 acres is aii that Mr. Gagne would sell to the County. Mr. Giigne stateci that he would sell 2.0 acres to the Courrty. Earl lohnron stated that the County has a budget to go by and that the 1.53 acres is aii they needed to buy to construct the library. Counc i Inenber Adams stated that the City has been allocated 115 sewer uriits from the recertt upgrading of the Orono-Lor.g Lake sewer system. Adams stated that the library may need 2 sewer units if they plan on expanding in the future because the se^," units may not be available later on. Zoning Administrator Kabusth stated that the Planning Commissiofi had recommended that aii access be from an access road and that such road shouia align with the Middle School's first drivcwav. Mayor Butler moved, Courrci imember Grabek seconded, to table Hennepin County's conditional use and variance so that the applicant and the property owner can discuss the purchase of a 2 acre site in c der to meet all zoning codes. Zoning Administrator Mabusth stated that the Pianri ng Commission had tabled Mr. Ericson's variance application awaiting clarification of per forma.-, ce standards for sub standard lots legally combined. John Ericson stated that Lot 3 is 56' and Lot 4 is 50'. Ericson stated that the boathouse was removed from Lot 4 per Council's recommendation. Ericson stated that he wished to build a new home on Lot 3. Ericson stated that there is sewer and water available. Mayor Butler stated that it has been the practice of the City to not create substandard lots. Butler stated that when the lots were combin'^.!, that it made this lot conform to the zorring code. Butier stated tiiat in asking to have those two lots separated, you are asking the City to ignore the zoning code and to create two substandard lots. 41 npGJLAR MEETING OF THE ORON.) Ericson noted that Ailcnburq's lot just down the road is a AO ' lot and the City approved that. Mayor Butler stated that the City does not want to create two substandard lots, when it conforms to the zoriincj code now. Mayor Butler noted that 41 percent meet or exceed the half-acre zoning requirement. Butler noted that 5? percent of the existing residetitiai uriits are four-terjths of an acre or larger. Butler noted that there are existing residential units that meet the zoning requirement. Butler stated tljat 16 percent of the existing residential units offer the potential of division it they are subject to the same per formance standards for lots of common ownership. Butler stated that 41 riew potential homes i tes could be created if the City sets a precedent by approving the Ericson application. Ericson stated that he could understand that if there wasn't sewer and water. Ericson stated that the area is predominately on 60' lots. Ericson asked how can the Ci ty ask people to pay taxes on proper ty they can’t build on. Zoning Administrator Mabusth stated that the City is really looking at a subdivision and if approved, both lots would need variances. Mabusth noted that it would bo a divisiori for tax purposes. Counc i Imenber Adams stated that it is just like coming in with a two lot plat where neither of the lots meet the zoning code. CounciImember Grabek stated that any action taken by the Council would certainly affect other people ar»d that a public hearing should be held for the neighbors input. Grabek stated that if they grant approval to Mr . Er icson that the Ci ty would have to grant approval to the other 41 people. Ericson stated that the neighbors were mailed notices of the Planning Commission meeting and no one showed up. Mayor Butler suggested that the Planning Commission look at this application in a broad range view of possibly 4.1 more units in the area. Butler stated that the Planriing Commission should address how those 41 units could affect the lake and the additiorial hardcover. Mayor Butler stated that the tax assessor does take into consider at ion the homestead and vacant land. The Board of Appeals and Adjustments shall recommend such conditions related to the character, and other features variance regarding the location, of the proposed building, structure, or use as it may deem advisable. The Council by unanimous action may waive reference to the Board of Appeals and Adjustments. B. The Board shall hold hearings as required by Minnesota .Statutes, Section 462.354 , Subd. 2. A notice shall be published in the official newspaper once at least ten days before he day of the hearing. Any party may appear at the hearing in person or by agent or attorney. For the purpose of giving mailed notice, the person responsible for mailing the notice may use any appropriate records to determine the names and addresses of each owner of affected property and property situated wholly or partly within 150 feet of the property that requires the variance. A copy of the notice and a list of the owners .nd addresses to which the notice was sent shall be attested to by the responsible person and shall be made a part of the records of the proceedings. The failure to give mailed notice to individual property owners, or defects in the nature shall not invalidate the proceedings, provided a bona fide attempt to comply with this Subdivision has been made. C. Subject to such limitations as may bo imposed by the Council, the Board may adopt rules for the conduct of proceedings before it. Such rules may include provisions for the giving of oaths to witnesses and the filing of written briefs by the parties. The Board shall provide for a record of its proceedings which shall include the minutes of its meetings, its findings and the action taken on each matter heard by it, including the final order. Subd. 3, Variances; Issuances. A. In considering applications for variance, the Council shall consider the advice and •'ecommendat ion of the Board and the effect of the proposed variance upon the health, safety and welfare of the community, existing and anticipated traffic conditions, light and air, danger of fire, risk to the public safety, and the effect on values of property in the surrounding area. Before granting a variance, the Council shall hear requests for variances from the literal provisions of this Chapter in instances where their strict enforcement would cause undue hardship because of circumstances unique to the individual property under consideration, and to grant such variances only when it is demonstrated that such actions will bo in keeping with the spirit and intent of this Chapter. "Undue hardship" as used in connection with the granting of a variance means: reasonable use controls. 1. The property in question cannot be put to a if used under conditions allowed by the official ORONO CC 265 (4-1-84) 1I § 10.08 2. The plight of the landowner is due to circumstances unique to his property not created by the landowner. 3. The variance, if granted, will not alter the essential character of the locality. 4. Economic considerations alone shall not constitute an undue hardship if reasonable use for the property exists under the terms of this Chapter. 5. Undue hardship also includes, but is not limited to, inadequate access to direct sunlight for solar energy systems. Variances shall be granted for earth sheltered construction as defined in Minnesota Statutes, Section 116J.06, Subd. 2, when in harmony with this Chapter. 6. The Board of Appeals and Adjustments or the Council may not permit as a variance any use that is not permitted under this Chapter for property in the zone whore the affected person's land is located. 7. The Board or Council may permit as a variance the temporary use of a one-family dwelling as a two-family dwelling. B. The Board or Council may impose conditions in granting of variances to insure compliance with this Chapter and to protect adjacent properties. No variance shall be granted or changed beyond the use permitted in this Chapter in the district where such land is located. Source: City Code Effective Date: 4-1-84 Subd. 4. Variances in Border Areas. The Zoning Chapter seeks to regulate land use throughout Orono so that the location of the various zones will be compatible to each other and to existing uses and regulations. Where property in the City adjoins property in another municipality whicli is subject to regulations substantially different from those applying to the City property, so as to make strict enforcement of all the City regulations as to such property unreasonable, the Council may take into account the location of the property and the regulations of the adjoining municipality in considering application for variances hereunder. The North wing and the proposed new South wing will be approximately 50* from the lake. The hardship that exists: A.) That the house cannot be built back because of the driveway directly behind the house. B. ) The steepness of the hill, next to the driveway, would require extremely high foundation and unuseable entrances/exits from the house to the lakeside. C. ) Rebuilding on a large portion of existing foundation and extending South with a new foundation allows the house to be built up...not out. REQUEST A.) The existing house, with the exception of the North wing, will be leveled to the foundation. The leveled portion of the house will then have its foundation extended up an additional 3 courses of blocks or 24". A new foundation “Hi be extended out and South from the East wall of the house. (The East wall being the lake side of the house}. The new foundation area will turn kfest to the driveway area, then North tc intersect the existing foundation. There, also, will be a small footing area extending slightly into the driveway for the entrance area into the house. A deck will be installer! on the lake side starting at the North wing and running parallel to the house. The new garage location is next to a bedroom in my house. The garage would not only block the morning sun from the bedroom but would also inhibit airflow. Noise and odors from the garage would be too close to the bedroom windows. Creating more parking space on the existing lot may just have the effect of attracting more vehicles. One of the reasons I moved to Orono was because of the 1/2 acre zoning and the feeling of openness. Allowing buildings to be built nearly on top of each other is not in the spirit of this zoning. In my opinion, no hardship exists because a new garage and car turn-around could be built with existing set-backs. In my opinion the fire protection issue is invalid because driveways exist on both adjoining prooerties that would allow access to the Kale house. Because of the above reasons and the fact that two families already live on the original 60 ft., 1/2 acre lot and that there are currently 5 structures on this original lot, I would like it if the planning Commission would uphold the existing set-back requirements. Background Inforr.ation Application to continue to keep about 12 laying hens Sept. 17, 1984 In April of 1969 LaVerna and I purchased a couple of dozen day-old white rock pullets and placed tnem in a snail brooder in our garage. Several weeks later, perhaps in May of 1969. the neighbor on the south of us. Wayne Keller, stopped by with a friend to view our 1910 Model T Fora which we h?.d in our garage. At that time he noticed the email hens and I Infcrried him we were going to keep some laying hens in a small ”hen shed" on our place. At that time nor at any other time did Mr. Keller voice any objections to us about the hens i In May of 1969. I spoke with Seorge Torkelson, the neighbor to the north of us. He asked about our plans for the small "hen house" and I informed him we planned to plaeo the laying hens in it. He suggested that I call the village hall and ask about any problems with the "village" on keeping laying hens. and Within several days of that date in 1969. I called/spoke with someone at the Orono Village Hill, Imasked about the keeping of laying hens or chickens. I was told that "There was no direct or specific ordinance concerning the keeping of chickens." I was told that there *.:ere rulos for the rasing of horses, but not of chickens* I relayed this information to Mr. Torkelson. I have never had any neighbors call me about the chickens. The young boys of several families, including the Alstons, Torkclsons. and others looked after our hcric. including the hens, when we were on vacations. In the 15 years when we have had the hens, which now number only 12, most of the close neighbors have known that we had a few hens as pets. Over the years several of the Crono inspectors or village officals including Mike Schuler and A1 Olson have known we kept these laying hens. The small building where we keep the hens is well built. It is i.'ell ventilated and in good repair. It has a small area on one side where the hens can be exposed to the sunlight. It is so well* shielded with bushes that when the city inspector came several \jeeks ago to look at the hens he had a difficult time finding then.I The little "shed" Ir kept clean. Thcrt is no noticeable odor. There is almost no noise. About the only noise is v:hon a hen is going to lay an egg and that is really not offensive. The noise from passing cars, opening and closing of car doors, lawn mowers, motor boats etc, is far greater.
